INTRODUCTION OF GUESTS CommisSioner Peterkin welcomed Mr. Brighton to Kenai and to the meeting. He was introduced to Commissioners that he had not met. COMMUN I CAT IONS .... Chairman Peterkin had received a telephone call from Captain Reynolds COE. Senator Stevens office had contacted the Corps of Engineers requestin~ the status of the boat harbor. Commissioner Wagoner reported that there was a conference call, April 14~ with himself, Chuck Welling, Marvin Dragseth & John Doyle, Uni.'versity of Alaska, Mar.The Ad'visory Project. Chuck Welling is convinced that he can write in fish quality with the harbor' study. He persuaded Mr, Doyle to send the COE a letter. Chairman Peterkin received a second call from Capt. Reynolds questioning the status of the bill in the Legislature. Capt. Reynolds will not give -1- Kenai Advisory Harbor Commission April .22, 1980 Meeting us. a report before it goes to the regional headquarters in Portland. 6. REPORTS a. Mayor O'Reilly reported on his trip to Juneau. (See copy of report in packet, ) The Capital Improvement Budget was knocked from 545 million to 500 million. He had no response from the Pre-Con Committee. He. would report to Chairman Peterkin when he found out more. He felt Murray Walsh proved very informative. He saw no problems with taking the $500,000 and matching it with CZM. We are also going to have to make sure the Borough meets it's CZM program. b. Commissioner Williams reported on the Juneau trip. He felt that the over, all response was positive. He suggested that Murray Walsh be put on the Harbor Commission's mailing list. He asked Don Statter's office · to furnish us with contractors & engineering firms that had done good work in the past. There was some disc'ussion on the bonding. There are now $1,250,000,000 worth of bonds being requested from the State this year. The Governor says that the money that is available must be used for projects that are already planned. It should be the priority of the'Harbor Commission to .get direct appropriation of the maximum amount that we are going to need for that harbor next January, Commissioner Ackerly asked how long after the $500,000 gets into the budget would it be before we get the check. Mayor O'Reilly stated that the State may be a little short cashed. There may be a new group in Juneau. Finance Director Charles Brown would develop a warrant and they would grant that warra.nt. Commissioner Williams stated that if everything is signed by July 1, it- may take 30 - 60 days to distribute the funds. As soon as the Pre-Con gets that money through, we should formulate our plans, send out a lot of inquires and begin to identify contractors, etc,. Mayor' O'Reilly commented that we will have to identify the.use of the entire $500,000. We must identify engineering, hydraulics and design pr.oblems, land pl. anning F~ & .~ and admi'nistrative effort, The Mayor added that we will put ~h~ 4....Ilion dollars in wi th the bond issue. If we are faced with a 5 or 6 year delay the other alternative is to have sufficient engineering design and hydraulic work so we can go back to the next legislatUre and let them know how much we need. Commissioner Ackerly suggested keeping it in with the bond and asking 'for the direct appropriation also. He added the question, do we have enough expertise to write the scope or proposal of what we want. Perhaps the COE would help us write a proposal. Commissioner Williams suggested that Don Statter's office could be a help to us. -2- Kenai Advisory Harbo~r Commi ssi on · April 22, 1980 Meeting Commissioner Williams questioned if the Council would be willing to loan the Harbor Commission the money until it comes through. Mayor O'Reilly.wasn't sure. He thought that if the money was passed by the Governor, it would be favorable. There was further discussion on the funding. Mayor O'Reilly stated that we were going to have to develop political strategy to apprOach the s i tuat i on. Commissioner Wagoner commented that he had met a gentleman in Juneau who had created the dry boat harbor concept. He didn't feel that it would work in our situation and would send a letter on his concept. c. Commissioner Wagoner reported on the EcOnomic Development Council meeting. Mr. Woodward had no mention' of Kenai or the Kenai River.. Kenai is part of the BOrough and 'should be part of this report. Mr. Woodward admitted that he screwed up'and forgot to put it in there. He had said he would submit it 1 ater. Commissioner Ackerly suggested sending a letter to the Borough and Wood- ward-Clyde telling them of our dissatisfaction with the report. There was discussion on the Borough and CZM. There Was to be a meeting on April 28, to discuss the Area Meriting Special Attention report. It was requested that the Admin. Assistant send copies of the report to Counci lmembers. Commissioner Burnett stated that he constantly heard the term "Trans- portation Committee~' We are a Port Committee or Con~nission. Trans- portation