CHAIR HENRY KNACKSTEDT, PRESIDING YTEM 1: CALL TO ORDER AND ROLL CALL Chair I{nackstedt called the meeting to order at approximately 7:03 p.m. The roll was confirmed as follows: Commissioners present: J. Zirul, J. Bielefeld, H. Knackstedt, C. Versaw, L. Porter Commissioners absent: E. Mayer and D. Haralson Others present: Airport Manager R. Cronkhite, Council Member R. Molloy, City Attorney C. Graves, and Department Assistant M. Bondurant A quorum was present. ITEM 2: AGENDA APPROVAL MOTION: Commissioner Bielefeld MOVED to approve the agenda as presented and Coriurii.ssioner Zirul SECONDED the motion. There were no objections. SO ORDERED. ITEM 3: APPROVAL OF MEETING SUMMARY -- March 8, 2007 MOTION: Commissioner Bielefeld MOVED to approve the March 8, 2007 meeting summary and Commissioner Versaw SECONDED the motion. There were no objections. SO ORDERED. YTEM 4: PERSONS SCHEDULED TO BE HEARD 4-a. Casey Madden, Wince Corthell Bryson -- Runway Project Update Madden updated those present on the runway project, noting Phase I was mostly completed during the fall and the FAA grant was accepted for Phase II. He distributed a May 3, 2007 newsletter on the project. It was also noted the float plane basin would possibly not be opened until June 2 due to deep frost. The Commissioners were also given a CD of the final Phase II Report, Supplemental Planning Assessment. ITEM 5: OLD BUSINESS 5-a. Discussion/Recommendation -- Airport Lease Renewals City Attorney Cary Graves reviewed the information included in the packet related to the automatic right of renewal. Discussion followed in which it was suggested 35 years would be a long time and guaranteeing a renewal too strong as it would not leave an option available for the city. It was suggested language be added the issue apply to aviation use leases. MOTION: Cormmissioner Zirul MOVED to recommend to Council Ordinance No. 2227-2007 be amended to apply only to aviation uses and the contract require the use continue to be aviation. Discussion/Recommendation -- Airport Property Lease Term City Attorney Graves reported the KEDS Team was concerned the 35-year term or the extension would be long enough. MOTION: Commissioner Bielefeld MOVED to recommend council not adopt Ordinance No. 2230- 2007 and the lease term not exceed 35 years. Commissioner Versaw SECONDED the motion. There were no objections. SO ORDERED. 5-c. Discussion -- Air Fair 2007/Update Administrative Assistant Mary Bondurant gave an update on the plannuig for Air Fair 2007, noting the posters were received; breakfast would be at the Soldotna Airport from 8-11:00 a.m.; the Air Force Band would be attending as entertainment; Commissioner Porter eras in charge of the barbecue; and, the next Air Fair Committee meeting would be held at 5:15 p.m. on Wednesday, May 16, 2007 at the Challenger Center. ITEM 6: NEW BUSINESS 6-a. Discussion/Recommendation -- Supplemental Master Plan/Airport Lease Lot Development AIRPORT COMMISSION MEETING MAY 10, 2007 PAGE 2 General discussion took place and it was suggested the item be included on the next agenda for further discussion. 6-b. Discussion/Recommendation -- Additional Funds General Aviation Parking Lot MOTION: Commssioner Zirul MOVED to recommend approval of Ordinance No. 2231-2007 and Commissioner Versaw SECONDED the motion. There were no objections. SO ORDERED. 6-c. Discussion/Recommendation -- urea Storage Building MOTION: Commissioner Zirul MOVED to recommend approval of Ordinance No. 2232-2007 and Conunissioner Versaw SECONDED the motion. There were no objections. SO ORDERED. 6-d. Discussion/Recommendation -- Construction of Cazgo Pad MOTION: Commissioner Bielefeld MOVED to recommend approval of Ordinance No. 2233-2007 and Cornrnissioner Zirul SECONDED the motion. There were no objections. SO ORDERED. 6-e. DiscussionJRecommendation -- Parking Fee Review During discussion of the issue and because of the distance of the parking area, the fee should be $1.00. Commissioner Bielefeld requested to abstain from voting due to a conflict of interest, i.e. his customers use the parking lot. Chair Knackstedt granted the request to abstain and the Comnussion stated no objections. MOTION: Commissioner Porter MOVED to recommend the parking fee for the General Aviation Vehicle Parking Lot be set at $1.00. Commissioner Zirul SECONDED the motion. There were no objections. SO ORDERED. 