Discussion -- Kenai River Bluff Erosion Study Update The Commissioners reviewed the February 13, 2004 Corps of Engineers project status report added to the agenda. Council Member Bookey reported he and City Manager Snow attended a meeting with Senator Murkowski in which they expressed the need for funding the project. Kornelis noted he briefly discussed the project with an Stevens' aide earlier in the day regarding the project. Mayor Williams will be meeting with Senator Stevens in Washington, DC to update the Senator with the project and discuss funding needs as well. ITEM 6: NE~V BUSINESS -- None. ITEM ?: REPORTS 7-a. Director -- Kornelis reported the follov~ring: • The dock lease bid opening is scheduled for March 9, 2404 at 10:00 a.m. A bid has already been received from R&J Seafoods. • The dunes road off Cannery Road is a dedicated right-of way (he provided the Commission with a map of the area). • A permanent, non-flammable toilet for placement on the north side of the River is not in the budget. The Parks & Recreation Director is investigating grant funding possibilities. • Raising the walkways for dip netters is also not in the budget. • Kenai Central High School students will be fee stations for the use during the dip net season. • He, Council Member Bookey, and Commissioner Eldridge will be attending a Coastal Dynamics Workshop in Homer, March 17 and 18. • There are two openings on the Harbor Commission. He asked the Commission to have interested parties contact the Clerk for an application or the city's website. 7-b. Dock Foreman -- No report. ?-c. City Council Liaison -- Council Member 8ookey reported he attended a portion of the Arctic Winter Games in VVood Buffalo, Alberta, Canada and discussed the Games and their economic effect with the Commission. Discussion/Recom:neadatioa -- Kenai Peninsula Borough Chapter 21.18 - Anadromous Streams Habitat Protection Council Member Bookey noted the information included in the packet and added, a draft ordinance is being prepared by the city attorney which, if passed by council, will assume the responsibilities of a''stration and enforcement of the Kenai Peninsula Borough Ordinance 21.18. A lengthy discussion followed in which comments included: • Of 64 permits processed by the Borough since 199b for properties within the city limits, only two required conditional use permits. • Political situations were changing across the Borough -- it would be far better for the city to manage its own portion of the river and it is important for the city to control its destiny. • The city ordinance will need to be equal or more stringent than the borough ordinance. • If the city adopts an ordinance, the city would be responsible for the regulation and would have environmental duties. Training for those duties could be received from the Borough. • The city currently has the ability/ opportunity to comment on applications. • There are some staffing concerns. • A''stration is not recommending the acquisition of the responsibility, but it is a policy decision of the council. • Funding is not a concern of the Harbor Commission. • The regulatory committee now has members from all over the Borough and only two from the City of Kenai. Currently, representatives from other areas of the Borough could ultimately make decisions affecting properties within the cifiy limits even if the city does not agree. • Properties/projects that could be affected are Kenai Land, Kena.i Packers, Dragnet fishing area. ~ • The draft ordinance will first go before the Planning & Zoning Commission for consideration and then it could be returned to the Harbor Commission for review. MOTION: Commissioner Eldridge MOVED the Commission recommend to council the city take over the Anadromous Streams Habitat Protection ordinance from the Kenai Peninsula Borough for the portion of the river in the Kenai city limits. Commissioner Foster SEC~NDED the motion. There were no objections. SO ORDERED. 3-b. Discussion J Recommeadation -- Kenai Boating Facility Exit Road Public Works Manager Kornelis reviewed his memorandum of May 13, 2004 which was included in the packet and set out a suggested procedure relating to a possible land trade with The Conservation Fund in which the city would acquire approxirnately ten acres on which to build a boating facility exit road. During the discussion that followed, comments were favorable, however it was expressed no restrictions be placed on the ten acres to be received from the Fund as was done on the boating facility property. The Commission's consensus was to recommend administration proceed forward with the land exchange with The Conservation Fund; bring the land appraisals back to the Commission for review; and, no restrictions be placed on the land the city will receive from the Fund. ITEM 4: ADJOURHMEHT Prior to adjournment, Council Member 8ookey reported on his trip to Washington, DC and ? discussions he and Ma or W'illiams held with members of the con essional dele ation and Y ~ g ~ their staff inembers relating to the coastal trail/bluff restoration project. WHEREAS, AS 29.4~.010 grants the Kenai Peninsula Borough planning, plattuig and land use regulation power on an area-wide basis; and WHEREAS, in 199b, the Kena.i Peninsula Boroug~i adopted an A-nadromous Steams Habitat Protection Ordinance, codified as KPB 21.18.010-140; and WHEREAS, KPB 21.18.100 allows cities within the covered area to administer and enforce the ordinance by enacting an ordinance incorporating it by reference into the city code; and ~VHEREAS, consistent with its home rule powers the City of Kenai finds it is in the best interest of the city to administer and enforce the Anadromous Streams Habitat Protection Ordinance by incorporating it into its city code as KMC 14.20.165; and VVHEREAS, the City of Kenai finds that zoning decisions affecting property within the City of Kenai should be made locally. ANADROMOL'S STI~EAMS H.