ROLL CALL Present: Phil Bryson, Nick Miller, Karen Mahurin, John Monfor, Jerry Andrews, and Ex-Officio Member Betty Glick Absent: Dwain Gibson and Sol Raymond Others: John Wise, City Manager; Jim Hendricks, Borough Planner; and Bert McCool, Mobile Home Sales 2. PUBLIC HEARINGS A. Petition to rezone Lot 15, Block C of Beaver Creek Alaska Subdivision from Rural Residential to General Commercial Phil Bryson opened the public hearing to the public for comments. Mr. McCool stated that he is requesting to rezone Lot 15 from Rural Residential to General Commercial so that he caneoperate a mobile home business. He originally leased the property from Vangas and thought at that time the land was already zoned Commercial. The Commission discussed the existing zoning and the surrounding area. The Commission further reviewed the memo from the Borough concerning this property. It was pointed out that the last study that was done had indicated this land should be zoned Commercial. Karen Mahurin stated that it seems to be logical to put Commercial zoning in this area as she could not see anything else being put in there. Jim Hendricks, Borough Planner, pointed out to the Commission that they would have to make a decision on the boundaries for the Commercial Zone and there needs to be a discussion concerning strip zoning. He further pointed out that there are existing businesses in the area and the Commission needs to decide the future land use. Nick Miller felt that this land would not be good for use as residential and if there is a need for a highway-orientated Commercial zone between Kenai and Soldotna, this would be a logical place for it. The zoning for the area should be changed all at once and not a lot at a time. Jim Hendricks suggested that if the Commission decides to rezone a certain area then they should make a Resolution statngT:this and also requesting that the Resolution be made a part of the Comprehensive Plan. Orice the Resolution is made, then they could deal with the individual requests for rezoning. Kenai Planning and Zoning Commission Regular Meeting, May 23,.1979 Page 2 ~ Nick Miller stated that he would be in favor of rezoning both rows of lots Commercial on the northern side of the road but only bne row deep on the southern side.: as the other land is swampy and wet. Jerry Andrews stated that he felt that the entire land should be rezoned Commercial and the streets could be used as a more definitive boundary. Betty Glick, Ex-Officio Member, stated that at the .last City Council meeting it was the concensus of Council to adhere to the Resolution which states no rezoning until the Comprehensive Plan is complete. She felt that Council would be receptive to any decisions the Planning Commission comes u~ with concerning the rezoning of the entire area to Commercial rather than isolated lots. Also, she felt that it should be made a part of the Comprehensive Plan. There would have to be a public hearing on the rezoning as much of this land was sold as residential. (State of AK sale of certain parcels in Beaver Creek Alaska Subdivision.) Jim Hendricks stated that the Consultant can not make all the decisions and the City should accept a certain amount of responsibility towards making decisions as to what to do with a local problem area such as this. The Planning Commission should make a planning decision on this area right now. The Commission should establish the boundaries and ask Thorpe and Associates to include this in their plan. There was a considerable amount of discussion concerning the boundaries, time frame for hearings, and the steps towards approval of the rezoning. Karen Mahurin felt that the Commission could indicate that this area should be zoned Commercial and at a later date after hearings and discussions set more ;exact- boundaries. The Commission discussed different approaches to the rezoning:. and expressed concern that if they vote to approve the individual petitions to rezone the lots for Mr. mcCool and Mr. Quandt and the rezoning request for the entire area is turned down then they would be spot zoning. The Commission discussed ways to avoid doing this. Karen Mahurin stated thht the Commission has been putting off making a decision on this land for some time now and something should be done. Mr. McCool expressed concern that he was in violation bf the zoning by operating a business on his lot'and would ~~ke to see some decision as to whether this land can be rezoned. MOTION: Nick Miller moved, seconded by Jerry Arid~rews, to petition to rezone the land within Beaver Creek Alaska Subdivision bounded on the west by Raven Street, Beaver Loop and Beaver Loop Extended to the east, Minchumina Way to the north and Tustumena Street to the south, and also include the Well House Site and the lot which the Beaver House sits from Rural Residential to General Commercial in view of the two applications rec{uesting a rezoning in this Subdivision. The Commission further