Alaska's Best Travel have both requested additional office space in the airport
terminal effective December 1, 2002.
Attached are the proposed Special Use Permits for the additional office spaces.
The terms and conditions are the same as their current permits.

SPECIAL USE PERMIT

The CITY OF KENAI ("City") for the considerations and pursuant to the
conditions and requirements set forth below hereby grants to:

Hereinafter sometimes referred to as the PERMITTEE, the right to
operate a travel agency at the Kenai Municipal Airport at the location
shown as Space 36A on Exhibit A, which is attached.
1. Term: The term of the Special Use Permit is for 1 year, commencing
on the 1 st day of December 2002 through the 30t~ day of November
2003.
2. Rental Payment: The rental specified herein shall be payable as
follows:
A. Right of entry and occupancy is authorized as the 1 st day of
December 2002.
B. Rental shall be a monthly fee of $207.90 based on $1.65 per
square foot for 126 square feet, for the privilege of conducting
business authorized hereto, plus any applicable tax.
C. The payment shall be made to the City of Kenai, 210 Fidalgo
Avenue, Suite 200, Kenai, Alaska, or by mailing to the following
address: Finance Department, City of Kenai, 210 Fidalgo Avenue,
Suite 200, Kenai, Alaska 99611-7794.
3. Use: The use by the PERMITTEE of the premises described above is
limited to the purposes specified herein and is not intended to grant
any exclusive use to the described premises unless otherwise provided
above. This use is also subject to the reasonable administrative
actions of the City of Kenai for the protection and maintenance of the
premises and of adjacent and contiguous lands or facilities.
4. Regulations- The exercise of the use granted herein is at all times to
be subject to the regulations governing the Kenai Municipal Airport
titled "Kenai Municipal Airport Regulations", issued in 197'6 or any
amendments thereto. By signing this Permit, the PERMrrTEE

acknowledges that he has received a copy of said regulations and has
familiarized himself therewith and will comply with the requirements
of said regulations.
5. Solicitation: Solicitation of donations or the promotion or operation of
any part or kind of business or commercial enterprise not
contemplated by this Special Use Permit upon, in, or above airport
lands without the written consent of the CITY, is prohibited.
6. Removal of Property: Any or all personal or real property placed or
u~ed upon land~ or in facilities in violation of the preceding
prohibitiona may be removed and/or impounded by the City of Kcnai,
a.nd when so removed and[ or impounded, such property may be
redeemed by the owner thereof only upon the payment to the CIT~ of
the cost~ of removal, plu~ atorag¢ charg¢~ of $215.00 per day.

Reassignment/Relocation: Should it be necessary to reassign
PERMITrEE to a d~fferent area of the airport terminal, the parties
agree as follows: It will be the intention of the CITY to give
PERMITTEE as much notice in advance as possible of such
reassignment. The costs of relocation, including the costs of moving
and setting up counter and related facilities, shall be borne by the
PERMITI'EE. Should reassignment and relocation be necessary,
PERMITI'EE shall be provided and afforded equivalent space, in termu
of both area and location, as that which it presently occupies, to the
extent found feasible by the Airport Manager. PERMITrEE agrees to
vacate space 36A, should no designated airline office or counter space
be available to a requesting air service provider.
8. Risks- PERMITrEE will provide all proper safeguards and shall
assume all risks incurred in performing its services hereunder.
9. Hold Harmless: PERMI~E agrees to save the CITY harmless from all
actions, suits, liabilities, or damages resulting from, or arising out of,
any acts of commission or omission by the PERMITI'EE, his agents,
employees, customers, or invitees, or arising from or out of the
PERMITI'EE's occupation or use of the premises demised or privileges
granted, and to pay all costs connected therewith.
10.Forbearance- Failure to insist upon a strict compliance with the
terms, conditions, and requirements herein contained, or referred to,
shall not constitute or be construed as a waiver or relinquishment of
the right to exercise such terms, conditions or requirements.

