ROLL CALL Present: Phil Bryson, Jack Castimore, Jim Blanning, Wayne Regelin, Paul Turner, Mary Quesnel, and Ex-Officio Member Betty Glick Absent: None 2. PUBLIC HEARINGS A. Petition to rezone a portion of Swires Subdivision Amended - Section 35, T6N, R11W. The parcel is presently zoned Rural Residential and a General Commercial District has been requested There being no persons present to represent the petition, Chairman Bryson brought the question before the Commission. Phil Bryson stated that in his opinion it was a spot zone. The property is surrounded by Rural Residential with the exception being General Commercial across the Spur Highway and another j strip being a portion of Thompson Subdivision. Wayne Regelin asked if this was the property that had come to question before the Commission previously by Mr. Zubec in that there were trailers being sold on this strip and this was the reason for the request. Mr. Brighton answered that it was. Phil Bryson pointed out that a~' ~ Est ip nearby had been denied at a Planning and Zoning meeting but was returned by the Borough for reconsideration and passed at that meeting by a non-unanimous vote, then passed at the Borough level. Wayne Regelin felt that if this strip were rezoned, then again there would be more requests until the entire strip was General Commercial. Phil Bryson felt that it is an extension of an existing General Commercial zone for all practical purposes. Jim Blanning asked if there was any input from any entity, be it Borough or individuals who were on the mailing list. There had been none. Jim Blanning also voiced his feeling that this would be a continuation of an already existing General Commercial zone. Kenai Planning and Zoning Commission page 2 Regular Meeting, December 9, 1981 MOTION: Jack Castimore moved, seconded by Jim Blanning to approve rezoning of the portion of Swires Subdivision as stated. Motion fails due to tie vote. The Commission requested Mr. Zubec be notified of the results of the public hearing. 3. AGENDA APPROVAL Mr. Brighton asked to be placed on the agenda for presentation of a lease assignment. Chairman Bryson placed Mr: Brighton on the agenda under New Business, Item B. Agenda approved with the above change. 4. APPROVAL OF MINUTES of November 25, 1981 ~ MOTION: Jim Blanning moved, seconded by Jack Castimore to approve the minutes as read. Motion passed. 5. OLD BUSINESS A. Lease application: F.B.O. Subdivision, Lots 1, 2, and 3, Donald and Karen Creamer There being no further information received from the Creamers, the application will expire on 12/17/81. B. Discussion of Gravel Pit applications by City of Kenai Mr. LaShot reviewed the progress of the applications for the Commission. The four borrow pits will-be ready for public hearing at the next commission meeting. The hold-up right now is proof of wonership on one site. Chairman Bryson asked if there were any prohibitions against using what was formerly a borrow site for a fill site and are not on the list. Mr. LaShot stated there was none to his knowledge. The Commission had no further discussion until the applications come back for public hearing. _ ~ Kenai Planning and Zoning Commisson Page 3 Regular Meeting, December 9, 1981 C. Discussion of Capital Improvements List The Commission agreed to pass on this item, having a work session following the meeting. 6. NEW BUSINESS A. Discussion of Memo from Frank Lazer, Borough Planner Betty Glick stated that the Borough is now getting more involved in .the upgrading and development of roads throughout the Borough and in doing. so they are now encountering the same problems that Kenai has and that is, the utilities review subdivision plats, plan the placement of utilities, but when actually placed, they are anywhere but where indicated nor as deep. A hassle has developed with the utilities now in that if the Borough wants utility lines moved, the Borough will have to pay for the move, not taking into consideration that the lines are not where they are supposed to be anyway. At the magnitude of the development going on, the Borough would have to come up with a sizable amount of money. Chairman Bryson asked if Public Works could prepare a recommendation and bring it back to the Borough. Keith Kornelis pointed out that at one time there was a Borough ordinance requested that would outline where utilities would lie, however, that ordinance did not pass. Mr. Kornelis also pointed out that the best idea at present would be to sit down with Soldotna, Kenai, the Borough, and the utilities