~BITAT PR(JTECTION* 21.18.010. Purpose. The purpose of this chapter is to ensure measures for the protection within the Kenai Peninsula Borough of sal~on spawning and rearing habitat are applied in a consistent ma~er while recognizing private praperty rights and providing cities the option to administer the ordinance within tbeir boundaries. It is the intent of this ordinance to avoid duplicating regulations of state, federal, or municipal agencies and to minunize conflicts between those regulations and this ordinance. tOrd. In enacting this ordinance the assembly finds numerous factors affect the habitat of the anadromous streaius v~~ithin the Kenai Peninsula Borough. Ainong others these include bank erosion, bank trampling, pollution, inadequate tourism infrastructure, unsuccessful attempts to remedy bank erosion or protect and restore habitat, inconsistent regulations, logging, grazing, mining, wetland fill and drainage, excavation and fill of property, dredging, inappro- priately installed culverts, fuel storage, and maintenance of existing structures. The assembly finds that the sensitivity of the river area requires general prohibition of activities within an area immediately adjacent to the anadron~ous streatns and only activities which do not damage the habitat should be allowed. The assembly finds that certain activities have ~ninor impact and that existing state, federal and local laws and regulations contain suff cient controls on these activities that further regulation is not currently needed. The assembly further finds that fuel storage and significant removal of vegetatioa within the I00-year flood plain along the anadromous streams need regulation ta protect the sal~aon habitat. (Ocd. Periodic review. 21.1b.~3~ As part of its role in connprehensive ptanning the planning de artment shall P prepare an assessment of the benefits and effectiveness of this chapter after one year, with a review every two years thereafter. There is established an anadramous stream habitat protection area. Except as other~vise provided in this section, this area includes all lands within 50 horizontal feet of the streams set forth in KP8 21.18.025. This shall be measured from the ordinary high u~ater mark or mean high water line in tidal areas. Where the banks w~ithin this ~0-foot area consist of a 60 degree or more cut bank the habitat protection area shall consist of the greater of 50 feet from the river or to a point 25 feet back from the top of the cut bank. (Ord. I~To. 2000-08, § 5, 5•16-00; Ord. No. 9fi-06, § ltpartl, I996) ZI.18.050. Flood plain-Restrictions within for habitat protection-Perinit required- Fuel storage tanks and logging-Conditions. A. No person shall install or replace a fuel storage tank or conduct logging activities as defined in this section within any flood hazard area bordering the Kenai River or any of its tributaries or other anadromous streams set forth in KPB 21.18.025 without first obtaining a permit from the borough planning director. In this section "~lood hazard area" means any area designated as such pursuant to KPB Z1.Ofi and shown on the most recent flood insurance rate maps published by the Federal Emergency Management Agency. B. Application for a permit shall be ~aade to the borougb plaaning department. No perrriit shall be issued unless the planning director or designee deterinines that the proposed actiti•ity meets the requirements of subsection C of this section. The spplicant shall submit site or work plans showing the location of the activity, the proposed means of conducting the activity, and information showing that tbe proposed activity meets the conditions of this section. C. Fuel storage tanks must be attached or anchored solidly to a structure or to the ground. Cables may be used for anchoring that are of su~icient strength to prevent the tank from tearing loose if it were to flaat while empty. The tank must also be instalied within an impervious contairmaent basin of a size sufficient to contain 1I0~ of storage capacity plus 1Z inches of free board. D. No permit shall be issued for logging unless the borough planning director, or designee, determines the clearing does not result in a cleared area larger than 20 percent of the total area of the parcel provided that clearing for the footprint of a building may exceed this 20 percent limit. Multiple cleared areas may exist an a pa~•cel but the total of all sucb areas may not exceed 50 percent of the total area of the parcel upon which the logging permit is sought. The planning director rnay ~lso deny a perinit upan a determination that the proposed logging will increase runoff andlor erosion to such levels that it may significantly damage the riparian habitat and wetlands within the habitat protection area. E. A decision of the planning director under this section may be appealed to the planriing comraission. The appeal must be filed with tbe planning director within seven days of the date of the decision and state the basis of the appeal. The ectiti~ities specified in this sectioa may be conducted within the babitat rotection P area zone without obtaining a permit frosn the borough under this chapter. This section in no way waives or modifies the necessity of adherence to other provisions of the KPB code , including KPB 21.06 ~flood plain management), or requirements of a permit fro~n federal sta , te or local goverr~ments. Conduct of activities listed in this section are expressly conditioned u pon obtaining all app~icable permits. Conduct of activity without obtaining necessa ermiis s , rY p hall be considered a violation of this chapter, subject to the provisions of Section 2t.18.11 0. 