6-f. Discussion/Recommendation -- Increasing Airport Comnussion Responsibilities Regarding Leasing Airport Reserve Land and Airport Budget AIRPORT COMMISSION MEETING MAY 10, 2007 PAGE 3 Attorney Graves reported the item was included on the agenda as a result of the joint work session between the Commission and Council. Ideas resulting from the work session were reviewed and a general discussion took place. It was noted, a second meeting of the Commission would take place only if a lease would be pending. Consensus of Commission was to agree with adnunistration's proposal as presented by City Attorney Graves. ITEM 7: REPORT 7-a. Commission Chair -- Chair Knackstedt expressed his appreciation to Airport Manager Cronkhite for her years of service to the city. 7-b. Airport Manager -- Airport Manager Cronkhite thanked the Commission for its support of her years of service. 7-c. City Council Liaison -- Council Member Molloy thanked Cronkhite for her service and reviewed the council meeting action agendas. ITEM 8: COMMISSIONER COMMENTS AND QUESTIONS Commissioner Bielefeld -- Questioned rotomill paving. Cronkhite explained the process and reported the parking lot would be open June 1. This alternative provides the means to move forward with both an expanded apron area, and new lease lots, with a minimum of reconstruction of existing improvements. It also provides a reasonable mechanism to add future lease lots as demand requires. Administration's second choice is configuration number three. Airport i;ornmission AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, AMENDING KMC 21.20.070 TO GIVE THE AIRPORT COMMISSION MORE AUTHORITY OVER LEASING DECISIONS WITHIN THE AIRPORT RESERVE. WHEREAS, 21.20.070 sets forth the duties and responsibilities of the Airport Commission.; and, WHEREAS, under KMC 21.10.070 the Airport Commission acts either only in an advisory role or is not involved in the decision at all; and, WHEREAS, The Airport Commission should be given additional authority to make decisions regarding leases wifnin the Airport Reserve subject to an appeal to the Council. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, that KMC 21.20.070 is amended as shown on Attachment "A." (a} Initial application review by: Q) Assistant to the Ciry Manager (for application completeness; conformance with Title 21); (2) Airport Manager (for conformance with the Airport Land Use Plan, Airport Layout Plan, Airport Master Plaaz, FAA regulations, AIP grant assurances, and airport operations); (3) City Planner (for conformance with the Airport Land Use Plan, Comprehensive Plan, municipal zoning, and future airport improvement projects); and (4) City Manager (for adequacy of the applicant's business plan and construction financing plans). (b) The above staff shall present to the City Manager their joint recommendation for action on the application, such as rejection, approval, or approval of a staff alternative. [(C) 7F THB CITY MANAGER CONCURS WITH THE STAFF RECOMMENDATION, THE MANAGER WILL: (7) ISSUE A REJECTION LETTER, STATING THE REASONS FOR REJECTION; OR (2) REFER TIME APPLICATION TO THE AIRPORT COMMISSION AND THB PLANNING AND ZONING COMMISSION FOR REVIEW AND COMMENT, TOGETHER WITH THE MANAGER'S RECOMMENDATION FOR APPROVAL OR APPROVAL OF THE STAFF ALTERNATIVE; AND (3) INFORM THE CITY COUNCIL OF THB MANAGER'S RECOMMENDATION. (D) IF THE CITY MANAGER REFERS THE APPLICATION TO THE COMMISSIONS, THB CITY MANAGER WILL CONSIDER THE RECOMMENDATIONS OP THB COMMISSIONS, A~~ID: (1) ISSUE A REJECTION LETTER, STATING THE REASONS POR REJECTION; OR (2) APPROVE THB APPLICATION OR STAFF ALTERNATIVE, AND DIRECT THE STAFF TO ISSUE THE LEASE; AND (3) INFORM THE CITY COUNCIL OF THE MANAGER'S DECISION TO APPROVE OR RE.lEC1' THE APPLICATION; OR (4) OBTAIN "['HE CITY COUNCIL'S CONCURRENCE IP THB MANAGER'S DECISION TO APPROVE OR REJECT THE APPLICATION IS CONTRARY TO THE RECOMMENDATIONS OF THE COMMISSIONS. If another complete and otherwise approvable application for lease of the same orooen application, the City Manager will forward the applications, the Manager's recommendation and the Planning and Zoning Commission's recommendation to the Aimort Commission for a decision. The Airport Commission mav, based upon the best interests of the City: anorove one of the applications or ii reiect both applications; or iii direct the City Manager to award a lease of the property by sealed bid. l~ IF ANOTHER COMPLETE