and decide where lines should go and try to set up some type of uniformity so all concerned would agree. Jim Blanning felt that what the memo was asking for was. to draft an ordinance and then sit down and have that sort of conference. Paul Turner asked if a motion would be in order to support the general idea of standardization of the placement of utilities. MOTION: Paul Turner moved, seconded by Jim Blanning that the Planning and Zoning Commission support the standardized placement of utilities in dedicated rights-of way. Motion passed unanimously Kenai Planning and Zoning Commission Page 4 Regular Meeting, December 9, 1981 B. Lease Application: Mr. John F. Steinbeck dba Kenai Food Center/D & A Supermarkets, Inc. Mr. Brighton presented the assignment to the Commission. Paul Turner asked Bill Brighton if the City had any objections to this proposal and Mr. Brighton assured the Commission that there were none, going on to state~lthat the city attorney had reviewed the assignment and found it to be in order. MOTION: Wayne Regelin made the motion to re-assign the lease of D & A Supermarkets from John F. Steinbeck dba Kenai Food Center to D & A Supermarkets. Jack Castimore seconded the motion. Motion passed unanimously. 7. OTHER BUSINESS A. City Council Report: Betty Glick Betty Glick reminded the Commission members of the party to take place on Friday evening, December 18th at the King George, and urged members to attend. Concerning Ordinance ~~864-81 which limits the application of Kenai Muncipal Cade to leases of land on airport and restricted to aeronautical related uses. This deletes the 50% cap on all lands that are not immediately adjacent to the airport, and all lands that fell under the cap will .now be paying the full lease price. This becomes effective now so that any new leases will pay the new or full rate. The Council adopted a resolution requesting the Borough to provide adequate staffing of assessors. This did not mean new persons hired, but to utilize the proper methodology to take into account the increased evaluation of property through the computor process. Another resolution supports the application for installation of Kenai Peninsula Cable Vision. There is currently an office in Kenai and the man in charge is Norm Barnett. Another resolution requested the Alaska Railroad build a spur to the City of Kenai and was amended to assure that the State in accepting the railroad would get the proper right-of-ways. ~ Discussion was held in regards to the Kenai~Soldotna relationship and trying to get something done jointly for the good of the entire area.. One of the main ideas discussed was a development or extension of an industrial water line. The discussion was not of a supportive nature. A few minor items were also discussed, ;~~ Kenai Planning and Zoning. Commission Page 5 Regular Meeting, December 9, 1981 with considerable input from the audience regarding the past relationship between Kenai and Soldotna. Minutes are available for further details. Mrs.. Glick stated for the record that Ruby Coyle had pointed out that in regards to the Capital Improvements priority list, she would like to see the City continue with the priority list as it was established last year, added to, and this way, by continuing with that list it would help .keep the integrity of the City with the legislators in Juneau. She asked that those comments be relayed to the Commission. At the next regular session of the City Council on Wednesday, Mayor O'Reilly suggested that Commission members participate in a joint work session. The Council will get back to the Commission members with specifics. Also, a public hearing on Saturday, December 19th at 9:00 a. m. B. Borough Planning Report: Betty Glick The Borough planning Commission conducted a public hearing on competitive oil and gas lease sale 435 in .the lower Cook Region. ~ At the las-t Planning and Zoning meeting, Jack LaShot, City Engineer pointed out that final approval for plats was being given administratively at the Borough level without the City being aware of it,until the subdivisions come to the City for maintenance for streets. When Betty Glick relayed this information to the administration, they requested a letter incorporating this request. MOTION: Paul Turner moved, seconded by Jack Castimore that the City of Kenai be allowed to review subdivision plats prior to Borough Administrative approval on a final basis to ensure they comply with the City of Kenai code which applies to road,. water,. and sewer standards.
