The revised agenda was approved without objection. ITEM 3. APPROVAL OF MINUTES -- May 13, 2003 The following corrections were requested: · 5-a: "hamburgers and beverages provided by the Kenai Firefighters Association". · 7-a: "Susan Hatch attended the meeting..." ITEM 4: PERSONS SCHEDULED TO BE HEARD -- None ITEM 5: OLD BUSINESS ,,, Dimmick requested the Commission discuss the Planting Day activities and changes in the eating schedule for next year. Dimmick stated she felt the lunchtime 'shifts' began too early, thus taking away planting time. MOTION: Member Brown MOVED to request a change in the lunchtime schedule during the planting day's in upcoming years to be anytime after 1 p.m. Additionally, Beautification planting day's should be a two day event. Member Roger SECONDED the motion. There were no objections. SO ORDERED. ITEM 6: NEW BUSINESS Discussion -- Flowerbed Assessment/Updates The Committee commented on the following: · Additional flowers are needed in approximately eight circle planters as the vegetation appears too sparse. · Friday (June 13, 2003) Several members of the Committee will be weeding and planting at Left Hansen Memorial. at 6:00 p.m. The summer weeding schedule is Tuesday's at 4:00 p.m. and Thursday's Discussion -- Cemetery Regulations Frates informed the Comnfittee that due to recent vandalism of the cemetery, the Kenai Police Department would be patrolling the area on a more frequent basis. The KPD might also take responsibility of opening and closing the vehicular traffic gates each day. Additionally, signage stating the cemetery is under electronic surveillance would be posted in the near future. Frates stated extra pruning and tree removal would improve overall visibility and could reduce the likelihood of vandalism. Regarding Appendix 2-c of the KMC, Frates stated he thinks an official 'cemetery clean- up day' to ensure plot maintenance and the timely removal of old trinkets and other items. 6-c. Discussion -- Old Banners Member Brown reminded Frates and the Commission of a prior arrangement regarding banners which stated when out of use the banners where to be given back to the Art Council to be auctioned off for fundraising. Brown was informed the old banners would not be used any longer and are being stored at the Kenai Recreation Center. Brown stated she would make arrangements to pick uP the banners at her earliest convience. ITEM 7: REPORTS Committee Cha/r-- Dimmick reported the following: · Dimmick stated she would like to see the Beautification Committee have a regularly scheduled meeting in the month of September. MOTION: Member Seymour MOVED to request to Council a regularly scheduled meeting for the Beautification Committee be added to for the month of September. Member Rogers SECONDED the motion. There were no objections. SO ORDERED. Frates stated he would make this request to Council. · Dimmick suggested having a "dandelion party" to pick and remove the unsightly and prolific dandelions which are blooming around the area. She stated, at the minimum, to provide more public education on how to rid the area of dandelions and other noxious weeds. 7-b. ITEM 8: Parks & Recreation Director-- No report given. Graves, City Attorney DATE: August 27, 2003 RE' Commission and Committee Powers The Council asked me to write a memorandum regarding the powers of the various city commissions and committees (hereinafter "commissions"). KMC 1.90 outlines the standard procedures for them. The general procedures apply unless there are speCific code sections regarding the commission or committee that specify otherwise. KMC 1.90.020(a) states that commissions and committees "shall act in an advisory capacity to department heads within the City Administration." (Emphasis added.) KMC 1.90.050 states, "All acts of boards, commissions and committees are subject to the paramount authority of the City Council." The impetus behind this memorandum was a move by a Commission Chair to independently go out for and craft a request for proposals tbr management of a city facility. In that case, it appeared the CommiSsion Chair intended for the commission to bypass the City Council and Manager and do its own process for the selection of management of the facility. Such a process clearly exceeded the scope of the intended powers of a commission. Of the various commissions, the one with primary independent authority is the Planning and Zoning Commission. That commission has independent authority under AS 29.40 and KMC 14.05.010 for the determination of various zoning issues such as granting of variances or conditional use permits. Those decisions, however, are still subject to appeal to the City Council acting as the Board of Adjustment and then the Superior Court. In other areas, that commission acts only in an advisory capacity to the city and borough. The other commissions act almost exclusively as advisory bodies. They, subject to council approval, adopt master plans for the physical development of facilities and some of them (e.g. Library, and Parks and Recreation) also make advisory recommendations as to hiring of a department head. The duties of the various commissions are in the code as follows' 1) Planning and Zoning~KMC 14.05.010; 2) Harbor~KMC 11.10.010; 3) Library~KMC 1.57.010; 4) Commission and Committee Members Aueust 27. 