Without further sacrifice on your part, we will attempt to address some large questions, - Sincerel , Vincent O'Reilly Mayor VO/eh CITY OF KENAI WORK SESSION - NOVEMBER 2, 1977 6: 00 P.M. - PUBLIC SAFETY BUILDING COMMENTS CONCERNING MAYOR'S MEMORANDUM TO COUNCIL DATED 10-19-77 We should be aware that the intent of the memo and the work session is not to make decisions at this point but to decide on the establishment of the process. Listed here are some general comments concerning Areas 1, II , III , IV and V. AREA I The type of information needed and effort to obtain it is very close to what would be needed in the early phase of the planning for a Comprehensive Plan. I do not believe we should allocate monies even on a matching basis for a Comprehensive Plan. I believe we can get sufficient aid from the Borough, Borough OEDP , the on-going Title IX Strategy Planning Consultant and our own staff, to do it ourselves. AREA II In preparing for the work session and thinking of this area, my thoughts kept turning toward projections, certainly of the base source of revenues and the base source of costs. AREA III The first three items in this heading appear to be the "seat" of some of our present problems, the balance of the items from "Commission relation- ships" downward appear to be in place and working. k. r • WORK SESSION - _.J�-SIBER 2, 1977, Page Two The first two items bring up the problem of "policy". Whatever it is, at what point is it set, how is it changed and who expresses it? A parallel problem is policy and speculative thoughts and premature publicity or partial emphasis causes speculative thought to be stated to the public as policy. Perhaps the Council would wish to enumerate items of concern to the City where no "policy" has been established and anyone in Council or Administration must exercise the .greatest discretion in discussing such items with anyone. AREA IV My conversations with the City Manager indicate this area is in place and under control. Council should periodically review to make sure personnel procedures are in place and functioning. AREA V The last item will be instituted when some sort has been accomplished in Area I. 1 AREA I A. Determination of City's Purpose 1. Are we a retail/commercial center? If so, what size? 2. Are we a "bedroom community"? Where are our people employed, doing what, characteristics of family? 3. How important is Kenai as a transportation center? Obtain measuring data. 4. Is our future controlled by factors within City limits or outside City limits? Define 5. Project where City's population growth will come from? Quantify projections by low growth case, high growth case, and parameters within time frames. B . Inventory 1. Inventory what facilities and services we are providing at present and project what facilities and services will be necessary to meet projections within estimated parameters. 2. . Inventory at a minimum should cover Police, Fire, Emergency Medical Services, Communication, Water -and Sewer, Roads, Planning, Zoning, Library, Airport, Land Sale and Leasing, Animal Control, harbor, General Public Facilities 3. Steps 1 and 2 above should establish what has to be built or what services expanded or initiated. The Council should then be able to decide priorities for providing such. C.. Data The initial data gathering and assembling will have to be done by a planning consultant. Part of the needed information can be obtained by CH2M Hill while they are involved in their present planning effort. Phil Waring, Borough Planning Director, is awart. . our need and agrees that the work should be done. Hopefully, he will be able to offer some planning effort from his Department and the OEDP staff. This twin approach will be pursued by the Mayor and City Manager. D. City Commissions The present City commissions such as Planning, Airport, Harbor, can offer some data to the planning effort and within the framework of what is being sought -- their comment as to future projections. E. Results The results of the findings and projections must be brought to public gatherings for public input prior to finalization. This can be accomplished by public meetings after dissemination of the information gathered and tentative projections. F. Cost Projections Cost projections, both capital and operating, should be made. AREA II Fiscal Means & Capabilities A. Hopefully," the attachment will also allow the following: A. Separate policy formulation and decision making from Administration and implementation. B. Within a framework, allow us all to classify what we are thinking and what is being communicated to us. C. Allow us to pinpoint trouble spots and determine what corrective measures should be taken and by whom. D. Allows for and encourages citizen input and communication at area of their concern. E. Provides a way Council, Manager, and Mayor may focus their particular skills. F. Is wide angled enough to allow for large scale future planning and activities, is detailed enough to make certain daily activities are functioning properly. G. Provides the means by which we may define what City resources allow us to do, what citizens wish done, and how it should be done. H. Can be modified. enlarged, or restricted by us. Conditional Use Permit: River Bend Sand and Gravel Kenai Planning and Zoning Commission Regular Meeting November 9, 1977 (Item 6 continued) Page 2 MOTION: Mrs. Loosli moved, seconded by Mr. Bryson, that the Commission approve the agenda of the November 9, 1977, meeting with additions as stated. Motion passed unanimously. 