8. The following activities, to the extent they do not result in significant erosion or da mage to riparian habitat, or result in or increase ground or water pollution, do not re uire th q e issuance of a permit under this chapter: 1. Per~nits are required for commercial activities of the same nature as those allowed under 21.18.070 B. for private non-commerciai use upon conditions that the activity is limited to pedestnan use over boardwalks, stair and docks necessary to alleviate the increased levels of activity attendant to the co~nmercial activity. There are activities which were conducted, and structures which were under construction, or exist and were in use before the enactment of this ordinance which would be prohibited or restricted under the tertas of this ordinance or future amendments. It is the intent of this section to permit these prior existing activities or structures to continue. Any such activities or structures must stitl comply with other applicable laws. The activities referenced in this section shall be allowed if they do not result in significant erosion or danaa e 8 to the riparian habitat. B. Structures. Structures which were under construction ar in use before the effective date of any provision of this chapter, but that would be prohibited or restricted under the terrns of this chapter shall be allowed to continue, provided that a structure under construction must be substantially completed within two years of enactment of this ordinance. Such a structure may be maintained or repaired without a perr~it. Such a structure may also be replaced or reconstructed within two years after acadental damage to accidental destruction by fire, explosion, or other casualty or act of God. Reconstruction or replacement not completed within two years of the date of tbe damage is prohibited except in compliance with current requirernents. Such replacement or reconstruction r~ay only be undertaken in the same space that the structure occupied prior to damage or destruction. A conditianal use permit shall be granted to an applicant if the enlargement or expansion will be conducted in a manner that does not result in significant erosion, destruction of wetlands or riparian habitat or increase in ground or water pallution. The permitting authority may attach conditions to the pernnit it feels are reasonably necessary to achieve the above objectives. E. Other provisions. 1. Any prior existing activity or structure which is abandoned for two years or more shall tbereafter nat be conducted, used or occupied except in conformity with the provisions of this chapter. ,~~ 2. Administration by cities-Delegation-Legai proceedings. A. The administration and enforcement of this ordinance may be undertaken by a city. B. A city may adapt the standards established in this chapter or prescribe standards more stringent than those established in this chapter for the areas of the city within the habitat protection area or other areas regulated by this chapter. A conditional use permit issued by a city planning commission may serve to satisfy the require~nents of 2I.18.072 and 2I.18.OSQ. C. A city wishing to administer and enforce this chapter shall enact an ordinance adopting the provisions of this chapter by reference, providing the city will undertake the adnairustra- tion in conjunction with the ad~ninistration of laAd use regulations and building and health codes enacted by the city. Within 30 days of passage of the ordinance the mayor shall transfer the administration and enforcement to the city. The city may relinquish and transfer the administration and enforcement back to the borough by ordinance, bowever the transfer shall not take eft'ect unti190 days after the city approves the transfer or the commencement of a new fiscal year for the borough, whicbever is greater. D. If a city assumes administration of this chapter, conditional use permit determinations ~ ~ shall be made by the city planning coramission, or by the city council, as provided by city ~~ ordinance. Snow, City Manager Date: Aprii 8, 2004 RE: KPBC 11.18.010 Anadromous Streams Habitat Protection Program The Administration was asked to research and provide specific information about what administrative and field work would be required if City Council decided to enact and authorize the administration and enforcement of the Borough habitat protection ordinance. Attached are the following documents to help you become familiar with the issue: (1) a copy of KPBC Chapter 2I.18; (2) a Multi-Agency Permit packet, which is currently distributed to the public by the Kenai River Center; (3) a spreadsheet of the pennits issued (by type and number~ within the Kenai city limits since 1996; and (4 a . .. , ) copy of the Borough Planning Commission Resolution Z004-13 granting a conditional use permit for the Kenai Landing Boat launch ramp project. The best way to begin describing the adminis~ative and field work re uirements to .. . , q administer and enforce KPBC 21.18 is to start with the process currently used by the Borough and which would also be used by the City if Council