ROLL CALL Present: Roland Raymond, Ron Malston, Cliff Heus, and Sharon Loosli Absent: Milton Stasek, and Nick Miller Ex-Officio Member Present: Betty Glick Others Present: City Manager John Wise, Loretta Knackstedt, Ruby Coyle, .Waldo Coyle, and John Williams 2. PUBLIC HEARING A. Ordinance 77-22: Rezoning within the City of Kenai Mr. Raymond stated that Ordinance 77-22 requested the rezoning of U. S. Government Lot 2; South one-half of U. S. Government Lot l; the South 165 feet of the West 524.06 feet of the North 660 feet of U. S. Government Lot l; Tract 3 of Killen Estates Addition No. One,• Northgate Subdivision Part One; and, the NWl/4SE1/4NW1/4 and the SWl/4NE1/4NW1/4, all located in Section 31, Township 6 North, Range 11 West, Seward Meridian, from Rural Residential (RR) District to Suburban Residential (RS) District. Mr. Raymond explained where these areas were on tree City map and proceeded to open the hearing to the public. Mrs. Knackstedt asked if the zoning change in this area would effect the tax status of this land. Mr. Wise stated that the tax status would-only change when the land was subdivided into separate lots. Mrs. Coyle asked about the adequacy of the water and .sewer facilities that would service this area. Mr. Williams stated that he felt that this was an awful large area to be rezoned without knowing the adequacy of the water and sewer facilities in this area and that he felt that only the areas that already have. water and sewer to the property should be rezoned at this time. Mr. Wise stated that presently a Sewer Treatment Plant Study is being done, and a new well is being worked on in order to meet larger future demands on the City's water and sewer systems. Mr. Raymond asked if there was any further public input. There being no further public input, the hearing was brought back to the Commission for further consideration. ~ Mr. Heus stated that according to Section 21.76.070 of the Kenai Municipal Zoning Code all areas zoned rural residential that are served by approved community water and sewer systems shall automatically be rezoned from rural residential to suburban residential, but that lot size requirements allow for smaller lot size in a suburban residential zone. i\41LK1 i ik1L1L 1117 ullu L 117 VV1LLLll1 JJ.L VL1 Regular Meeting April 27, 1977 (Item 2-A continued) Page 2 The Commission discussed which of these items should come first, the rezoning to allow for smaller lot size, or the water and sewer system. MOTION: Mr. Malston moved, seconded by Mr. Heus, to table Ordinance 77-2 until the next regular meeting of the Advisory .Planning and Zoning Commission meeting and,. in the meantime, have the Public Works Director check on the capabilities of the water and sewer facilities in this area, have the City Attorney check into the legal aspects of the Zoning Code as to which should come first, the rezoning to allow .for smaller lot size or the water and. sewer system; and request that the Borough table any action on this item until further recommendations are received from -the Kenai Advisory Planning and Zoning Commission. Motion passed unanimously by roll call vote. B. Ordinance 77-24: Rezoning within the City of Kenai Mr. Raymond stated that Ordinance 77-24 requested the rezoning of Tracts 16A, 31, 32, 33, 34 and 35 of Killen Estates Addition No. One, from Rural Residential (RR) District to Suburban Residential (RS) District. Mr. Raymond explained where this area was on the City map and proceeded to open the hearing to the public. Mr. Williams stated that. this was the same situation as the previous item 2-A and that he felt that this should be handled in the same way. Mr. Raymond asked if there .was any further public input. There being no further public input, the .hearing was brought back to the Commission for further consideration. MOTION: Mr. Malston moved, seconded by Mrs..Loosli, to table Ordinance 77-24 until the next regular meeting of the Advisory Planning and Zoning Commission meeting and, in the meantime, have the Public Works Director check on the capabilities of the water and sewer facilities in this area and have the City Attorney check into the legal aspects of the Zoning Code as to which should come first, the rezoning to allow for smaller lot size or the water and sewer system. Motion passed unanimously by roll call vote. 3. AGENDA APPROVAL MOTION: Mr. Malston moved, seconded by Mrs. Loosli, that the Commission approve the agenda of the April 27, 1977, meeting. APPROVAL OF MINUTES OF APRIL 13, 1977 MOTION: Mr. Hews moved, seconded by Mrs. Loosli, that the Commission approve the minutes of the April 13, 1977, meeting. Motion passed unanimously. 