Kristine Schmidt-- Airport Noise
Schmidt distributed a handout from the City of Scotsdale, AZ website in which there is
information relating to airport noise and also provides a place for the public to submit
aircraft noise complaints. She suggested something similar be available in Kenai as
the email would provide formal tracking of complaints.

Discussion -- Off-Airport Car Rental Fees
The Commission again reviewed the issue and the draft ordinance (included in the
packet) to establish an off-airport vehicle permit system and require off-airport vehicle
rental operations to acquire a permit and pay a fee of ten percent from rentals where
the renter or rental vehicle is picked up or dropped off at the airport by the vehicle
rental business or its agent.
MOTION:
Commissioner Watkins MOVED to recommend Council adopt this ordinance and that
airport management review other fees and bring them to the next commission meeting
for consideration. Commissioner Bielefeld SECONDED the motion.

included in the packet.

It was noted a seaplane had a problem when taxiing due to a rescue boat obstruction.
It was suggested, on inspection, make sure the ramp is clear. It was also questioned
how much area does ERA have designated on the terminal ramp.

RE' Commission and Committee Powers
The Council asked me to write a memorandum regarding the powers of the various city
commissions and committees (hereinafter "commissions"). KMC 1.90 outlines the standard
procedures for them. The general procedures apply unless there are specific code sections
regarding the commission or committee that specify otherwise. KMC 1.90.020(a) states that
commissions and committees "shall act in an advisory capacity to department heads within the
City Administration." (Emphasis added.) KMC 1.90.050 states, "All acts of boards,
commissions and committees are subject to the paramount authority of the City Council."
The impetus behind this memorandum was a move by a Commission Chair to independently go
out for and craft a request for proposals for management of a city facility. In that case, it
appeared the Commission Chair intended for the commission to b,vpass the City Council and
Manager and do its own process for the selection of mana~ement~ of'the facility. Such a process
clearly exceeded the scope of the intended powers of a commission.
Of the various commissi°ns, the one with primary independent authority is the Planning and
Zoning Commission. That commission has independent authority under AS 29.40 and KMC
14.05.010 for the determination of various zoning issues such as granting of variances or
conditional use permits. Those decisions, however, are still subject to appeal to the City Council
acting as the Board of Adjustment and then the Superior Court. In other areas, that commission
acts only in an advisory capacity to the city and borough.
The other commissions act almost exclusively as advisory bodies. They, subject to council
approval, adopt master plans for the physical development of facilities and some of them (e.g.
Library, and Parks and Recreation) also make advisory recommendations as to hiring of a
department head. The duties of the varioUs commissions are in the code as follows: 1) Planning
and Zoning~KMC 14.05.010; 2) Harbor~KMC 11.10.010; 3) Library~KMC 1.57.010; 4)

1.90.010 Creation.
All boards, commissions and committees created
by the Council of' the City, of Kenai, shall consist of
seven (7) members who shall be nominated by the
Mayor and confirmed by the City Council from ap-
plications submitted to the City Clerk. A chairman
and vice-chairman shall be selected annually and
shall be elected from and by the appointed members.
The Mayor and one Council Member elected by the
Council as ex-officio members and as consultants of
any board, commission or committee, may attend ali
meetings, but shall have no voting power on the
board, commission or committee. A member of
Council or City administrative staff shall attend all
meetings of' boards, commissions and committees
and supply staff support.
1.90.020 Duties.
(a) Members of' boards, commissions and commit-
tees shall be required to establish policies relat-
ing to their respective organization. They shall
act in an advisory, capaci ,ty to department heads
within the City Administration if' there are such
departments in the City organization that di-
rectly relate to the board, commission or com-
mittee.
(b) If the board, commission or committee has in-
come stated within the City of Kenai annual
budget, said board, commission or committee
shall work with the Ci,ty Manager to establish
expenses projected for me year tbr approval t~y
the City Council.
1.90.030 Qualifications.
(a) A member of a board, commission or committee
must be a resident of the City of Kenai, unless
the board, commission or committee is specifi-
cally exempted by Council from this require-
ment. The member cannot be an officer or em-
ployee of the City of Kenai. If any member
should move.his residence from the corporate
limits of the City of Kenai (if' applicable), is an
officer or employee of the City of Kenai, or shall
be elected or appointed as an officer or em-
ployee of the City of Kenai, the service of such
member shall terminate immediately. He should
be aware that he will serve without salary, but
will be reimbursed for ali reasonable expenses
incurred in connection with this service, only af-
ter approval by Council.
(b) The Beautification Committee, and Harbor, Li-
brary, and Parks and Recreation Commissions
may at the discretion of the Council have up to
two non-resident members each. (Ord. 1948-
2002)
1.90.040 Terms.
(a) A member of a board, commission or committee
shall serve for a term of three (3) years, unless
the board, commission or committee is specifi-
cally exempted by Council from this require-
ment. At renewal date, the Mayor, with consent
of the Council, can reappoint the member or
recommend a replacement.
(b) The terms of the initial board, commission or
committee member shall be staggered so that
three (3) members will be appointed for one
year; two members will be appointed for two
years: and two members will be appointed for
three years. Terms shall commence on January i
of' each year.
1.90.050 Proceedings.
(a) All boards, commissions and committees will
have regularly scheduled meetings which shall

