ROLL CALL Present: Phil Bryson, Mary Quesnel, David Curtis, Jim Blanning, George Fox Absent: Wayne Reglin, Jerry Andrews, and Ex-Officio Member Betty Glick Others: Jim Swalley, Airport Operations Manager 2. PUBLIC HEARINGS 3. AGENDA APPROVAL MOTION: Jim Blanning moved, seconded by George Fox, to approve the agenda as submitted. There were no objections. 4. APPROVAL OF MINUTES OF November 12, 1980 ~ MOTION: Jim Blanning moved, seconded by David Curtis, to approve the minutes of November 12, 1980 as submitted. There were no objections. 5. OLD BUSINESS A. Spur Highway Property Adjacent to Gusty Subdivision Jim Swalley stated that he had talked with members of FAA which stated that they leaned towards releasing the frontage lots but not the land behind the lots. He brought the topo maps, sections of plat maps and a photograph of the area for the Commission's review. Phil questioned whether the FAA stated what sort of airport related facilities they envisioned in the area that they are reluctant to release. Jim Swalley thought that they did not have any uses in mind but that they hesitate to allow develop- ment in this area because of possible accidents. It was. questioned how much the concession lots encroach upon the frontage lots .and that the Estes Building would divide these lots. The area is in need of a survey. Kenai Advisory Planning and Zoning .Commission Regular Meeting, December 10, 1980 Page 2 Ron Yamamoto would like to lease a portion of the land next to Lot 3 Gusty Subdivision. George Fox questioned what FAA has to say about building in the clear zone. Jim Swalley stated that he enclosed a copy of a letter from the FAA stating their requirements. Mr. Fox stated that he thought that this area should not allow office buildings but that retail businesses would be o.k. The noise level would be too much for office-type businesses. Phil questioned where the water and sewer lines were. Water runs behind the lots and sewer stops behind Lot 3. He did not see any idea with the concept of leasing the frontage lots. He thought that they should consider a green belt area. MOTION: Dave Curtis moved, seconded by Jim Blanning, to recommend to the City Council that they have the land adjacent to Gusty Subdivision platted per the pattern set by extending Lots 1, 2 and 3 of Gusty Subdivision and made available for lease for retail or commercial use, precluding leasing this land for office structures. AMENDMENT: The lots should be platted to the limit of usable terrain in a westerly direction from Gusty Subdivision, terminating short of the unnamed creek. The motion as amended was approved unanimously. B. Ordinance No. 612-80, Sale of Airport Lands George Fox stated that he would like to see Section F, Paragraph 1 deleted from the Ordinance as it is not necessary and will not serve in the City's best interest. He thought that if a broker has a buyer then he will bring him forward. This paragraph could actually hurt the City if the City Manager was allowed to grant large blocks of land to exclusive listing. It holds the potential that a City P~anager could give exclusive listings to favored realators excluding other realtors. die didn't feel that it is necessary to favor a certain few and it could allow them to take unfair advantage of the City. Phil questioned whether the City is contemplating hiring an individual to be a land manager and would this person also be receiving a percentage payment in addition to his salary. ' Kenai Advisory Planning and Zoning Commission Page 3 Regular Meeting, December 10,1980 _J) One of the commissioners remarked that Jerry Andrews indicated that there is more activity if there is exclusive listings rather than open. Mary Quesnel felt that it would be more advantageous to have multiple listing. MOTION: George Fox moved, seconded by Dave Curtis, to recommend that the City Council consider deleting Section F, Paragraph 1 from Ordinance No. 612-80 for the following reasons. Some members of the Commission felt that this Section was not necessary to the Ordinance as it was not in the best interest of the City. It could actually hinder the sale of City lands if a City Manager had the authority to give exclusive listings for large blocks of land to favored realtors excluding other realtors. They felt that it should be to the advantage of the City to keep the listings open so that any realtor could bring in a buyer. The motion passed with Jim Blanning voting negative. 6. Borough Report: Jane Gabler Jane stated that this would be the last meeting that she would be attending as the Borough would not be giving the Cities any more assistance. There was some discussion concerning the changes in the Borough. 8. COPIMISSION QUESTIONS AND COMMENTS Phil mentioned that the subject of zoning in CIIAP and Fidalgo Subdivisions should be reviewed as most of the subdivisions are light industrial and do not fit the types of buildings which will be going in them. He suggested a work session at the end of the next meeting to discuss this and would like to have plat maps and zoning maps of this area brought to that meeting. 9.
