The attorney .a.gr.eed that this w.aul.d be the .bast w.ay. C.ommissinner Bryson asked t.he -diff.er.e.n.ce between .a res.oluti.on .and the .orali.nanc.e, .J.e.ff L.abahn .ex.plai.ner! it w.as mainly for the .b_anks w.ho .agr.e.ed that this would .be.a.cceptabl.e to.cle.a.r their .pr.o.bl.ems. Commissioner Smalley .asked for details concerning the nrdinanc.e relating to buildi.n.g survey r.equireme.nts that w.as s.e.nt to .C.ou.ncil, .Jeff Labahn explained that it w.as felt, .mainly by the builders, that the .expens.e of .havi.ng 2 s.uru.eys done w.oul.d h.av.e t.o .be .passe.d .on t.o the PLANNING COMMISSION October 24, 1984 Page 2 COTE: buyer which they wanted to avoid. OLD .B.USINESS a._l.eas.e A.p~lic-ati.on: Lot 3, .Baron Park 5/D - Sandwi.c.h Shop - Swenor Leff .Laba.hn introduced the .ap.pli.c.ati.an stating that the minutes of the Last meeting r.efl.e.ct that there were 3.questi.o.ns whic.h.cvncer.r~ed the Cammissio.n. Chuck Swenbr .came forw.ar.d to address the .q.uestions. Mr. Swen.or stated that .his intention is the .constru.et the 2 .driveways initially; the l.ands.caping will be the same as .on the original .appli.cation anal the b.uff.er, w.hil.e there are n.ot.many si.gnifi.ca.nt trees existing, he wi11 be putting in some .bir.ch. Mr. Sw.enor st.ate.d that the pl.a.ns deviate somewhat from the sit.e.pl.a.n pr.esent.e.d in that he wi11 be.p.utti.ng the building on a 6.0° angle r.at.her than .as shown. Gou.ncilman .Wise asked Mr. Sw.en.or if h.e is .aware .of the .cost .of the .lot, .answer yes. Commissioner $ryson asked if there had been any attempt .on the .part of the Swe.n.ors to.ev.alu.ate .any other parcels, answer n.o. The Swenors felt this w.as the best location for their resta.ur.ant, the main r.e.as.on .bei.ng that it lies .b.etween the Dairy Que.e.n .and the Nigh School. C.ammissioner Smalley ask.e.d if the Sw.e.n.ors were -aware of the c1.os.ed .c.a.mpus .p.olicy, the Sw.e.nors .are informed. Th.e Sw.e.n.ors v.oi.c.ed concern .ov.er the present 1oc.ati.o.n. C.ammissi.o.ner Bryson asked .t.he Sw.e.n.ors f.or an .estimat.e of s.p.a.ce would b.e .need.ed for just the restaurant .phase of the lease, answer about 250'. Go.mmissioner Bryson stated that .his con.cer.n is with th.e layout; that it is poorly laid o.ut; there is a lot of front.a.ge with .slot .of depth; .plus the .cast .of the water .& s.ew.er. There is only the ballfield bejro.nd this lot. MOTION: C.ommissio.ner Smalley moved _a.pproual of lease application f.or the Swen.ors on .des.cri.bed property, s.e.c.onded .by .Commissi.o.ner Z.ubeck. VDT.E: T.he Commission .discussed the p.ossi.bility of splitting the lease to a.c.commod.ate the 2.p.has.e .constr.uction pl.a.ns, .cutti.ng the .cost for the lessee a.n.d providing for the possibility that the .business becomes to.o exp.e.nsive. .Gommissi.o.ner Z-u.bec.k asked w.hy the .City su.b.diuided t.h.os.e lots s.o .big if that is a .co.nc.ern. Jeff La.b.ahn explained that there are some .us.es that would require that mu.c.h space or more c.o.nsi.deri.ng the fact that this is .extremely .desir.a.ble fro.nt.ag_e. Motion passeal unanimously. b. .L.ease A.ppli.c.ati.on: .L.ot 4, .Gusty S/.D - .Commercial