discussed the boundaries and any possible need for a buffer zone. They discussed the time frame for public hearings and whether the land should be re-zoned all at once or individually. The motion passed with Karen Mahurin and Phil Bryson voting negative. There were no comments from the public on this rezoning. MOTION: Karen Mahurin moved, seconded by Nick Miller, that the petition to rezone Lots 7 ~ 8, Block F of Beaver Creek Alaska Subdivision from Rural Residential to General Commercial is recommended for approval; however, further action should be deferred until the rezoning of the larger tract in this area is resolved by the City Council. The motion passed with Phil Bryson and Jerry Andrews voting negative. The motion passed unanimously. The motion passed unanimously. The Commission further discussed the rezoning and Nick Miller emphasized the fact that he would vote for the rezoning of these lots only as a part of the larger rezoning of the whole area. It was suggested tthat approval on the rezoniBg of these lots be postponed until a public hearing could be held on the larger rezoning. MOTION: Jerry Andrews ,moved, seconded by Nick Miller, to postpone the petition to rezone Lot 15, Block C of Beaver Creek Alaska Subdivision from Rural Residential to General Commercial until June 13 meeting. The motion passed unanimously. MOTION: Nick Miller moved, seconded by Jerry Andrews,`to table this lease application due to lack of information and a site plan. The motion passed unanimously. B. Lease Application: Lots 3 ~ 4, F.B.O. Subdivision, Block l: John and Kristine Stoehner There was a brief discussion of these lots. MOTION: Nick Miller moved, seconded by John Monfor, to table this lease application due to lack of information and a site plan. The motion passed unanimously. C. Lease Application: Part of Lot 5, Old Town of Kenai, ' Edward Garnett There was a discusion by the Commission concerning where this lot is located. John Wise pointed out to the Commission that this land is foreclosed property and that the City does not recommend that foreclosed lands be leased but rather that they be sold. Mr. Wise recommends dTSapproval of the lease application. Jerry Andrews stated that he feels many people in the City would like to see more of City lands being released into private hands. MOTION: Karen Mahurn moved, seconded by Jerry Andrews, to approve the lease application, Part of Lot 5, Old Town of Kenai, Edward Garnett. The motion failed unanimously. D. A.S.L.S. 79-57, Section 36 Lands: Preliminary/Final The Commission discussed the Borough Staff Report on this land and the plats. Kenai Planning and Zoning Commission Regular Meeting, May 23, 1979 Page 6 ~~~ MOTION: Nick Miller moved, seconded by John Monfor, to adopt Resolution PZ 79-19 approving A.S.L.S. 79-57, Section 36 Lands: Preliminary/ Final upon the following conditions: corrections of negative findings of Items 8 ~ 9. Item 10 is not applicable. 8. Status of surrounding land is not shown. 9. Utility easements, if required, are not shown. The motion passed unanimously. E. Killen Estates, Tract I, Addition I, fronting on Redoubt ..Boulevard at 29th Avenue request to initiate rezoning from Rural Residential to Suburban Residential: Nick Poi~pin. Jerry Andrews stepped down from the table as he is representing Mr. Poppin in another matter. Jim Hendricks pointed out to the Commission that Mr. Poppin had been in contact with the Borough on this rezoning and the Borough had no reason why it should not be rezoned~as it is served by City water and sewer and the surrounding area is already Suburban Residential. He further stated that this could be rezoned later as a part of the housekeeping when the Comprehensive Plan is complete. If Mr, Poppin would like to do it earlier, then he should petition for the rezoning, The secretary was asked to write to Mr. Poppin stating this. 7. OTHER BUSINESS A. City Council Report: Betty Glick Betty G~:ick reported on the last City Council meeting and stated that Ordinance 479-79 was approved,ameriding the street excavation ordinance; 481-79 was not approved for forming an assessment district for luminaries along Willow Street; passed 489-79 amending airport regulations for a grass ski'°etrip; passed 79-41 accepting Kenai Municipal Airport Master Plan; approved appoin ments of members of Harbor Commission; approved 79-67 accepting a grant from the State for Parks and Trails Program; passed Resolution 79-70 rezoning lands within-the City from Conservation to Commercial. B. Borough Planning and Zoning Report: Betty Glick There was no Borough Report. C. Administrative Report There was no Admn;5t~.atve.Report. D. Borough Report: Jim Hendricks Jim Hendricks stated that the Borough has received six proposals for the Section 36 Study. The cut off date is Monday and the .intent Kenai Planning and Zoning Commission. ADJOURNMENT MOTION: Nick Miller moved, seconded by Karen Mahurin, to adjourn the .meeting.
