1. ROLL CALL

2. PUBLIC HEARINGS
A. Petition to rezone Government Lot Ne. 97, located in a
portion of Section 34, T6N, R11W, S.M. from Rural
Residential to Suburban Residential.
There was no one present from the public concerning this
rezoning petition. There were no written .comments submitted.
The Commission reviewed the memo from the Borough concerning
this rezoning. Jane Gabler explained that the applicant
was waiting to have this lot combined with another lat to
make one subdivision once the rezoning was approved.
,~ Phil Bryson stated that his firm was doing some engineering
for the applicant and he would abstain from voting.
George Fox: questioned where the lot was located.
MOTION:
Jerry Andrews moved, seconded by Karen Mahurin, to approve
the petition to rezone Govern.,Lot No. 97, located in a
portion of Section 34, T6N, R11W, S.M. from Rural Residential
to Suburban Residential.
The motion passed with Phil Bryson abstaining.
B. Petition to rezone Government Lot 91, located in
Section 34, T6N, R11W, S.P~7., at the intersection of
Candlelight and Kiana, from Rural Residential to
Suburban Residential.
Mike Schmidt was present and questioned what the use of the
property in question would be, particularly whether it would
be used for muli-family units. He has purchased property
adjacent to this lot.
Jane Gabler commented on the Borough memo concerning this
lot. A rezoning would allow for smaller lot size.

Mr. Schimdt was concerned that the rezoning would raise his
~ taxes. Mr. Bryson stated that it would not change the
assessment status of the lots which he owned.
MOTION:
Jerry Andrews moved, seconded by Wayne Regelin, to approve
the petition to rezone Government Lot No. 91, located in
Section 34, T6N, R11W, S.M, at the intersection of
Candlelight and Kiana, from Rural Residential to Suburban
Residential.
The motion passes unanimously.
C. Petition for a Conditional Use Permit from St. Francis
by the Sea, Episcopal Church of Greater Kenai to allow
the use of Government Lots. 40 and 61 for a Day Care
Center.
There were no public comments on this conditional use permit.
Jane Gabler explained that .day care centers are allowed in
this zone ..and are subject to filling the zoning requirements
for parking anal site plans.
There was some discussion that the Commission has to
grant the Conditional Use Permit as long as the requirements
are met.
MOTION:
Karen Mahurin moved, seconded by Jerry Andrews, to approve
the Conditional Use Permit from St. Francis by the Sea,
Episcopal Church of Greater Kenai to allow the use of
Government Lots 40 and 61 for a Day Care Center. Res. PZ-11.
The motion passes unanimously.
3. AGENDA APPROVAL
MOTION:
Jerry Andrews moved, seconded by George Fox, to approve
the agenda.
There were no objections.
4. APPROVAL OF MINUTES OF July 9, 1980.'
MOTION:
Wayne Regelin moved, seconded by Jerry Andrews, to approve
the minutes of July 9, 1980 as submitted.
There were no objections.

5. OLD BUSINESS
A. Lease Application: Kenai Airport Property: Rainier Fund
The Commission commented on the letter received from the
Rainier Fund. The lot is now available for lease as they
have withdrawn their application. The Commission did think
that Rainier's suggestion •to evaluate the parcel for future
possible use for a shopping center was a valid-one.
Jerry Andrews commented that the City is in a position to
order the development it wants on its lands. There is
approximately 1,400' of highway frontage and taking out
100' would not affect it significantly.
B. Lease Application: Kenai Airport Property: Thomas Ackerly
and Patrick O'Connell
Bill Brighton, City Manager, stated that the .applicants wish
to purchase some of the real estate that they have made
lease applications on. The City will have to go through
the process of advertising for sale and will take bids.
The City will not accept bids lower than the appraised value.
They also want to purchase the Dairy Queen property. If the
land is not available for lease then they will apply for its
release from the FAA. It is the Council's desire to sell
property rather than lease it. The applicants want to process
the lease application but hold it up before Council.
Phil Bryson commented that this is a concept lease application
and the City would have the lot surveyed if approved.
Jerry Andrews stated that businesswise it seems right to
attach the 100' to their other lot but he has- reservations
about taking a large parcel such as this and subdividing it
without thought for the entire parcel.
George Fox suggested that the City needs to develop some
plans for this parcel.
The Commissioners asked the City Administration to provide
them with a map of .the City showing existing uses, zoning,
and City owned lands.