decides in favor of takin . g over this program from the Borough. Anyone planning any kind of a project within the habitat protection area (KPBC 21.18.040) must submit a project application to Borough personnel at the Kenai River Center. In trying to determine whether a pIanned activity requires a permit, ap licants . . , , p most often meet with various agency personnel both in the River ~enter office and at the project site before the appiication is finaliZed. If the ap lication lans as submitted P P , , meet the requirements under KPBC 2I.18.070 (B), a letter is sent to the property owner advising that while the planned activity does not require a conditional use permit under the Borough ordinance, a permit will be required by other named agencies (as ma be . . , .. Y appl~cable). For fuel storage and logging activities, there must be an initial determination from Borough staff about whether the proposed activity is iocated within the Botou 's ~ flood ha~:ard area (KPBC 21.06 and 21.18.050). ) According to John Mohorcich, about 90% of all applicants will need permits from agencies other than the Borough, e.g., Departrnent of Natural Resources, Department of Fish & Game, Department of Environ~mental Conservation, Corps of Engineers, Environmental Protection Agency, U.S. Fish & Wildlife, etc. Therefore, snitial me~tings and field woric w•ilI help determine which of the permitting agencies may be required for further reviews and permitting. These meetings also help the applicants provide accurate measurements and project descriptions, answer any questions the applicant may ha:•~ about which activities are prohibited within the protection area (KPBC 21.18,060), whicl~ activities may be conducted in the area without obtaining a permit from the Borou h g~ which activity may be permitted by the Borough within the protection area (KPBC Z 1.18.O~Z), and which prohibited activities may be issued a conditional use ermit b the P Y Borough (KPBC 2I.18.~80) at no charge. Additionally, some activities may be allowed under KPBC 21.18.090 regarding prior existing acqvities and structures. While many proj ects may appear to be prohibited at first glance, working closely with the applicants to find ways that projects may be authorized will more likely result in successful projects and promote better relationships betwecn the agency and citizens. Once the appiication is finalized and submitted, it is copied to all other permitting agencies for further review. The review group schedules administrative revicw meetings weekly and field reviews individually or as may be agtccd upon. The Department of Natural Resources requires permit decisions to be issued within 30 days of receiving the application, so all of the other agencies comply with that time frame for the purpose of coocdination and cooperation. If t~e City of Kenai were responsible for the administration and enforcement of this ordinance, it is clear that a transition time would be required for implementation, during which the Administration, Planning & Zoning Commission, and City Council would need to be educatcd about the intricacies of KPBC 21.18. This could be achieved and make the transition easier for everyone if we held a couple of joint work sessions for commissioners, council members, and staff. In addition to the work sessions, our public works staff would necd further training in the technical aspects required to provide citizens with the specific knowiedge and expertise required for the anadromous strearns habitat protection program. The most effective way of doing this would be to provide staff with on-the-job training; in other words, we would schedule varied work "internships or apprenticeships" with Botough personnel at the River Center during the sumrner when there are many ongoing projects and new applicants. In addition to learning how to do the job, we would also be establishing the coopecative working relationships with Kenai River Center agency personnel needed for successful program implementation. VVe would then transition to the City's program during the fall and winter when there are not so many projects. During the interim period described above, we would undoubtedly discover many more ways of providing for a smooth trzansition than we can envision now. At this time, however, it is anricipated that we would be able to use the existing permit application packets with the inclusion of a new City of Kenai file form. If the Kenai City Council decides to take over the administration and enforcement of KPBC 21.18, however, we will do everything possible to do the best job possible within the parameters of allocated resources. Fees will be used to offset costs associated with maintaining the beach and will allow dip net participants 12-hour parking and camping within the management area. Management Fees: S10 Parking $10 Camping $20 Parking & Camping Fee Stations! Stations have been erected on both the north beach and south beach access points. If the attendant is not available, place fee envelope in the fee collection box and display receipt on dashboard and/or at campsite. Beach Access! South beach access is via Dunes Road located on Cannery Loop Road. For public safety reasons, the ~ld Cannery Road will be temporarily (seasonally) closed. There is a small public parking lot on Dunes Road (no overnight camping}, however, the adjoining property is privately owned. Please respect private property.