Permanent records or minutes shall be kept ol'ail
proceedings and such minutes shall record the
vote of each member upon every, question.
Every decision or finding shall immediately be
filed in the office of the City Clerk and shall be
a public record open to inspection by any per-
son. All acts of boards, commissions and com-
mittees are subject to the paramount authority of
the City Council.
(b) If the commission, committee or board member
shall be absent from more than one-half of all
the meetings of his/her committee, commission
or board, regular and special, held within any
period ofthree (3) consecutive calendar months.

(c) In all matters of parliamentary, procedure.
Robert's Rules of Order as revised shall be ap-
plicable and govern ali meetings, unless as
specified in KMC 1.15.060 motions: KMC
I. 15.100, speaking; and KMC 1.15.110, Voting.
(d) The responsibility, of insuring that ali members
of boards, commissions and committees receive
a copy of the Standard Procedures of Boards.
Commissions and Committees lies with the City
Clerk.

commissions and committees.
Requirements of boards, commissions and com-
mittees as set forth in KMC 1.90 are general re-
quirements and shall be followed to the extent that
they do not conflict with specific requirements found
in code sections specifically pertaining to individual

(a) The Commission shall be required to perform
the following duties:
(1) Review and act upon requests for vari-
ance permits, conditional use permits,

(2) Interpret the pwvisions of the Kenai
Zoning code and make determinta/ons
when requested by the Admin/mative
Official.
(3) Review the City of Kenai Comprehensive
Plan on an annual basis and conduct a
minimum of one public heating. Said
recommendations shall be forwarded to
the Council for consideration.
(4) Promo~ public interest and understanding
of comprehensive planning, platting,
zoning, land management, and other
issues relating to community planning
and development.
($) Proposed plans for the rehabilitation or
redevelopment of any area or district

(6) Perform historic preservation reviews and
duties as set froth in KMC 14.20.105.
(b) The Commission shall act in an advisory ca-
pacity to the Kenai City Council reg~g the
following matters:
(1) Kena/Zoning Code and Official City of
Kena/Zoning Map amendments.
(2) City and airport land lease or sale pet/-
t/om.
(3) Capital Improvements Programming. The
Commission shall submit annually to the
Council a list of recommended capital

the Commission, are necessary and desir-
able to be constructed during the forth-
coming three-year period. Such list shall
be arrange~ in order of preference, with
recommendations as to wh/ch projects
shall be constructed in which year.
(c) The Commission shall act in an advisory ca-
pacity to the Kenm Peninsula Borough Plan-
ning Commission regarding the following mat-