AND OTHERWISE APPROVABLE APPLICATION FOR LEASE OF THE SAME PROPERTY IS SUBMITTED BY A DIFFERENT APPLICANT BEFORE THE CITY MANAGER ENTERS INTO A LEASE WITH THE FIRST APPLICANT, THE CITY MANAGER WILL FORWARD THE APPLICATIONS, THE MANAGER'S RECOMMENDATION AND THE COMMISSIONS' RECOMMENDATIONS TO THE CITY COUNCIL FOR APPROVAI, OF THE APPLICATION ANTICIPATED TO BEST SERVE THE INTERESTS OF THE CITY. This property is located in the Airport Reserve. Airport Land Use Plan - A limited ALP was completed in December 2006. NARRATIVE: Arctic Barnabas Ministries Inc. proposes to build an aircraft hangar with offices and public-use coffee shop facility on Lot 9A Blk-5, located on the S W comer of Crranite Point Street and North Willow Street (located at Kenai Municipal Airport, Latitude N60° 33' 45" Longitude 151° 14' 40"). The proposed construction period is Tune 2007 through December 2009. Estimated cost of the proposed project is $1.5 million. The construction is to be a metal building which includes an 80' X 100' hangar with an attached 44' X 80' office/coffee shop space. Street access will be from North Willow Street and from Granite Point Street. A. Explain how the proposed use and development of the property will conform to the Zoning Ordinance of the City. Subject property is zoned Light Industrial. Airports and. Related. Uses, Professional Offices, and Restaurants are Principal Permitted Uses for an area zoned II,. Additionally, the IL zoning is intended for development of industrial and commercial uses which are compatible with surrounding property, and that will not introduce any nuisance effects to the area. Principal uses of the facility will involve working on and parking of aircraft used in the business, housing professional offices of the organization and a small coffee shop. These features appear to be compatible with other businesses and facilities in the area. (Reference: City of Kenai Zoning June 2006 map; KMC 14.20.130 Light Industrial Zone; 14.22.010 Land Use Table) KMC 14.20.130 Light Industrial Zone states that restrictions against noise shall not apply to uses located within two thousand (2,000) feet of the airfield landing strip. The facility is located within that measurement boundary, so operation noises will be within parameters of the municipal code. KMC 14.20.130 states that no open storage shall be located closerthan twenty-five feet (25') to the adjoining right-of-way of any collector street or main thoroughfare, and if visible from a collector street or main thoroughfare, it shall be enolosed with an eight-foot (8') high fence of good appearance acceptable to the Commission. A dumpster will be located. on the SW corner of the building, away from any collector street or main thoroughfare, as shown on site plan. The residential buffer described in KMC 14.20.130 is not required for this facility, as the subject property does not abut a residential zone. The requirements of KMC 14.25.040 Landscaping plan -Performance criteria, will be rnet by the intended landscaping as shown on the site plan. All trees and four feet of overburden will be removed from the site. Trees or shrubs and grass will be replanted as a buffer between the proposed ABM project site and the business located to the south. Areas of the site that are not along a street right-of- way will have gravel, grass, or cement. There will be pavement on the outside of the fence in the parking area, with grass and shrubs in planting areas. Parking for the facility complies with KMC 14.20.250 Of£ street parking and loading requirements. According to square footage/seat requirements, 8 spaces are required for the hangar portion, 4 spaces for the hangar office area, 6 spaces for the coffee shop, I space for the barista, and 16 spaces for the professional offices, for a total of 35 required. spaces. If the individual parts of the facility are considered under the Joint Parking Areas code, then 75% of that number is required for a total of 27 spaces. 35 parking spaces are shown on the site plan. The designated parking and loading areas will only be for their designated uses. No special lighting is planned for parking areas; there will be the existing street lights, and architectural Lights on the building. There will be driveway curb cuts off Granite Point Street and driveway curb cuts off North Willow Street; the curb cuts are situated to avoid creating traffic hazards.