~ North beach access is located at the end of Spruce Street in Kenai. Parking is very limited and the gravel road parallel to the beach is for picking up and dropping off only (no parking). Camping is $10 per 1 Z-hour period and generally means staying on the beach past the 11 p.m. fishing closure time. If fishing is allowed on a 24-hour bases, the camping fee will be valid for a 24-hour period. Camping wilt mean setting up a tent or some other shelter~ on the beach with the intention of staying overnight. Setting up a tent or shelter on a temporary bases not intended for overnight is not considered camping. Remember... each overnight of camping costs $10. Parking is $10 per 12-hour period. If f shing is allowed on a 24•hour bases, the parking fee will be valid for a 24-hour period. Safet Use common sense~ Cook Inlet water is cold and tidal influences severe. Many of its bank areas are also muddy. A life jacket and extra clothing are always sound advice. Please keep watch of children at all times. Watch For Soft Sand! Extreme caution must be exercised v~hile traveling the beach; four-wheel drive pick-up trucks or a11-terrain vehicles are typically required. The sand is very soft (especially at the access points) and high tides can be unforgiving. Always check the tide table before venturing onto the beach. The City of Kenai and other agencies involved hope that all participants have a safe and enjoyable eaperience. They ask all dip net participants to please obey all rules and regulations and practice good safety habits. I guess the Feds like to mix things up for exatement. Receipt of this report allows us to works toward complefing the environmental and hydraulic wnte-ups, which will be included in the technical report. A{though not final, our report wiil state that bluff stabilization will have minimal advecse affects on the coastal dunes, hydraulic characteristics of the river, or the environmentai resources. This is not to say that the project has cleared the environmental hu~dles. 6ut our study was tailored to address agency comments on the PN&D conceptual design, so hopeful{y we have taken great strides toward lowering or eliminating the hurdles. Let me know if you have comments or revisions to the update, psf «Kenai project status 23 Jun 04.doc» b/24/2004 \~ CEPOA-EN-C~-PF 23 June 2004 MEMORANDUM FOR RECaRD SUBJECT: Kenai River Bluf~Erosion Study - Project Status Invertebrate studv - Study was conducted in April 2003 and found little in the way of invertebrates in the riverbank area, Limnolo~v StudX - Temperature and salinity profiles were conducted to characterize the physical dynamics of the Kenai River estuary in conjunction with the baseline fish assessment completed March 2004. Bird Survev - Monthly bird surveys were completed in May 2044. Fish Stud - Spring and winter fish studies have been completed by ADF&G. The A.DF&G report, which presents the findings of the studies, was completed March 2004. Toao~raphicaUhvdro~ra~hical survevs - Survey cross-sections have been completed. This data was used in the development of the hydraulic model of the lower Kenai River. Hvdraulic StudX - Modeling of river conditions with and without-bank stabilization has been completed. Results of the modelin~ indicate that minimal changes to the river's flow patterns would occur under a stabilized bank condition. Riv_erbed sediment samples - Sediment samples were collected in May 2403 along the main river channel and bank areas. Results of the hydraulic model study will be used in conjunction with the riverbed samples to determine what, if any, changes to the river channel would occur under a stabilized bank condition. Sedimerrtation Studv - A draft sedimentation study report by the Corps' Engineerin$ Research and Development Center (formerly the ~Vaterways Expenment Station) was presented to the Alaska District May 2404 for review. Reviev~ comments were submitted to ERDC June Z 1, 2004 with a requested turn-around date of July ?, 2004. This completion needs to be confirmed with ERDC. Geotechnical Studv - Geotechnical fieldwork to determine groundwater flow rates has been completed. The piping of groundwater out of the face of the bluff is considered to be a major factor in bluff erosion process. Slope stability analysis of the bluff has been completed. Additianal geotechnical work has been completed to verify previous data findings. The geotechnical report is to be completed by mid-July. ~ T ' - ' n of the technical re ' ~ ~ echnical Report An outli e port has been prepared. The report w~ll cons~st of a main report section and appendices. The main report will summarize the study and appendices and will serve to tie the technical elements (environmental, geotechnical, hydraulics, and sedimentation) toge~her. The main report will present study conclusions (does bluff stabilization adversely affect the dunes and environment?} and recommendations, such as remaining work to fully analyze and design a bank stabilization project. Study Schedule - All fieldwork has been completed. A draft of the sedimentation analysis report has been completed. Delay in receipt of this report has caused additional delays in preparing the environmental and hydraulic reports. The main report and appendices are scheduled for completion August 2004. The study team, including the city of Kenai, will review the draft prior to it being finalized. It is uncertain if, or to what extent the report will undergo an agency (ADF&G, USFWS, EPA, etc) review. The concern is that an agency review may result in inordinate delays or recommendations for additional studies beyond the scope of this study. The report is scheduled for completion September 2004.
