3. AGENDA APPROVAL
It was suggested that Item A under New Business be moved
after Item E and all other items moved up.
MOTION:
Jim Blanning moved, seconded by Wayne Regelin, to approve
the agenda with the change.
There were no objections.
4. APPROVAL OF MINUTES OF May 13, 1981
MOTION:
Wayne Regelin moved, seconded by Jim Blanning, to approve
the minutes of May 13, 1981 as submitted.
There were no objections.
5. OLD BUSINESS
A. Lease Application: F.B.O. Subdivision, Lots 4, 5, 6
Blue Mountain Ventures, Inc.
Notice of reconsideration given. No action taken.
B. Three W's Subdivision; Addition No, l: Preliminarv Plat
MOTION:
Wayne Regelin moved, seconded by Jim Blanning, to take this
item from the table.
The motion passed unanimously.
Wayne Regelin commented that the City approved Three W's

Subdivision final plat without the streets being put in to
City standards and feels that we should not approve the final
platting of any new subdivision until the streets meet the
City codes. The City is having to go back several years later
to upgrade these streets.
Jack La Shot commented on the specifications that are in the
City Code. Bob Wortham, developer of Three W Subdivision stated
that the Code calls for water and sewer and does not exclude
them. These utilities are not available from the City in this
area.
Phil Bryson commented that the Addition No. 1 is the plat that
the Commission is presently .considering.
Mr. Wortham stated that this will push people out of the City.
There is underground electric and gas in the subdivision. He
wants to have good roads in the subdivision and would put
gravel in but not until the gas and electric companies install
their lines. He would like to have the City maintain the roads.
Phil questioned Mr. Wortham on the cost difference as he is
building the road with sand and all that remains is a gravel
surface.
Mr. Wortham answered that additional costs would be in compacting
and upgrading with gravel. He stated that presently the roads
are in good shape, having been packed down. and require very
little maintenance.
Wayne Regelin suggested getting together a worksession to
discuss how the City is going to handle this in the future.
Each time that they approve a plat that is not up
to standards, we are creating problems later. We have an
Ordinance that we are not enforcing.
Dick Mueller commented as a realator in the City and familiar
with the situation. He does not have a problem with the City
standards prior to approval but should there be two standards
for heavily populated and downtown areas with paving, water,
and sewer, and streets and another for more rural areas. Also,
there should be some type of allowance for where utilities can
not be put in .to the subdivision right away. It is a tremendous
cost to the developer to put in gravel and then have the utility
companies come in. He commented that he has no personal interest
in this subdivision.
Phil Bryson stated that the Planning Commission should have a
meeting with the Public Works Committee, the Public Works
Director and City Engineer on this subject.

Wayne Regelin commented that what the City has now is not
workable .and the City needs to be consistent from now on.
Ron Rice, engineer representing Bob Wortham, reminded the
Commission that they were presently considering the Addition
to Three W Subdivision as a preliminary plat. He has been
discussing the original subdivision with the City and
that subdivision was approved without any mention about
developing the streets and now they are at the second stage
there is discussion regarding putting the roads in. He
would like the Addition addressed separately on the merits
of that subdivision. He can also understand-the concerns
of the Planning Commission and that it is something that
needs to be discussed. He would prefer to address the
subdivision plat only and Questioned if there was a
specific concern with the design, drainage, etc. He would
like to avoid combining this with a subdivision designed
two years ago.
Bill Brighton commented that the City is having some
difficulty with the first portion of the subdivision and
asked what is to say that the second portion will be put
in according to specifications.
Ron Rice asked if it would be possible to get a conditional
approval... and just what the City is asking for. He would
prefer to work with the Administration and make the conditions
known to the developer.
Phil Bryson stated that this was presented as a preliminary
plat and certain stipulations could be .placed on the final
approval. We are now only approving the general layout.
Jack LaShot stated that he thought that the owner is aware
of what the City wants. Mr. Wortham stated that he was not.
He would like to have some kind of compromise as he cannot
see constructing roads and then having the utility companies
come in and tear them up.
The Commission took a short recess at this time to consult
the Code regarding subdivision specifications.
The meeting was brought back to order and Phil Bryson Quoted
from the Ordinance.
MOTION:
Jim Blanning moved, seconded by Jack Castimore, to adopt
Resolution No. PZ 81-6 approving Three W's Subdivision
Addition No. 1 with the corrections of the following negative
items: 7, 8, 9, 10, and 11.

