1. ROLL CALL
Present: Phil Bryson, Karen Mahurin, John Monfor, Jerry Andrews,
Sol Raymond, Dwain Gibson, and Ex-Officio Member
Betty Glick
Absent: Nick Miller
Others: John Wise, City Manager; Jim Hendricks, Borough
Planner; Ed Ambarian, City Councilman; Bill Nelson,
City Engineer; and Pastor Glenn Bryars, Kenai
Church of God.
2. PUBLIC HEARINGS
A. Petition to rezone Woodland Subdivision Parts I, II, and
III from Rural Residential to Suburban Residential
Phil Bryson opened the public hearing to the public for
comments. There was no one from the public who wished to
comment.
Jim Hendricks, Borough Planner, explained that this rezoning
was a housekeeping item, that the subdivision was served with
City water and sewer and should be Suburban Residential.
MOTION:
Sol Raymond moved, seconded by Dwain Gibson, to recommend
approval of the petition to rezone Woodland Subdivision Parts
I, II, and III from Rural Residential to Suburban Residential.
The motion passed unanimously.
3. AGENDA APPROVAL
The Kenai Church of God requested that it be added to the
agenda. There were no objections from the Commission members.
MOTION:
Sol Raymond moved, seconded by Karen Mahurin, to approve.':.
the agenda with the addition of Kenai Church of God's letter
as'Item 2C under New Business.
There were no objections.
4. APPROVAL OF MINUTES OF May 23, 1979.
MOTION:
Karen Mahurin moved, seconded by Dwain Gibson, to approve
the minutes of May 23, 1979.
There were no objections.

A. Three W's Subdivision: Preliminar
MOTION:
Karen Mahurin moved, seconded by John Monfor, to take
Three W's Subdivision off the table.
There were no objections.

Jim Hendricks reviewed the Borough Staff Report concerning
this subdivision. The Commission members discussed and
reviewed the plat. It was pointed out that. this Subdivision
had previously been tabled by the Commission because of
the lack of information. There was discussion concerning
adequate access and road connections.
MOTION:
Sol Raymond moved, seconded by Karen Mahurin, to adopt
Resolution PZ 79-7 approving Three W's Subdivision: Preliminary
upon the following conditions:, Corrections of negative
findings of Items 6, 9, and 10.
6. Set back lines are not indicated.
9. Utility easements, if required, are not shown.
10. Lots are not identified by street addresses in accordance
with City code.
The motion passed unanimously.
6. NEW BUSINESS
A. Lease Application: Fidalgo Block 4, Lots 2 and 3
International Karate Asso. of Kenai, Inc.
The Commission members reviewed the drawings submitted in their
packets. There was no one present to represent the lease
application.
Sol Raymond commented that he would like to see what type
of a building they would be constructing. Other members
commented that it was an appropriate use for the zoning.
Dwain Gibson stated that he would like to see a drawing of
the building, where it would be situated on the lot, parking,
landscaping, and drainage.

MOTION:
Sol Raymond moved, seconded by Karen Mahurin, to table this
lease application for Fidalgo Subdivision, Block 4, Lots 2 and 3
International Karate Asso. of Kenai, Inc. and request that
the following information be provided to the Commission.
1. Plot plan showing location of building on the lot,
entrances, exits, parking, landscaping, and drainage.
2. A sketch of the building showing how it will look.
The motion passed unanimously.
The secretary was asked to notify. the Karate Asso. and request
that they have a representative present at the next meeting.
B. Lions request to put up a Welcome to Kenai Sign
John Wise outlined some of the discussion he has had with
the police concerning a safe and appropriate place to put
this sign. There was further discussion concerning the
size of the lettering .and the amount of information contained
on the sign. The:,way this sign is detailed means that a
person could not read it while driving by so would have
to be in a pull off area.
It was stated that the Lions are interested in putting
the sign as close as possible. to Beaver Loop-.and the Spur
so as to get the traffic coming into the City from both
roads.
It was suggested by some of the Commission members that
the Lions. should come up with some alternative solutions as
to where to put the sign and what the information on the sign
would be.
MOTION:
Karen Mahurin,moved, seconded by
item until the next meeting and

