ITEM 6: OLD BUSINESS , Discussion -- Airport Projects Update (Terminal Access Modifications, Taxiway "H" Access to Lease Lots, Fence Improvements, and Terminal Interior Modifications for Passenger Screening) Terminal Access Modification, Taxiwa¥ H' Bielefeld stated he believed access should be full width to Lots 6, 7, 8 and 9. Fence Improvements.;. General discussion. Parking Proiect; Suggestion this item be tabled until the next Commission meeting. Terminal Interior Modifications' Commission discussed the planned modifications and suggested the designers investigate needs for passenger seating, etc. MOTION: Commissioner Ha. raison MOVED to recommend the terminal access modification proceed as presented and Commissioner Bielefeld SECONDED the motion. There were no objections. SO ORDERED. MOTION: Commissioner Haralson MOVED to recommend the design of Taxiway "H" continue with the design of the full width access to Lots 6, 7, 8, and 9 to the extent possible, accommodating drainage. Commissioner Wattdns arrived at 7'50 p.m. Discussion -- Kenai Peninsula Borough prOposed Aircraft Flat Tax/Update It was reported Assembly Member Chay scheduled a meeting on Friday, February 13 at 6:440 p.m. in the borough Assembly Chambers to discuss the aircraft flat tax ordinance. Commissioners Bielefeld and Ha. raison would be attending and Commissioner Knacksted and Versaw will attend ff possible. Haralson updated the Commission on Assembly meeting discussion of the ordinance to date. ITEM 7: NEW BUSINESS Recommendation -- Lease Application of John C. & Marie L. Parker & 20/20 International, Inc. / Lot 11, Block 1, FBO Subdivision. Applicant john Parker discussed his plans and desire to lease the property. their discussion, Knackstedt noted the Master Plan design. . During MOTION: Commissioner Bielefeld MOVED to recommend approval of the lease and Commissioner Watson SECONDED the motion. There were no objections. SO ORDERED. AIRPORT COMMISSION MEETING FEBRUARY 12, 2004 PAGE 2 Recommendation -- Lease Application of Arctic Barnabas Ministries, Inc./Lots 8 & 9, Block 5, General Aviation Apron. Joel Caldwell, a representative of Arctic Barnabas Ministries, Inc. explained their concept of use of the properties, including a professional office building. MOTION: Commissioner Watson MOVED to recommend approval of the lease application to Arctic Barnabas Ministries, Inc. and Commissioner Versaw SECONDED the motion. There were no objections. SO ORDERED. Discussion-- Central Peninsula Air Fair Mary Bondurant, Airport Administrative Assistant updated the Commission with Air Fair plans to date. An initial committee meeting was scheduled. May 22, 2004 was suggested as the date for the Fair. MOTION: Commissioner Watson MOVED to recommend May 22, 2004 as the date for the Air Fair and Commissioner Versaw SECONDED the motion. There were no objections. SO ORDERED. 7-do Discussion -- Alaska State Aviation Trade Show A general discussion took place relating to the Trade Show and participation taken by the Kenai Airport. MOTION: Commissioner Versaw MOVED to recommend the Kenai Municipal Airport have a booth at the Trade Show and Commissioner Haralson SECONDED the motion. There were no objections. Discussion -- Lease of Old Fish & Wildlife Hangar A lengthy discussion took place in which several issues were discussed: · Could the airport keep the hangar and just lease the space? · If the Airport leases the space, what is the city's liability? That KPB 5.12.120 is hereby amended to read as follows: 5.12.120. Personal property tax-Levied-Amount-Statutory authority. All personal property within the corporate limits of the borough which is not exempt from taxation by law or ordinance, is subject and liable to an annual tax for school and borough purposes, of not more than 8 mills on the assessed valuation of such property, unless the people of the borough by referendum, authorize a tax levy at a higher rate and except as authorized by Section 5.12.250 and the owner thereof shall be liable for payment of the tax This shall not apply to roe sub'ect to a flat tax a The borough shall collect such tax as is levied on the property within a city by the city council pursuant to law and Charter. SECTION 2. That KPB 5.12.155 is hereby enacted to read as follows: 5.12.155. Personal property tax-Assessments-Aircraft-Appeal- A. The