2. PUBLIC HEARINGS
A. Petition for a Conditional Use Permit to the Kenai Peninsula
Nick Miller assumed the chair as Phil'Bryson was not present.
Mr. Miller explained that a hearing was advertised for this
Conditional Use Permit application fear the last Planning and
Zoning meeting but as the wrong description was used, the petition
was tabled until the correct description was advertised.
Mr. Miller opened the meeting to the public for comments.
Waldo Coyle questioned why the Commission did not send a map and
copies o the application and information which the Commission
members received as the City is proposing to put a road through
a portion of his property. He further questioned why the City
is giving the State $100,000 wo~h of gravel when the City has
men able to go in and make a road. He also stated that where
the State proposes to put a road there is a creek present.
John Wise replied to the questions stating that the State has
a sect~±on line right-of-way; the reason the City does not put
the road in themselves is the lack of time and money available;
ahd if the access is not desirable as indicated at the present,
then it will be moved.
Phil Bryson came in at this point and assumed the Chair.
Mr. Wise further stated that the State will not interfere with
the flow of the creek.
Chester Cone stated that he did not have any objections as such
ut t is proposed site is in the middle of Wetlands which is
being given a lot of attention at this time. He could,.°nbt
understand how the City can put in a gravel permit and an
individual would have a herd time doing it.

Mr. Cone questioned who was going to police the City.
Mr. Wise stated that the City would police itself according
to the same treatment given to the private gravel pits.
The City does have an application in for a Wetlands permit.
There were no -.other comments and the item was brought back
to the table for discussion.
John Monfor questioned the feasibility of having the State
put the road in and how much it would cost.
Mr. Wise pointed out that in the application it stated the
cost for the opening of the pit would be $100,000.
Mr. Bryson stated that this was not a very precise statement;
it should be itemized.
Mr. Hendricks, Borough Planner, read the recommendations from
the Borough concerning this application.
Jerry Andrews stated that this appears to be a joint venture
with the State - giving them gravel in exchange for services.
He questioned whether the City has considered doing the same
with private enterprise. He questioned the right to grant
the Conditional Use Permit as the Council has put a stop. to
rezoning until the completion of the Comprehensive Plan.
Mr. Wise stated that there are existing gravel pits in the
area and this would be a logical extension of the use. A
Wetlands permit is being applied for and the City will not
develop the gravel pit until everything is legal.
Mr. Hendricks explained that there is a difference between a
rezoning and a Conditional Use Permit as the later is closer
to a permitted use.
There was further discussion concerning the Comprehensive
Plan, rezoning, and. Conditional Use Permits.
Mrs: Wise stated that the Council had been briefed and is
aware of the application. The City is seeking approval of
the request to put a gravel pit in this area.
There was further discussion concerning the testing of the
land, when it would be done in relation to the application and
contract signing.
Sol Raymond stated that he felt that the City's application
~ should be a model one and that the existing application needs
to be more complete and exact and should not leave any questions
unanswered. The Commission might want to put in a stipulation
that the Planning and Zo~~g Commission or a designated
Committee would police the area.

The Commission members further discussed the need for a
more explicit application and whether there would be a
less expensive way of developing the pit. There was
considerable discussion concerning reclamation. It was
stated that any gravel. taken by the State in excess of the
agreed upon amount would be charged for and put in an escrow
account to go towards reclamation. The City is responsible
for the reclamation as the owner of the pit.
Phil Bryson questioned who was going to keep track of the
gravel taken out of the pit by the contractors etc.
Mr. Coyle stated that he has a pit next to the proposed one
and it does:.not seem;~to~ him that it should cost this much to
put a road in.
Nick Miller pointed out that gravel is scarce in the area and
questioned where the gravel was going as the State has few
gravel roads in the City of Kenai.
MOTION:
Sol Raymond moved, seconded by Nick Miller, to recommend
concept approv~.l of the Petition for a Conditional Use Permit
to the Kenai Peninsula Borough Code of Ordinances, Title'21,
Section 21.76.141, specifically for .extraction of gravel from.
the SW4, NE4 SE4, SZ SE 4, of Section 3, TSN, R11W, S.M.:
City of Kenai pending the inclusion of the Borough recommendations
as listed in the Memo from Jim Hendricks, Borough Planner, and
~~turn to.:_th~ Planning Commission for final approval.
There was further discussion concerning whether the Commission
would be voting on just the concept of the gravel permit in
this area and/or the contract with the State. It was
clarified that the Commission could only vote on the concept
and the Contract would be voted on and drawn up at the City
Council.
Phil Bryson commented on Items 8 and 9 in the Borough memo
and stated that he would like to see provisions for screening.
The motion passed with Phil Bryson voting negative.
B. Comprehensive Plan Presentation: R. W. Thorpe
Mr. Bob Thorpe and Mr. Len Zickler presented:`.tb the Commission
and the public present a report on the progress to date on
the Comprehensive Plan. They distributed summary reports on
The Attitude Survey, Economics/Population, Land Use Analysis.
Mr. Thorpe stated that public hearings and open houses have
been scheduled for this week in an attempt to obtain feedback
from the public. His firm is requesting criticisms and comments.

