Commissioner Holloway SECONDED the motion. There were no objections. SO ORDERED. ITEM 3' APPROVAL OF MINUTES - June 14,2001 and July 12,2001 MOTION: Commissioner Holloway MOVED to approve the minutes as presented. Commissioner Van Zee SECONDED the motion. There were no objections. SO ORDERED. ITEM 4: ITEM 5- PERSONS SCHEDULED TO BE HEARD-- None OLD BUSINESS a. Discussion --Jim Bielefeld/Air Fair Report Commissioner Bielefeld reported the following: · Approximately 60 people attended the fly-in breakfast; approximately 14 participated in the poker-mn. Bielefeld stated he felt more would have participated if the weather had been better. · For next year's poker run, an established date will be set in late June. · Participants of the poker run filled out comment sheets which will be reviewed Friday (August 10,2001) during a final.meeting of organizers. Additionally, the financial outcome of the event will be reviewed. ITEM 6' NEW BUSINESS 6-a. Discussion -- Alaska's Best Travel Request for Five-Year Lease Dottle Fischer- Kenai (Owner of Alaska's Best Travel) provided the following information to the Commission' · Alaska's Best Travel has been a tenant of the Kenai Airport for the past five years; Fischer has had to renew her lease contract each year. · Her mare reason for requesting an exclusive-use permit is to guarantee a lack of direct competition (which would raise property value and increase overall appeal of space). The Commission spoke briefly regarding terms of an exclusive-use permit for Alaska's Best Travel and how that may affect other businesses in the airport. It was determined that prior to approval, exact lease verbiage would need to be reviewed by the attorney. Additionally, the Commission addressed the issue of rack-cards, which are placed on business counters as Van Zee stated they are better placed at the Visitors Center. He also stated airport tenants display rack-cards only as a gesture of good will; the rack- cards are of little or no benefit to those who display them. Cronkhite stated she would look into this issue. MOTION: Commissioner Van Zee MOVED to forward the five-year exclusive-use lease request to council for approval. Commissioner Holloway SECONDED the motion. There were no objections. SO ORDERED. Discussion -- Aircraft boarding for Passengers with Disabilities Chairman Knackstedt stated he received a complaint regarding airport/airline procedures involving life devices for passengers with disabilities. After a brief background of the situation, the Commission spoke at length on the following points' · The Kenai Airport does not own plane-specific lift devices for aircraft. Additionally, Era Aviation does not have lift equipment to accommodate all its aircraft. · There are many issues involved in lift devices that need to be considered: Stability, plane size, passenger needs. Cronkhite stated that the Kenai Airport is aware of this issue and need and accommodates airlines when needed. Additionally, a lift device company will be coming to Kenai in the fall to look into the situation. · Federal mandates state that an airport must have a plan to provide equal access for all passengers; the Kenai Airport is currently in the planning stages and is actively pursuing information on lift devices to accommodate all. The Commission spoke about whether the brunt of this problem lies with the airport or individual airlines. 'ITEM 7: REPORTS Commission Chair-- Chairman Knackstedt repOrted on the following- AIRPORT COMMISSION MEETING AUGUST 9, 2001 PAGE 2 · The B-24's and B-17 arrival on July 4 was a successful event. The Commission spoke briefly regarding the cost to the city to host this event and of a potential return schedule. The following was concluded: · Due to the high expense of the Collings Foundation visits, the Commission would prefer they return every two years. · If the Collings Foundation prefers to return every year, the Commission agreed that an invitation letter specifying a date should be sent. The date (perhaps in late June) could coincide with the poker-run or some other event. · If the Co!!~ngs Foundation decides not to come on the requested date, all costs would need to be covered by them. Cronkhite stated she would draft a letter to the Collings Foundation for Commission review in the near future. 7-b. Airport Manager-- Airport Manager Cronkhite reported on the following: The new airport parking design has been completed. 