ROLL CALL Present: Phil Bryson, Karen Jerry Andrews, Sol Ex-Officio Member Mahurin, David Curtis, Raymond,* and Betty Glick, Absent: Dwain Gibson Others: Jim Hendricks, Borough Planner; Howard Hackney, Building Inspector; Mr. and Mrs. Miles Dean; Mr. and Mrs. Kenneth Kirk; Bill Nelson, City Engineer; Ernie Schlereth, City Attorney; Mike McLane, Surveyor; Bill and Calvin Quandt 2. PUBLIC HEARINGS 3. AGENDA APPROVAL MOTION: Karen Mahurin moved, seconded by Jerry Andrews, to approve the agenda as submitted. There were no objections. 4. APPROVAL OF MINUTES OF September 12, 1979 MOTION: Karen Mahurin .,moved, seconded by David Curtis, to approve the minutes of .September 12, 1979. There were no objections. 5. OLD BUSINESS A. Tract D, City of Kenai Boat Ramp: Preliminary/Final This item has been tabled at the Harbor Commission and at the Planning Commission. Phil Bryson and Betty Glick had attended the last Harbor Commission and commented on this plat. Mrs. Glick stated that both this plat and the Kenai Spit Subdivision plat are separate from the lease application requests and the Harbor Commission is reviewing the lease applications not the plats. The Commission members discussed the plats and how they were drawn up to suit the lease applications. Some of the members questioned whether the Commission should approve the plat to fit a lease application that was not approved yet. Some other application might want a different survey. Kenai Planning and Zoning Commission ~tegular Meeting, September 26, 1979 Page 2 Mike McLane, representing the surveying of the plats, stated that quite a bit of time and money has gone into the surveying already and they could always be changed later but the City should file them now. Tract D's boundaries are logical ones with the northern portion bounded by Tract C, the western by the Kenai River, the eastern by the Bridge Access Road, and the southern by a Section Line. MOTION: Jerry Andrews moved, seconded;~.by David Curtis, to bring Tract D, City of Kenai Boat Ramp: Preliminary/Final Plat back to the table. The motion passed unanimously. MOTION: Jerry Andrews moved, seconded by Karen Mahurin, to adopt FZ 79-29 approvrg~;Tract D, City of Kenai Boat .Ramp: Preliminary/Final upon the following conditions: Correction of negative finding of Item 9 and the setback along the highway should be 50 feet instead of 25 feet. The Commission questioned Miles Dean cregarding the stream which cuts through the property. Mr. Dean stated that the stream should provide a flushing action for the harbor and will be left in its natural state. He was also asked for an up to date development plan. *Sol Raymond came in at this time. There was a discussion on the present status of the Corps permit and Mr. Dean brought in a copy of the present development plan and pointed out what they plan to do. Phil Bryson again-painted out that the Commission was presently considering the plat and not the lease application. The Commission further discussed the roadway and whether it should be private or a right of way. There was considerable discussion concerning the small stream in the south west corner of the tract and some of the members felt that 'this should form a boundary on that corner. MOTION: Karen Mahurin moved, seconded by-Jerry Andrews. to amend the motion to take out the south west corner to follow the boundary of the creek and to include a 60 foot right of way inside the southern boundary. The amendment to .the .motion failed with--a.l~~.but'~Karen.Mahurn voting negatively. J Kenai Planning and Zoning Commission Page 3 `Regular Meeting, September 26, 1979 Sol Raymond .stated that the reason that re voted .against the } amendment was because of the 60 foot right of way. He would. like to see a 30 foot right of way and the creek as the boundary. MOTION: Sol Raymond moved, seconded by Jerry. Andrews, to amend the motion to include a 60 foot right of way along the southern boundary with 30 feet falling within Tract D and 30 feet below and the westerly portion with .the creek be deleted and extend the boundaryfz•orr. the existing WCMC to a point 600 feet east of the WC. The amendment passed unanimously. The motion with the amendment passed unanimously. B. Kenai Spit Subdivision: Preliminary/Final Plat MOTION: Jerry Andrews moved, seconded by David Curtis, to bring Kenai Spit Subdivision: Preliminary/Final Plat back to the table. j The motion passed unanimously. The Commission discussed this plat and its relationship to surrounding property. They also discussed the right of way. The Commission questioned the operational plans for the City in this area. MOTION: Sol Raymond moved, seconded by Jerry Andrews, to adopt Resolution PZ - 79-21 approving Kenai Sp~ Subdivision: Preliminary/Final Plat upon the following conditions: Corrections of negative findings of Items 9 and 10. 