2003 Pace 2 of 2 Parks and Recreation~KMC 19.05.010; 5) Airport~KMC 21.25.010; 6) Beautification--KMC 1.90.020 and 7) Council on Aging~KMC 1.90.020 and Article VI of its Bylaws. Snow, City Manager 1.90.010 Chapter 1.90 STANDARD PROCEDURES FOR BOARDS, COMMISSIONS AND COMMITTEES Sections: 1.90.010 Creation. 1.90.020 Duties. 1.90.030 Qualifications. 1.90.040 Terms. 1.90.050 Proceedings. 1.90.060 Specific requirements of boards, commissions and committees. 1.90.010 Creation. All boards, commissions and committees created by the Council of'the Ci,ty of Kenai, shall consist of seven (7) members who shall be nominated by the Mayor and confirmed by the City Council from ap- plications submitted to the City Clerk. A chairman and vice-chairman shall be selected annually and shall be elected from and by the appointed members. The Mayor and one Council Member elected by the Council as ex-officio members and as consultants of any board, commission or committee, may attend all meetings, but shall have no voting power on the board, commission or committee. A member of Council or City administrative staff shall attend ali meetings of' boards, commissions and committees and supply staff support. 1.90.020 Duties. (a) Members of boards, commissions and commit- tees shall be required to establish policies relat- ing to their respective organization.. They shall act in an advisory, capacity, to department heads within the City Administration if there are such departments in the City organization that di- rectly relate to the board, commission or com- mittee. (b) If the board, commission or committee has in- come stated within the City of Kenai annual budget, said board, commission or committee shall work with the City, Manager to establish expenses projected for t~e year tbr approval the City Council. 1.90.030 Qualifications. (a) A member o£a board, commission orcommittee must be a resident of'the City of Kenai, unless the board, commission or committee is specifi- cally ~xempted by Council from this require- ment. The member cannot be an officer or em- ployee of' the City of Kenai. If' any member should move his residence from the corporate limits of the City of Kenai (if applicable), is an officer or employee of the City of Kenai, or shall be elected or appointed as an officer or em- ployee of' the City of Kenai, the service of such member shall terminate immediately. He should be aware that he will serve without salary, but will be reimbursed for all reasonable expenses incurred in connection with this service, only af- ter approval by Council. (b) The Beautification Committee, and Harbor, Li- brary, and Parks and Recreation Commissions may at the discretion of the Council have up to two non-resident members each. (Ord. 1948- 2002) 1.90.040 Terms. (a) A member of a board, commission or committee shall serve for a term of three (3) years, unless the board, commission or committee is specifi- cally exempted by Council from this require- ment. At renewal date, the Mayor, with consent of the Council, can reappoint the member or recommend a replacement. (b) The terms of' the initial board, commission or committee member shall be staggered so that three (3) members will be appointed for one year; two members will be appointed for two years; and two members will be appointed for three years. Terms shall commence on January, i of each year. 1.90.050 Proceedings. (a) All boards, commissions and committees will have regularly scheduled meetings which shall (Kenai 9-7-02~ 3 2 1.90.050 be open to tl~e put~lic. Permanent records or minutes shall be kept o£all proceedings and such minutes shall record the vote of each member upon every, question. Every. decision or finding shall immediately be filed in the office of the City Clerk and shall be a public record open to inspection by any per- son. All acts of boards, commissions and co,n- mittees are subject to the paramount authority of the City Council. (b) lfthc commission, committee or board member shall be absent from more than one-half of ali the meetings of his/her committee, commission or board, regular and special, held within any period ofthree (3) consecutive calendar months. he/she shall thereupon cease to hold the seat. (Ord. 1610-94) (c) In all matters of parliamentary, procedure. Robert's Rules of Order as revised shall be ap- plicable and govern ali meetings, unless as specified in KMC 1.15.060 motions: KMC 1.15.100, speaking; and KMC 1.15.110, voting. (d) The responsibility, of insuring that ali members of boards, commissions and committees receive a copy of the Standard Procedures of Boards. Commissions and Committees lies with the City Clerk. 