7-c. City Council Liaison -- Councilwoman Swarner reported on the following: · August 25, 2001 is Industry Appreciation Day. · The deadline for submitting petitions to run for Mayor or City Council is August 15,2001. · Jason Elson has been chosen as an airport commissioner. He will begin in September. ITEM 8: COMMISSIONER COMMENTS AND OUESTIONS Commissioner Haralson requested an update on the issue of the Airport Master Plan. Cronkhite stated the Master Plan would be integrated into the city comprehensive plan. Both are in the beginning stages of development. Commissioner Van Zee requested information on the review of the airport regulations including policy and language changes. A brief discussion took place and Cronkhite stated that more attention will be given to this in the future and that any suggested changes can be sent to her at any time. Commission has been aware of this possibility and has discussed the option of advertising for proposals for the restaurant and gift shop areas. We would like, if possible, to vacate the premises December 31, 2001. (Ord. 316) AIRPORT RiEGULATIONii .S Chapter 4.0.5 AERONAUT!CAL ACT!VI.T. IES 4.05.010 Aeronautical activities. (a) Aeronautical activities at the Airport, and all flying of aircraft departing from or arriving in the airspace above the Airport shall be conducted in conformity with current provisions of the Federal Aviation Administration ~egulations and orders issued by the Regional Director or Air Traffic Control Or Automated Flight Service Station F,.,~,i!it!es Chief at the Kenai Airport not in conflict with said regUlations. (b) In the event that any person shall show intent to board and/or operate an aircraft while he is physically incapacitated or mentally irresponsible by virtue of intoxication or the effects of drugs, or if any person shall attempt to board or operate an aircraft illegally, it shall be the duty of the Airport Manager, Airport employees and Aviation Operators to restrain in any manner necessary such person from performing such activities. (c) In the event any person commits an act contrary to these regulations and such act is witnessed by a Flight Service Specialist or Flight Controller Technician, it shall be the duty and privilege of the Facility Chief or Flight Service Specialist, or other person witnessing the transgression, to report such act to the Airport Manager immediately for prompt punitive action. (d) Special notices of items of interest to persons engaged in business with the City in respect to the Municipal Airport shall be issued under the authority of this section at such time and in such a manner as the Airport Manager deems necessary. (e) in the event the Airport Manager believes the conditions of the Airport to be unsafe for landing or take-off, it shall be within his authority to issue a NOTAM closing the Airport. Impoundment may be a~mplished by a~xin9 a seal to the door of the aircraft or the movin0 of the aircraft for impoundment purposes. Inconvenience or damaoe that may result from such movement will be at the risk of the owner. (Ords. 3~6, 461, Res. 91-20) (c) An impoundment fee of $100 plus towage fee at cost shall be charoed on each aircraft impounded and a storage fee of $50 per day shall be charged for each day the aircraft remains impounded. (Ords. 3 ~ 6, 461 ) (d) All impounded aircra~ which am not r~eemed within nine~ days a~er impoundment shall be considered abandoned and shall be subject to sale at public auction. Notice of any auction shall be published. Publi~tion shall be in a newspaper of 9eneral circulation in that ama for at least once durin9 each of throe consecutive weeks not mom than thi~ days nor less than seven days before the time of the auction. (Ords. 316, 461) ,,A!i ,,R, PORT REGULATIONS Chapter 6.05 PARKING 6.05.070 Transient aircraft. (a) All aircraft owners or operators parking transient aircraft in an area designated by the Airport Manager shall register their aircraft with the Airport Manager's Office upon arrival. (Ord. 365) (b) Transient aircraft under 10,000 pounds shall park at the tail tie-downs on the south terminal ramp apron, unless other.arrangements are made. with or direction given by Airport Manager. (Ord. 365) (c) All aircraft owners or operators parking aircraft in an area designated by the Airport Manager will be charged a transient parking fee of two dollars ($2.00) per day. No aircraft shall be allowed to park in the transient parking area for more than five consecutive days, unless specifically authorized by action of the Airport Manager. There will be no fee for parking an aircraft for a period of six hours or less. (Ords. 365, 1056) A!iR,, PORT REGULAT,,!ONS Chapter 8.05 AIRCRAFT ACCIDENTS 8.05.020 Airport property damages. Any person damaging any light, fixture, or other Airport property by means of contact with an aircraft or any other means, shall report such damage to the Airport Manager's office, Air Traffic .Control, or Flight Service Station personnel immediately and shall