7. APPROVAL OF MINUTES OF OCTOBER 26, 1977 MOTION: Mrs. Loosli moved, seconded by Mr. Bryson, that the Commission approve the minutes of the October 26, 1977, meeting as written. Motion passed unanimously. *Mr. Raymond stated that Mr. Terry Gose and Mr. Mike Beaumaster could not stay for the complete meeting because they had to catch a plane back to Anchorage, so the item which they wished to present to the Commission (Item 9-A) would be considered first. 9. NEW BUSINESS A. Concept Lease Application: Unplatted Lot Bounded by Ryan's Creek and the Katmai Motel Mr. Gose presented his plans for a Taco Hut on this property and reviewed the plans with the Commission. Mr. Gose explained that his plans were only conceptual and were just strictly an idea so they were very flexible. Mr. Gose stated that they would also be willing to use the lot if it were 150' deep and 200' wide instead of 200' deep and 150' wide, but they would like to lease property on the Spur Highway. The Commission felt that the small piece of land that would be left over should be considered and utilized, along with the property being considered, as one parcel. MOTION: Mrs. Loosli moved, seconded by Mr. Miller, that the Commission recommend approval of the concept lease application for the unplatted lot on the Spur Highway bounded by Ryan's Creek and the Katmai Motel to Mr. Terry H. Gose and Mr. Thomas C. Doctor for a Taco Hut. Motion passed unanimously by roll call vote. Kenai Planning and Zoning Commission Regular Meeting November 9, 1977 Page 3 8. OLD BUSINESS A. Resolution No. PZ 77-14: Amending Chapter 21.76 of the Kenai Peninsula Borough Code of Ordinances Pertaining to the Kenai Municipal District Zoning Code Mrs. Kidd stated that City Attorney Janis Williams had not arrived yet, but that she would like to speak to the Commission regarding Resolution No. PZ 77-14. The Commission decided to hold item 8-A until Miss Williams arrived and go on to item 8-B at this time. B. Brokerage of City Land Mr. Raymond reviewed this item for the benefit of the new members. Mrs. Glick stated that no further action has been taken on this item by the City Council. Mrs. Glick also stated that she would try to get the revised copy of the counter proposal for the brokerage of City land to the Commission by their next meeting so that they may review it. Mr. Raymond asked that this item be placed on the agenda for the next regularly scheduled meeting of the Advisory Planning and Zoning Commission with hopes of having the revised copy of the counter proposal for the brokerage of City lands for the next meeting. C. Kenai Spur - Airport Lease Property: Preliminary/Final Plat Mr. Wise explained that Tract "B" of this plat would be the only property available for lease and that Tract "C" would be maintained by the City. MOTION: Mrs. Loosli moved, seconded by Mr. Miller, to adopt Resolution No. PZ 77-32 recommending approval of Kenai Spur - Airport Lease Property, Preliminary/Final Plat, subject to the following conditions: correction of negative findings of item 10. 10. Lots are not identified by street addresses in accordance with City code. Motion passed unanimously by roll call vote. D. Bicentennial Tract: Preliminary Plat Mr. Raymond explained that Mr. Heus was concerned with the 40' strip of land between the Bicentennial Tract and Mr. Bookey's land that seemed unusable. Mr. Day explained that the 40' strip of land between these two pieces of property is where the utility lines lay which makes that strip of land unusable anyway Kenai Planning and Zoning Commission Regular Meeting November 9, 1977 (Item 8-D continued) Page 4 MOTION: Mr. Bryson moved, seconded by Mrs. Loosli, to adopt Resolution No. PZ 77-33 recommending approval of the Bicentennial Tract, Preliminary Plat, subject to the following conditions: correction of negative findings of items 9 and 10. 9. Utility easements, if required, are not shown. 10. Lots are not identified by street addresses in accordance with City code. Motion passed unanimously by roll call vote. E. Conditional Use Permit: River Bend Sand and Gravel, Mr. Wise stated that Mr. Borgen's original conditional use permit allowed for the drainage that Mr. Borgen was presently using from his gravel pit which not only caused flooding on the gravel pit side of the road, but also flooded onto private property across Beaver Loop Road from the gravel pit. Mr. Wise also stated that the City had asked Mr. Borgen to extend his drainage ditch to the natural drainage culvert going across Beaver Loop Road. Mr. Borgen stated that the original drainage ditch has already been closed off and that the State has been notified and has approved the plans for the modified drainage ditch running to the natural drainage culvert. Mr. Borgen presented his letter of approval from the State to the Commission members, a copy of which is attached and hereby becomes part of the official transcript of the proceedings of this meeting. Mr. Borgen also stated that he also talked to Mr. Ed Hollier, State of Alaska, and Mr. Hollier told him that the water flow from Mr. Borgen's gravel pit into the natural drainage culvert would have to be metered to make sure that the culvert can handle the extra water flow. Mr. Hollier also told Mr. Borgen that if it was found that the natural drainage culvert could not handle the water during spring run-off, Mr. Borgen would be required to bore an additional culvert of sufficient size through the subgrade. MOTION: Mrs. Loosli moved, seconded by Mr. Monfor, for approval of River Bend Sand and Gravel's modified drainage ditch with the stipulation that the letter from the State of Alaska be complied with. Motion passed unanimously by roll