ROLL CALL t-~rrxlJV~11 Present: Sol Raymond, Karen Mahurin, Nick Miller, Phil Bryson. Absent: Cliff Heus, John Monfor, Dwain Gibson and Ex-Officio Member Betty Glick. Others: City Attorney Ernie Schlereth and Borough Attorney Andrew Sarisky 2. PUBLIC HEARINGS None 3. AGENDA APPROVAL MOTION:. Mr. Bryson moved, seconded by Mr. Miller, to approve the agenda as submitted. There were no objections. 4. APPROVAL OF MINUTES OF JULY 12 and 18, 1978 MOTION: Mr. Bryson moved, seconded by Mr. Miller, to approve the minutes of July 12th and July 18, 1978 as submitted. The motion passed with no objections. 5. OLD BUSINESS A. Variance Request by Mr. Richard Brown fora Camper Repair Business in ~ Rural Residential Zone. Chairman Raymond read the letter received from Phil Waring, Kenai Peninsula Borough Planning Director regarding the Commission's action on Mr. Brown's variance. b Kenai Planning and Zoning Commission Page Two Regular Meeting July 26, 1978 5_ A_ ~nnt MOTION: Mr. Bryson moved, seconded by Mrs. Mahurin, to reconsider the Commission's action on the Brown variance request at their meeting of July 18, 1978. Mr. Schlereth, the City Attorney, was present and went over his memo included in the packet and the resolution he drafted up for the Commission's review. He stated the problems with the Commission's actions at their July 18th meeting and asked that the Commission rescind its Resolution PZ 78-33 and consider Resolution PZ 78-34 instead.. The motion to reconsider passed unanimously. MOTION: Mr. Bryson moved, seconded by Mrs. Mahurin, to rescind Resolution No. PZ 78-33 and substitute Resolution No. PZ 78-34. There was brief discussion on the letter from the Borough. Planning Director. Mr. Schlereth explained that the Commission cannot deny a variance and then give permission to continue the operation of an unlawful business. The Commission must either deny or grant a variance and after that decision has been made, it is up to City Administration to enforce. The Commission reviewed Resolution No. PZ 78-34. The motion passed unanimously. B. Kenai Native Association's Request to Erect a Sign. A telephone poll was taken of the Commission on this matter on July 21st in light of the City Attorney's opinion on that date. The Commission reviewed the vote taken July 21st which approved a conditional use permit for Kenai Native Association to erect a sign. MOTION: Mr. Bryson moved., seconded by Mrs. Mahurin, for ratification of the telephone poll taken on July 21, 1978 approving a conditional use permit for the Kenai Native Association request to erect a sign. Motion passed unanimously. ~. Resolution No. PZ 78-32 Declaring that the Assistance of the Kenai. Peninsula Borough Planning Department is Solicited and Desired. Mr. Bryson and Mr. Miller both commented that they appreciate any comments or in-put from a professional planner through the Borough Planning Department. r -~ #' Kenai Planning and Zoning Commission Page Three Regular Meeting July 26, 1978 5. C. Cont. MOTION: Mr. Miller moved, seconded by Mr. Bryson, to adopt Resolution No. PZ 78-32 declaring that the assistance of the Kenai: Peninsula Borough Planning Department is solicited and desired. Motion passed unanimously. The secretary was instructed to send a copy of Resolution No. PZ 78-32 to Mrs. Glick and to the Borough Planning Director. 6. NEW BUSINESS None 7. OTHER BUSINESS A. City Council Report: Bett Glick. There was no City Council report given as Mrs. Glick was not present. ~ B. Borough Planning and Zoning Commission Report: Betty Glick There was no Borough Planning and Zoning Commission Report given as Mrs, Glick was not present. C. Administrative Report. Chairman Raymond read City Manager Wise's memo to the Commission regarding the August 2, 1978 public hearing for the Kenai Municipal Airport Master Plan Study. 8. COMMISSION QUESTIONS AND COMMENTS Mr. Miller asked if City Administration could perhaps send a letter to the State Highway Department asking them to paint the lines on the Spur Highway running through downtown Kenai earlier in the year. He noted that the painting is usually done in the fall and then covered by the winter snow. By the time the snow is gone, the lines have faded again. 9.