In order to defray the expenses connected with
the consideration of applications for variances and
conditional use permits, the person presenting the
application shall pay to the City Clerk a fee in the
amount of one hundred dollars ($100.00). A fee in
the amount of one hundred dollars ($100.00) shall
accompany an application for amendment to the
Kenai Zoning Code or Official Map. Whether an
application is granted or den/ed by the Commission,
the petitioner or applicant shall not be entitled to the

matter, shall show the Commission's
recommendations for the development of
the City Harbor facilities may include,

and sequence of all public harbor
facilities;
(ii) the relocation, removal, extension, or
change of use of existing harbor
facilities;

Council, not less than ninety (90) days
prior to the beginning of the budget year,
a list of the recommended capital ira-
provements which, in the opinion of the
Commission, are necessary or desirable to
be constructed during the forthcoming

onunendations as to which projects shall
be constructed in which year.
(3) Make investigations regarding any matter
related to City harbor facilities, tide or
submerged lands. Make recommendations
to the Council relative to thc care, con-
trol, and development of tide and sub-
merged lands.
(4) Act in the capacity as directed and autb~
rized by a tidelands ordinance adopted-
the City.
(5) Review all City leases of City-owned
tide, submerged, and lands or navigable
waters within the City, and as to the
planned improvements proposed and
make recommendations to the City Coun-
cfi.
(6) Make and prepare repons and plans for
approval by the City Council.
(7) Coord/nate public efforts, individual and
group, to the effectuation of approved
plans.
(8) Shall act in advisory capacity in the se-
lection of a Harbor Director should such

The Commission shall:

nautical lands.
(b) Observe, oversee and guide in an advisory
capacity, any matters relating to use of airport
runways, airport terminal, and airport aeronauti-
cal lands.
(c) Act in an advisory capacity to the Council and
the Airport Manager.
21.25.020 Qualifications.
Members of the Airport Commission will con-
form to the requirements of the City of Kenai
Boards, Commissions. and Committees Standard
Procedures as established by KMC 1.90, except that
members of the Airport Commission need not be

The Commission shall comprise of seven (7)
members who shall be chosen so as to represent
broadly the following areas:
(a) One member, fixed base operator (FBO)

tion Administration functions.
(d) One member, representing the Civil Air Patrol.

Article VI
POWERS OF THE COUN'CIL
The powers of the Council are advisory only and are derived from the federal, state,
and city local governments which provide the funds for operation and all powers and
activities shall be exercised in accordance with law. All action taken by this Council
shall be submitted to the City Administrator and shall be subject to approval by the
Kenai City Council.

Off-Airport Car Rental Fees
At the August 14 Commission meeting a recommendation to Council for adoption
of a draft ordinance establishing off-airport vehicle permits and fees passed
unanimously.
Because of the City Attorney's workload and the upcoming municipal election, I
elected to postpone introduction of that ordinance until the October 15 Council
meeting.
This memo is to inform Commission of that delay and also to bring to your
attention the attached photo of a van apparently owned by a Soldotna vehicle
rental company. The company is parking this van in airport parking lots to
advertise their rental business. Under the current regulations, this is legal.
I would appreciate the Commission's support in developing a regulation that
would require ali businesses conducting operations on the airport to have a
permit. Under this regulation permits would not be issued that conflicted with
current concession agreements. I would also like to add language to the off-
airport car rental ordinance that details the rights to drop off or pick up but not to
stage cars on airport property.
All of these ideas require review by the City Attorney; however, your
endorsement at this meeting would allow me to proceed to Council on October
15.

At the August 14 Commission meeting, Kristine Schmidt requested the Airport
provide an easy way for the public to. file noise complaints online. Attached for
your information are the new main page for www. KenaiAirport.com and the
comment/complaint page.
in her comments, Ms. Schmidt also indicated that the emails would allow the
Airport to track noise complaints. The Airport has tracked noise complaints for
several years. An example of the noise complaint database is attached.
I am still soliciting proposed wording for a sign at the floatplane basin
encouraging pilots to be good neighbors in the noise arena.

Over the past few years, the Airport Commission and City Coundi have explored several
possibilities for airport marketing studies and mission statements. Last week I attended a
conference and school on airpo~ and several of the dassos were on Airart Business Plans.
Attached to this memo are excerpts fTom several handouts.
After attending these dasses and speaking to many airport managers and consultants I am
convincod that we can accomplish many of our ~oals through development of an airport
business plan. I am also convinced that some, if not all of the funding could be eligible for
ai~ort grant money h~we am ve~t caroful in our approa~ and scopo.

