HomeMy WebLinkAboutResolution No. 2025-35goal 0 - LOJO]l1r.421 WHEREAS, both the City and the Tribe have resources, knowledge, and professional expertise that can support efforts in areas of mutual concern such as community development, education, cultural preservation, environmental protection, and economic growth; and, WHEREAS, the proposed MOU establishes a framework for cooperative engagement between the City and the Tribe, including provisions for regular communication, designated liaison contacts, and the opportunity to develop joint initiatives; and, WHEREAS, the City Council recognizes the value of formalizing a government -to -government relationship that encourages mutual respect, continued partnership, and shared goals that serve the Kenai community as a whole. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA: Section 1® That the City Council approves the Memorandum of Understanding between the City of Kenai and the Salamatof Tribe. Section 2. That the Mayor is authorized to execute the Memorandum of Understanding. Section 3® That this Resolution takes effect immediately upon passage. The attached Memorandum of Understanding (MOU) between the City of Kenai and I e document establishes a foundation for continued dialoguecoordinaona development, economic initiatives, cultural and historical preservation, environmental protectio and the coordination , of public services. It is designed to support future partnerships encouraging proactive discussions and cooperative planning. I Approval of this agreement reflects a mutual commitment to working together in the interest the greater i community. It provides a respectful and practical framework for ongoedInr ,?.nd shared success. This Memorandum of Understanding is made and entered into by and between the City Kenai (City) and the Salamatof Tribe (Tribe) to recognize areas of mutual concern I Both the City and the Tribe have responsibilities and interests in the establishment of cooperative relationships that meet the needs of both City and Tribal governments. The City, in managing municipal affairs, has information and resources beneficial to the Tribe. The Tribe, in managing tribal affairs, has information and resources beneficial to the City. It is the desire of both parties to cooperate concerning the legal and political matters inherent in a government — to - government relationship. Make Tribal resources, lands and professional expertise available for the furtherance of cooperative relationships envisioned by this agreement, subject to the applicable tribal and federal laws and regulations, as well as the approval of the Salamatof Tribal Council. 2. Cooperate in the planning, implementation and monitoring of project work undertaken pursuant and supplemental to this agreement. Make Municipal resources, lands and professional expertise available for the furtherance of cooperative relationships envisioned by this agreement, subject to the applicable municipal, state and federal laws, as well as the approval of the Kenai City Council. Cooperate in the planning, implementation and monitoring of project work undertaken pursuant and supplemental to this agreement. Assign a Municipal liaison officer who shall be responsible for routine activities between the City and the Tribe. The parties will meet at least annually to develop guidelines for cooperative relationships and proposals to meet the purposes of this agreement, including, but not limited to: a. Zoning and development of areas important to the respective governments; C. Protection of the environment and customary and traditional hunting, fishing, and gathering; d. This agreement in no way restricts the parties from participating with othM public and private agencies, organizations, and individuals, or from accepti contributions and donations for other similar agreements or projects. 5. l Nothing in this agreement shall obligate either the City or the Tribe ependite for fdsor by ftetf nee i respective governments. Memorandum of Understanding Page 2 of 3 The City and Tribe agree, at a minimum, that each government will FM responsible for its own acts and the results thereof; shall not be responsib for the actions of the other party; and each party agrees it will assume itself the risk and liability resulting in any manner under the terms of th agreement. 1� The duration of this agreement is perpetual, until and unless revised or terminated pursuant to the terms of this agreement.
