RESOLUTION NO. PZ12-17
SUBDIVISION PLAT
A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF THE CITY
OF KENAI RECOMMENDING THAT THE ATTACHED SUBDIVISION PLAT BE
APPROVED SUBJECT TO THE FOLLOWING CONDITIONS:
WHEREAS, the attached plat Baron Park 2012 Addition as referred to the City of
Kenai Planning and Zoning Commission on June 14, 2012, and received from
WHITFORD SURVEYING.
WHEREAS, the City of Kenai Planning and Zoning Commission finds:
1. Plat area is zoned Education & Light Industrial and therefore subject to said zone
conditions.
2. Water and sewer: Ct water & sewer are available to serve this subdivision.
3. Plat does not subdivide property within a public improvement district subject to
special assessments. There is not a delinquency amount owe_ d to the City of Kenai for
the referenced property.
4. Installation agreement or construction of improvements is not required.
5. Status of surrounding land is shown.
6. Utility easements, if required, shall be shown.
7. Plat shall verify that no encroachments exist. If an encroachment exists; plat does not
create nor increase the encroachment.
8. Street names designated on the plat are correct.
9. CONTINGENCIES:
NOW, THEREFORE, BE IT RESOLVED, THAT THE PLANNING AND ZONING
COMMISSION OF THE CITY OF KENAI RECOMMENDS THE KENAI

MOTION:
Commissioner Knackstedt MOVED to approve PZ12-17 and Commissioner Bryson
SECONDED the motion.
City Planner Kebschull reviewed the staff report included in the packet, recommending
approval with no contingencies.
Twait opened the meeting to public comment. There being no one wishing to speak,
the public hearing was closed.
General discussion occurred.
VOTE: MOTION PASSED UNANIMOUSLY.

This plat reconfigures Baron Park Subdivision Fire Addition from three lots into five lots,
vacates a portion of Magic Avenue and associated utility easements, dedicates an
extension of Magic Avenue, and dedicates utility easements to accommodate existing
water and sewer mains. The resulting lots range in size from approximately 6.2 acres to
9.8 acres. Tract 113 of Baron Park 2008 Replat is included in this subdivision because of
the partial vacation of Magic Avenue. The parcels in this subdivision are zoned
Education and (IL) Light Industrial. The minimum lot size in the Education zone is
20,000 square feet. There is no minimum lot size for lots in the Light Industrial zone.
The City is in the process of requesting a rezone for existing Baron Park Subdivision Fire
Addition from the Education zone to Light Industrial.

Tracts 4, 5 and 6 will be accessed off Marathon Road. Tracts 2 and 3 will be accessed off
Magic Avenue. The plat includes dedication of an extension of Magic Avenue to provide
access to Tract 2. Tract I is accessed off the Kenai Spur Highway. Marathon Road is
maintained by the City to the intersection of Willow Street. The Kenai Spur Highway is
maintained by the State of Alaska. The City will construct Magic Avenue. Magic
Avenue will be maintained by the City of Kenai.
This is a City of Kenai development. Water and sewer will serve all lots. Water is
available and sewer will be extended to Tract 2. The extension of Magic Avenue will be
built to City standards.
An installation agreement will not be required. The purpose of an installation agreement
is to ensure that infrastructure in new subdivisions is completed so the City does not have
to assume responsibility for construction of the utilities and roads. Because the City is
the property owner, an installation agreement would serve no purpose.
RECOMMENDATIONS
This plat reconfigures Baron Park Subdivision Fire Addition from three lots into five lots,
vacates a portion of Magic Avenue and associated utility easements, dedicates an
extension of Magic Avenue, and dedicates utility easements to accommodate existing
water and sewer mains. The resulting parcels meet all zoning requirements. The parcels
are located off Marathon Road, Magic Avenue, and Kenai Spur Highway. The parcels
will be served by City water and sewer. An installation agreement is not required.
Recommend approval as submitted.