Kenai City Finance Director is scheduled to testify in favor of this ordinance. The discussion by Airport Commission will depend on the outcome of the Borough meeting. Aircraft that have been dismantled, destroyed or crashed and the FAA N number has been retained by the aircraft's owner of record may submit to the assessor on an approved form "Aircraft Statement of Condition" that would allow for ad valorem taxation of that aircraft if approved. Aircraft for which such registration or licensing has lapsed or that has not passed the annual inspection required by the FAA shall not qualify On this basis alone for ad valorem taxation unless it has been dismantled, destroyed or crashed. C. Commercial aircraft operated by a scheduled airline shall be exempt from the flat tax and shall be taxed on an ad valorem basis in accordance with the KPB landing schedule formula. The KPB landing schedule formula provides for the prorated calculation of scheduled aircraft by dividing the total hours per year into the total time aircraft operated by a scheduled carrier are in the KPB, and multiplying the result by the assessed value of each aircraft. D. Def'mitions. For purposes of this section: "Aircraft" means any engine powered contrivance invemed, used, or designed to navigate, or fly in, the air and that is capable of being manned and is required by the FAA to be registered and certified in order to be manned. "Aircraft engine" means an engine used, or intended to be used, to propel an aircraft, except the tail rotor of a helicopter. "Commercial aircraft" means any aircraft transporting passengers and/or cargo for some payment or other consideration, including money or services rendered. "Crashed" means aircraft for which only parts remain that, due to their condition, can no longer be assembled to create any contrivable aircraft. This shall be evidenced by a FAA accident report and/or copy of an insurance claim that determines the aircraft to be a total loss. "Destroyed" means aircraft that have been damaged by age, weather, neglect and/or external influences outside the owner's control, and only unusable parts remain that, due to their condition can no longer be assembled to create any contrivable aircraft. This shall be evidenced by photographs and a physical inspection by the KPB Assessing staff appraiser if deemed necessary by the borough assessor. "Dismantled" means aircraft that have been voluntarily disassembled and only parts remain that can no longer be assembled to create any eontrivable aircraft. Evidence such as photographs and a physical inspection by the KPB Assessing staff appraiser shall be provided or allowed if deemed necessary by the borough assessor. "Scheduled airline. A "scheduled airline" is any individual, partnership, corporation or association: (1) Engaged in air tmnspomtion under regular schedules to, over, away from, or within the U.S.; and (2) Holding a Foreign Air Carrier Permit or a Certificate of Public Convenience and Necessity, issued by the Department of Transportation pursuant to 14 CFR Parts 201 and 213. E. An aircraft owner may appeal the determination of the borough assessor under this section ming the procedures set out in KPB 5.12.050 - .060. htm://www.borough.kenai.ak'us/AssemblyClerk/Assembly/Ordinances/2003/O2003---4/1/2004 MEMORANDUM MEMORANDUM Page I of 1 TO: Pete Sprague, Assembly President Members, Kenai Peninsula Borough Assembly FROM: Chris Moss, Assembly Member DATE: March 4, 2004 SUBJECT: Ordinance 2003-45, mending KPB Chapter 5.12 to provide for a flat tax on aircraft After the third public hearing on this ordinance, Assembly Members Chris Moss and Dan Chay met with aircraft owners on February 13, 2004, to give them an oppommity to voice their concerns over the ordinance and to obtain aid in developing the ordinance. The development of categories for taxation of aircraft based upon weight appears to be a reasonable compromise to fairly address aircraft for personal use and commercial use, and to permit efficiency, accuracy, .and fairness in the assessmem of aircraft. Using the Manufacturers Gross Weight with Internal Load ("MGWlL") as a basis instead of the number of aircraft engines will permit ease of verification and promote equality in taxation. The following amendment to 5.12.155(A) in Section 2 is proposed: SECTION 2. That KPB 5.12.155 is hereby enacted to read as follows: A. The first $100,000 in assessed value of personal property subject to an ad valorem tax is exempt from taxation. Watercraft and motor vehicles are both subject to a fiat tax. This has no value-based exemption as the tax is not related to the value. Aircraft are similarly motor powered vehicles used for transportation,, and it seems equitable to impose a fiat tax upon aircraft rather than an ad valorem tax. Anchorage currently imposes a similar "registration tax" on aircraft situated in the Municipality of Anchorage. If enacted, this ordinance would impose a fiat tax on each aircra~ in the borough of $75 per aircraft engine on each aircraft. It applies to all aircraft that have been issued a Federal Aviation Administration N number. Aircraft owned by scheduled carriers are excluded from this ordinance as they are taxed on an ad valorem basis, but only for the percentage of time spent in the borough. Imposing a flat tax would potemially result in either double taxation or a complete loss of tax revenue as flat taxes are not, by their nature, generally apportioned between jurisdictions. The approval was based on concurrence from the City of Soldotna. Steve Bonebrake, City of Soldotna Public Works Manager has given his approval on behalf of the City. Does the Airport Commission wish to recommend the Central Peninsula Air Fair change to Kenai Peninsula Air Fair? www.ci.kenai.ak.us. 2004 Kenni Peninsula Air Fair Committee Meeting- March 25, 2004 ATTENDANCE: Henry Knackstedt, Mary Bondurant, Sharen Sleater, Chip Versaw, Audie Goode, Rich Mullowney, Rebecca Cronkhite, Janie Hempstea& Jan Bobek Date: Saturday, May 22 is the date for the 4~ annual KP~. Additional events being worked on are: Military Appreciation Evem- Jan Bobek will work on this and get in touch with both Mayor Williams & Mayor Carey Spot Landings/Flour Bombings Competition- Audie Goode is to get a copy of the EAA insurance policy to cover these events. Henry/Chip will investigate the feasibility of these events being done at the KMA around 4pm Location/Times: EAA will be doing the breakfast at the Soldotna Airport from 8am to 1 lam. The Soldotna breakfast is $5 for adults and $3 for senior citizens 65 & older and children 12 & under. The Kenai barbeque will be $6 for adults and $3 for senior citizens 65 & older and children 12 & under. Fun Flight participants' meals are included in the registration fee. Mary has new wristbands for the paying public and ID tags for participants, vendors, & volunteers to ensure better tracking of who has or does not pay for their food. Advertising: PAWPAW is designing Posters/postcards. Becky presented a draft poster and the Committee liked the layout. Posters will be sold and given to businesses that donate prizes. Mary handed out a draR of the T-shirt design SunDog is working on. The Committee suggested that the plane be changed to a Beaver, the word FAIR be decreased, the star showing the Peninsula area included and the sponsor logos will be at the bottom in white. The Committee agreed to let the Alaska Airmen logo be on the front left side of the t-shirt. We will also put the 99's and the CAP logo on the t-shirt. The logos need to be given to Mary asap. Mary will be attending the Alaska State Aviation Trade Show in May to do registration there also. It was suggested the name of the Air Fair be changed from Central to Kenai Peninsula. Air Fair. The Committee agreed unanimously and with the approval of the City of Soldotna, it will be changed. ***The City of Soidotna had no objections to changing the name. Static Displays: Mary received approval from the Pentagon for military support. She has contacted all branches for static or flyover displays and is waiting for responses. The USCG in Kodiak will send an H65 with a crew of 4. Mary will also check back with Mark Carr and the Peninsula Modelers Association to see what their intentions are. Fun Run Stops: Airports involved will be Soldoma, Kenai, Seward, Homer, Kasilof, McGahan, Ninilchik, and Quartz Creek, Seward. Floatplanes are aho invited to participate this year; 2002 stops were Beluga Lake, Browns Lake, Kenai Muni Seaplane, Longmere Lake, & Stormy Lake. We will need volunteers to make the tickets and take the buckets to the participating airstrips. Vendors: Vendors are not paying a table/booth fee so they will be paying for their meals (except mih'tary recruiters.) The Marines will have a representative at both airports. Anyone interested in participating is encouraged to attend. hal Municipal Airport Memo To: From' Airport Commission Rebecca Cronkhite - Airport Manager ~-~~.