ROLL CALL Present: Phil Bryson, Karen Mahurin, Jerry Andrews, Nick Miller, and Ex-Officio Member Betty Glick Absent: Dwain Gibson, John Monfor, and Sol Raymond Others: Jim Hendricks, Borough Planner; Ron Malston,• City Councilman; Mike McLane, Surveyor; and Ernest Schlereth, City Attorney; Bill Nelson, City Engineer. 2. PUBLIC HEARINGS A. Petition to rezone Lots E-lA and F-lA, Resubdivision Tract 1-A, Killen Estates, Addition No. 1 from Rural Residential to Suburban Residential. Jim Hendricks outlined the Borough's recommendations concerning this rezoning. He stated that the Commission had considered this item at a previous meeting and the applicant had been informed by both the City and the Borough that he might want to wait until the completion of the Comprehensive Plan for it would be rezoned as a matter of housekeeping then. Mr. Poppin decided not to wait and initiated the rezoning. There was no one present from the public to give comment. MOTION: Karen Mahurin moved, seconded by Nick Miller, to approve the Petition to rezone Lots E-lA and F-lA, Resubdivision Tract 1-A, Killen Estates, Addition No. 1 from Rural Residential to Suburban Residential. The motion passed unanimously. B. Petition to rezone Lots 1-14, Block B; Lots 1-16, Block F; Lots 1-12, Block G; Lot 1, Block H; Lots 1-4, 6-11, 14-16, Block C and Lots ALS 76-118 Beaver Creek Alaska Subdivision from Rural Residential to General Commercial. Phil Bryson opened the meeting to the public for comments. There was no one present from the public. Jim Hendricks briefly outlined the Borough's comments on this rezoning. He also stated that both Mr. Morgan from Luke's and Mr. Olsen, Secretary and Treasurer of Anchorage Trailer Parks, Inc. were in favor of the rezoning. These were the only comments received. He further stated that the Borough felt that it was logical to have Commercial development in this area but did not think that it would be wise to have Commercial zoning two lots deep on the South side of the Spur. _-- KENAI PLANNING AND ZONING COMMISSION age 2 Regular Meeting, July 11, 1979 -~ Mr. Hendricks stated that it might create problems in the future by zoning the lots Commercial as there would be no buffer zone between the Rural Residential area to the south of Tustumena Street. There was considerable discussion concerning this rezoning and of the lots in question. Jerry Andrews stated that he felt that the original amount o_f lots to be rezoned is excessive. There was discussion of what lots should be rezoned. It was suggested that the Commission could rezone a potion of the lots Commercially now and later a neighborhood business-type zone could possibly be considered for the back lots. MOTION: .Karen Mahurin moved to approve the petition to rezone Lots 1-14, Block B; Lots 1-16, Block C, Lots 1-8, Block F; Lots 1-6, Block G; Lot 1, Block H and ALS 76-118 from Rural Residential to General Commercial. The motion failed for the lack of a second. The Commission discussed the lots further. MOTION: Jerry Andrews moved, seconded by Nick Miller, to approve the petition to rezone Lots 8-14, Block B; Lots 14-16, Block C; Lots 1 and 2, Black F; Lots 1-6, Block G; and Lot 1, Block H from Rural Residential to General Commercial. The motion failed with Karen P!Iahurin and Nick Miller voting no. The Commission discussed alternatives for rezoning the lots. Betty Glick stated that in the past people have expressed the view that the land would not be good as residential. MOTION: Nick Mi!11er moved, seconded by Karen Mahurin, to approve the petition to rezone Lots 8-14, Block B; Lots 9-16, Block C (excluding Lots 12 and 13 which are already CG); Lots 1-8, Block F; Lots 1-6, Block G; and Lot 1, Block H from Rural Residential to General Commercial. The motion passed with Jerry Andrews voting negative. C. Petition to rezone Lot 15, Block C of Beaver Creek Alaska Subdivision from Rural Residential to General Commercial. D. Petition to rezone Lots 7 and 8, Block F of Beaver Creek Alaska Subdivision from Rural Residential to General Commercial. Public Hearings were held on Items C and D at the May 23, 1979 meeting and both rezoning requests have been approved as a part of the rezoning in Item B. There were no other comments from the public. Petition to rezone Lots 6 and 7, Block 4 and Lots 3-7, Block 3 of the proposed Fidalgo Commercial Center from Conservationh to General Commercial. There was no one present from the public for comment. The Commission briefly discussed this petition for rezoning. MOTION: Karen Mahurin moved, seconded by Nick Miller, to approve the petition to rezone Lots 6 and 7, Block 4 and Lots 3-,7, Block 3 of the proposed Fidalgo Commercial Center from Conservation to General Commercial. The motion passed unanimously. 3. AGENDA APPROVAL MOTION: Karen Mahurin moved, seconded by Nick Miller, to approve the agenda as submitted. There were no objections. 4. APPROVAL OF MINUTES OF June 27, 1979 MOTION: Karen Mahurin moved, seconded by Nick Miller, to approve the minutes of June 27, 1979. There were no objections. 5. OLD BUSINESS 6. NEW BUSINESS A. Sunset Rim Subdivision: Preliminary Plat Jim Hendricks pointed out to the Commission the present plat and the previous one which was submitted to the Planning and Zoning Commission. Mike McLane was present and stated that because of high water along the creek the only way to get approval is to not plat the creek frontage. MOTION: Nick Miller moved, seconded by Karen Mahurin, to adopt Resolution PZ 79-22 approving Sunset Rim Subdivision: Preliminary Plat upon the following conditions: Correction of negative finding of Items 9 and 10. 9. Utility easements, if required, are not shown. 10. Lots are not identified by street addresses in accordance with City Code. Vacation Plat _ Portion Florida Avenue: Final Plat The Commission briefly discussed. this plat and pointed out that they had approved the concept at a previous meeting. The. Borough stated that they approved upon corrections of minor drafting errors. MOTION: Nick Miller moved, seconded by Karen Mahurin, to adopt Resolution No. PZ 79-23 approvn.g;the Vacation Plat - Portion Florida Avenue: Final Plat upon the following conditions: Corrections of negative finding of Item: 8. 8. Status of surrounding land is not shown. The motion passed unanimously. 7. OTHER BUSINESS A. City Council Report: Betty Glick Betty Glick reported on the last City Council meeting where Ordinance 500-79 was passed concerning Airport Regulations and the use of the .grass strip; approved ordinance for Willow Street luminaries.; passed Ordinance 508-79 concerning oil and gas drilling in Kenai;. Ordinance 509-79 concerning ~ the animal control program gives the animal officer citation powers. B. Borough Planning and Zoning Commission Report: Betty Glick Betty Glick stated that the Borough has distributed a limited amount of copies of the proposed lands for sale. More copies should be available within a week. Until then anyone interested may borrow her copy. C. Administrative Report- There was no administrative report given. D. Borough Report: Jim Hendricks There was no Borough Report given. 8. COMMISSION QUESTIONS AND COMMENTS The members were reminded that there will be a work session Thursday at 7 p.m. on the Comprehensive Plan at'the'Borough. The Commission briefly discussed the public notice concerning Miles'Dean's request and stated that this should be an agenda item on the July 25 meeting.