The Commission requested that the City Administration

of the area. They also requested that the Administration
bring in a map of the City's leased lands.
MOTION:
Jerry Andrews moved, seconded by Karen Mahurin, to postpone
a decision on this item until the next meeting when the
City Administration will bring a topo map or air photo of
this parcel of land.
The motion passed unanimously.
6., NEW BUSINESS
A. Jackson Property Deed o.f Record Survey: Preliminary Plat
Jane Gabler reviewed the Borough memo concerning this plat.
Phil Bryson explained that this was an existing parcel and
now it is being formalized.
MOTION:
Wayne Regelin moved, seconded by George Fox, to approve
Resolution No. PZ 80-12 as written upon correction of
negative items No. 8 and 9.
8. Utility easements, if required, are not shown.
9. Lots are not identified by street addresses in accordance
with City Code.
The motion passed unanimously.
B. Letter on LSR~T
Phil Bryson pointed out that it is the responsibility of the
Commission to make recommendations and provide priorities
for public works projects. He requested that this be
discussed at the next Planning meeting. Also, the Public
Works Department needs to make their recommendations.
Jerry Andrews stated that the City has a great opportunity
with the Section 36 lands to create a new life style and
put every lot fronting on a park. This may mean the difference
in selling the property.

C. Airport Parking Plan
Jim Swalley explained that Gate 54 has requested more
parking since their expansion. He pointed out that the
plan for the parking for the airport. has been revised
and explained why. The City Administration has met
with the car rentals and the FAA to try and meet their
needs for parking. The car rentals pay 10 percent of their
earnings a year for the parking.. There is a problem with
the car rentals with the cars being parked in front of
the terminal building.. This revised plan should help
with the parking problem and provide better utilization of
the space.
Jerry Andrews felt that the revised plan was better.
Jim Swalley explained that after the City employees move
out, the :.parking used for the City now would be for
Airport employees.
George Fox questioned whether there would be adequate
parking for the short term area and did-.not think that
the local citizens should have to walk the farthest to
park their cars. The rental car people should not be
treated better than the local citizens.
Ed Ambarian stated that the rental car people pay for the
use of the parking area and the short term parking 1s free.
Bill Brighton mentioned that the people using the cars were
businessmen from'outside the City for the most part and
they brought income to the City.
George Fox stated that the car rental business is paying
but so are the citizens of the City. The parking problems
could be better enforced.
Jerry Andrews, Karen Mahurin, and Wayne Regelin all agreed
that the revised plan was a sound one.
Jim. Swalley stated that the lease agreement provided the
car rental businesses with spaces for 40 vehicles.
The Commission indicated support of the proposed amended
Airport parking plan.
D. Corps of Engineer's Permit Application: Union Oil Company
Union Oil has been before the Planning Commission for a permit
for drilling an oil well. The Commission and the Council both
approved.their conditional use permit and the Council issued
a drilling permit. The Commission requested that a letter of
non-objection be sent to the Corps with the condition that
~ Union Oil conform with the requirements of the conditional
use permit for gravel extraction.

Jane Gabler stated th~.t copies of the Spheres of Influence
and Summary reports were available at City Hall.
8. COMMISSION QUESTIONS AND COMMENTS
Karen Mahurin stated that hindsight is not the best when
making planning decisions. She requested that the City
Administration bring in a copy of a map showing City
owned lands and what lands ale available for lease.
9. ADJOURNMENT
