MOTION: Commissioner Holloway MOVED to approve the agenda as amended and Commissioner Van Zee SECONDED the motion. There were no objections. ORDERED. SO ITEM 3: APPROVAL OF MINUTES -- October 10, 2002 MOTION: Commissioner Holloway MOVED to approve the minutes of October l 0, 2002 as presented and Commissioner Kleidon SECONDED the motion. There were no objections. SO ORDERED. ITEM 4: PERSONS SCHEDULED TO BE HEARD -- None. ITEM 5: OLD BUSINESS-- None ITEM 6: NEW BUSINESS Discussion-- New Parking Lot Configuration--Phil Bryson (Wince, Corthe11, Bryson) Phil Bryson, of Wince-Corthell-Bryson explained his company had been requested to review problems in routing and parking at the airport terminal for automobiles. He handed out parking lot layout drawings as follows: · Existing parking · Existing parking designations with approximate number of stalls available. He noted the long-term parking area sometimes is under stress with the number of vehicles and types of vehicles using the facility; the short-term area did not have those problems; and the rental concession areas are about half assigned (each company has 15 assigned stalls and one company has requested an additional five). · Alternate "A' parking (re-striping option) -- The same driving lane and the same center of stalls was used, however the stalls were widened to alleviate crowding for the larger vehicles. · Alternate "B' parking (re-striping option) -- Areas north of the terminal were modified and larger stalls were incorporated to take care of problems with large trucks with cabs and eight-foot beds. It was noted, it was unknown whether people would use these spaces. · Existing parking layout -- included for Commission members to draw out their ideas of parking designs. · Reconstruction Layout "C' -- A conceptual drawing with larger lanes in the long term area, additional stalls and re-positioning at the northwest end of the terminal (previously employee parking and permitted parking) which would create a different flow pattern. This drawing would also include two drop-off lanes in front of the terminal. It was noted, the re-striping option would cost approximately $5,000 and the reconstruction option had no estimate at this time. A lengthy discussion followed. Information and a suggested ideas were as follows: Security cameras will be added on top of the building which will pick up activities in the parking lots. Additional lighting could be advantageous, however the area needing more lighting is toward the current restaurant parking area. · Change the ingress of the lots from the north side of the parking area and change the direction of the stalls to north/south instead of east/west. Combine the short and long-term parking areas and exit from the south. · Consider adding parking areas with plug-ins for employees of the airport. The plug-ins can possibly be billed out to the individual or the company. · Consider including in the short-term parking area spaces for overnight parking with a pay box ($2.00 for one overnight stay). Adding those spaces could alleviate some of the swain on the long-term parking lot for those needing to park for more than one night. · Because people like parking close to the front door, it may be difficult to train users not to park smaller vehicles in spaces set aside for large trucks, etc. and visa versa. Enforcement would require additional staff, which is not a current possibility. · Snow removal is a problem with the barricades now in place in the short- term parking area as well as the long-term area. · It is important to keep the permitted parking area close to the terminal as the desire is to cater to them and address their needs. They are a good cash flow to the airport. AIRPORT COMMISSION MEETING NOVEMBER 14, 2002 PAGE 2 · With parking spaces running north/south, ready-return spaces for rental vehicles may be possible. · Parking spaces for restaurant/bar users should remain close to the terminal as parking them further away could be an impact on the restaurant by local users. · Designs need to include adequate parking and access for taxis, courtesy vans and 40' buses for possible larger tourist trade. The Commission also discussed the possibility of using the overflow parking area across the street for additional large vehicle parking (recreation vehicles, large trucks, buses, etc.) Also, the use of the now vacant property at the east end of the car rental parking lot was discussed for future needs. Additional comments included: · It is very important to the marketability of the airport to make it available and user-friendly as the highway use by travelers is very competitive. · FAA parking regulations are fluid and a new version of the 300' rule is in the works, however currently the airport is not subject to the 300' rule. · Additional parking spaces closest to the terminal can be made if the parking spaces are turned east/west. Commission members were requested to draw out any ideas they had in regard to the parking areas and forward them to Cronkhite who will pass them on to Bryson. The consensus of the Commission was they liked Option B with several