11.Insurance: The PERMITTEE shall provide proof of insurance coverage
on the travel agency and its contents. Such insurance coverage shall
be in an amount satisfactory to the Airport Manager.
12.Area Maintenance: The PERMITTEE shall be solely responsible for the
maintenance and for keeping the area clean.
13.Disadvantaged Business Enterprise Participation: PERMITTEE
(concessionairet is required to take all necessary and reasonable steps
to foster Disadvantaged Business Enterprise participation in its
airport concession activities.
A. This agreement is subject to the requirements of the U.S.
Department of Transportation's regulations, 49 CFR Part 23,
Subpart F. The concessionaire agrees that it will not
discriminate against any business owner because of the owner's
race, color, national origin, or sex in connection with the award
or performance of any concession agreement covered by 49 CFR
Part 23, Subpart F.
B. The concessionaire agrees to include the above statements in
any subsequent concession agreements that it enters and cause
those businesses to similarly include the statements in further
agreements.
14.Cancellation: Permits in good standing may be canceled in whole or
part at any time upon mutual written agreement by PERMI~TEE and
the City Council or by the PERMITTEE upon thirty (30) days
PERMITI'EE notice.

Hereinafter sometimes referred to as the PERMITTEE, the right to lease
office space at the Kenai Municipal Airport at the location shown as
Space 34 on Exhibit A, which is attached.
1. Term: The term of the Special Use Permit is for 1 year, commencing
on the 1 st day of December 2002 through the 30t~ day of November
20O3.
2. Rental Payment: The rental specified herein shall be payable as
follows:
A. Right of entry and occupancy is authorized as the 1 st day of
December 2002.
B. Rental shall be a monthly fee of $425.70 based on $1.65 per
square foot for 258 square feet, for the privilege of conducting
business authorized herein, plus any applicable tax.
C. The payment shall be made to the City of Kenai, 210 Fidalgo
Avenue, Suite 200, Kenai, Alaska, or by mailing to the following
address: Finance Department, City of Kenai, 210 Fidalgo AvenUe,
Suite 200, Kenai, Alaska 99611-7794.
3. Use: The use by the PERMITTEE of the premises described above is
limited to the purposes specified herein and is not intended to grant
any exclusive use to the described premises unless otherwise provided
above. This use is also subject to the reasonable administrative
actions of the City of Kenai for the protection and maintenance of the
premises and of adjacent and contiguous lands or facilities.

be subject to the regulations governing the Kenai Municipal Airport
titled "Kenai Municipal Airport Regulations", issued in 1976 or any

amendments thereto. By signing this Permit, the PERMITI'EE
acknowledges that he has reCeived a copy of said regulations and ha~
fami!i~ed himself therewith and will comply with the requirements
of said regulations.

