1. Public Emplovees Retirement Svstem (PERS
The City is in favor of the provisions of HB 375 for handling the PERS funding.
This bill passed the House last session unanimously or nearly so, but it did not
pass the Senate. The key points are that it establishes accounts designed
similar to the school debt reimbursement program. The governor puts the
amount of State funding required by the bill in the Uudget. The amoLmt of
State funding is 85% of the contribution required from each municipality to pay
the past service cost. This would leave the municipalities paying 15% of the
past service cost and all of the normal cost for pensions. For Kenai this would
be a rate of about 19% out of a total rate of nearly 46% of covered payroll.
Gov. Murkowski recommends that the State pay all of the increase resulting
from the FY 2008 rates set by the ARMB. Since the State paid 5% of tihe FY
200'7 rate, municipalities would be responsible for the 15~ 5% of the rate
increase for FY 2008. This recommendation is good, Uut does not provide a
plan going forward.
Governor Murkowski also recommended that an addifional $500 million be
paid directly to the plans to reduce the unfunded liability. This
recommendation should be implemented and a commitment should be made to
use a significant part of any Uudget surplus to pay down the liability.
2. Revenue Sharin~
Revenue sharing should be reinstituted. The formula allocation of the previous
revenue sharing plan seemed to work. Small municipalities received a floor
allocation and larger municipalilies with taxing ability were allocated based on
a fornlula that recognized population and self help through taYation. If the old
formula is used, sales tax should be considered in the formula along with
property tax. When the revenue sharing program was about $100 million the
City of Kenai received about $1 million through the program. At its peak the
City received $1.8 million from this program.
3. Kenai Snur Hi~hwa
The Kenai Spur Highway Uetween Soldotna and Kenai has become an
increasingly more dangerous roadway. The conflict between through traffic

traveling at higher rates of speed, and traffic attempting to exit the roadway into
local businesses and residential subdivisions has created an unsafe condition.
At present there is not a project on the Statewide Transportation Improvement
Plan. The City of Kenai requests legislative assistance in having ADOT/PF
provide some preliminary engineering data produced showing costs for having
the Kenai Spur Highway upgraded to a three-lane configuration, with overhead
street lighting in appropriate areas.
The City of Kenai will work with the City of Soldotna, and the Kenai Peninsula
Borough to submit a project nomination to ADOT/PF.
3. Statewide Sales T~
Several years ago the State of Alaska was discussing a statewide sales taY in
response to low oil prices and an anticipated revenue shortfalL Had the State
instituted a statewide sales tax, given the exemptions allowed by statute, it
would have been devastating to the political subdivisions with sales taY. I
estimate it would have reduced annual sales taY revenue to the City of Kenai by
30%-50%.
If the Council believes it iinportant, I suggest asking the leglslative contingent to
introduce legislation that would prohibit the State from instituting a statewide
sales taY that would have a negalive financial impact on political subdivisions
with existing sales taz~es. If adopted, I recognize that the legislature could
change the law in the future to eliminate the protection, but it would be one
more step the legislature would have to go through.