1.90.060 Specific requirements of boards, commissions and committees. Requirements of boards, commissions and com- mittees as set forth in KMC 1.90 are general re- quirements and shall be followed to the extent that they do not conflict with specific requirements found in code sections specifically pertaining to individual boards, commissions and committees. (Ords. 1223, 1239) (Kenai 9-7-021 Chapter 14.05 PLANNING AND ZONING COMMISSION Sections: 14.05.010 14.05.020 Duties and powers. Fees. 14.05.010 Duties and powers. (a) The Commission shall be required to perform the following duties: (1) Review and act upon requests for vari- ance permits, conditional use permits, planned unit residential development permits, and other malters requiring con- sideration under the Kenai Zoning Code. (2) Interpret the provisions of the Kenai Zoning code and make determinations when requested by the Adminisuative Official. (3) Review the City of Kenai Comprehensive Plan on an annual basis and conduct a minimum of one public hearing. Said recommendations shall be forwarded to the Council for consideration. (4) Promote public interest and understan~g of comprehensive planning, platting, zoning, land management, and other issues relating to community planning and development. (5) Proposed plans for the rehabilitation or redevelopment of any area or district within the City. (6) Perform historic preservation reviews and duties as set froth in KMC 14.20.10:5. (b) The Commission shall act in an advisory ca- pacity to the Kenai City Council regarding the following matters: (I) Kenai Zoning Code and Official City of Kenai Zoning Map amendments. (2) City and airport land lease or sale peri- tions. (3) Capital Improvements Programming. The Commission shall submit annually to the Council a list of recommended capital 14.05.010 impwvemems which, in the opinion of the Commission, axe necessary and desir- able to be constructed during the forth- coming three-year period. Such list shall be arranged in order of preference, with recommendations as to which projects shall be construct~ in which year. (c) The Commission shall act in an advisory ca- pacity to the Kenai Peninsula Borough Plan- ning Commission regarding the following mat- tel's: (1) Subdivision Plat proposals. (2) Right-of-way and easement vacation petitions. (3) City of Kenai Comprehensive Plan (KMC 14-3; Ords. I$$, 403, 1018, 1161, 1179, 1892-2000) 14.05.020 Fees. In order to defray the expenses connected with the consideration of applications for variances and conditional use permits, the person presenting the at~lication shall pay to the City Clerk a fee in the amount of one hundred dollars ($100.00). A fee in the amount of one hundred dollars ($100.00) shall accompany an application for amendment to the Kenai Zoning Code or Official Map. Whether an application is granted or denied by the Commission, the petitioner or applicant shall not be entitled to the retum of the fee paid. (a) The Commission shall be required to do the following: (1) Develop, adopt, alter, or revise, subject to approval by the City Council, a master plan for the physical development of harbor or port facilities for the City. Such master plan with accompanying maps, plats, charts, descriptive, and explanatory matter, shall show the Commission's recommendations for the development of the City Harbor facilities may include, among other things: (i) development of the type, location, and sequence of all public harbor facilities; (ii) the relocation, removal, extension, or change of use of existing harbor facilities; (2) Submit annually to the City Manager and Council, not less than ninety (90) days prior to the beginning of the budget year, a list of the recommended capital im- provements which, in the opinion of the Comm/ssion, are necessary or desirable to be constructed during the forthcom/ng three (3) year per/od. Such list shall be arranged in order of preference, with rec- ommendations as to which projects shall be constructed in which year. (3) Make investigations regarding any matter related to City harbor facilities, tide or submerged lands. Make recommendations to the Council relative to the care, con- trol, and development of tide and sub. merged lands. (4) Act in the capacity as directed and auti- rized by a tidelands ordinance adopteci the City. (5) Review all City leases of City-owned fide, submerged, and lands or navigable waters within the City, and as to the planned improvements proposed and make recommendations to the City Court- cfi. (6) Make and prepare reports and plans for approval by the City Council. (7) Coordinate public efforts, individual and group, to the effectuation of approved plans. (8) Shall act in advisory capacity in the se- lection of a Harbor Director should such a position be created by the City Council. (Ords. 474, 1161, 1802-98) 165 (Kenai 5-21-99) Chapter 1~7 LIBRARY COMMISSION Sections: 1.57.010 1.57.020 Duties and powers. Library regulations. 