Hertz Rental Car Concession
Attached is correspondence between Hertz Corporation and me regarding the
vacant rental car concession in the Airport Terminal.
Hertz is the only company that has expressed an interest in the space; therefore,
we are not required to pursue a competitive bid process. In the proposed
contract, Hertz will occupy the space currently used by Payless and pay the
appropriate fees and space rent.

Attached is a draft copy of the lease agreement for Car Rental Concessions in the
terminal. The available space and rent are included; you need to provide signatory
information and addresses. A copy of the letter of agreement between the City and
existing concessionaires allowing reallocation of spaces is also included, as is a diagram
of the terminal and rental car parking lot.
The next Airport Commission meeting is October 9. If your lease is to be on the agenda,
I will need a letter confirming your desire to conduct business in th® terminal by October
1. Once the Airport Commission recommends approval, a completed lease agreement
can be sent to City Council at any time. Council meets twice monthly; the Airport
Commission will not meet again until December 11. I will make every effort to ensure
the paperwork is processed expediently to meet your proposed schedule.

Attached is a lease application for property that the State of Alaska, DePartment of Natural
Resources, Division of Forestry, currently leases from the City. The current lease will expire on
November 30, 2003. They are proposing a new, 1 O-year lease. The purpose is for support of
wildlife fire operations fi'om the Kenai Municipal Airport, specifically for fire retardant storage
and as a re-load base to air tankers.
KMC 21.10.080 states the term shall depend upon the durability of the proposed use, the amount
of investment in improvement proposed and made, and the nature of the improvement proposed
with respect to durability and time required to amortize the proposed investment. The FAA has
agreed that the City may use the criteria used by the State in 17 AAC 45 for their airport leases.
This application meets the criteria that allows for a 1 O-year lease for a $35,000 - $40,000
investment. Prior to leasing, an appraisal must be approved by the Federal Aviation
Administration.
Aiter review by the Airport Commission, the application will be forwarded to the Planning and
Zoning Commission to determine if the intended use complies with the zoning ordinance and
Comprehensive Plan of the City.
The Airport Commission needs to determine if the intended use complies with the Airport
Masterplan. The recommendations of both commissions will be forwarded to the Kenai City
Council for lease application approval.

Kenai Retardant Site Lease
The Division of Forestry (DOF) is requesting a lease of Lot 4, F.B.O. Subdivision No. 7. to support
Wildland Fire Operations from the Kenai Municipal Airport. The primary purpose of this site is to
support fire retardant storage and loading into Airtankers used for the suppression of Wildfires.
DOF is completing a 2-year lease of this site that ends on Nov. 30, 2003. During these two years the
following improvements were completed:
· Lot appraised and surveyed
Gravel pad constructed (70 ft x 150 ft) at a cost of $24,576.77
RetardanffWater Tanks re-located from airport apron area to gravel pad
Phone lines installed
· Electricity installed
The next phase of development includes developing access to the gravel pad with a road and gate
from North Willow Street. Our intern is to develop the water and sewer lines to the site in
conjunction with the road improvements. The estimated costs for these additional improvements
range between $35,000 and $40,000.

The Federal Aviation Administration (FAA) has completed an aeronautical study on your
September 3, 2003 proposal to construct an aircraft hanger at the Kenai Municipal Airport. The
FAA has no aeronautical objections to this proposal.
This determination does not mean FAA approval or disapproval of the physical development
involved in this proposal. Rather, this is a determination with respect to the safe and efficient use
of airspace by aircraft and with respect to the safety of persons and property on the ground. This
determination does not include any temporary construction equipment, such as cranes, derricks,
etc., which may be used during the actual construction phase of this proposal. Nor does it
include add-on devices (i.e. radio antennas). Such equipment which has a height greater than the
proposed structure and a height which would exceed the notice standard of Part 77 of the Federal