connotes four modes which we won't have until we have a railroad. Chairman Peterkin asked if the Port C'ommission Ordinance had been presented to Council. Councilwoman Glick stated that there was a committee of herself, 'Council- man Ambarian and Commissioner Burnett. Ben Delahay had requested that it be reviewed before it was presented to Council-. Councilman Ambarian was to arrange a meeting to review it. Chairman Peterkin requested the Admin. Assistant contact Mr. Ambarian and ask when a meeting could be arranged. d, Mr. Brighton gave a review of a luncheon meeting with FAA. The conclusion was that FAA ought to designate an area near the airport for use by only the airport. FAA has a policy from the 1940's that they control all real estate, all revenues, leases, & rents & these be used for the airport. Chairman Peterkin addressed ADAP funding. FAA v~ill expect an overall plan, and this Commission will more than likely be involved in a master plan on the 3 stages of development. The FAA will 'help with the request for money and help develop the plan. -3- Kenai Advisory Haruor Commission April 22, 1980 Meeting Councilwoman Glick commented on the tract of land for FAA's antenna. We must sell it at fair market value by their own rules. In preparation of becoming a Port Commission, Commissioner Williams requested that the Admin. Assistant prepare a copy of the final report by the land committee and distribute it to Commissioners. There was some discussion on a letter that Mayor O'Reilly would send to Mr. Castleberry, with a copy to Senator Gravel. He would-bring it to the Harbor Commission for ideas before sending it out. Chairman Peterkin commented that through the City Planning Commission, the City needs to figure out what tracts of lands they want to develop and then negotiate with FAA to have it approved for sale or lease. FAA could have a report back within 2 weeks on individual parcels. There was further discussion'on this. Mr. Brighton suggested putting a program together, and show FAA that it will not only benefit Kenai, but also the airport. It will provide taxes, employment, etc. This money will i~it~ate additional revenues. e. Commissioner Burnett reported that nothing had been done on the Port of Entry as yet, and he would be getting into that this week. Mr. Zoet, from Port of Valdez would be sending' information on how Valdez was able to achieve POE so quickly. Commissioner Burnett gave Mr'. Brighton an update on POE. Commissioner Burnett also discussed the budget for 1970-80 and 80-81. It was cut from $19,000 to $2,500. Mr. Brighton commented that it has only recommended to be cut to $2,500, the final amount will be determined by the City Council. Mr, Brown must work with the monies available. Budget sessions would be starting on Apri 1 30. Chairman Peterkin requested that Con,missioner Burnett attend. Mr. Brighton suggested that 'a one page budget be submitted to him and he would forward i t to Counci 1, Commissioner Wagoner asked if he would like a letter of transmittal with that. Mr. Brighton replied yes.. f. Mayor O'Reilly reported that he had a conversation earlier in the day with Mayor Don Gilman. Mayor Gilman had a previous commitment to attend the Ninilchik Chamber of Commerce and could not attend this meeting. Mayor Gilman told him that Pacific LNG had run acro$.s~.~.a snag.~ - The Court of Appeals has referred the entire case back to Ferk. This is because of some findings of U.S. Geological Service that there may be some active faults offshore from the del iquefaction plant. The earliest action that could be taken would be July. -4- Kenai Advisory Harbor Commission April 22, 1980 Meeting MOTION' Mayor Gilman had also commented that Assemblyman Arness had brought in an ordinance to the Borough Clerk, that will be introduced at the May '6 meeting. It would create a harbor service area for Kenai and North Kenai. Assemblyman Campbell will introduce an ordinance providing for non-area wide service area. Councilwoman Glick noted that Would just be an introduction of the ordinance. It would be a month later before a public hearing. Mayor O'Reilly commented that we may wish to ask the Borough Clerk for copies of the ordinance. Chaiman Peterkin stated he would like to ask Assemblyman Arness to a Harbor Commission ~meeting. The ordinance would have to go up for a vote wi th the people of Kenai and North Kenai. There was further discussion. Mayor O'Reilly stated that we are a Home Rule City, with harbor powers, which can't be taken away. You can create a service district to perfom certain functions, if there is not a munic- ipality nearby that can perform these services. It was decided to have the City Attorney look into this, have him render an. opinion and direct it to the Harbor Commission. Chairman Peterkin stated if the City says yes, in favor of the ordinance, they'll do it. If they say no, there will be a commission formed of 1/2 Borough and 1/2 CitY. 7. Old Business