GENERAL DF-,SCRI~ION
An executive level job classification with substantial responsibility for the exercise
of independent judgment in marketing, planning, directing and coordinating all
activities at the airport.
ESSENTIAL JOB FUNCTION~
AIRPORT OPERATIONS
· Ensure compliance with federal regulations, city ordinances, state statutes
and environmental regulations to secure the safe and efficient operation of the
airport.
· Determine current and future operational needs of the airport. Prepare fiscal
budget. Prepare and maintain financial and statistical records and reports on
the status of airport operations and finances.
· Direct a work force in maintaining the airport, its facilities and installations,
and in providing services for tenants, lessees, and other users.
· Confer with representatives of federal and state agencies, commercial air
carriers, private operators, and other users of the airport facilities relative to
mutual problems and overall airport operations.
* Obtain and administer Federal Aviation Administration (FAA) grants through
the Airport Improvement Program (A.I.P.) and be familiar with the Passenger
Facility Charge (P.F.C.) application process as an alternative funding source
for FAA approved projects.
· Attend City Council meetings, work sessions and Airport Commission
meetings as required.
AIRPORT MARKETING
Develop and implement marketing plans and strategies to increase and
enhance commercial and general aviation capabilities of the airport.
· Promote the commercial and general aviation capabilities of the airport
through development of advertising and publicity strategies.
* Negotiate leases and agreements with commercial and general aviation users
of the airport as well as terminal vendors.
· Work with the Airport Commission on airport plans and strategies to provide
a~istance to them in their advisory role to the City Council.
OUALIFICATION~
· Knowledge of the principals and practices of public administration and
business administration, including methods of airport marketing, planning
and management.
· Knowledge of FAA grant programs, both the Airport Improvement Project
(A.I.P.) and Passenger Facility Charges (P.F.C.) programs.
* Knowledge of airport design and construction with the ability to analyze and
effectively report on operating conditions and problems and to recommend
appropriate solutions.
* Skill in public relations to maintain effective working relationships with airport
employees, representatives of federal and state agencies, commercial and
private operators, and the general public.
· Skill in interpreting financial reports, writing and editing technical material,
orally communicating the essential facts of a complex subject.
· Ability to perform tasks with little or no supervision. Often must complete
duties with inflexible deadlines.
· Ability to deal with the City Manager, City Council, lessees, the general public,
and employees.
· Physical ability to perform essential job functions.
Education and E~ehence.
A bachelor's degree in marketing, business administration, aviation, public
relations or related field, or succe~aful work experience in theae fields.
Five years of increasingly responsible professional work experience related to
airport marketing, management, and operations is preferred.
Experience in aircraft and airport safety is preferred.
Licenses and Special Requirements.
A valid Alaska driver's license is required.
Experience as a pilot will be given consideration but is not required.
This position is a 24 hours per day, 7 days a week call-out.
VHF radio communication skills preferred.

Cronkhite contacted the Spokane International Airport regarding off-airport car rental
operators and was informed Spokane charges ten percent of the monthly gross
revenues payable by the tenth of each month with an additional .50-cent fee accessed
per trip to the airport.
Commissioner Van Zee addressed the following:
· Informed the Commission that according to his contract with the City of
Kenai, he is required to pay ten percent of his gross income on car rentals or risk being
in violation. This, he stated, creates an unfair atmosphere as off-site agencies ut~t~e
the airport and its parking lot by using it for drop-offs and/or pick-up's; without
paying the ten percent airport concessions fee.
· His lease allows four rental car agencies to conduct business at the
airport. This, in essence, is being violated as the off-airport rental agencies are
utilizing the airport.
The Commissioners agreed a code revision could be in order to rectffSr this problem and
requested the following:
· Recommend a draft ordinance/amendment to the code to begin tatung
ten percent (10%) of the gross revenue from off-airport car rental operators.
· Set a public hearing for Soldotna and Kenai area car rental businesses to
review and discuss the proposed code change.
Discussion -- Airplane Taxes (Dave Wartmbee)
Cronkhite stated Wartinbee could not be in attendance due to a work conflict- She
provided copies of the two letters submitted by Wartinbee who requested his comments
be made a part of the meeting..
The Commissioners read and reviewed the letters submitted and commented on the
following:
· Cronkhite stated she would provide Wartinbee with the information
compiled by Finance Director Semmens and from the inquiry and poll taken at the
request of the Commission several months ago.
· The Commission discussed various differences in methods of taxation for
boats, cars, airplanes and other personal property tax issues.
· Several Commissioners opined that if the tax is eliminated more business
would be generated by overall business moving in; the result of this trickle down effect
could eventually make up the loss of taxation revenues.
Pat Porter- 310 Rogers Road:
Porter briefly addressed the Commission and suggested they reaffirm an earher motion
to request looking into the notion of a flat tax and/or exemptions.

