Swarner and Airport Manager R, Cronkhite ITEM 2: AGENDA APPROVAL MOTION: Commissioner Bielefeld MOVED to approve the agenda as presented and Commissioner Versaw SECONDED the motion. There were no objections. SO ORDERED. ITEM 3: APPROVAL OF MEETING SUMMARY 3-a. July 14, 2005 3-b. August 11, 2005 MOTION: Commissioner Versaw MOVED to approve the meeting summaries of July 14 and August 1 l, 2005 as presented. Commissioner Bielefeld SECONDED the motion. There were no obj ections. SO ORDERED. ITEM 4: PERSONS SCHEDULED TO BE HEARD -- None. ITEM 5: OLD BUSINESS -- None. ITEM 6: NEW BUSINESS 6-a. Discussion -- Supplemental Planning Assessment b-a-1. Airport V~sion and Mission Statement Vision Statement: A general discussion took place during which it was suggested the word "scheduled" in the first line be deleted and "general aviation facilities and services" be inserted in the second line after "destinations." MOTION: ~ ~ _ Commissioner Zirul MOVED to recommend adoption of the Vision Statement urith the changes noted (deleting "scheduled" in the first line and inserting "general aviation facilities and services"). Commissioner Bielefeld SECONDED the motion. There were no objections. SO ORDERED. Mission Statement: A general discussion took place during the review of the draft Mission Statement which was included in the packet. MOTION: Commissioner Bielefeld MOVED to recommend adoption of the Mission Statement as presented and Commissioner Zirul SECONDED the motion. There were no objections. SO ORDERED. 6-a-2. Airport Lease Program Suggested Changes General discussion took place related to the Airport Leasing Program (included in the packet) and the recommended delegation/reorganization of authority and responsibility for the airport. Comments included: • Advantages of an airport operating board and how it might help the airport grow. ~ Advantage of having people from the business community involved. ' Consensus of the Commission was to recommend approval of the leasing program, _ including the land lease rates, term guidelines, and investment amounts, however they felt the investment amount seemed to be very low. b-a-3. Airport Land Use A general discussion took place during the review of the land use plan which was included in the packet. Comments included: • Keep the line in place. • Change the light blue area to non-aviation related. ` • Term retained for future aviation support or medium-term development support. • The Airport Commission needs to support the land use plan and help Council understand how important the land is. • Short-term, medium-term, and long-term development and let go of aviation-related development terminology. 6-b. Recommendation -- Use Agreement/Mobile Massage Chair AIRPORT COMMISSION MEETING SEPTEMBER 8, 2005 PAGE 2 The Commission reviewed and discussed the request information which was included in the packet. Discussion noted: • If a 1-c becomes required, then the applicant should be 1-c. • Discussion on set fee rather than percent of gross. The Commission recommended to move forward with the request or set up a Request for Proposal. Return the issue to the Commission with a designated space or set rent. 6-c. Recommendation -- Amendments to Airport Regulations, Chapter 6.05, Entitled "Parking." The Commissioner reviewed the proposed amendments. MOTION: Commissioner Bielefeld MOVED to recommend approval of the amendments as presented and Commissioner Zirul SECONDED the motion. There were no objections. SO ORDERED. 6-d. D~=cussion -- Meeting Schedule The Commission reviewed the information included in the packet and suggested the ability to attend by teleconference. ~ MOTION: Commissioner Zirul MOVED to not have a meeting in December and July, but continue the remainder of the year on the regular schedule. Commissioner Versaw SECONDED the motion. There were no objections. SO ORDERED. ITEM 7: REPORT ?-a. Commission Chair -- Chair Knackstedt noted the following: • An advertisement in the Civil Air Patrol magazine, i.e. Alaska Wing Tips. • He spoke to Air Supply Alaska owners and welcomed them to the airport. The owners told him the lack of the airplane tax enabled them to operate on the airport, however they almost walked awaked away from the lease because of bureaucracy. Commissioner Zirul stated he felt this was a prime example of why the leasing process was needing to be streamlined. ?-b. Airport Manager -- Airport Manager Cronkhite noted the follouring: • Referred to Item 7b of the FAA concerns related to runway incursions (information was included in the packet). ?-c. Ms. Kim Howard, Assistant to the City Manager, has provided the attached lease application for Commission recommendation. In her memo, Ms. Howard states that the Airport Commission needs to determine: 1. If the intended use complies with the Airport Master Plan. The December 1997 Master Plan designates this area for Future Lease Lots - Attachment A. The unapproved 2005 Master Plan update designates this area for Terminal Expansion - Attachment B. During the current Master Plan update land use, recommendations went through numerous public meetings and there was no objection to designating this area for future terminal expansion. 