PUBLIC HEARING Ike Waits, Phillip Waring, Craig Freas, Tawna Gray, Chuck Crabaugh, and Kenneth Padget A. Petition to Rezone Lot 1, Block 5, Lots 1 and 12, Block 7, Lot 1, Block 8, Mommsen Subdivision No. 1, and Lot 1, Block 2, Mommsen Subdivision No. 2, Located within the City. of Kenai, From Suburban Residential (RS) District to Urban Residential (RU) District Because this Public Hearing was advertised to be held at 7:30 p.m., the Commission decided to go on to Items 3 and 4 and then return to Item 2-A. 3. AGENDA APPROVAL MOTION: Mrs. Loosli moved, seconded by Mr. Malston, that the Commission approve the agenda of the June 8, 1977, meeting. Motion passed unanimously. 4. APPROVAL OF MINUTES OF MAY 25, 1977 Mrs. Loosli stated that the second paragraph of Item 2-A should read as follows: Mr. Wise pointed out the tentative changes that had already been made to the proposed zoning change. Mr. Malston stated that the motion in Item 5-A should read as follows: Mrs. Loosli moved, seconded by Mr. Malston, to re-elect Betty Glick to the position of Borough Planning and Zoning Commission Representative for the Kenai Advisory Planning and Zoning Commission. MOTION: Mr. Heus moved, seconded by Per. the minutes of the May 25, 1977, Malston, that the Commission approve meeting with corrections as stated. ~ Motion passed unanimously. Petition to Rezone Lot 1, Block 5, Lots 1 and 12, Block 7, Lot 1, Block 8, Mommsen Subdivision No. 1, and Lot 1, Block 2, Mommsen Subdivision No. 2, Located within the City. of Kenai, From Suburban Residential (RS) District to Urban Residential (RU) District Mr. Padget, from Crown Developers, stated that development of this area was planned for this building season. r~r. Padget also stated that Crown Developers would be doing a survey to find out exactly what type of housing is most needed in the community before going ~ ahead with their development. There being no public input at this time, the hearing was brought back to the Commission for further consideration. MOTION: Mr. Heus moved, seconded by Mrs. Loosli, that the Commission recommend approval of the petition to rezone Lot 1, Block 5, Lots 1 and 12, Block 7, Lot 1, Block 8, Mommsen Subdivision No. 1, and Lot 1, Block 2, Mommsen Subdivision No. 2, located within the City of Kenai, from Suburban Residential (RS) District to Urban Residential (RU) District. The Commission also asked that the following items. be noted: 1. There was no public opposition. 2. There is water and sewer available in sufficient Quantities to ~' service this area. 3. There is a wide and paved thoroughfare that is a main arterial in the City of Kenai. 4. The area has a potential for an Urban type of setting because of the existing subdivision and the approved mobile home court. 5. There is no other existing development adjacent to this area that this development will interfere with. Motion passed unanimously by roll call vote. 5. OLD BUSINESS A. Ordinance 77-18: Amending Chapter 21.76 of the Kenai Peninsula Borough Code of Ordinances Pertaining to the Kenai Municipal District Zoning Code Mr. Raymond reviewed all previous action that has taken place regarding Ordinance 77-18 and explained the primary opposition to this ordinance. Mr. Waring, Borough Planning Director, and Mr. Waits, Assistant Borough Planning Director, discussed Ordinance 77-18 with the Commission. Kenai Planning and Zoning Commission Regular Meeting June 8, 1977 (Item 2-A continued) Page 3 Mr. Waring stated that the Commission might take the following items into consideration when reviewing Ordinance 77-18: 1. Increase lot size requirements for multi-family dwellings. 2. Maintain Conditional Use Permits and review each one as it comes through. 3. Go back and draw in some more zoning districts in the City. Mr. Waring also stated that the Borough was considering hiring two more people for the Borough Planning Staff specifically to work with the Planning Commissions. Mr. Raymond stated that the Commission needed to do some more review work on Ordinance 77-18 and that they would like to acquire the help of someone from the Borough Planning Staff on this ordinance. Mr. Waits stated that if someone would contact him, that he or Mr. Waring would try to attend the next work session. Mr. Freas stated that Wince-Corthell would be happy to volunteer their services to the City of Kenai Planning Commission if they should need any technical services in regard to Ordinance 77-18. The Commission stated that they would like to set up a work session for Thursday, June 16, 1977, 7:00 p.m., in the City Manager's office. B. Kenai Peninsula Estates Subdivision: Final Plat MOTION: Mrs. Loosli moved, seconded by Mr. Malston, to adopt Resolution PZ 77-11 recommending approval of Kenai Peninsula Estates Subdivision, Final Plat, subject to the following conditions: correction of negative findings of items 6, 8, and 9. 6. Set back lines are not adequately indicated. (Set back lines should be 25') 8. Utility easements, if required, are not shown. 9. Lots are not identified by street addresses in accordance with City code. Motion passed unanimously. Kenai Planning and Zoning Commission Regular Meeting June 8, 1977 Page 4 6. NEW BUSINESS A. Northgate Subdivision, Addition No. ~: Preliminary Plat MOTION: Mr. Heus moved, seconded by Mrs. Loosli, to adopt Resolution PZ 77-12 recommending approval of Northgate Subdivision, Addition No. 2, Preliminary Plat, subject to the following conditions: correction of negative findings of items 6, 7, 9, and 10. 6. Set back lines are not indicated. 7. Copies of agreements between the City of Kenai and the subdivision owner for the provision of utilities and amenities such as, but not limited to, public water, sanitary sewers, storm sewers, road(s), street lights, paving, curbs and gutters in accordance with City standards have not been received. 9. Utility easements, if required, are not shown. 10. Lots are not identified by street addresses in accordance with with City code. Motion passed unanimously. B. Lease Assignment: Lot lA, Deshka Subdivision, Section 5, R11W, T5N, S.M. Mr. Crabaugh stated that this lease assignment would be a continuation and extension of Costa's lease. Mr. Crabaugh also stated that he planned to use this property for the development of a Readi-Stop Grocery Store. MOTION: Mr. Heus moved, seconded by Mrs. Loosli, that the Commission recommend approval of the lease assignment for Lot lA, Deshka Subdivision, Section 5, R11W, T5N, S.M., to Mr. Crabaugh. Motion passed unanimously. C. Inquiry into Day Care Center in Kenai Miss Gray stated that she had just purchased 2 1/2 acres on Evergreen Street and needed to find out what the requirements would be for building a Day Care Center on the property. The Commission recommended that Miss Gray contact the State agency for the Division of Health and Social Services and find out what their requirements would be for a Day Care Center and then apply for a conditional use permit from the City of Kenai. Borough Planning and Zoning Commission Report As Mrs. Glick was not present, there was no report given. C. Administrative Report As Mr. Wise was not present, there was no report given. The Commission asked that the Administration report on all of the Natural Resource Extractors in the City at the next regular meeting of the Advisory Planning and Zoning Commission on June 22, 1977. 8. ADJOURNMENT MOTION: Mr. Malston moved, seconded by Mrs. Loosli, that the Commission adjourn the June 8, 1977, meeting. Motion passed unanimously.