7. Status of surrounding land is not shown.
8. Utility easements, if required, are not shown.
9. Lots are not identified by street addresses in accordance
with City Code.
10. 77th Avenue should be changed to comply with existing
street naming ordinance.
11. The final plat be reviewed by the Planning and Zoning
Commission prior to approval for compliance with City Codes.
The motion passed uanimously.
6. NEW BUSINESS
B. Review Lease General Aviation Apron, Lot 1 Block 4: Ray Cason
This item was included for informational purposes. It has already
approved by Council as a lease renewal.
C. Lease Application: Fidalgo Commercial Center, Block 4, Lot 7
Sidney Webb
Dick Mueller stated that he is working with Mr. Webb on this
lease application and representing him. He stated that they
would like to get started as soon as possible and plan to
start building 30 days after approval-and if approved would like
~ to have some assurance that a time limit has been set.
It will be a retail store, outlet, with freezers to sell fish
and sides of beef, etc. It would require processing sides of
beef but there would be no butchering on site.
Jack Castimore questioned being able to see the side of the
building from the road. Mr. Mueller suggested using trees for
screening or low bushes. They do not want to block their
visibility.
There was some discussion regarding the parking lot:
Phil Bryson questioned the setbacks from a primary federal
aid highway. They should be 150'. It might be a possibility
to move the building back. Mr. Castimore stated that he liked
the idea of moving the freezers back and putting in shrubbery.
MOTION:
Wayne Regelin moved, seconded by Mary Quesnel, to approve the
lease application for Block 4, Lot 7, Fidalgo Commercial Center
to Sidney Webb with the stipulation that the City Administration
check to see that there is no prior filing on this lot.
The motion passed unanimously.
D. Letter G. A. Heppner regarding Lots 1, 2, and 3, F.B.O.

The Planning Commission was to review these lots as they
had originally requested Council to withdraw them and now
have been asked to reconsider this decision. The Council
was afraid to become landlocked in the Terminal and parking
lot. Mr. Brighton further commented that there is abundant
parking available and the land adjacent to the ramp is valuable
for aircraft access.
MOTION:
Jack Castimore moved, seconded by Wayne Regelin, to open up
lots 1, 2, and 3 F.B.O. Subdivision for lease.
The motion passed unanimously.
E. Lease Application: F.B.O. Subdivision, Lots 1, 2, and 3,
_ Block 1, Donald and Karen Creamer
MOTION:
Wayne Regelin moved, seconded by Mary Quesnel, to table this
item until Council decides to lease these lots or not.
The motion passed unanimously.
A. Change in Kenai Code 21.10.030
The City Administration is requesting a change in the Kenai Code.
ADD: "No application will be accepted by the clerk unless
it is apparently complete."
DELETE "After filing, a maximum of 30 days shall be allowed
to complete the application."
P2OT I ON
Jim Blanning moved, second by Jack Castimore, to concur with
the proposed changes to Chapter 21.10 of the Kenai Code,
Leasing of Airport Lands.
The motion passed unanimously.
7. OTHER BUSINESS

D. City Administration Report
Bill Brighton commented on the letter from the Department of
Natural Resources. They are asking for the City to accept
Tract M along with the park and want a letter of non objection.
The members had no objection to writing the letter.

8. COMMISSION QUESTIONS AND COMMENTS
The Commission discussed the memo from the
Planning Commission regarding the proposed
ordinance concerning platting large tracts

MOTION:
Wayne Regelin moved, seconded by Jim Blanning, that the
Planning Commission write a letter to the Borough Assembly
Members opposing the subdivision ordinance, the letter to
be drafted by a committee named by the Chairman.
The motion passed unanimously.
The Commission discussed the need for traffic lights at the
intersection of Beaver Loop and the Spur and Willow and the
Spur.
Bill Brighton commented that the State is the only one to
put up the lights and maintain them. Alex Shadura gave a
presentation on this at the last Council meeting. The State
plans to do another traffic count. Jack Castimore commented
that it would be a sad thing to see some young person killed
because a traffic light was not put in.
Bill Brighton commented that the Chamber is getting ready
to put a push on Council to get after the junk yards.
Phil Bryson questioned the commercial operation by Frenchy's.
9. ADJOURNMENT
MOTION:
Wayne Regelin moved, seconded by Jim Blanning, to adjourn the
meeting. There being no further business the meeting was
adjourned at 9 p.m.
