There were no objections. SO ORDERED. ITEM 4' PERSONS SCHEDULED TO BE HEARD -- None ITEM 5: OLD BUSINF~S Discussion --Airport Flyer/Mail Out Cronkhite reported on the status of the airport flyer. The commission agreed on sending a postcard mail-out to approximately 200 local private pilots. The commission discussed various items to be listed on the flyer as well as various style and layout designs. The following items and services were suggested: · Tie down rates · Electrical outlets · Control Tower · Safety record · Airport Operational Facility · Float Plane Facility · Provide a quote from a tenant · 24-hour fuel service · Camping facilities · Full instrument approaches "Gateway to Alaska's Playground" Councilwoman Jackman explained that while postcards are the most expensive form of mail-out advertisements, they are also the most effective provided they are visually stimulating. Ideally, the postcard would be white with colorfUl pictures such as an aerial view of the airport. 5-]3. Discussion-- 2002-2003 Goals and Objectives The Commission reviewed the 2001-2002 goals and objectives and discussed additions and modifications for the 2002-2003 goals and objectives list. The Commission made the following changes' Airport Beautification *Maintain current levels of efforts without additional expenditures Gravel / Ski Strip · Storage Box Standard Design Float Plane Basin oSignage for Float Plane Basin · Maintain currently rented slips Terminal Building .Terminal Exterior/Concrete Work .Parking and driveway design Airport Administration .Evaluate need for additional personnel Advertising and Marketin~ °Hire consultant to evaluate and develop airport long-range economic development and marketing strategy *Develop Airport brochure *Use Clarion and Anchorage Daily News classified ads to promote tie-down availability and Float Plane Basin Airport Rules and Regulations .Ramp driver training program Other .Electrical outlets at ski strip *Commission have more input in the meeting packet (SUch as agenda information) .Security: Gates/Fences .Local Radar System KENAI AIRPORT COMMISSION MARCH 14, 2002 PAGE 2 Discussion-- Marketing No further discussion was spent on marketing. 5-d. Discussion -- Customer Survey The Commission discussed surveying options geared towards local pilots and other airport users to help determine airport needs. Cronkhite requested the Commission review the attached examples as a guide to develop a base methodology for the survey. The Commission discussed the advantages of mail-out surveys, individual telephone calls, and in-person questioning. Cronkhite requested the Commission provide feedback to her as to how to proceed. ITEM 6: NEW BUSINESS Recommendation -- Special Use Permit/Rozak Engineering-- Remedial Action Plan on Behalf of Kenai Airport Fuel Service. MOTION: Commissioner Elson MOVED to recommend Council approve the Special Use Permit to Kenai Airport Fuel Serv/ce. Commissioner Van Zee SECONDED the motion. There were no objections. SO ORDERED. ITEM 7' REPORTS Commission Chair-- No report 7-b. Airport Manager -- Cronkhite reported on the following: .The Airport is currently undergoing CERT'inspections. *Cronkhite attended a Runway Incursion Safety Action Meeting. City Council Liaison -- Councilwoman Jackman provided a recap of Council action items. ITEM 8: COMMISSIONER COMMENTS AND OUESTIONS Elson: Elson reported he would be absent for the April 11, 2002 meeting. Knackstedt' Knackstedt inquired as to when the new ARF/SRE facility would be completed; Cronkhite stated completion should be done by duly 2002. As you can see from this regulation, the primary avenue for enforcement is the impound procedure. Research with other operators of airport parking lots indicates that a process that incorporates steps prior to impound are more effective and more accepted by the public. Does the Airport Commission wish the Administration to pursue a proposal for a vehicle parking fine schedule specific to airport parking lots and parking areas? Reserved parking. Impound procedure. Aircraft parking. Transient aircraft. Aircraft leaseholds. Motor vehicle parking. (a) No person shall park a motor vehicle in an area designed for moving traffic. Vehicles so parked shall be subject to impound. (Ord. 461) (b) No person shall park a motor vehicle on the ramp without permission of the Airport Manag- er. Vehicles improperly parked shall be subject to impound. (Ord. 46 l) (c) No person shah park a vehicle on Airport Drive, Terminal Loop. The only exception to this is in the areas marked for "Loading Only" and the spaces marked for "Handicapped." The loading only area on the terminal side of the loop is restricted to vehicle parking for periods of time as designated by the Airport Manager. The loading only area on the parking lot side of the loop is restricted to public transportation and commercial vehicles. Parking for loading only for both private and public transportation vehicles and parking for the handicapped shall be permitted between the hours of 5:00 a.m. and 3:00 a.m. Parking for loading only is de- fined as the use of a motor vehicle to transport airline passengers and their luggage to and from the airport terminal. Vehicles in violation of this section shall be subject to impound. (Ord. 461, Res. 91-20, 91-41, Amendment by City Manager 8/18/95) 6.05.020 Short-term parking area. The Airport Manager shall designate an area or areas for short-term vehicle parking. Parking is permitted in this area from 5:00 a.m, to 3:00 a. rra All improperly parked cars are subject to impound. (Ord. 461, Res. 91-20) 6.05.030 Limited long-term parking. The Airport Manager shall designate an area or areas for long-term vehicle parking. Parking is per- mitred only in those areas, and only on those condi- tions as are set forth at the designated entrances and -within said parking areas. Any vehicle or property within the long-term parking areas for a continuous thirty-day period or within said area contrary to the terms or conditions of use as stated herein, or as posted by the aforementioned signs, shall be subject to impound pursuant to KMC 12.25.040. The Air- port Manager, with conctm'ence of the City Manag- er, may establish a pay parking system in the long- term vehicle parking areas. (Ord. 879, Res. 91-20) 6.05.040 Reserved parking. Reserved parking areas so identified and marked by appropriate signs, established through lease or established through other document are re- served and not available for general public parking. Sincerely, Re~ Pitts DRAFT SPECIAL USE PERMIT DATE: The CITY OF KENAI (herein sometimes referred to as CITY), for the considerations of and pursuant to the conditions and requirements set forth below, hereby grants to Reean D. Pitts P.O. Box 1916 Soldotna, Alaska 99669 (herein sometimes referred to as PERMITTEE), the right to operate an automated teller machine at the Kenai Municipal Airport building. The Airport Manager shall determine the exact placement after consultation with PERMITTEE. 