Building - Yamamot.o T.he .Gou.ncil .awarded the lease .t.o Mr. Ya.ma.mot.o a.nd since the Commission has n.ot formally reviewed it .a.nd made rec.omme.nd.ati.ons it returns. Jeff .L.abahn.expr.essed concern .over the l.a.ck .of i.nf.ormati.on .c.o.nc.er.ni.ng .gravel or paving of th.e parking area, snow removal, .and lan.dsca.ping of the RDW. C.ou.n.cilman klis.e r_e.c.ommende.d that rather than .h.ol.d .u.p the process any longer, the Commission can send along its recommendation if it f.e.els that .paving is n.ecess.ary. Commissioner Smalley stated he felt .uncomf.ortable in requiring paving as it has .not been .done in the past. MOTION: C.ammissioner Smalley moved a.pprov.al .of the lease _applicati.on f.or Mr. X.a.ma.moto f.or the des.cri.b.ed .pro.perty, with the f.oll.owing att.a.c.hme.nt: that h.e verify whether paved or.gravel.ed .parking .anal that snow r.emov.al be taken to the rear of _t.he .buil.di.ng, sec.a.nded .by Commissioner Os.b.orne. Lease Application: Lot 1, Et.olin S/D 1st Add. -for Recre.ati.on.a11 Civic Center - B.utl.er' Mr. Butler .n.ot in .attendance. Jeff L.aba.hn stated that this lease is on a lot which had been previously approved f.or a bowling alley. That l.eas.e had .b.e.e.n drop.p.ed. T.he .building ins.p.ect.or expressed some .concern .over the us.e of the s.ec.ond story. Jeff L.abahn ex_presse.d .c.on.c.er.n .over .the .p.ar.l~i.ng, that it is mi.ni.mal, .and citing A.nc.hor.a.g_e.as a.n .exa.mpl.e, for .a roller rink similar i.n siz_e, the r.e.quirement is for 120 spaces as opp.os.ed t.o the .69 indi.cat.ed. .commissioner Ol.eson noted .that the roller rink in Sol.dotna does .not have as many .as b9 and _app.arently have no.p.robl.em since.most o.f the .b.usiness is from .ki.ds w.h.o ar.e dropped off. There are high s.c.ho.ol .a.ge .drivers, .b.ut from what is o.bs.erve_d, they .arriv.e several .pers.o.ns to .a v.ehcl.e. T.he .Commissi.on felt that ©nly .a very f.ew lots w.oul.d be affected and would 1.eav.e the problem u.p to the .dev.elo.p.er. Th.e sec.on.d c.o.ncer.n w.as with the .number .of Lots an a .cul-.de-sa.c, the .Commissio.n agreed to leave the issue up to the Bor.au.gh. Preliminary Plat PZ84-9D: Zubeck S/D It is noted that rezoning is req.uest.ed on lots 2-1.0 .only, lot 1 is t.o remain GG. Mr. Z.ubec.lc n.ot.e.d that this plat was .diff.er.e.nt t.ha.n the one he .had been given by the s.urv.ey.~r, that the plat showed a co.ntin.uati_on of Ali.ak when t.her.e is .no.provisi.an for a .ROW f.or .his property. It was the agreement of the Commission that perhaps what th.e surveyor .had i.n.mi.nd was a s.ecti.on 1i.ne .eas.eme.nt, .howev.er, this .a.p.pears t.o .be .on a quarter section. T.he Capital Improuements list was revised after .Mr. .McAl.pine's visit. C.ou.ncilman YVise i.nfor.me.d the .C.ommission .t.hat the .Commissio.ners were invited t.o attend the Munisip.al L-ea.gue s.essio.ns being held in Anc.hor.a.g.e November 14-17. T.her.e is money au.ail.a.bl.e for travel ex.p.enses for any w.ho .could attend. .Jeff L.abahn stated that 11/14 w.as t.h.e .day s.che.dul.e.d for .planning rel.ate.d.activity .and this would be the best .day for the Commissioners to .att.end.
