MEETING SUMMARY ~ ITEM 1: CALL TO ORDER 8a ROLL CALL The meeting was called to order at appro~mately ?:03 p.m. by Commission Chair Jack Castimore. Roll was confirmed as follows: ~ Present: Sandahl, Gifford, Castimore, Steiner Absent: Hultberg, Baxter, Werner-Quade Others Present: Councilwoman Porter, Parks & Recreation Department Representative Micah Rogers, and City Clerk Freas ITEM 2: AGENDA APPROVAL Castimore requested the following items be discussed as Old Business: Updates on Skateboard Park; Municipal Park Vandalism; Ice Rink Security System; and Recreation Center/~oys & Girls Club. He also requested Ice Rink Contracts for Services be added / as a New Business item. There were no other chan~es requested and there were no objections to the agenda with the amendments requested. ITEM 3: APPR~VAL QF MINUTES -- June 3, 2003 There were no corrections or changes and the minutes were approved as presented. ITEM 4: PERSONS SCHEDULED TO BE HEARD -- None ITEM 5: OLD BUSINESS 5-a. Update -- Skateboard Park -- It was noted the purchase order to as halt p the pad was approved at the July 2 council meeting. The work should be com leted p with in the next two weeks and fencing is to be added in the near future. Castimore stated his hope the fencing would be added prior to the facility being open for use. 5-b. Update -- Municipal Park Vandalism -- Castimore reported dama es g done to the restroom and other areas at the Park. It was suggested more visibili was tY needed for the areas to deter more damages and rebar should be used to close off the entrances to vehicular traffic. It was requested the Commission be kept informed of vandalism problems. 5-c. Update -- Ice Rink Securitp System -- It was reported Parks & Recreation Director Frates was investigating a security system for the facility. Again it was suggested cont~nued efforts be made to open the area with undercutting of trees, etc. to allow better visibility. i ~ ! ~~ 5-d. Update -- Recreation Center/ Boys & Girls Club Update -- It was reported the Boys & Girls Club took over management of the facility on July 1 and the Teen Center would be closed for approximately 12 days for painting and repairs to be made. ITEM 6: NEW BUSINESS 6-a. Discussion -- Cemetery Regulation Draft Amendments The Commission discussed concerns there should be more stringent regulations for the cemetery, i.e. grave fences, memorabilia removal, yearly clean-up, etc. It was noted the suggested recommendations were included in the information included in the packet. A lengthy discussion followed and the matter was requested to be included on the next meeting agenda for further review. Porter reported, after receiving notice a fund could be created for cemetery donations, the Council gave their permission for the fund to be established. A''stration was requested to include for discussion on the next meeting agenda the cemetery regulations; plot pricing; foundation fund; and include regulations from other cemeteries for comparisons. 6-b. Discussion -- Ice Rink/ Contracts for Services Castimore stated his concern the rink required more marketing in order for it to not be a financial burden to the city. He suggested other contracts be investigated and stated he would contact the current contractor to discuss the issue further. He will report back to the Commission. ITEM ?: REPORTS ?-a. Commissioa Chair -- No report. 7-b. Director -- Rogers reported the Parks 8~ Recreation Department office was moved to the crew building (address is 410 North Willow Street, cell phone 394- 2609, land line will be knoum in the near future); summer activities and work was going well; a sizable softball tournament would be held over the weekend and a number of others during the remaining summer. ?-c. City Council Liaisoa -- Porter reported the Home Depot ceremony was well attended and their representatives stated they planned to be open in January. KMC 1.90 outlines the standard procedures for them. The general procedures apply unless there are s ecific code ' p sections regarding the commission or committee that specify otherwise. KMC 1.90.050 states "All acts o , f boards, commissions and committees are subj ect to the paramount authorit of the Cit Counci " Y y l. The impetus behind this memorandum was a move by a Commission Chair to inde en p dently go out for and craft a request for proposals for management of a cit facilit . In that Y y case, it appeared the Commission Chair intended for the commission to b ass the Cit Coun ' . Yp y cil and Manager and do its own process for the selection of mana~ement of the facilit . Suc . ~, y h a process clearly exceeded the scope of the intended powers