1. Term' The term of this Special Use Permit is for one year, commencing on the 1st day of July 2002 and extending through the 30th day of June 2003. This permit may be renewed annually on mutually agreed terms. 2. Rental Payment: The rental specified herein shall be payable as follows: A. Right of entry and occupancy is authorized as the 1st day of July 2002. B. Rental shall be a monthly fee of 15% of transaction surcharge receipts on a monthly basis for the privilege of conducting the business authorized herein, plus any applicable tax. PERMITTEE shall provide monthly revenue reports for audit purposes. C. All payments shall be made monthly within ten (10) days after the end of each month; and shall be accompanied by a separate certified statement showing gross receipts from each of the businesses herein authorized for the month for which payments are made. If any such certified statements are found to be incorrect statements of gross receipts for the month involved, any additional amount determined to be due the CITY shall be immediately paid to the CITY by the PERMITTEE and any amount of overpayment by the PERMITTEE shall be credited against the next monthly payment due the CITY under this agreement. 3/22/02 Page 1 of 4 DRAFT D. The payment shall be made to the City of Kenai, City Administration Building, Kenai, Alaska, or by mailing to the following address: City of Kenai, 210 Fidalgo Avenue, Suite 200, Kenai, Alaska 99611-7794. 3. Use: The use by the PERMITTEE of the premises described above is limited to the purposes specified herein and is not intended to grant any exclusive use to the described premises unless otherwise provided above. This use is also subject to the reasonable administrative actions of the City of Kenai for the protection and maintenance of the premises and of adjacent and contiguous lands or facilities. 4. Regulations' The exercise of the use granted herein is at all times to be subject to the regulations governing the Kenai Municipal Airport rifled "Kenai Municipal Airport Regulations" issued in 1999, or any amendments thereto. By signing this Permit, PERMITTEE acknowledges that she has received a copy of said regulations and has familiarized himself therewith and will comply with the requirements of said regulations. 5. ,.S,,.,olicitation: Solicitation of donations or the promotion or operation of any part or kind of business or commercial enterprise not contemplated by this Special Use Permit upon, in, or above airport lands without the written consent of the CITY, is prohibited. 6. Installation- All costs associated with installation shall be borne by the PERMITTEE. 7. Removal of Property: Any or all personal or real property placed or used upon lands or in facilities' in violation of the preceding prohibitions may be removed and/or impounded by the City of Kenai, and when so removed and/or impounded, such property may be redeemed by the owner thereof only upon the payment to the CITY of the costs of removal plus storage charges of $25.00 per day. 8. Reassignment/Relocation- Should it be necessary to reassign PERMITTEE to a different area of the airport terminal, the parties agree as follows: Advance notice, costs and site of relocation shall be by mutual agreement. Should reassignment and relocation be necessary, PERMITTEE shall be provided and at'forded equivalent space, in terms of both area and location, as that which it presently occupies, to the extent found feasible by the Airport Manager. 9. Risks: PERMITTEE will provide all proper safeguards and shall assume all risks incurred in performing its services hereunder. 3/22/02 Page 2 of 4 DRAFT 10. Hold Harmless: PERMITTEE agrees to save the CITY harmless from all actions, suits, liabilities, or damages resulting from, or arising out of, any acts of commission or omission by the PERMITTEE, his agents, employees, customers, or invitees,, or arising from or out of the PERMITTEE's occupation or use of the premises demised or privileges granted, and to pay all costs connected herewith. 11. Forbearance: Failure to insist upon a strict compliance with the terms, conditions, and requirements herein contained, or referred to, shall not constitute or be construed as a waiver or relinquishment of the right to exercise such terms, conditions or requirements. 12. Insurance- ATM, the PERMITTEE shall provide proof of insurance coverage on the Automated Teller Machine. Such insurance coverage shall be in an amount satisfactory to the Airport Manager 13. Unit Maintenance: The PERMITTEE shall be solely responsible for the maintenance and for keeping the unit clean. 14. Disadvantage Business Enterprise Pa_rt~icipation- PERMITTEE (CONCESSIONAIRE) is required to take all necessary and reasonable steps to foster Disadvantaged Business Enterprise participation in its airport concession activities. Ae This agreement is subject to the requirements of the U.S. Department of Transportation 's regulations, 49 CFR Part 23,. Subpart F. The concessionaire agrees that it will not discriminate against any business owner because of the owner's race, color, national origin, or sex in connection with the award or performance of any concession agreement covered by 49 CFR Part 23, Subpart F.