be fully responsible for any costs required to repair the damage or replace the damaged item. F-AA Co,-,tro! Tower personnel will report any incident of damages upon the failure of an aircraft operator to do so. AIRPORT REGULATIONS Chapter 10.05 GENERAL INFORMATION 10.05.010 General. No person shall, without the permission of the Airport Manager: (a) Destroy, injure, deface or disturb in any way any buildings, signs, .equipment, marker, or other structure, tree, flower, lawn or other property on the Airport property. (b) Alter, make additions to, erect any building or sign, or make any excavations on the Airport without the consent of the Airport Manager. (c) Willfully abandon any personal organizational property on the Airport. (d) Enter the Airport movement area or romp. (e) No person shall interfere with, tamper with, unlawfully remove or injure any part of the Airport or any of the equipment thereof. (f) No person shall knowingly or willfully make any false statement or report to the Airport Manager or to any Airport employee. (g) No person shall interfere or tamper with, any aircraft or put in motion the engine of such aircraft, or use any aircraft, aircraft parts, instruments or tools, without permission of the owner or by specific direction of the Airport Manager. (h) No person shall enter any restricted area posted as being closed to the public except as may be permitted by these regulations. (i) No person shall enter upon the field area except: (1) persons assigned to duty therein; (2) authorized representatives of the Airport and Federal Aviation Agency; (3) persons authorized by the Airport Manager; and, (4) persons, under appropriate supervision, entering the area for purposes of enplaning or deplanin~ emb~~gon 3.,'~ deb..~rk.~cn. (j) No person shall engage in any business or commercial activity of any nature whatever on the Airport except with the approval of the Airport Manager, and under such terms and conditions as may be prescribed in the City of Kenai Code of Ordinances. (k) No person shall post, distribute or display signs, advertisements, circulars or any other printed matter at the Airport except with the approval of the Airport Manager and only in such manner as he may prescribe. (I) No person shall travel on the Airport other than on the roads, walks, or places provided for the particular class of traffic. (m) No person shall occupy the roads or walks in such a manner as to hinder or obstruct their proper use. (n) No person shall operate any type of vehicle for the disposal of garbage, ashes, or other waste material on the Airport without the approval of the Airport Manager. (o) Any person who has been denied the use of the Airport by the Airport Manager shall come upon or use the Airport only while traveling through as a passenger in a taxicab or other vehicle when enplaning or deplaning as a passenger of an aircraft operating on the Airport. (p) All shops, garages, equipment and facilities not the property of the City of Kenai are expressly for the conduct of the owners or lessees business operations. No persons other than the owners or lessees or their employees shall make use of these facilities without individual and specific permission of the owners or lessees. 10.05.020 Penalties. Any person who knowingly and willfully violates any regulation prescribed herein, or any order or instruction issued in keeping therewith, shall be guilty of a violation and upon conviction thereof, may be fined not more than five hundred dollars ($500.00) or imprisoned for not more than thirty (30) days, or both, under the authority of the Code of Ordinances, City of Kenai. ' AIRPORT REGULATIONS. Chapter 14.0,5, ,LANDING.FEES,, 14.05.010 General. (a) Them shall be a landing fee of fifty cents ($0.50) per thousand pounds of weight on aircraft with a certified gross take-off weight of four thousand (4,000) pounds or over, payable monthly. The landing fee shall be computed on the certified maximum gross take- off weight of each aircraft. The minimum monthly landing fee is twenty-five dollars ($25.00) per commercial operator. (b) Them is no landing fee for aircraft under four thousand (4,000) pounds certified gross take-off weight and no landing fee for float planes. (Res. 90-66, 92-71, 93-42; memo dated 5-31-2000) 14.05.020 Monthly reports. All commercial operators operating aircraft with a certified gross take-off weight of four thousand (4,000) pounds or over shall submit a report showing the total number of landings of different types of aircraft made on the Airport each month. This report shall be accompanied by the above landing fees for that month and must be received no later than the fifteenth (15th) day of the following month.