- Date: Apdi 1,2004 Subject: Airport Vehicle Parking The project to remodel the Terminal sidewalks and handicap access is progressing with construction slated for August 2004. The second phase of this project involves changes to the parking lot. The parking lot modifications are not eligible for FAA funding and therefore require funding from the Terminal Fund. The Airport Commission has reviewed preliminary drawings of a reconfigured parking lot and approved the concept. It would be counter productive to passenger service to attempt both projects in one year; however, I believe that limited changes in the short- term parking lot could occur this spring with minor construction and new paint. I believe the layout could be modified and the rules changed for a minimal cost. With a few simple changes and minimal cost, we could provide short-term parking (up to 4 hours) in the spaces closest to the Terminal and begin charging for all day parking. Them is an average of 20 - 50 cars parked in the short-term lot during the day and evening. If 20 of those vehicles paid a $2.00 fee, the airport would recover $14,600.00 per year. These funds could then be used to pay for additional modifications to the parking areas. Funds are available in the Terminal account to have a simple layout prepared for Council approval. Council ~CUTIVE SESSION- None Scheduled ITEM M: nal Municipal Airport Airport Manager's Monthly Report March 11, 2004 MARK YOUR CALENDARS FOR MAY 22' 4th Annual Central Peninsula Air Fair Plans are under way for the biggest and best Air Fair ever. We are renting a booth at the Alaska State Aviation Conference and Trade Show May 15th and 16th in Anchorage. Last year's show attracted over 16,000 pilots and aviation enthusiasts. Mary will be there registering pilots for the Air Fair and handing out tie-down information. The Alaska Airmen's Association has come on board as a sponsor joining the FAA, City of Soldotna and the Experimental Aircraft Association. The Kenai Fire Department will be manning the bar-b-que grill serving hot dogs and hamburgers while Mike Tart and Steve Horn once again serve up the best ribs in town. We need volunteers to help with set up, registration, traffic control, food service and prize donations. We are also looking for vendors to set up booths and advertise the many things available to pilots and visitors here on the peninsula. If you know anyone who would be interested in having a booth (there is no charge) or donating a prize for the poker mn please contact Mary Bondurant at 283-7951 x22. Airport Security: The TSA continues to screen 100% of baggage and we continue discussions with them on plans for expanding their operation. Training: I will be traveling to Anchorage International Airport on March 15 & 16 to attend an Intermediate Incident Command Class. Lt. Wannamaker, Sgt. Sandahl and Assistant Fire Chief Mike Tilly will also attend this training session that provides advanced training in emergency procedures with a focus on aircraft accidents and incidents. Thanks to the Anchorage Airport Operations staff for inviting us to participate, free of charge. Terminal: A new contract for janitorial services is up for Council approval in this packet. The proposed contract will save over $1200.00 a month. There is also a proposed lease for intemet service to the traveling public and a new calling card machine. Era Aviation: Era has been offering weekend specials on their web site that appear to be increasing our enplanement numbers. Check it out at www.FlyEra, com. Full Scale Drill: On February 25 we conducted the FAA required triennial full-scale emergency exercise. The Kenai Police and Fire Departments preformed in an exemplary manner as always. Special thanks to Era Aviation for providing an aircraft and Mike Tilly for orchestrating the event. All of the participants did a great job, however Lt. Kim Wannamaker deserves a special acknowledgement for his innovation and acting ability above and beyond the call of duty.
