V1°ll°11JA1VLV SPECIAL MEETING SEPTEMBER 29, 1976 CITY-MANAGER'S OFFICE 6:00 P.M. ROLL CALL Present: Rona°I~lalston, Roland Raymond, Cliff Heus and Betty Glick Absent: Nick Miller and Mike Hamrick Ex-Officio Member Present: Ed Ambarian Approval of Construction of Permanent O'ffi'ce Facility: Peninsula Moblie Home Sales Peninsula Mobile Home Sales had been given a temporary permit by the Commission to use their present office facility until April 28, 1976, at which time a permanent structure would-have to be built. Peninsula Mobile Home Sales had been contacted by the City Administration to bring the Commission up to date on their plans for construction of a permanent office facility. Mr. Joe Becker, Manager of Peninsula Mobile Home Sales in Kenai, stated that the delay in construction had been caused by tia.rnover in management and that Peninsula Mobile Home Sales wished to concur with the Commission's requirements. Mr. Wayne Green of Peninsula Mobile Home Sales stated that the building they wished to construct was a modular home. The frame is taken off of the wheels and placed on a permanent foundation. The building would be used for an office and a residence for the night watchman. There are approximately $3/4 million worth of mobile homes on this lot and they need someone on the premises to pr..otect:.ther``.nvestment against theft and vandalism. The building will be brought to the site by road and can either be towed or placed on a low-boy. Mr. Malston asked the difference between a modular home and a mobile home. Mr. Johnson stated that a modular could be placed on a permanent .foundation. Councilman Ambarian read the definition of a mobile home as it appears in the zoning ordinance and stated that according to the ordinance, the Commission could not grant permission to Peninsula Mobile Hame Sales to use this unit. According to the ordinance, this is a mobile home whether or not it is placed on a permanent foundation. Mr. Corella of Peninsula Mobile Home Sales showed the Commission plans of the proposed building. Councilman Ambarian stated that if the Commission granted usage of this structure as a permanent structure, they should consider changing the zoning ordinance. Mr. Green stated that this structure met the requirements of the City Building Inspector. 1~~1VA1 YLHLV1V11V1i at GV1V11V1i l:Vl"11~11b~1V1V SPECIAL MEETING SEPTEMBER 29, 1976 Mr. Heus asked why businesses were not allowed in mobile homes. Mr. Malston stated the Fire Department had requested that. they not be used because of fire safety reasons. Since 1971,. the State has implemented codes concerning mobile homes and modulars comply with 'the Uniform Building Codes. Mr. Green, stated that electrical standards have become more stringent in recent years than they were in the past for mobile homes. Mr. Heus asked if this building had to meet fire codes for a public building. Page 2 MOTION: Mr. Malston moved,. seconded by Mr. Heus, that the Commission grant approval of use of this modular unit, set on a permanent .foundation, by Peninsula Mobile Home Sales for a combination office and residence at their mobile home sales lot in Kenai, with the following stipulations: 1. That the Fire Department approve the fire safety standards of this unit for use as a public building. 2. That it is the intent of the Commission to redefine mobile home in the zoning ordinance. Mr. Heus stated that a problem might arise if someone in the. area wished to put in the same type unit as a home. ~ Councilman Ambarian stated that he was sure that requirements for newly constructed mobile homes were greater than they had been in the past,and he could see no problem with this type of structure being used as a home. Mr. Green stated that Howard Hackney, City Building Inspector, had discussed this matter with officials in Anchorage and found that the structure met the necessary requirements. AMENDMENT: Mr. Raymond moved, seconded by Mr. Malston, that the main motion be amended with the addition of the following: 3. That this structure meets the building codes for a conventional built structure. Motion passed unanimously by roll call vote. QUESTION - MAIN. MOTION: Motion passed unanimously by roll call vote. Work Session: Rezoning of Government Lot 1, Section 5, Township 5N, R 11W The Commission discussed the possibility of rezoning the above described lot so that the property could be used in a commercial capacity. Mr. Wise had stated that the Commission should consider KENAI PLANNING & ZONING COMMISSION SPECIAL MEETING .SEPTEMBER 29, 1976 Page 3 rezoning a strip on either side of the highway in this are to avoid spot zoning. After further discussion the Commission determined that the portions outlined on the attached map would be rezoned to general commercial. Mr. Wise stated that the City Administration would pursue this matter. Approval of Minutes of September 8, 1976 and September 9, 1976 MOTION: Mr. Malston moved, seconded by Mr. Raymond, that the Commission approve the minutes of September 8th as distributed and the'.m.inutes of September 9; 1976 with the following additions and corrections: 1. Check tape for last paragraph on Page 7,and first paragraph on Page 2. 2, Page 3, Paragraph 4, should read "on his" instead of "next to his". 3. Page 4, Paragraph 2, should be rewritten to be more coherent. Motion passed unanimously. Other Business Mrs. Horton advised the Commission that she had been contacted regarding the correct zone for a day care center for preschool age children. The center would not be in a home and there'.is no j provision for a day care center except as a home occupation in the zoning ordinance. Mrs. Horton asked the opinion of the Commission in this regard. It was the consensus of the Commission that an urban. residential zone would be most satisfactory zone for this use, but that a conditional use permit would be required. Councilman Ambarian stated that the Airport Advisory Committee had their first meeting on September 28th. Mr. Hamrick was not present as representative of the Planning Commission. A representative from the FAA Planning Department was there along with representatives from the firm doing the Airport Study. Adjournment MOTION: Mr. Raymond moved, seconded by Mr. Malston, for adjournment of the September 29, 1976 meeting of the Kenai Planning & Zoning Commission. Motion passed unanimously.
