ROLL CALL Present: Roland Raymond*, Ron Malston, Nick Miller, Cliff Heus, and Sharon Loosli Absent: Milton Stasek Ex-Officio Member Absent: Betty Glick Others Present: John Williams 2. PUBLIC HEARING A. Resolution PZ 77-7: Recommending that Certain Property in the Vicinity of the Kenai Spur Highway and Lake Street be Rezoned-from Con's'ervation to General Commercial Mrs. Loosli explained where this area is on the City map and then opened the hearing to the public. Mr. Williams stated that he was in favor of rezoning for commercial development in this area with the thought kept in mind of protecting the natural green strip. There being no further public input, the hearing was brought back to the Commission for further consideration. MOTION: Mr. Malston moved, seconded by Mr. Heus, that the Commission adopt Resolution PZ 77-7, recommending that certain property in the vicinity of the Kenai Spur Highway and Lake Street be rezoned from Conservation to General Commercial. Motion passed unanimously by roll call vote. 3. AGENDA APPROVAL Mrs. Kidd stated that there would be an addition to the agenda of Item 6-D, Inquiry into Status of Zoning in Beaver Creek Alaska Subdivision, Mr. Phil Ames. MOTION: Mr. Heus moved, seconded by Mr. Malston, that the Commission approve the agenda with the addition of Item 6-D as stated. Motion passed unanimously. APPROVAL OF MINUTES OF APRIL 27, 1977 I Mr. Miller stated that he was not present at the April 27, 1977, meeting of the Planning and Zoning Commission. MOTION: Mr. Malston moved, seconded by Mr. Heins, that the Commission approve the minutes of the April 27, 1977, meeting with the above stated correction. Motion passed unanimously. ,i 5. OLD BUSINESS A. Ordinance 77-22: Rezoning within the City of Kenai The Commission reviewed the written comments of the Public Works Director which stated that at this time the water and sewer mains supplying Forest Drive and Redoubt Avenue are adequate for what appears to be the planned development of this area. The Commission also reviewed the written comments of the City Attorney which stated that there was nothing to prevent a normal rezoning of this area because section 21.76.080 of the Zoning Ordinance states that "the RS zone ~ is .intended to provide for medium density residential ~ development in areas which will be .provided with common utility systems." MOTION: Mr. Malston moved, seconded by Mr. Heus, that the Commission recommend approval of Ordinance 77-22. Motion passed unanimously by roll call vote. B. Ordinance 77-24:~ Rezoning within the City of Kenai Mr. Heus stated that Ordinance 77-24 was tabled for the same reason as Ordinance 77-22 and that the written comments of the Public Works Director and the City Attorney applied to both items. MOTION: r~r. Malston moved, seconded by Mr. Heus, that the Commission recommend approval of Ordinance 77-24. Motion passed unanimously by roll call vote. Inquiry into Placing a Temporary Trailer on the Moose Range Headquarters Property for the Summer Help Mr. Richey stated that U.S. Fish and Wildlife would like to bring their field trailer in from the Moose Range and place it next to the regular bunk house at the Kenai Moose Range Headquarters temporarily to provide more facilities for their summer help. Mr. Richey stated that this would be for the summer only, and then the trailer would be moved back out to the Moose Range. MOTION: Mr. Heus moved, seconded by Mr. Malston, to grant U.S. Fish and Wildlife a conditional use permit allowing them to place their field trailer at the Kenai Moose Range Headquarters from May 1, 1977, to December 1, 1977. Motion passed unanimously. B. Cottonwood Circle: Preliminary/Final Plat MOTION: Mr. Heus moved, seconded by Mr. Miller, to adopt Resolution PZ 77-10 recommending approval of Cottonwood Circle, Preliminary/Final Plat subject to the following conditions: correction of negative findings of items 7, 9, and 10. '~ 7. No copies of the agreements between the City of Kenai and the subdivision owner for the provision of utilities and amenities such as, but not limited to, public water, sanitary sewers, storm sewers, road(s), street lights, paving, curbs and gutters in accordance with City standards have been reviewed. 9. Utility easements, if required, are not shown. 10. Lots are not identified by street addresses in accordance with City code. Motion passed unanimously. C. Resolution PZ 77-9: Recommending that Certain Property, Specifically Lot 1, Section 35, and Lot 2, Section 36, T6N, R12W, SM, be Rezoned from Rural Residential (RR) to Urban Residential (RU) MOTION: Mr. Malston moved, seconded by Mr. Miller, that the Commission table Resolution 77-9 at this time. Inquiry into Status of Zoning in Beaver Creek Alaska Subdivision: Mr. Phil Ames Mr. Phil Ames was not present to ~aresent this item to the Commission. MOTION:* Mrs. Loosli moved, seconded by Mr. Malston, for reconsideration of Item 6-C. Motion passed unanimously. The Commission recommended that since this is State owned land they would like to have the City Administration contact the State authority that has control of this land and inquire as to their intentions regarding the use of this land; also making note that the City feels that this is prime land for Commercial or high density residential development, particularly in view of the close proximity of the established water and sewer. 7. OTHER BUSINESS A. City Council Report '~ As Councilwoman Glick was not present, there was no report given. B. Borough Planning and Zoning Commission Report. As Mrs. Glick was not present, there was no report given. C. Administrative Report Mrs. Kidd reported that Mrs. Glick's appointment as the Borough Planning and Zoning Commission Representative to the City of Kenai Advisory Planning Commission is up on June 30, 1977, so the City of Kenai Advisory Planning and Zoning Commission members should consider someone to fill this position. 8. ADJOURNMENT MOTION: Mr. Malston moved, seconded by Mr. Miller, that the Commission adjourn the May 11, 1977, meeting. Motion passed unanimously. Depending on future development, construction, and zoning, the `adequacy of these mains will need to be reevaluated at some point in the future. Zoning Commission FROM: City Attorney DATE: May 11, 1977 SUBJECT: Rezoning of 90 acres You have asked my opinion. as to the meaning of Section 21.76.070 c. 3. d., Kenai Peninsula Borough Code of Ordinances. This section, which provides for automatic rezoning of areas served by water and sewer from rural residential to suburban residential, is particularly troublesome in view of the fact that there are no procedures for this kind of rezoning in the zoning ordinance. Since there are none, we have been using the normal legislatitiTe rezoning procedures. If we intend to retain this section, some soxt of procedures for administrative rezoning need to be set up. The rezoning would be done only upon application by . the owners of all the land to be rezoned. It is my opinion that this section provides far after the fact rezoning of an area where individual lots are serviced by water and sewer. Where indiv- idual lots are so serviced, the primary reason for a rural residential zone no longer exists; that is, the prevention of health hazards in areas not served by public water and sewer. The rezoning you are now considering does not, in my opinion, come under the section in c{uestion. Since you are going through. the normal legislative procedures for rezoning, with public hearings and action by the Borough Assembly, nothing prevents you from recommending a normal rezoning of the area. For a normal rezoning there is no requirement that an area already be served by water and sewer. Section 21.76.080 states that "the RS zone is intended to provide for medium density residential development in areas which will be provided with common utility systems~Emp~asis added.) You, as the planning commission, must decide if you want to give developers of this area the latitude to plat the land as suburban residential so that water Memorandum May 11, 1977 gage 2 and sewer may be run to individual lots. By recommending that it remain rural residential, you are stating that you wish this area of the City to remain rural and open. JW/eh