1.57.010 Duties and powers. The Commission shall be required to do the following: (a) Develop, adopt, alter, or revise subject to ap- proval by the City Council, a master plan for the physical development of library facilities for the City; (b) Submit annually to the City Manager and Council a list of recommended capital and other improvements in regards to the library; (c) Make recommendations regarding any matter related to library service; (d) Serve as the liaison between the public and the City Council in regards to library service; (e) Work closely with the Kcnai Community Li- brary Board for the betterment of the Kenai Community Library; (f) Shall act in an advisory capacity in the selec- tion of the City Librarian. The Commission shall: (a) Develop, adopt, alter or revise, subject to ap- proval by the City Council, a master plan for the airport development. This may include: (1) Development of type, location and se- quence of all airport terminal facilities; (2) Development and use of all airport aero- nautical lands. Observe, oversee and guide in an advisory capacity, any matters relating to use of airport runways, airport terminal, and airport aeronauti- cal lands. Act in an advisory capacity to the Council and the Airport Manager. (b) (c) 21.25.020 Qualifications. Members of the Airport Commission will con- form to the requirements of the City of Kenai Boards, Commissions, and Committees Standard Procedures as established by KMC 1.90, except that members of the Airport Commission need not be residents of the City of Kenai. I531-93) Article VI POWERS OF THE COU'N'CIL The powers of the Council are advisory only and are derived from the federal, state, and city local §ovemments which provide the funds for operation and all powers and activities shall be exercised in accordance with law. Frates, Kenai Parks & Recreation Director DATE: August 25, 2003 Kenai Municipal Cemetery Code- Suggested Regulation Amendments At our next regular Commission meeting on September 4, 2003, I would like to review the following suggested amendments to the current Cemetery Regulations. For comparison purposes, regulations from other cemeteries throughout Alaska are included for your review. Also included are suggested regulations for the proposed new area. CARE OF CMETERY 24.20.30 Maintenance of cemetery The City of Kenai is responsible for the appearance of the Kenai Municipal Cemetery. The maintenance of the cemetery shall be accomplished through a program administered by the Parks & Recreation Department. There is a cemetery donation fund account established for the purpose of' providinE funding for perpetual cemetery improvements. The City of Kenai shall maintain the driveways, gates, and fencing of' the cemetery and may close access to such facilities in periods of adverse conditions. CEMETERY REGULATIONS Section 1- Plots b. The City Clerk shall charge a fee of' [ONE HLrND~D FIFTY DOLLARS ($150.00)] two hundred fifty dollars ($250.00) per standard plot, [ONE HUNDRED DOLLARS ($100.00)] one hundred fit~ dollars ($150) for infants or [FIFTY DOLLARS ($50.00)] one hundred dollars ($100)for cremains. Section 2' Interment and Disinterment c: Only markers set in a concrete base shall be used~ and they shall be installed at the head of the grave. Section 3: Maintenance Genernl b. Planting of trees, shrubbery, plants or turf within the Kenai Mumcipal Cemetery shall be with the consent of the Parks and Recreation Director or Ms&er designated representative. Failure to get prior authorization may result in removal of plant material. The City will maintain the driveway in winter and clear the path to the grave if a funeral is scheduled. The City of Kenai shall provide grass cutting at reasonable intervals, as well as raking, cleaning, grading and landscaping. Suggested height of trees is no more than eight feet. Enclosures c. Enclosures such as a picket fence [WALL, HEDGE, OR DITCH] or a perimeter shall be permitted around or about any grave or burial plot only upon prior expressed authorization of the Parks & Recreation Director or his/her designee. Enclosures or headstones placed, before authorization is granted are subject to remova_!. Enclosures not maintained or that create n safety hazard may be removed a_nd discarded without prior notice at thc di. scretion of the Parks & Recreation Director or his/her designee. Markers f'. Only markers and headstones set in a concrete base shall be used, and they shall be installed at the head of the grave, cemered and inside plot area. The Parks & Recreation Director must be notified in writing prior to any plot preparation, construction, or placement of headstone or marker. Decorations g. [WOODEN BENCHES,] Boxes, shelves, toys, and other such articles upon a grave or burial lot shall be permitted only if contained within the plot and maintained [ON AN ANNUAL BASIS] monthly (April 1 through September 30___.,. [ENCLOSURES AND OTHER] Articles that are not maimained, [AND/OR RESTRICTING MAINTENANCE EFFORTS ARE SUBJECT TO REMOVAL] impede maintenance efforts, or become unsi.