modifications, i.e. include the concept of the north/south parking, eliminate some of the entrances and exists, remove concrete barricades in the short-term parking area, add some additional lighting toward the restaurant end of the building. Bryson will bring ideas discussed at this meeting to the February meeting for additional review and discussion. Discussion-- Special Use Permits--Requests for Office Space' Hertz Rent-a-Car Alaska's Best Travel Cronkhite explained she had received requests for additional office space from Hertz Rent-a-Car and Alaska's Best Travel. However, between the time the packet was mailed and the meeting, desires had changed and the information included in the packet was no longer appropriate for the requests. She noted, the Hertz request was no longer relative. Cronkhite explained Alaska's Best Travel has requested a Special Use Permit for additional rental space in the terminal. Cronkhite added, she suggested Space 34 which had recently been painted and new carpet installed. Because Alaska's Best AIRPORT COMMISSION MEETING NOVEMBER 14, 2002 PAGE 3 Travei-does not need the entire Space 34, she will place a temporary barricade to divide the space into two areas, identifying them as Space 34A and 34B. If it is found more space will be needed by Alaska's Best, the Special Use Permit can be modified. However, it would be unfair to other lessees to allow the use of the whole space for only half the cost. Cronkhite also noted, if another airline moves into the Kenai market, the Permit would be cancelled and the space would be available for the airline's use. MOTION: Commissioner Van Zee MOVED to draw up a special use permit to lease Space 34A to Alaska's Best Travel and Commissioner Holloway SECONDED the motion. There were no objections. ~O ORDERED. -Ce Discussion-- Central Peninsula Air Fair Cronkhite reported plans were already being formulated for the next Air Fair and the tentative date was set for May 31 (the weekend after Memorial Day). Because the FAA will be involved in a Centennial Flight event, it is hoped it can be incorporated into the Air Fair. A portion of that event is to honor the fu:st flight into the area and what type of plane and who it was is being investigated. Cronkhite added, whether to incorporate static displays and vendors had been discussed and because the objective of the Fair is to get people to fly to Kenai, it was felt vendors was not a main purpose of the event. Knackstedt noted this year the breakfast will be held at Kenai and the barbecue at the $oldotna airport. Larger aircraft will be on display in Kenai and smaller in Soldotna because of the airports' capacities. The Commission had no objections to the Air Fair date. It was also noted the December meeting would be held at the new SRE building. Discussion-- Airport Manager Cronkhite left the room. Knackstedt explained he requested this item be included on the agenda and noted since Cronkhite had been employed at the City, the Commission was being kept better informed of activities at the airport, had been encouraged to be more involved in the airport through items brought to them during their meetings, etc. He added, he felt Cronkhite was doing a very good job in keeping the Commission informed. Because the Commission had never seen the airport manager job description, he requested it be included in the packet. He noted, the position is two- fold -- everyday management of the airport and marketing of the airport. AIRPORT COMMISSION MEETING NOVEMBER 14, 2002 PAGE 4 Councilman Bannock reminded members the Commission was advisory and that without the City Attorney, City Manager Snow or Cronkhite being present, he was very uncomfortable with the Commission discussing the city's employees as the membership did not have authority to evaluate the airport manager. Knackstedt stated that was not his intention and only wanted to say he thought Cronkhite's involvement with the Commission had helped the Commission do a better job and stay motivated. Van Zee noted it was his understanding Knackstedt wanted to give a vote of confidence to the airport manager. Discussion -- Personal Property/Flat Tax on Aircraft Bannock noted, the city council had discussed the personal property tax on aircraft during their recent work session. During the work session, he suggested a flat tax of $75 for each non-commercial plane. To that end, the city attorney had prepared a draft ordinance to establish the flat tax, which was distributed to the Commission for their review and comment. Bannock explained, unlike eliminating the personal property tax in Kenai, it was his belief a flat tax of $75 would have virtually no impact on the General Fund. Additionally, eliminating the tax would affect the property owners of the city as the deficit that would be created by the elimination of the tax would probably have to be regained by raising property taxes. Cronkhite noted, she believed the flat tax would be a good idea, though it wouldn't be perfect. She added, it would fight the current perception that Kenai has a huge tax on aircraft and note all the good things has to offer at the