2. If the lease application complies with the airport land use plan and airport layout plan. The 1997 Master Plan does not fully address land use, The 2005 Master Plan update did include an extensive study of land use and the proposed land use is depicted in Attachment 6. The current Airport Layout Plan ~ALP~ has not yet been updated to reflect the unapproved 2005 Master Plan update. 3. If it does not, can an interim use be allowed? Interim uses of property adjacent to the passenger terminal should be approached very conservatively due to the unpredictable nature of air travel. www.ci.kenai.ak,us. 4. is there a determination when the land wouid be needed for uses that conform with the land use pian as outlined in Paragraph 4 on Page 1? Attachment C is the proposed airport development schedule from the 2005 Master Plan update. The first project listed in Phase III is Terminal Rehabiiitation. According to the latest planning effort, this project wiil occur in 2016. Recent similar projects in Anchorage and Fairbanks have revealed inadequate seismic engineering that resulted in demolition of older terminai structures. If that should occur in Kenai, it is reasonable to assume a new terminal wing might be constructed to the south and become the main terminai while the existing structure is reconstructed. This scenario limits the available interim use to 10 years. The airport has also had discussions with the rental car agencies concerning the possibility of constructing a joint use rental car cleaning and fueling station in this area. Three of the four agencies are very mush in favor of this development. The intention is to negotiate terms of the facility overthe next few years. The proposed development would require taxiway access. A taxiwa to this . Y property was discussed under a previous project; however, that taxiway project was dropped due to the recommendations of the consultants and the current Master Plan update. It is unlikely that the FAA would fund a taxiwa to access a . . . . . y property in direct conflict with the airport land use plan. There are several properties available for lease north of the terminal. In recent discussions with FedEx, their property manager indicated a desire to locate on the main cargo ramp north of the terminal to allow for future rowth and lar er . 9 g aircraft. I would suggest that this applicant be encouraged to look in that direction. The Commission may wish to provide Council with an alternative other than outright denial of this lease application. I would again suggest that the a licant pp be encouraged to pursue development on one of the avaiiable ro erties north of , , , P p the terminal. If this is unacceptable, I sug est Commission consider the . . 9 information on Attachments D and E. If the development were located on the south side of the Iot and the lot width reduced by 150 feet, it would leave that additional 150 feet for the Terminal Redevelopment Project. I .. y suggest that Commission recommend the developer look to the lots north of the terminal. If that is unacceptable, Commission may wish to offer the option shown on Attachment D. It should be noted that the rental car concessions bring in over $80,000 a year in revenue to the air ort and the p Y have a demonstrated need for a facility to clean and fuel vehicles. Condor Properties, LLC is proposing to construct a hangar building. Mr. Tulin's letter of October 2g`n states the minimum estimated value of improvements is $1 million and asks for a SS-year lease term. According to the proposed Term Guidelines for Leases of Land ~~vithin the Airport Reserve, a 35-year lease term is the maximum allowed. KMC 21.25.010 (b) states the Airport Commission shall observe, oversee and guide in an advisory capacity, any matters relating to use of airport aeronautical lands. The Airport Commission needs to determine: l. If the intended use complies with the Airport Master Plan. 2. If the Iease application complies with the airport land use plan and airport layout plan. ~ 3. If it does not, can an interim use be allowed? 4. Is there a determination when the land would be needed for uses that conform with the land use plan as outlined in Paragraph 4 on Page 1? After review by the Airport Commission, the recommendation and application will be forwarded to the Planning and Zoning Commission. As outlined in KMC 21.10.030 (b)(5~ and KMC 21.10.060 (a) the Plaoning and Zoning Commission needs to determine: l. If the intended use complies with the zoning ordinance and comprehensive plan of the City. 2. If the application is complete. 