~htlv will be removed and discarded without prior notice at the discretion o~ thee Parks & Recreation Director or his/her designee. Plastic or silk flowers and artificia! decorations are only permitted during the 30-day period after burial, between October I and April 30, and three days before and ending two days after Memorial Day. All plastic or silk flowers and artificial decorations shall be removed on the third day alter Memorial All decorations (except those on burials less than 30 days) will be removed during a selected Saturday in the month of May each year during the annual cemetery clean-up. A 20-day notice will be posted at the cemetery_. Family and friends may either remove their properly placed decorations before Saturday's clean-up and replace them later, or request the cemetery not to remove their properly placed decorations by calling or writing .the Parks & Recreation Director. The Kenai Police Department or the Kenai Parks & Recreation Departmem may be comacted for emergency access during closed hours. d. Bicycles, skateboards~ roller blades, roller skates~ motor bikes~ three or four wheelers are not allowed on the cemetery ~ounds. e. No child under the age of 12~ unaccompanied by a guardian or parent or other adult, shall not be allowed on the cemetery grounds. f. Food, beer or other intoxicating liquors are strictly prohibited within the' confines of the cemetery. Plots The City Clerk shall charge a fee of two hundred fit~y dollars ($250.00) per standard plot, one hundred fifty dollars ($150) for infants or ~ne hundred dollars ($100) for cremains. Markers The new section of' the cemetery is reserved for flat markers only. Permanent grave markers must be made of' cast bronze, cast brass, cast aluminum or natural stone. Minimum measurements shall be 5" x 9" and markers must have raised or engraved letters of' at least one-quarter inch in depth/thickness. All markers shall have a minimum inscription' First and last name of' deceased, year of birth and 3tear of' death. A Permanent fiat marker shall be installed within 12 months (1 year) after the burial. Temporary fiat markers are acceptable until the permanent marker is installed. ,. Temporary wooden crosses or small uptight markers are permitted between October 1 and April 30 to mark the grave for the winter months. Enclosures Permanent raised obstructions, enclosures, concrete slabs, placement of rocks covetings of any kind are prohibited and will be removed without prior notice. O1' Decorations Placing temporary potted fresh plants and flowers, summer wreaths, or baskets on a grave is permitted. The same must be removed within ten (1 O) days, unless watered and cared for by relatives. Digging holes or removing grass is prohibited. Balloons, whirligigs, or any other moving decoration, clothing, candles, stuffed animals, toys and other such articles other than plants or flowers shall be allowed only in the first thirty (30) days after a burial. If not otherwise removed by thirty (30) days, the Parks & Recreation Director or his/her designee shall remove items without prior nOtice. Decorations shall not be placed in or attached to trees, shrubs, or fence. Planting of trees, shrubs, plants, turf or removal of sod are prohibited. Where lots and/or assigned sections of a cemetery are reserved, it shall be the responsibility of the applicant to maintain the lots, to include but not be limited to: (1) Leveling of the headstone; (2) Filling any and all grave depressions with suitable material; (3) Any work deemed necessary by the department of public works; and (4) A minimum of twice a season from May 1 through September 15, mow and weed grass areas, and trim brush and trees where necessary. Except as provided in paragraph I, a niche may be opened only by request of the niche owner as listed in the cemetery burial records (per sm-pcs) or as determined by the cemetery director. All such openings shall be documented in thc records maintained by the Anchorage Memorial Park Ccmctcry. All opening and closings and work relating ~o inches or the columbarium in general will be compleced by cemetery personnel under the direction of management. The inscription on the bronze, niche plaque will include only the th-St name, rni~c initial (if desired), and last name to§ether with the year o£ birth and the year of death. 2. The inscription on the .granitc niche plaque will include the name(s) of ~hc deceased and/or family name and if. desired, the.month (three letter abbreviation), day and year'of birth and of death (or just the year of birth and death). The cost of the niche includes an initial engraving of up to 40 letters. Subsequent engravings and engravillg in excess of 40 lcttcrs will incur additional charges as specified in Section 25.60.065. 3. Ifnot otherwise removed from the columb~um, all floral arrangements shall be rcmovcd on the third day after the holiday or burial by cemetery personnel. Cemetery personnel are nol responsible for plants, vases or decorations and assume no responsibility for their return.. 