airport for only $75. It was suggested it would be a good idea to encourage the Borough to also set a flat tax. MOTION: Commissioner Bielefeld MOVED to approve the draft ordinance providing for a flat personal property tax as written and Commissioner Holloway SECONDED the motion. There were no objections. SO ORDERED. Van Zee stated he felt it important to pursue a tax incentive for commercial aircraft as well, however it was understood the Genera/Fund would have to be manipulated to fill the deficit it would cause. Cronkhite stated she would investigate incentives offered in other parts of the country to bring businesses to the airport. It was noted, it may be helpful to speak with the Soldotna Airport Commission to this regard. Bannock noted the city and the borough have a mechanism in their economic development powers by which incentives can be offered under special circumstances. ITEM 7: REPORTS Commission Chair-- Knackstedt noted he attended the joint work AIRPORT COMMISSION MEETING NOVEMBER 14, 2002 PAGE 5 session with the council and representatives of ERA Aviation. He added, it was his impression the airport survey would not include an airfare study, but other items would be investigated. He requested the matter be brought back on the next meeting agenda and a copy of the work session notes be included in the meeting packet in order for the issue to move ahead. 7-b. Airport Manager-- Cronkhite reported the following: · Council discussed the off-airport car rental fees during the Airport Commission report at the council's November 6 meeting. The council directed the city attorney to draft an ordinance dealing with a ten percent concession fee for off-airport car rental agencies for review by council, the Commission and the public for comment. A copy of the draft ordinance was distributed to the Commission for review. Asked if council had discussed reviewing other taxes at the airport, i.e. taxi concessions, etc., . and Cronkhite reported no, and added, court cases refer to taxis as vehicles-for-hire and the airport could charge a fee over and above those already paid for the city's vehicle-for-hire licenses. · There were several diversions to the airport during the previous week due to fog in Anchorage and all went well. 7-¢. City Council Liaison -- Councilman Bannock reviewed actions taken at the November 6 meeting and noted, the council would be holding at least one more policy work session. ITEM 8: COMMISSIONER COMMENTS AND 0UESTIONS Commission Watkins questioned what is available for fueling at the float plane basin and Cronkhite noted there is an automated fueling facility at the basin and she is now in negotiations with a local fueling coming to take it over. To further enhance this area and eliminate the effect of the evergreen trees overshadowing the flagpole, I requested a proposal from Booth's Landscaping suggesting improvements. Attached for your review is the landscape architect's suggested layout for this area. The project including the proposed sign is estimated to exceed $10,000. AiI:z-P~ nal Municipal Airport II Monthly Reportii School Tours: The airport conducted tours for 21- first grade students from Tustamena Elementary and 26 - fourth and fifth graders from North Star Elementary in October. The students also toured the Control Tower and the Kenai Flight Service Station. Alaska Airlines Diverts 737s: On Friday, November 8, Kenai Airport accepted diverted aircraft from Anchorage due to low visibility. Included were two Alaska Airline 737's and three cargo jets. The aircraft fueled and remained on the ground here for about 2.5 hours. Numerous small aireraf~ also diverted to Kenai. Acting Airport Manager Mary Bondurant did an excellent job of addressing issues of parking, FAA security and coordination with City Police and Fire Departments. Her l0 years experience dealing with similar issues at the Kodiak Airport paid off and demonstrated that Kenai can handle many types of aircraft. More Diversions- On Wednesday, November 13, low visibility in Anchorage again caused several aircraft to divert to Kenai. Frontier Airlines diverted two 1900s. Those passengers were deplaned into the terminal where they were able to patronize our restaurant. Airport Terminal Parking Lot and Driveway Reeonfiguration Project: Phil Bryson presented drawings and preliminary ideas to Airport Commission for discussion. The first task is to identify the needs of all user groups and then work to meet those needs while maintaining security and accessibility. We plan to use the November and December meetings to develop several options and then send letters to all user groups inviting them to the January meeting with the goal of bringing a recommendation to Council in February. Aircraft Handicap Lift: The Airport Manager has been working with Paul Landis at Era Aviation for several years on compliance with ADA and Air Career Access Act requirements for boarding disabled passengers. The issue was complicated by the unique configuration of the Convair 580. Since the recent decision to phase-out the Convair from the Kenai market, Mr. Landis has provided reformation