5. OLD BUSINESS A. Kay Lynn Subdivision: Final Plat MOTION: Mrs. Loosli moved, seconded by Mr. Heus, that the Commission adopt Resolution No. PZ 77-8 recommending approval of Kay Lynn Subdivision, Final Plat subject to the fallowing conditions: correction of negative findings of item 10. 10. Lots are not identified by street addresses in accordance with City Code. Motion passed unanimously by roll-call vote. B. Request for Variance: Lots 1, 2, and 3, Block 15, Old Kenai Townsite Mr. Raymond stated that City Manager John Wise had received a ` letter from Mr. W. E. "Gene" Kizer on April 21, 1977, requesting that his previous request for variance be withdrawn because he had acquired some extra property and would no longer require the variance. MOTION:. Mrs. Loosli moved, seconded by Mr. Malston, for reconsideration of the Request for Variance, Lots 1, 2, and 3. Block 15. Old Kenai Townsite. Motion passed unanimously.. MOTION: Mrs. Loosli moved, seconded by Mr. Heus, for approval of the Request for Variance, Lots 1, 2, and 3, Block 15, Old Kenai Townsite. Motion failed unanimously by roll call vote. 6. NEW BUSINESS A. Resolution 77-7: Recommending that Certain Property in the Vicinity of the Kenai Spur Highway and Lake Street be Rezoned from Conservation to General Commercial Mr. Wise stated that this area has never been platted and that there is a shortage of commercial property near the downtown area of Kenai and the property in the vicinity of the Kenai Spur Highway and Lake Street, which is currently'zoned.Conservation, would be prime commercial property. Mr. Wise also stated that this property is currently zoned Conservation because of the natural drainage running through the center of this area and, since this land is owned by Kenai Planning and Zoning Commission Regular Meeting April 27, 1977 (Item 6-A continued) Page 4 the City of .Kenai, the City can control the development of it so as not to interfere with the natural drainage.. Also, the property adjacent to this is being used .for commercial purposes so this property is a logical extension of the present commercial development of Kenai and there is interest in development of this property for commercial purposes. MOTION: Mrs. Loosli moved, seconded by Mr. Malston, that the Commission set up a Public Hearing on Resolution No. PZ 77-7 at the next regular meeting of the Kenai Advisory Planning and Zoning Commission on May 11, 1977, so that public input may be gathered. Motion passed unanimously by roll call vote. 7. OTHER BUSINESS A. City Council Report Councilwoman Glick stated that at the meeting of April 20, 1977, Council passed a personnel ordinance stating that City employees do not have to live within City Limits. City Council also approved the lease applications for Andy°s Flying Service and Phil Evans.' dry storage. The City Attorney also reported to the Council that there was an appeals conference held with the Kenai Baptist Temple in the Judge's chambers and since Kenai Baptist Temple has sold their building, there is no longer an issue for litigation, so the Judge urged the parties to settle and he will review the case in 30 days. B. Borough Planning and Zoning Commission Report Mrs. Glick stated that at the ,April 25, 1977, meetinct of the Borough Planning and Zoning Commission a public hearing was held on the Resolution regarding changes in the Kenai Municipal Zoning Code. Mrs. Glick stated that five people testified, all were against the changes, and the Borough decided to return the resolution to the City for review. C. Harbor Commission Report Mrs. Glick stated that the Commission had not met since the last meeting and that no future meetings were scheduled so this item could be deleted from the agenda. D. Administrative Report Mrs. Kidd reported on the Public Works Director Phil Aber's comments regarding the Kenai Peninsula Borough Planning Commission's Resolution No. 77-4 concerning dedication of temporary turnarounds and stated that he hoped to be able to offer some recommendations of alternatives for temporary turnarounds at the next regular meeting of the Kenai Advisory Planning and Zoning Commission. 8.