The plan will be to distribute the material on the three
areas brought to the meeting and ask the members and others
interested to comment and revise and then return the material
to Thorpe and Asso. They will then have additional information
ready for review in June and July. Rather then presenting
the City with all the information and data in September, Thorpe
-and Asso. will be submitting three or four elements at a time..
Each Commission member will receive a notebook with tabs for
each item and it will serve as a workbook.
Mr. Thorpe further discussed each of the submitted summary
reports in more detail and answered questions concerning
their findings so far.
Mr. Zickler pointed out the maps and drawings which their
firm have been working=~;o.n :.showing topography, hydrology,
streets, utilities, current zoning, etc. He stated that
they still have work to complete on them,and they will also
be working on parks and roadways.
Mr. Thorpe introduced his wife Pat Thorpe as a consultant
for their firm. She has experience with airport leased lands.
~ Mr. Thorpe would like to see a "wish list" from the Commission
members and other citizens as to what they. would like to
see done in their city.
Jim Hendricks suggested that the Commission members set a time
to meet this coming week so that they can review the submitted
summary reports, markthem and return them right away~to the
Planners.
Phil Bryson left the meeting at this time and Nick Miller
assumed the Chair.
3. AGENDA APPROVAL
It was requested that the Concept Lease Application:
Royal Pacific Fisheries: Marvin Dragseth be included a~
Item 6C under New Business.
MOTION:
John Manfor moved, .seconded by Karen Mahurin, to approve
the Agenda with the addition.
There were no objections.
4. APPROVAL OF MINUTES OF April 11, 1979.
j MOTION:
Karen Mahurin moved, seconded by Sol Raymond, to approve the
minutes of April 11, 1979, as submitted.
There were no objections.

6. NEW BUSINESS
A. Alaska State Land Survey No. 76-118: Preliminary/Final
There was a brief discussion of the plat and where the land
is located. Mr. Wise explained that the land was unplatted
and needed to be platted so that the City could lease the land.
MOTION:
Sol Raymond:'moved, seconded by Karen Mahurin, to adopt
Resolution PZ 79-18 approving the Alaska State Land Survey
No. 76-118: Preliminary/Final with the condition that this
Resolution confirm to any Borough requirements.
The motion passed unanimously.
B. Lease Application: A Portion of Section 9, TSN, R11W, S.M.
R. L. Roper
Mr. Roper explained to the Commission his need for more land
to expand as the Boat Harbor takes up the existing land.
The Commission reviewed the maps included in -the packets and
discussed what. Mr. Roper's needs were. Mr. Raymond stated
that the lease application was alright for a concept lease but
it needs a development plan, more accurate drawing of the land
~n question, and what would be put on the land. Mr. Andrews
also stated that a more definite property description and
development plan needs to be done.
MOTION:
Sol Raymond moved, seconded by Jerry Andrews, totable-.rth~,-

R. L. Roper until more definite information, both dimensions
and development plans, is brought before the Commission.
The motion passed unanimously..
C. Concept Lease Application: Royal Pacific Fisheries,
Marvin Dragseth
The Commission reviewed the two proposals submitted by Royal
Pacific Fisheries, one of which .asked for the same land as
MI?; Roper,.; Mr. Dragseth explained to ,the Commission that his
company needs a dock facility and has submitted two proposals.
The first one would be the least expensive and is also the same
property that Mr. Roper would like to lease. He further stated
that he would not be in competition with Mr. Roper but wants
to provide a dock for boats out of his own fisheries. He would
be willing to put in an access road if he was able to get the
necessary permits.

The Commission stated that they would need to see a development
plan and a more definite drawing of the land in question,
Mr. Dragseth stated that he would only need approximately
5 acres. of land and would be willing to work with Mr. Roper
to share this property.
The Commission requested that the City Administration work with
Mr. Dragseth''and;Mr.~Roper"':and the~,r;proposals and come up
with a workable solution to both their needs. The Commission
also requested that the City Administration look at the general
area t.o see.what land is available and how the land is presently
used. They would also like to have suggestions from the
Recreation Commission as to any future proposals which they
might have.
MOTION:
Sol Raymond moved, seconded by Jerry Andrews, to table the
Concept Lease Application: Royal Pacific Fisheries, Marvin
Dragseth until more definite information, both dimensions and
development plans, is brought before the Commission.
The motion passed unanimously.
7. OTHER BUSINESS
A. City Council Report:° Betty Glick
Betty Glick reviewed items of interest to the Commission
concerning the last City Council Meeting. Carmen Gintolli
presented to the Council plans for renovating the Airport
Terminal Building; An Ordinance was introduced to purchase
a used tractor for the Parks and Recreation Dept.; The
view Parks and Recreation Director is now on board and will
come to a Planning and Zoning Meeting to be introduced;
The Resolution that would approve the Airport Master Plan
was tabled; The Resolution which would rezone certain areas
within the City was tabled until-'.the next City. Council
Meeting; PaSSed a:8esolution concurrent with the Planning
Commission's action approvirng dedication of road right-of-way
for Central Heights Subdivision.
B. Borough Planning and Zoning Commission: Betty Glick

D. Borough Report: Jim Hendricks

Jim Hendricks. distributed copies of the new subdivision
ordinance and requested that the Commission bring questions
to the next meeting. Mr. Hendricks commented on the
Coastal Zone Study and that it is in the data gathering stage.
He further suggested that it would be helpful to set up
a meeting in the next week for the Commission to discuss the
Comprehensive Plan.
The Commission decided to meet Monday, April 30, 1979, at
7 p.m. in the Public Safety Building. The Secretary was
to check on the availability of the Building and notify
Phil Bryson and Dwain Gibson of the meeting.
