Lanier Attorney At Law 1700 North Chester Avenue Bakersfield, California 93308-2596 RE: Conditional Use Permit fora Bed & Breakfast Establishment - 2820 Watergate Way - Helm Dear Mr. Lanier: The application for conditional use permit for a bed & breakfast establishment was approved by the Commission on January 24, 1990. A copy of the approved minutes is attached for your information. From those minutes you will find that Mr. Helm carried the public hearing process one step further by approaching those local residents himself and presented a petition of non-objection signed by those persons. A copy of the petition is also attached. As for. the notice not reaching you in time for your comments, the City of Kenai does follow the code (attached) and I'm sorry, but the City of Kenai cannot be responsible for when you pick up your mail. I~am sending a copy of the letter stamped with the date received by this department and as you can see, it reached City Hall the day after the hearing. There are provisions for persons wishing to file an appeal to any decision made by the Planning Commission and a copy of that portion of the code is also attached. In this instance there were several comments in favor of the application that went beyond the certified notices sent out. If you wish to pursue the matter further, I await hearing from you. Again, I regret that your comments couldn't have been heard by the Commission, however, under the circumstances unless you submit your request for appeal in writing, the Commission would not reconsider the matter. Existing Zoning: Rural Residential Carrent Land Use: Multi-family Residential nTCr~ttce-rn~r. The applicant desires to operate a river guide service, bed & breakfast, multi- family residence, and Xerox business from this location. The bed & breakfast was approved at the meeting of January 7.4, 1990. The approved minutes of that meeting are attached. Page 2 indicates the decision of the Commission that the applicant return for a home occupation permit for his Xerox business. While this i.s not the issue at this point, the Commission should take this into consideration as there will be four businesses contained in one building. Also attached for your information is a letter received after the last public I hearing regarding the bed & breakfast. Again, 18 certified notices were sent out and there were no comments received by today.