call vote. Kenai Planning and Zoning Commission Regular Meeting November 9, 1977 Page 5 (Item 8 continued) A. Resolution No. PZ 77-14: Amending Chapter 21.76 of the Kenai Peninsula Borough Code of Ordinances Pertaining to the Kenai Municipal District Zoning Code City Attorney Janis Williams explained to the Commission that what they are actually doing in their attempt to change the zoning ordinance is radically changing the use of the property in many of the zones. In fact, they are actually almost rezoning the property. (For example, in the Suburban Residential Zone changing the requirements to allow single family dwellings only with multi -family dwellings as a Conditional Use only.) Miss Williams stated that at this time there are no specific procedures set up in the code for the changing of the zoning ordinance. Miss Williams also stated that this resolution would require individual notice as a rezoning. Mr. Raymond stated that he felt that the Commission should give some thought to Miss Williams' comments and asked that the new Commission members familiarize themselves with this resolution. Mr. Raymond asked that this item be tabled until the Commission could have some work sessions to review Resolution No. PZ 77-14 with Miss Williams' comments in mind and until such time as the Commission was ready to have this item placed on the agenda again. 9. NEW BUSINESS B. Concept Lease Application: Approximately 600' North of Terminal Building Mr. Wise explained that this was the property between the F.A.A. Tower and the parking lot area with access to the apron. Mr. Wise also explained that Aviation Consultants, Inc., would like to put a building on this property out of which they plan to operate a fixed -base aviation operation. Mr. Wise explained that the leasing of this property would depend upon the results of the Airport Master Plan Study. MOTION: Mrs. Loosli moved, seconded by Mr. Miller, that the Commission table this item until a representative of Aviation Consultants, Inc., could be present to give further details on this application. Motion passed unanimously by roll call vote. Renai eianning ana zoning commission Regular Meeting November 9, 1977 Page 6 10. OTHER BUSINESS A. City Council Report Councilwoman Glick reported that at the November 2, 1977, meeting Council adopted several resolutions some of which included the Airport Drive Paving, Water and Sewer Lines, Redoubt Way Paving, and Street Improvements. Council also approved the transfer of funds for City Street Lights and adopted Resolution No. 77-127 awarding the contract for City street lights to Redi Electric. Ordinance 378-77 was approved appropriating $7,000 from Water and Sewer Special Revenue Fund, reserve for future plant expansion for engineering services, relating to interim improvements to the Sewer Treatment Plant Facility. Also, bid was awarded for Improvements to the water and sewer system. City Attorney Janis Williams advised Council that she wished to resign her position effective upon selection of a replacement. Mayor O'Reilly advised that Nick Miller had been re -appointed to the Kenai Planning and Zoning Commission and also appointed Phil Bryson to fill out the seven member board. B. Borough Planning and Zoning Commission Report Mrs. Glick stated that there was a work session scheduled for the Borough Planning and Zoning Commission on October 31, 1977, but there was not a forum so there was no meeting. C. Airport Advisory Committee Report As Mr. Heus was not present, there was no report given. Mr. Raymond stated that there would be a meeting of the Airport Advisory Committee on Tuesday, November 29, 1977, at 7:00 p.m., in the Public Safety Building. D. Administrative Report Mrs. Kidd reported that so far this year there have been 86 building permits issued for single family dwellings, 24 permits for apartments (consisting of 141 units al together), 7 permits for trailers, 13 permits for commercial buildings, and 34 permits for additions and/or alterations. Mr. Wise announced that the Chamber of Commerce has asked the contractors in the Kenai area to attend a breakfast on November 15, 1977, at the Sheffield House. Mrs. Loosli stated that since the next regularly scheduled meeting of the Advisory Planning and Zoning Commission is November 23, 1977, the night before Thanksgiving, she would like to make a motion at this time. MOTION: Mrs. Loosli moved, seconded by Mr. Bryson, that the Commission cancel their meeting of November 23, 1977, not to return until the next regularly scheduled meeting of December 14, 1977. The easement is for utility purposes, and runs north and south between lots 1 and 12 of Block 7, Mommsen Subdivision, Addition No. 1, as noted on attached copy of plat. Our reasons and support for this request are: 1- Easements were placed on the back lot lines for planned utility installations but were not used by the developers. 2- The property will still have an easement running east and west along the northern boundry. 3- All utilities are into the lots but did not us this easement. 4- Sewer stubouts are in the roadway; original plans show the sewer in the back of the lots. Thus, there will be no need to use this easement for any future sewers. 5- Water is installed throughout the subdivision without this easement. The easement is not really needed due to the fact other easements can be utilized to service any adjacent areas, and these two lots already have service without using this easement. A building was designed for best utilization of these two lots, and a building permit issued, but will require building over this easement and lot Tines.