Mr. Bryson read the letter from Mr. Bryars to the Commission.
Jim Hendricks commented on the request to put a mobile home
on a General Commercial zoned lot. The General Commercial
zoning does not allow churches. This is not a conditional
use because it is not in harmony with the zone. The existing
Church could continue but cannot be enlarged or altered.
The main question is whether the request to put a building
on the lot next to the Church would be considered an
accessory to the Church. If it was not, then a building

j ~ ~ permit for a structure (not a mobile home) could be allowed.
There is a problem in that General Commercial zone excludes
new residential so there would have to be a rezoning.
Mr. Hendricks read the memo which he wrote to John Wise
concerning this. He outlined the options which the.
Commission might take.and questioned past cases which the
City might have allowed expansion of residential homes in
a General Commercial area.
Mr. Bryars stated that his intent is to upgrade the Church's
property and that his family of five children need more
room. The existing parsonage has only a bedroom and a half
which makes it difficult for his family. Someone has
volunteered to donate a mobile home for his family to live
in and he would like to install it on this property. Further
plans would be to put a permanent foundation under the mobile
home and put an outside finish of T-111 to match the existing
buildings.
The Commission members discussed the incompatibility of
a Church in a General Commercial zone and what has bean
decided in the past concerning this. It was stated that
there have been several requests in the past tb'put in mobile
homes in an area other than where they are allowed and they
were all denied.
Phil Bryson questioned past actions and decisions concerning
expansion of residential in a Commercial zone.
It was pointed out to the Commission that the lot that
adjoins the Church on one side is a corner lot that is
not zoned General Commercial. The Commission discussed how
long the Church has been there.
Jim Hendricks suggested that the zoning could be changed and
this area could be looked at as a part of the Comprehensive
Plan.
Mr. Bryars stated that this home will meet all building
requirements and it would not look like a trailer when finished.
Jerry Andrews suggested that there needs to be some clarification
concerning trailers within the zoning code.
Betty Glick stated that the Commission must deal with issues
such as this uniformly - what you do for one must be done.
for all. The Code is the guideline which must be followed.
The Commission stated that it would like to have Thorpe
address the issue of trailers plus the zoning in this area
for the future.

~ Betty Glick suggested that the Commission needs a
work session concerning Section 36 Lands, trailers, and
the drecton,~zonng might take in future years.
There was a considerable amount of discussion concerning
the term accessory and whether the addition would be
considered a part of the Church. It was pointed out that
it would not be an accessory as the building would not be
on the same lot as the Church.
It was requested that the City Attorney and Building
Inspector research past building permits for expansion of
residential homes in a Commercial zone and also new construction.

Jerry Andrews moved, seconded by Karen Mahurin, to conduct:
a work session concerning the Administration's, the Legal
Department's, and the Building Inspector's findings concerning
Mr. Bryar's request, zoning in the area, and modular homes.
There were no objections and the work session was scheduled
for 6 p.m, on June 27, 1979.
7. OTHER BUSINESS
A. City Council Report: Betty Glick
Mrs. Glick reported on the City Council Meeting of June 6, 1979.
Ordinance 494-79 set the new budget; Mr. Oberts wishes to
donate property to the City for use as a future well site and
Council was favorably; re-introduced Ordinance 455-78, Tidelands
Ordinance and it lias been referred to the Harbor Commission;
there was an Ordinance authorizing the sale of Spur Subdivision
No, l; Resolution 79-80 concurred with the Planning Commission
on the rezoning of Beaver Creek Alaska Subdivision; There
has been a transfer of monies for schematics for a City Hall.
B. Borough Planning and Zoning Commission Report: Betty Glick
The action was postponed concerning the rezoning of the
lots in Beaver Creek Subdivision. Mrs. Glick pointed out
the notice in the packets concerning Sea Catch.
C. Administrative Report
Mr. Wise briefly reviewed the status of the Roper lease request.
D. Borough Report: Jim Hendricks
Mr. Hendricks distributed copies of the updated Zoning Code.
He stated that Mr. Thorpe will be in Kenai during the
week of June 25 and will announce the schedule at a later
date. Also, Thorpe and Associates have been selected for
the Section 36 Land study.

MOTION:
Karen Mahurin moved, seconded by Sol Raymond, to adjourn
the meeting.
There being no further business, the meeting was adjourned
at 9:45 p.m.