1 I. At no other time shall plants, vases or artificial decorations be placed at columbarium. ' 12. No memorials, inclu~ but nol limited to, candles, flals, stuffed animals, balloons, mobiles or other moving.decorations, clothing, toys, food, etc. shall be placed at the columbarium. These shall be immediately removed and discarded by cemete~ personnel without prior notice. Purchase, Thc cost of the niche shall include the niche itself, one opcninl/and closing, ami perpetual care. A sinl~lc niche shall also include a cast bronze niche plaque with appropriate lettering. The cemetery is not responsible for replacing such decorations. A 20-day notice will be posted in the cemetery. Discussion -- Kenai City Cemetery Review Frates began by thanking the Gettys for their hard work in keeping the cemetery in good condition. Frates explained some of the discrepancies at the cemetery with regard to enclosures, articles on gravesites, and vandalism. Frank Getty, t~e volunteer at the cemetery, also explained some of the problems he encounters while working in the cemetery which include' · Vandalism-- there has been a tremendous amount of vandalism in the cemetery and it makes it very di/ficult for he and' his- son to want to continue their volunteer clean-up and repair efforts. Getty reported, he's observed several young kids partying in the cemetery at various times throughout the night and asked the Comnfission to consider establishing gate closure hours. Frates added, the Police Department would take the responsibility of locking and unlocking the gate. Freas added, a key to the cemetery would be available in her office as well as the police department. Frates noted the pedestrian gate would remain unlocked. MOTION: Commissioner Sandahl MOVED to recommend City Council approve locking the cemetery gate from 10:00 p.m. to 6:00 a.m. from May 1,t to Labor Day (summer months} and locking from 6:00 p.m. to 10:00 a.m. from Labor Day to May 1,t (winter months). Other items discussed with regard to preventing vandalism at the cemetery included: · Security Cameras -- Frates reported four signs would be placed on the cemetery fence to read, "This facility is under electromc surveillance." Porter added the Airport Manager is working with FAA on funds for security, cameras for the airport; when the funds are awarded, a camera w/Il be installed for surveillance of the cemetery as well. · Fence -- Porter reported the fence would be raised to eight feet by the airport. This work should commence within the month. · Undercutting-- Porter reported the Police Department recommended some of the trees be undercut to allow more visibility. Discussion took place on grave enclosures and the encroachments some of them cause. Frates ~tated he would contact those responsible for the encroachments and will work with them to eliminate the problem. It was suggested the City should change the section of the regulations regarding enclosures to read, "effective a certain date, no PARKS & RECREATION COMMISSION MEETING JUNE 5, 2003 PAGE 2 additional enclosures will allowed." Freas noted some cultures place fences around graves and that regulation would be difficult to enforce. Discussion also took place on articles placed on graves and left. Frates suggested the City provide a Proclamation designating a day for cemetery clean up and would be the day old articlea would be removed. Frates continued, effort needs to be made to get the community involved by establishing pride and ownership. Getty reported he had researched plot rates in various.¢ommumties and found the City's rates to be quite low. Getty recommended the City consider increasing the rates by $100 for the 5 x 10 plots, $50 for infant plots and $50 for cremains. Discussion ensued regarding the current rate structure. Freas noted, the last change was made in 2000. Castimore asked if the plot revenue went into a fund for cemetery maintenance or if it went directly to the General Fund. Frates replied, it went to the General Fund. Castimore asked if it would be possible to have the revenue designated for cemetery maintenance only. Porter stated a fund could be established at anytime but pointed out the General Fund already provides monies for maintenance and improvements at the cemetery. Discussion took place on the type of headstones being used at the cemetery. Sandahl suggested flat stones be required on any new plots. Freas stated it was also difficult to monitor as people place headstones on graves without the City being aware of it and again the cultural background becomes an issue. Discussion took place on expansion of the cemetery and Frates reported discussions are taking place with the City Engineer, Airport Manager and the City Manager. Director-- Frates reported the following: · The City Council approved the budget at their June 4, 2003 meeting. · The Parks and Recreation Department is working with the Boys & Girls Club on the transition and fee structure. · A large softball tournament is scheduled for June 14th. · Dandelion control is a big issue right now and the Alaska Water Soil Association has a grant to educate the public on how to deal with noxious Weeds and will be meeting with the Department. · Summer hire crews started work on Monday. · When asked about the cost of a security camera at the multipurpose facility, Frates reported Guardian Security is providing a cost estimate. PARKS & RECREATION COMMISSION MEETING JUNE 5, 2003 PAGE 3 · The FAA gave approval to use the land for the skateboard park close to the softball fields. There are some stipulations such as not expanding or enhancing the park, no bleachers or seating, etc. Public Works is requesting bids for the asphalt work. 7-c. City