on his preference for a passenger lift. His letter is in your packet under reformation items. It has been a common practice within the industry for the airport to purchase loading equipment and the career to maintain and operate the equipment. There is also a possibility FAA funding may be utilized for the purchase. A standard letter of agreement will be forwarded to the City Manager for review along with recommendations for equipment purchase. KCHS Work-Experience Program: Kenai Central High School student John Cook is working at the airport under the KCHS work-experience program. This is the second time the airport has participated in this program. Additional reformation on the program is included under information items. Annual Air Fair: Staff has started planning and working with volunteers and the Soldotna Airport for this annual event. The tentative date is set for May 3 l~t. Christmas Lights: Kudos to Steve Kegler, our seasonal groundskeeper, for the many hours he has invested in stringing extension cords and hanging lights. We will continue to add to the displays over the next week. Off-Airport Vehicle Rental Concessions: The Airport Commission had requested the Airport Manager send a letter to all businesses potentially affected by this proposed fee inviting them to participate in a discussion at the next Airport Commission meeting. The letter was not sent and the item deleted from the Commission agenda, as Council has taken up the discussion and referred it to the City Attorney. Airport Commission Christmas Meeting: The December 12 Airport Commission meeting will be held at the new Operations Facility as requested. WHEREAS, City of Kenai is the owner and operator of the Kenai Municipal Airport ('Airport') under the authority of the Kenai City Charter and the statutes of the State of Alaska; and WHEREAS, the Airport is financed and managed under policies and practices designed to ensure that it is and will continue to be self-supporting and will not require the expenditure of local tax funds; and WHEREAS, off-airport rental companies are benefiting from the use of the Airport but are not paying a significant and fair share of the costs and expenses of operating the airport; and WHEREAS, off-airport rental vehicle companies do not contribute fees toward the cost of the Airport to an extent equal of the value of the privileges they enjoy or the facilities they use or benefit from; and WHEREAS, at many airports throughout the nation off-airport vehicle rental companies are required to and are paying a percentage of gross revenue fees for the right to conduct airport operations, and the City desires to pattern such fees at the Airport in the same manner; and WHEREAS, for purposes of establishing and /'ming fees, the City finds that rental vehicle companies, including off-airport companies, constitute a specific class of business operations dependent on the use of Airport property; and WHEREAS, it is necessary, appropriate and reasonable to establish and f'tx appropriate fees for off-airport rental vehicle companies to preserve and maximize rental revenues; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA that KMC 21.05.045 is adopted to read as follows: Ordinance No. December 2, 2002 Page 2 of 2 KMC 21.05.045 Off-airport Vehicle Rentals (a) (b) (c) (d) (e) (0 (g) To operate an off-airport vehicle rental business on the Kenai Municipal Airport, a person who does not have a concession to operate a vehicle rental business in an airport terminal building must hold a current vehicle rental business permit issued under this section. Operating a vehicle rental business on the Kenai Municipal Airport for purposes of this section means picking up or dropping off a vehicle rental customer by the operator or its agent or leaving a vehicle to be picked up by the customer at the airport or having the customer leave a vehicle at the airport to be picked up by the operator. A person must submit an application for a vehicle rental business permit in writing to the Airport Manager and include a description of the services that the applicant proposes to offer under this permit. The Airport Manager shall approve an application for a vehicle rental business permit unless the Airport Manager determines that (1) The proposed use would interfere with or is incompatible with the safety, maintenance or operation of the airport; (2) The proposed use would result in a violation of applicable law or regulation; (3) The proposed use is inconsistent with sound airport planning. A decision by the Airport Manager to deny an application for a vehicle rental business permit must be in wr/ting. The decision shall state the grounds for a denial. A decision to deny a permit may be appealed to the city council by filing an appeal with the city clerk within thirty days of wriRen notification of the decision. KMC 14.20.290 shall govern the procedure of the appeal. A vehicle rental business permit is not transferable and may not exceed five years. An off-airport business permittee shall pay ten percent of gross sales from rentals derived from the Kenai .Municipal Airport. Rentals