Councilwoman dackm~ informed the Commission of upcoming work sessions and
urged all to attend and to reiterate the Commission's request for a flat tax and
exemptions for aircraft.
MOTION:
Commissioner Haralson MOVED to recommend City Council review airport taxation to
be in line with the current Borough method of exemption. Commissioner Holloway
SECONDED the motion. There were no objections. SO ORDERED.
MOTION:
Commissioner Haralson MOVED to encourage City Council approach the Kenai
Peninsula Borough to enact a Borough-wide fiat tax similar to Anchorage and the Mat-
Su Borough. Commissioner Holloway SECONDED the motion. There were no
objections. SO ORDERED.
ITEM 6:
NEW BUSINESS
Discussion -- Commission Meeting Site
Cronkhite informed the Commission of several problems involved in conducting a
meeting at the new Airport Operations Facility including: acoustics, meeting space and
public notification. Because the November meeting may involve a larger than usual
public attendance, Cronkhite suggested having the December meeting at the new
facility, if the Commission was so inclined.
Commissioner Bielefeld stated he did not mind having one meeting at the new facility,
but felt the best place for the Commission meetings is at City Hall. Councilwoman
Jackman stated she and Council wanted the Commission to hold a meeting at the new
facility at least once. The Commissioners agreed to hold the December meeting at the
new facility; the meeting will also include a Christmas party.
ITEM 7: REPORTS
7-a. Commission Chair- Knackstedt reported on the following:
Stated he recently returned from the Reno Air Races; he found it to be
interesting and fun.

· Earl Hicks was hired as the new Airport Operations Manager. Cronkhite
added he is very qualified and she is very pleased to have him on board.

· The a/rport had a visit from the FAA Compliance section which respected
areas involving persons with disabilities. Cronkhite noted the respect/on went well.
· The a/rport has received over $900,000.00 in grant funds to be used
toward equipment purchases, runway improvements, security, etc.
7-e. City Council Liaison -- Councilwoman Jackman provided a brief recap of
City Council action items.

COMMISSIOI~_R COMMENTS AND QUESTIONS
Commissioner Holloway stated he would not be in attendance for the work session
meetings.
Commissioner Van Zee encouraged the Commissioners to not lose focus of the goals
of the study; which is not about airfare. Van Zee stated the planned study is about the
airpor~ itself and its future.
Commissioner Bielefeld stated ERA is grounding and se/ling their Conveyor aircra/ts.
Commissioner Haralson requested information regarding past Co_m__m_ission
discussions and surveys, as well as other pertinent information, be put into a Yact-
book' prior to the October 15 work session with Council.
Commissioner Wat~~ requested the ~rass and weeds near Granite Point be mowed
prior to winter, as the grass in this area is shaggy and unsightly.

AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, AMENDING
KMC 7.05.010 TO PROVIDE A FLAT PERSONAL PROPERTY TAX OF $75.00 FOR
NON-COMMERCIAL AIRCRAFT AND CLARIFYING THE E~STING EXEMPTIONS.
WHEREAS, currently the personal property tax for non-commercial aircraft is on an
ad valorem basis; and
WHEREAS, it is in the best interest of the City of Kenai to have a flat personal
property tax of $75 on non-commercial aircraft; and
WHEREAS, the existing personal property tax exemptions in KMC 7.05.010(c) should
be clarified;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI,
ALASKA that KMC 7.05.010 be amended by replacing section (c) and adding two new
sections (d)and (e) as follows:
(C) [IN ADDITION TO EXEMPTIONS PRESENTLY AUTHORIZED BY THE KENAI
PENINSULA BOROUGH, THE INVENTORY OF A BUSINESS HELD FOR
RESALE IN THE NORMAL COURSE OF THAT BUSINESS IS HEREBY
CLASSIFIED AS PERSONAL PROPERTY EXEMPT FROM TAXATION FOR

THE CITY OF KENAI.]
In addition to the exemptions required by law,. the household furniture and
effects of family or a householder .are classified as exempt from taxation.
Household furniture and effects shall include household appliances, garden
tractors, garden supplies and accessories, noncommercial garage
equipment' home workshop machinery_ and any vehicles not requiring
registration or licensing. The inventory of a business is hereby classified as
personal property exempt from taxation for the City of Kenai.
[d) Aircraft (freed and rotary wing) that are not used for commercial
purposes are taxed at a flat rate of $75 per year and not as provided
in KMC. !4.05.010 (a) and (b).above.
(e) Motor vehicles required to be registered by the State of Alaska shall be
taxed as provided in KPB 5.12.245.