3. The use proposed in the application is the highest and best use and conforms to the Airport Master Plan and other goals set by the Commission or the City Council. The recommendat~ons of both commissions will be forwarded to the Kenai City Council for lease application approval. The applicant is aware that although a taxiway proj ect has been discussed in the past, there is no aircraft access to the property and at this time the City has no intention of building a taxiway. In her memo, Ms. Howard states that the Airport Commission needs to determine: 1. If the intended use complies with the Airport Master Plan. The December 1997 Master Plan did not address planned land use in this area. Attachment A. The unapproved 2005 Master Plan update designates this area for aviation related development. Attachment B. Z. If the lease application complies with the airport land use lan and . p airport layout plan. The 1997 Master Plan does not fully address land use. The 2005 Master Plan update did include an extensive study of land use and the proposed land use is depicted in Attachment B. The current Airport Layout Plan (ALP) has not yet been updated to reflect the ur~approved 2005 Master Plan update. 3. If it does not, can an interim use be allowed? Interim uses of ro e p P ~Y adjacent to the passenger terrninal should be approached ve . , , . ~' conservatively due to the unpredictable nature of the air travel industry. www.ci.kenai.ak.us. 4. Is there a determination when the laad would be needed for uses that conform with the land use plan as outlined in Paragraph 3 on Page 1? The Terminal Redevelopment Project is scheduled for 2016. The subject property is not included in this project, however terminal growth could necessitate additional aviation need in this area. Commission should also consider the fact that there are several large commercial developments in the works and the need for aviation related property could increase exponentially in the next 10 years. As noted in Ms. Howaxd's memo, the proposed lease is in the Airport Reserve and is on properry designated for aviation related use. A mini storage facility is not aviation related and the City should require Mr. Johnson waive any right to purchase the property as suggested by the City Attorney. Further, language should be added to the lease requiring a full Airport Commission and Planning Commission review of the lease prior to any extension of the term. Does the Commission find that the proposed use complies with the Airport Master Plan? The' proposed lease does not comply with the 2005 Master Plan Update which designates this property for aviation related uses. Does the Commission find that the proposed lease complies with the airport land use plaa and airport layout plan? The proposed lease clearly does not qualify as airport related use. ` Does the Commission recommend that an interim use be allowed? There is no current aviation related need for this property, therefore I would recommend an interim lease be recommended if the lessee waives the right to purchase the property. Does the Commission recommend an interim use time period? My recommendation is to take a conservative approach and grant a 5-year interim lease and require a land use review at the end of that time. Johnson's application states the minimum estimated value of improvements is $95,000 and he has asked for a maximum lease term. According to the proposed Term Guidelines for Leases of Land within the Airport Reserve, a 12-1/2 year lease would be allowed. The ose of the lease is to ex and p~ p the storage facility that Mr. Johnson has constructed on adjacent Lot 2, Block 5(which he purchased from the City). KMC 21.25.010 (b) states the Airport Commission shall observe, oversee and guide in an advisory capacity, any matters relating to use of airport aeronautical lands. The Airport Commission needs to determine: 1. If the intended use complies with the Airport Master Plan. 2. If the lease application complies with the airport land use plan and airport layout plan. 3. If it does not, can an iuterim use be allowed? 4. Is there a determination when the land would be needed for uses that conform with the land use plan as outlined in Paragrapb 3 on Page 1? After review by the Airport Commission, the recommendation and application will be forwarded to the Planning and Zoning Commission. As outlined in KMC Z1.10.030 (b)(5} and KMC 21.10.060 (a) the Planning and Zoning Comtnission needs to determine: 1. If the intended use complies with the zoning ordinance and comprehensive plan of the City. 2. If the application is complete. 3e Tbe use proposed in the application is the highest and best use and conforms to the Airport Master Plan and other goals set by the Commission or the City Council. The recommendations of both commissions will be forwarded to the Kenai City Council for lease application approval. Because the land is in the proposed Airport Reserve, the City Attorney has suggested that if the lease application is processed before the new land code is adopted, the City should have Mr. Johnson expressly waive the right to purchase the property in his lease.