Council L/a/son -- Councilwoman Porter provided a report based on actions taken at the June 4th City Council meeting. ITEM 8: COMMISSION QUESTIONS ~ COMMENTS Commissioner Hultberg asked when the Unity Bike Trail would be completed and if the contractor had plans to smooth out the edges. Hultberg added, he felt they are a major safety issue the way they are currently. Frates stated, the bike trail is a State project. It was noted, right-of-way negotiations are ongoing relating to a quarter m/le section close to Eagle Rock. Hultberg suggested a letter be sent to former Commissioner Wisniewski to thank him for his participation on the Commission. It was pointed out the Mayor had already sent a letter. ITEM PERSONS PRESENT NOT SCHEDULED TO _~ _ Mark Necessary, Kena/, Ahslm -- Thanked the Commission for their hard work on the recreation center issue and atated he felt badly Wisniewski resigned because of it. Necessm~ asked the Commission to "hang in there." Krlstine Schmidt, Kenai, Alaslm-- Schmidt noted the following: · Expressed disappointment the City Council approved the partnership agreement with the Boys & Girls Club. Schmidt stated she also found it interesting the Council spent a lot of time discussing how to best use dust control funds, requesting 'alternatives be brought back to them; she was disappointed the same could not be done for the recreation center. · Asked the Commission to continue to investigate opportunities to operate City facilities, such as partnering with the Borough since they too use the facilities. · Asked the Commission to have work sessions to look at other alternatives. * Reported a petition was filed with the City Clerk to put the issue on the ballot. MEETING SUMMARY ITEM 1: CALL TO ORDER & ROLL CALL The meeting was called to order at approximately 7:03 p.m. by Commission Chair, Jack Castimore. He also requested Ice Rink/Contracts for Services be added a~ a New Business item. There were no other changes requested and there were no objections to the agenda with the amendments requested. ITEM 3: APPROVAL OF MINUTES -- June 3, 2003 There were no corrections or changes and the minutes were approved as presented. ITEM 4: PERSONS SCHEDULED TO BE H~_A~n None ITEM 5: OLD BUSINESS 5-a. Update -- Skateboard Park -- It was noted the purchase' order to asphalt the pad was approved at the July 2 council meeting. The work. should be completed with in the next two weeks and fencing is to be added in the near future. Castimore stated his hope the fencing would be added prior to the facility being open for use. 5-b. Update -- Municipal Park Vandalism -- Castirnore reported damages done to the rest. room and other areas at the Park. It was suggested more visibility was needed for the areas to deter more damages and rebar should be used to close off the entrances to vehicular traffic. It was requested the Commission be kept informed of vandalism problems. 5-c. Update -- Ice Rink Security System -- It was reported Parks & Recreation Director Frates was investi§atin§ a security system for the facility. A§am it was su§§ested continued efforts be made to open the area with undercuttm§ of trees, etc. to allow better visibility. 5-d. Update -- Recreation Center/Boys ~k Girls Club Update -- ~ was reported the Boys & Girls Club took over management of the facility on July 1 and the Teen Center would be closed for approximately 12 days for painting and repairs to be made. ITEM 6: NEW BUSINESS Discussion-- Cemetery Regulation Draft Amendments The Commission discussed concerns there should be more stringent regulations for the cemetery, i.e. grave fences, memorabilia removal, yearly clean-up, etc. It was. noted the suggested recommendations were included in the information included in the packet. A lengthy discussion followed and the matter was requested to be included on the next meeting agenda for further review. Porter reported, after receiving notice a fund could be created for cemetery donations, the Council gave their permission for the fund to be established. Administration was requested to include for discussion on the next meeting agenda the cemetery regulations; plot pricing; foundation fund; and include regulations from other cemeteries for comparisons. Discussion-- Ice Rink/Contracts for Services Castimore stated his concern the rink required more marketing in order for it to not be a financial burden to the city. He suggested other contracts be investigated and stated he would contact the current contractor to discuss the issue further. He will report back to the Commission. ITEM 7: REPORTS Commission Cha/r-- No report. 7-b. Director -- Rogers reported the Parks & Recreation Department office was moved to the crew building (address is 410 North Willow Street, cell phone 394- 2609, land ]L~e will be known in the near future); summer activities and work was going well; a sizable softball tournament would be held over the weekend and a number of others during the remaining summer. 7-c. City Council Liaison -- Porter reported the Home Depot ceremony was well attended and their representatives stated they planned to be open in January.