9. Utility easements, if required,are not shown. 10. Lots are not identified by street addresses in accordance with City code. The motion passed unanimously.. MOTION: Sol Raymond moved, seconded by Karen Mahurin, regarding the access to the Kenai Spit Subdivision that the City not. expand or lease the additional property without an access development plan of the unsuitable parcels. Complaint received from Kenneth Kirk Page 4 The Commission reviewed the letters and material submitted in their packets concerning the complaint .against Mr. Miles Deana The Kirks stated that Mr. Dean built a garage too close to their .property line and in fact put material and excavated on their land. Ernie Schlereth, City Attorney, stated that the Commission could only hear the complaint but that action had been taken by the City and Mr. Dean had been requested to - move his building .back the necessary footage. The Commission itself could take no action. Phil Bryson questioned whether a variance request had been requested. Mr. Schlereth stated that a variance cannot correct a mistake and this would 'not be the correct procedure to follow. Mr. Dean. was present and stated that he had made a mistake. He did claim that the survey markers had been moved. The Kirks were present and stated that Mr. Dean had stored his property and excavation material on their land. Again, Mr. Schlereth emphasized that administrative action was being taken by the City in requesting Mr. Dean to move his building; a variance should be applied for before building a structure and the Commission does not have the power to grant a variance. The Commission questioned the responsibility of having the survey done.. Betty Glick stated that she did not believe that the responsibility is with the City. There was further discussion on this. It was brought out that it is the builder's responsibility to set his house correctly on his lot. Jim Hendricks stated that the builder at the time of requesting the building permit should meet the code. It would be correct for the bL~.ilding inspector to ask fora survey to be done., if there were any questions. No action was taken at the meeting. Street Naming .Ordinance Discussion in reference to Petition to change .street name from Wildwood Extended to Cook Inlet View The Commission discussed the petition and_the Street Naming Ordinance. Bill Nelson, City Engineer, had copies available of the street map currently in use. It was suggested that the street be called Cook Inlet Drive to concur with the current street naming ordinance. MOTION: Sol Raymond moved, seconded by Jerry Andrews, to change the street known as Wildwood Extended to Cook Inlet (see attached Resolution PZ-79-31. The motion passed .unanimously. 7. OTHER BUSINESS A. City Council Report: Betty Glick Mrs. Glick reported on the City Council meeting of September 19 at which time the Ordinance to purchase the shop building 1 passed; Resolution to build`an addition to the senior Citizens Center was approved; V.I.P, will be supplied with natural gas; the special use permit for Wien was approved; there will be a work session concerning proposals for a new City Hall. B. Borough Planning and Zoning Report: Betty Glick Mrs. Glick stated that the Borough reviewed the Woodward/Clyde Report. C. Administrative Report D. Borough Report: Jim Hendricks Jim Hendricks stated that the Comprehensive Plan Drafts will arrive on the Saturday Wien flight. He stated that the Council would have to decide on a date for the public hearing and that the City would have to advertise for this hearing. He briefly outlined what the tentative schedule for approval would be. The land sale brochures are available at the Borough and City Offices. ADJOURNMENT MOTION: Karen Mahurin moved, seconded by Sol Raymond, to adjourn the meeting.