of a commission. Of the various commissions, the one with primary inde endent authorit is the . p y Planning and Zoning Commission. That commission has independent authorit under AS 29.40 y and KMC 14.05.010 for the determination of various zoning issues such as rantin of va ' g g r~ances or conditlonal use permits. Those decisions, however, are still sub'ect to a eal to the ,' ~ pp City Council acting as the Board of Adjustment and then the Superior Court. In other areas that commi ' , ssion acts only in an advisory capacity to the city and borough. The other commissions act almost exclusively as adviso bodies. All boards, commissions and committees created by the Council of the City of Kenai, shall consist of seven (7) members who shall be nominated by the Mayor and confirmed by the City Council from ap- plications submitted to the City Clerk. A chairman and vice-chairman shall be selected annually and shall be elected from and by the appointed members. The Mayor and one Council Member elected by the Council as ex-officio members and as consultants of any board, commission or committee, may attend all meetings, but shall have no voting power on the board, comrnission or committee. A member of Council or City administrative staff shall attend all meetings of boards, commissions and committees and supply staff support. 1.90.020 Duties. (a) Members of boards, commissions and commit- tees shall be required to establish policies relat- ing to their respective organization. Tlley shall act in an advisory capaciry to department heads within the City Administration if there are such departments in the City organization that di- rectlv relate to the board, commission or com- mittee. (a) A member of a board, commission or committee must be a resident of the City of Kenai, unless the board, commission or committee is specifi- cally exempted by Council from this require- ment. The member cannot be an officer or em- ployee of the City of Ke~lai. lf any member should move his residence from the corporate limits of the City of Kenai (if applicable), is an officer or employee of the City of Kenai, or shall be elected or appointed as an officer or em- ployee of the City of Kenai, tlle service of such member sl~all terminate immediately. He should be aware that he will serve without salary, but will be reimbursed for all reasonable expenses incurred in connection with this service, only af ter approval by Council. (b) The Beautification Committee, and Harbor, Li- brary, and Parks and Recreation Commissions may at the discretion of the Council have up to two non-resident members each. (Ord. I948- 2002) ~ 1.90.040 Terms. (a) A member of a board, commission or committee shall serve for a term of three (3 ) years, unless the board, commission or committee is specifi- cally exempted by Council from this require- ment. At renewal date, the Mayor, with consent of the Council, can reappoint the member or recommend a replacement. (b) Tl~e terms of the initial board, commission or committee member shall be staggered so that three (3) members will be appointed for one year; two members wi11 be appointed for two years; and two members will be appointed for three years. Terms shall commence on January 1 of each year. 1.90.050 Proceedings. ~a) All boards, commissions and committees wiil have regularly scheduled meetings which shall (I~enai 9-7.021 j ~ 1 .70~ v~o be open to the punlic. All acts of boards, commissions and com- Y mittees are subject to the paramount authority of the City Council. (b) If the commission, committee or board member shall be absent from more than one-half of all the meetings of his/her committee, commission or board, regular and special, held within any period of three (3 ) consecutive calendar months, he/she shall thereupon cease to hold the seat. (Ord. 161 Q-94) (c) In all matters of parliamentary procedure. Robert's Rules of Order as revised shal i be ap- piicable and govern all meetings, unless as specified in KMC 1.15.Ob0 motions; KMC 1.15.100, speaking; and KMC 1.15.110, voting. (d) The responsibility of insuring that all members of boards, commissions and committees receive a copy of the Standard Procedures of Boards. Commissions and Committees lies with the Ciry Clerk. 