KENAI PLANNING F, ZONING COMMISSION REGULAR MEETING, NOVEMBER 13, 1974 7:00 P.Nf., CITY r1ANAGER'S OFFICE RON MALSTON, CHAIRMAN The regular meeting of the Kenai Planning. and Zoning Commission was cal-led to order at 7:00 p.m. by Chairman Ron Malston. ITEM 1: -ROLL CALL Members Present - Beverly Fillio, Harry Gaines, Betty Glic Clifford Heus, Nels Kjelstad, Ron Malston,.and Jon Nelson.- Also Present - C. R. Baldwin, City Attorney ITEM 2: APPROVAL OF MINUTES, NOVEMBER 4, 1974 The minutes of the special .meeting. of November 4, 1974,. were approved unanimously. '~ ITEM 3: OLD BUSINESS a. - Administration Report - Conservation Zone Kenai R1ver ri ge rea A letter and report .from Alan Boraas of the Kenai Peninsula Community College to the City Manager was distributed to the.. members of the Commission. Chairman Malston stated that. he felt the information contained in this report was_for informational use only at this point. Nels Kjelstad moved that a copy of the report be forwarded on to Mrs. Mary'Willets and the Mayor's Committee on History and Tradition... Beverly Fillio seconded the motion. The motion was approved unanimously by the Commission. .The Commission requested that 'City Administration continue investigation into. the matter and keep the .Commission .advised as to the progress of the situation. b. - 2 - Ap lication for lease (re-submitted) Coo k-Inlet Industrial Par Reference was made to the Planning and Zoning. Commission meeting of September 25, 1974, where Commission members referred the matter to Administration with the following recommen- dations: 1. Separate .lease for each lot. 2. A minimum of .03 cents per sc{. ft. if they build right away. 3. Development plans should be completed before Planning Commission approval. 4. One. year for substantial improvements .and completion of all building within two years. 5. Payment of all assessments or make an in-lieu of tax payment, if due. Though a letter from the City Manager was } sent to Cherries ~ Cherries outlfining the above,. the application was re-submitted in .its original form for Commission approval. but again members had certain reservations regarding the lease and the following action was :taken. Jon Nelson moved that the lease be referred once again to Administration and that the City Manager contact Cherries ~ Cherries and reiterate the recommendations from the .meeting of September 25 and also furnish Cherries ~ Cherries with a copy of the Kenai City Ordinance that refers to the specifications for building in an area zoned as light industrial. Also, that a one (1) year `lease be given at present until the evaluation of lease rates is"completed and at that time a new lease .can be renegotiated fora longer period of time. Commission requests a re-submitted lease application which would include in the development plan a plan frame -for construction and a blue print or some way that Planning F~ Zoning can judge the structure for architectural uniformity and that the. lease include. the stipulation of one (1) ~ year for substantial improvements and com- pletion of all .building .within two years ,from date that lease is granted. - 3 - ITEM 4: The motion was seconded by Betty Glick. Motion approved unanimously by the Commission. Commission also requested that the City Manager re-adjust the lease rate to Cheerier ~, Cherries as the lease rate of .015 as first quoted to them is unrealistically-low and should not be less than x.03 per sq. ft. NEW BUSINESS: a. ~ Announcement of Public Hearing (12/11/74). The Commission requested that Administration report as to why ARCO is building a structure prior to a Public Hearing being held or approval of rezoning by the Borough.: The Public Hearing will be held at City Hall on December 11, 1.974, for rezoning of Radar Subdivision to light industrial. I b. Tide Lands Ordinance City Attorney, Rick Baldwin, asked Commission members to review the Tide Lands Ordinance and submit their comments and. recommendations. Jon Nelson moved to defer this to the next regular meeting which would give. members an opportunity to .read the Ordinance and take action. upon it at that time. The motion was seconded by Nets Kjelstad. Motion approved unanimously by the.Commission: c. City Lands Ordinance Ciry Attorney, Rick Baldwin, informed the Commission that he .felt it advisable that it be written out as to City of Kenai's present procedure €or disposing of City owned Lands, .(leasing or selling). Commission members were asked to read and comment on the proposed Ordinance and .offer their suggestions and recom- ~ mendations at the next regular meeting. ... i.~> 4 _~ d. Proposed Zoning .Ordinance A Work Session was held on the proposed Zoning Ordinance.
