ROLL CALL Present: Phil Bryson, Sol Raymond, Nick Miller, Jerry Andrews Karen Mahurin, and Ex-Officio Member Betty Glick Absent: Dwain Gibson and John Monfor Others: Jim Hendricks, Borough Planner; John Wise, City R4anager; Bill Nelson, City Engineer; Calvin Quandt; and Allen Bishop. 2. PUBLIC HEARINGS A. Petition to rezone Lots 7 and 8, Block F of Beaver Creek Alaska Subdivision, located at the intersection of Raven Street and the Kenai Spur Hig way rom Rural Resi ential to Heavy Industrial. Mr. Bryson pointed out the area in question on the zoning map. He then opened the publichearing to the public for comment. Mr. Calvin Quandt was present and explained to the Commission the background of this property and how it was acquired. He pointed out that it was leased land from the State. He is presently requesting a zoning change to Heavy Industrial as he feels the area is best suited for commercial use rather than residential. He also stated that there are several other businesses in the area which are zoned Commercial and wants this property to be rezoned also. It was also stated that he feels the City needs more Commercially zoned areas. There were no other comments from the public. Mr. Bryson then read the Public Notice and the memo from the Borough concerning the rezoning. Jim Hendricks, Borough Planner, commented on M Quandt '.s request and pointed out on the zoning map the existing zoning in the area. He further stated that the Comprehensive Plan will state .where there should be future development as Commercial areas. Mr. Quandt questioned when the Comprehensive Plan would be complete. Mr. Hendricks stated that there was a recent news release from the planners which states that by April 24 or 26 there will be preliminary information mailable. Mr. Bryson questioned whether Mr. Quandt wants to rezone the property Heavy Industrial or General Commercial as the other property in the area. • • Kenai Planning and Zoning Commission Page 2 Regular Meeting, March 14, 1979 -~ Sol Raymond stated that he would be against rezoning the property Heavy Industrial and would like to request that Mr. Quandt wait another two months for the preliminary report from the Comprehensive Plan study. Nick Miller also stated that it might be possible that this would be an area that would be designated for future use as General Commercial but would not go along with a rezoning tci Heavy Industrial. He further questioned whether Mr. Quandt would have to refile at the Bcrough if he waited. Jim Hendricks stated that he would not have to file again. Nick Miller questioned Mr. Quandt whether General Commercial would be.~.oe.eptable to him and fit his needs rather than Heavy Industrial. Mr. Quandt stated that he would like to change his zoning request from Heavy Industrial to General Commercial. Mr. Hendricks stated that it would be necessary to advertise t~e•.Pfblic Hearing again a~ there is a change in the zoning request. MOTION: j Sol Raymond moved, seconded by Karen Mahurin, to delay action on the rezoning request from Calvin Quandt to rezone Lots 7 and 8, Block F of Beaver Creek Alaska Subdivision, located at the intersection of Raven Street and the Kenai .Spur Highway from Rural Residential to Heavy Industrial until the May 9, 1979 meeting and that the Commission recommends to the Borough that they delay action pending the results of that meeting. In view of Mr. Quandt's request and the Commission's concurrence, the zoning change should be from Rural Residential to General Commercial. The motion passed unanimously. 3. AGENDA APPROVAL MOTION: Sol Raymoh.d moved, seconded by Nick Miller, to approve the agenda. There were no objections. 4. APPROVAL OF MINUTES OF February 28, 1979 MOTION:: Nick Miller moved, seconded by Sol Raymond, to approve the minutes of February 28, 1979 as submitted. There were no objections. Subdivision, Lots 1 - 4, Bis op Brot ers Allen Bishop presented to the Commission a preliminary plan done by a firm in Seattle.. It showed three phases of planned development with Phase 1, a building; Phase 2, covered storage; and Phase 3, an extension of the building. He is also considering leasing Lots 1 and 2 with options on Lots 3 and 4. This would not present such a financial burden on the company at this time. There was further discussion concerning the type of building, fuel storage, and the storage area. John Wise, City Manager, pointed out that if the Planning Commission agrees with the three phases then building permits will be issued. If they deviate from those plans, then they would have to come back before the Commission ,for approval. Jerry Andrews stated that he did not see any problem with the plan as submitted. It was requested by the Commission to attach the plan to the tentative lease application. Mr. Bishop pointed out his plans for maintaining security of the area and will have it fenced. Mr. Raymond expressed concern about the storage area and whether it would be completely enclosed. Mr. Bishop assured him that the area would be enclosed. No further action was taken at this time. 6. NEW BUSINESS A. Petition to Vacate that portion of the 60~~foot right.-of- way known as Florida Avenue being that 150.7 feet which lies between Lot Five, Block One and Lot Orie, Block Eight. Mommsen's Su ivislon Ad ition One an Two. Jim Hendricks brought a letter from the Borough concerning the Vacation of this property. He pointed out that usually they are handled at the Bcrough level and then to the city Council for approval but he felt that this should home before the Planning and Zoning Commission also. The land in questioned was pointed out on the maps. Mr. Wise stated that if the vacation occurs the land should be either surveyed to give an easement for existing utilities or become an easement so that the City would have access to the lines. The Commission discussed the land in question and the possibility of acquiring land from the adjoining subdivision to continue the road all the way through MOTION: Sol Raymond moved, seconded by Jerry Andrews, to recommend approval of the petition to vacate that portion of the 60-foot right-of-way known as Florida Avenue being that 150.7 feet which lies between Lot Five, Block Ohe and Lot One, Block Eight, Mommsen Subdivision Addition One and Two.upon the condition that when replatted that the entire width be dedicated as an easement or an easement granted for utilities. The motion passed unanimously. 7. OTHER BUSINESS A. City Council Report: Betty Glick Betty Glick reported that most of the last City Council Meeting concerned housekeeping items. Ordinance 479-79 was introduced cano.erning excavation permits; the Roper Lease was approved; R.Lee. Seafoods requested to change their name to Seacatch. It was requested that a copy of the excavation permit be sent to the Commission members. B. Borough Planning and Zoning Commission Report: Betty Glick Mrs. Glick stated that Mrs. Loretta Breeden gave a presentation which concerned high. pressure gas lines on private property. She brought up several important points such as providing the property owners with as builts showing existing lines. It was requested that House Bill 184 revising the delegation of authority from the Borough to the City be sent~~o~the ~: Commission members. C. Administrative Report. D. Borough Report: Jim Hendricks Mr. Hendricks brought the press release from Thorpe to the attention of the members and also pointed out that questionnaires have been distributed to the public. 8. COMMISSION QUESTIONS AND COMMENTS Karen Mahurin questioned whether caution signs could be put up at the end of Fourth as there is alot of traffic in that area.