shall be deemed to have been derived from the Kenai Municipal Airport if the vehicle rental business customer is picked up or dropped off at the airport by the permittee or the permittee's agent or if the rental is left for the customer to pick up at the airport or dropped off by the customer at the airport. Gross rentals shall mean the value of all charges incurred by the renter, other than the fee prescribed, by this section, for the use of a motor vehicle, regardless of whether paid in the form of money, property, or services, except for only the following items if separately stated on the rental contract: (1) The mount of federal, state borough or municipals sales or other similar taxes separately stated and collected and/or reimbursed from customers. (2) Any sums received from insurance or other settlements for damage to automobiles or other property of the concessionaire, or any charges collected from a customer for damages to the vehicle rented. (h) A vehicle business rental permittee shall provide such evidence of insurance coverage for the permittee's operations on the airport as provided for on airport rental vehicle concession holders. (i) A vehicle rental business permittee may park, wait and drop off or pick up a passenger only at premises or in an area the Airport Manager has designated for that purpose. (j) A vehicle rental business permittee may cancel a permit and cease operations at the airport any time on written notice to the Airport Manager. (k) Cancellation of a vehicle rental business permit by the Airport Manager must be in writing and state the reasons for the cancellation. Reasons for cancellation are: 1) if the Operator should breach or fail to perform any of the terms, covenants, or conditions of this section or any regulations adopted relating to this section; 2) if the Operator should default in or fail to make payments at the times and in the amounts required under this section or any regulations adopted relating to this section; 3) If the Operator should fail to abide by all applicable laws, ordinances, rules and regulations of the United States, State of Alaska or the City of Kenai. A permittee may appeal a cancellation to the City Council by filing a written notice of appeal to the City Clerk within thirty days notification of cancellation. KMC 14.20.290 shall govern the procedure of such an appeal. (1) The City Manager may, pursuant to KMC 21.05.030, establish rules, regulations and permit conditions regarding an off-airport vehicle business permit. The Associated Press (Published: November 19, 2002) Small interest checks have been distributed to 15 Fairbanks businesses, organizations and individuals who pledged $100,000 to Condor Airlines to fly to the [nterior city. The investment, which some people believed risky, has laid the groundwork for the German-based vacation airline to make stops in Fairbanks next summer. The backers were handed their share of $734 in interest on Nov. 7. "The sponsors are very pleased to have their cash returned unblemished," said Dave Carlstrom, director of marketing at Fairbanks International Airport. Carlstrom, who helped spearhead the recruitment of the airline, invested some of his own money in the effort. Carlstrom said the revenue for the airport from the airline through landing and fuels fees was minimal, somewhere in the $30,000 range. "The payoff is to the community and the tourism businesses," he told the Alaska Journal of Commerce. Condor carried passengers from Frankfurt to Fairbanks via Whitehorse, Yukon. The airline ran weekly nonstop return flights from Fairbanks through Sept. 26. Backers' money, put into an escrow account, guaranteed the number of passengers through the 19-flight season would be at least 950. Tourism officials said 1,154 people, primarily returning German tourists, boarded Condor in Fairbanks for the trip to Frankfurt. Round-trip tickets ranged from $650 to $850. Had the return flight not averaged 50 seats, Condor would have been compensated under the terms of the deal. The Fairbanks convention and Visitors Bureau put in $14,000 toward the pledge. Other businesses, ',.,including hotels, tour operations and fuel companies, pledged at least $1,000 each. "The community rallied. This past season showed an increase of 33 percent over 2001 for travelers arriving in Fairbanks and a 14 percent increase for those returning to Europe, according to the visitors bureau statistics, The bureau will spend about $70,000 in the next few months promoting Fairbanks and the Interior to Germans, Hickok said. Like Fairbanks, airports across the United States are wooing airlines with cash incentives to lure airlines to stop in their communities to spur economic development. Carlstrom points to Portland, Ore., where several businesses ponied up $10 million recently to attract Lufthansa, which intends to offer a nonstop route to Europe. He said Fairbanks, while successful with its Condor business, still needs to work to get airlines to the Interior's largest city. "We're barely past the embryonic stage in market development right now, but we are on the map," Carlstrom said.