1.90.060 Specific requirements of boards, commissions and committees. Requirements of boards, commissions and com- mittees as set forth in KMC 1.90 are general re- quirements and shall be followed to the extent that they do not conflict with specific requirements found in code sections specifically pertainin~to individual boards, commissions and committees. (Ords. 12?3, 1239) ~ 3 (Kenai 9-7•02) 14,05.010 Chapter 14.05 PLANNING AND ZOMNG C~MMISSION Sections: 14.05.010 Duties and powers. - 14.05.020 Fees. 14.05.010 Duties and powers. (a) The Commission shall be r~quir~d to perform the following duties: (1) Review and act upon requests for vari- ance permits, conditional use permits, planned unit residential development permits, and other matters requiring con- sideration under the Kenai Zoning Code. (2) Interpret the provisions of the Kenai Zoning code and make detenninations when requested by the A''strative Official. (3) Review the C~ty of Kenai Comprehensive Plan on an annual basis and conduct a minimum of one public hearing. Said recommendations shall be forwarded to the Council for considerarion. (4) Pr+omote public interest and understanding of conaprehensive planning, platting, zoning, land management, and other issues relating to community planning and development (5) Proposed plans for the rehabilitation or redevelopment of any ar~a or district within the Ciry. (6) Perfonn historic preservation r~eviews and duties as set froth in KMC 14.20.105. (b) The Commission shall act in an advisory ca- pacity to the Kenai City Council regarding the following ma~ers: (1) Kenai Zoning Code and Official City of Kenai Zoning Map amendments. (2) City and airport land lease or sale peti- tl0I1S. (3~ Capital Improvements Programmin$. The Commission shall submit annually to the Council a list of recommended capital impr~ovement~ which, in the opinion of the Commission, are necessary and desir- able to be constructed during the forth- coming three-year period. Such list shall be arranged in order of pr~ference, with recommendaltions as to which projects shall be constiucted in which year. (c) The Commission shall act in an advisory ca- pacity to the Kenai Petiinsula Borough Plan- ning Commission regarding the following mat- ters: (1) Subdivision Plat proposals. (2) Right-of-way and easement vacation petiaons. (3) City of Kenai Comprehensive Plan amendments. (KMC 14-3; Ot~s. 155, 403, 1018, 1161, 1179, 1892-2000) 14.05.020 Fees. In order to defray the expenses connected with the consideratiion of applicaations for variances and conditional use pernaits, the person presenting the application shall pay to the City Clerk a fee in the amount of one hundr~d dollars ($100.00). A fee in the amount of one hundred dollars ($100.00) shall accompany an application for amendment to the Kenai Zoning Code or Official Map. Whether an application is granted or denied by the Commission, the peritioner or applicant shall not be entitled to the retum of the fee paid. (a) The Commission shall be required to do the following: (1) Develop, adopt, alter, or revise, subject to . approvai by the City Council, a master plan for the physical development of harbor or port facilities for the City. Such master plan with accompanying maps, plats, charts, descriptive, and explanatory matter, shall show the Conunission's recommendations for the development of the City Harbor facilities may include, among other things: (i) development of the type, location, and sequence of all public harbor facilities; (ii) the relocation, removal, extension, or change of use of existing harbor (4 j Act in the capacity as directed and autho~ rized by a tidelands ordinance adopted by the City. (5) Review all City leases of City-owned tide, submerged, and lands or navigable waters within the City, ann as to the planned improvements proposed and make recommendations to the City Coun- cil. (6) Make and prepare reports and plans for approval by the City Council. (7) Coordinate public efforts, individual and group, to the effectuation of approved plans. This may include: (1) Develapment of type, location and se- quence of all airport terminal facilities; (2) Development and use of all airport aero- nautical lands. (b) Observe, oversee and guide in an advisory capacity, any matters relating to use of airport runways, ailport terminal, and airport aeronauti- cal lands. (c) Act in an advisory cap~ciry to the Council and the Airport Manager. Z1.25.020 Qualifications. Members of the Airport Commission will con- form to the requirements of the City of Kenai Boards, Commissions, and Committees Standard Procedures as established by KMC 1.90, except that members of the Airport Commission need not be residents of the City of Kenai. The Commission shall compnse of seven (7) members who shall be chosen so as to represent broadly the following areas: (a) One member, fixed base operator (FBO) (b) One member, lessee of airport aeronautical lands or terminal facility. (c) One member, with expertise in Feder~l Avia- tion Adminis~ation functions. (d) One member, representing the Civil Air Patrol.
