FROM: ~ Ca R. Graves '

DATE: August 27, 2003
RE: Commission and Committee Powers
The Council asked me to write a memorandum regardin the owers of the va ' '
~ p nous city
commissions and committees (hereinafter "commissions"). KMC 1.90 outlines the
standard
procedures for them. The general procedures apply unless there are s ecific code '
p sections
regarding the commission or committee that specify otherwise. KMC 1.90.020 a sta
( ) tes that
commissions and committees "shall act in an advisor ca acit to de artment heads w' '
. „ p Y p ithln the
City Administration. (Emphasis added.) KMC 1.90.050 states "All acts o
, f boards,
commissions and committees are subj ect to the paramount authorit of the Cit Counci "
Y y l.
The impetus behind this memorandum was a move by a Commission Chair to inde en
p dently go
out for and craft a request for proposals for management of a cit facilit . In that
Y y case, it
appeared the Commission Chair intended for the commission to b ass the Cit Coun '
. Yp y cil and
Manager and do its own process for the selection of mana~ement of the facilit . Suc
. ~, y h a process
clearly exceeded the scope of the intended powers of a commission.
Of the various commissions, the one with primary inde endent authorit is the
. p y Planning and
Zoning Commission. That commission has independent authorit under AS 29.40
y and KMC
14.05.010 for the determination of various zoning issues such as rantin of va '
g g r~ances or
conditlonal use permits. Those decisions, however, are still sub'ect to a eal to the ,'
~ pp City Council
acting as the Board of Adjustment and then the Superior Court. In other areas that commi '
, ssion
acts only in an advisory capacity to the city and borough.
The other commissions act almost exclusively as adviso bodies. The sub'e
~Y y, ~ ct to council
approval, adopt master plans for the physical development of facilities and some of them
(e.g.
Library, and Parks and Recreation) also make adviso recommendations as to h' '
d ~Y lring of a
epartment head. The dutles of the vanous commissions are in the code as follows: 1 Plannl