a. Wince-Corthel 1 , , , Commissioner Wagoner moved that we forward the Wince-Corthell study from the Harbor Commission to the City Council with no action. The motion was seconded by Commissioner Williams. There was discussion of the motion. Commissioner Ackerly stated that the intent of the motion is not clearly stated and possibly· there should be an amendment to the motion to express the true feelings of the Harbor Commission about the report. The report may be received as favorable, but it is not worth the $10,000. It should reflect that to the Council. Commissioner Williams added the report does not reflect totally the sub- jects as anticipated by the Commission. When.we hire someone, it should not be because they are a local concern. Commissioner Wagoner stated~ we shoul~ take n~ action~, in-approving or disapproving the report. We approved it by distributing it in Juneau, but didn't think we should endorse the report to Council. Chairman Peterkin stated that the City Council already has the report. Commissioner Williams withdrew his second and Commissioner Wagoner made a new motion. MOTION: Kenai Advisory Ha', ~or Commission April 22, 1980 Meeting Commissioner Wagoner moved that the Harbor Commission take no action on the Wince-Corthel 1 report. The motion failed for lack of a second. Commissioner Burnett added that he .agreed with Commissioner Ackerly. It shouldn't go to CounCil with no statement. It would imply acceptance, by lack of a statement. Mr. Brighton asked if the Commission asked City Council to appropriate money to provide this report? Then the Commission is morally obligated to indicate that it has received something. Then add any comments~by some type of communication. You must keep all avenues open-.with Council. Commissioner Williams stated we should move to accept the report and then issue a letter of communication about the report. Chairman Peterkin appointed Commissioner Williams as Chairman of a sub- committee including Commissioner Wagoner and Commissioner Issacs, to 'develop a letter to go to City Council on the Craig Freas/Phil Bryson report from Wince-Corthell. Commissioner Williams moved the report to the committee for further action. .' b. Chairman Peterkin reported that he would write a letter to Pacific Northwest Waterways Association and send $100.00. c. Mayor O'Reilly reported on. the Administrative Coordinator position. There have been three responses thus far. Keith Kornelis has them. Mr. Kornelis, Councilman Malston, and Chairman Peterkin would screen the applications and make a recommendation to the Mayor. Councilwoman Glick added that Councilman Malston would be out of town until Thursday. Chairman Peterkin requested the Admin. Assistant contact Mr. Malston and find out when the meeting would be held to screen applicants. Chairman Peterkin asked Commissioner Wagoner if he could make the Borough · Planning meeting of April 28. Commissioner Wagoner believed he could attend., d. The Governor has a Transportation Commission. Chairman Peterkin felt we should have someone in the Kenai area on that Commission. Commissioner Wi 11 iams stated that Mayor O' Rei 1 ly has a 1 i st of every commission, committee and group, of the State of Alaska that the Governor appoints, and their terms. We need to go down that list and identify all of them that affect the City and see if there are any that we would like representatives on, and send letters. Chairman Peterkin requested that Commissioner Williams get a copy of the list from the Mayor. -6- Kenai Advisory HarbOr Commission April 22, 1980 Meeting Mayor.O'Reilly stated that he had a lengthy'~'- conversation ~with Terry Miller and his assistant. The Mayor pointed out to them that there seems to be a shortage~of people on..the Peninsula on these commissions. TheY will be res ponding to that. Commissioner Ackerly asked if there was anything we can communicate to Juneau on to the Pre-Conference to let them know we 'are still concerned about our projects? Mayor O'Reilly stated that he had aslked Weller today if we should contact Joe Montgomery, and he indicated no. It's ih Malone's, Tillion's, and O'Connell's hands now. He thought a telegram would be alright, as long as no new matters were brought up. Commissioner Williams added that it is doubtful that a telegram would reach them. 8. Commissioner Williams outlined the letters that would be sent. The first was a letter to the Borough asking them to advise this commission as to where they were at with CZM. The second was a letter to Don Statter advising this commission on acceptable contractors from the State. Mayor O'Reilly would address a letter to Murray Walsh to ask the procedures to set up the 80- 20 applications. ADJOURN- Commissioner Wagoner would write a letter to Ike Waits, at the Borough, stating the Commission's dissatisfaction with the latest draft of the Woodward-Clyde report. At ll-30 p.m., with no.'further business, Commissioner Williams moved the meeting adjourn.
