La Shot reported that the property is located on Airport Lease Lands so it requires
Commission approval. Doyle is developing aself-serve car wash next to his existing
car wash. The landscaping will be similar to the existing car wash.

La Shot reported that the property is in the Townsite Historic Zone (TSH). The
applicant wishes to combine 5 irregular lots into 3. The surveyor has verified that
there are no building encroachments. If development exceeding $10,000 in value is
planned a iandscapinglsite plan review will be required.

a. Resolution PZ 94-14: Sundance Construction -Lake Street
Jack La Shot reported that the development is behind Dan's TV, and is located on
private lots. It is the new building for Central Peninsula Counseling Services and is on
a fast track. A building permit was issued for the foundation as the valuation was
under $10,000, any framing which is being done has been at the builder's awn risk. A
ROW vacation request will probably be coming before P&Z in the near future. The
owners are also hoping to acquire adjacent lots, if they can not obtain these lots there
should be room on their lot to extend parking area into their property on the left side.
Phil Bryson said he was uncomfortable approving a plan on property that belongs to
someone other than the applicant, which is in a public status. He felt it was wrong to
give an opinion before there was a public hearing on the vacation of the easement,
and approving a sitepian for off the lot is ill advised.
La Shot recommended an option that approval of the sitepian be contingent on the
vacation being approved or have the owner extend parking onto his own property. He
also recommended that the Commission stipulate that the landscaping plan not be
deviated from, at least on the east side of the lot should they need to expand parking
on that side.
Ron Goecke asked if there was a reason that the vacation had not been applied for

Rick Vann, Sundance Construction, P.O. Box 561, Kasilof, the process has been
started at the Borough level. The Counseling Service has to be out of their present
offices by June 1, so he is trying to get the building done. What they are doing is
taking out the overburden which will have to be done even if the road extension has to

go through there for access to the property. Between now and the time the vacation
is approved he will go right into the planting stage far the landscaping.
Phil Bryson, asked La Shot if the area where the parking is proposed to be off the lot
was a 60 foot ROW?
La Shot, said yes, that entire parking lot is wi#hin that ROW.
Bryson asked i# the picnic area was on another lot?
Rick Vann said there were three lots there, two have already been purchased the third
he was waiting on the paperwork on. Most of the property is over the bluff and there
is very little usable property left.
MOTION:
BRYSON MOVED TO APPROVE THE SITEPLAN FOR THE SUBJECT LOT WITH A
REQUIREMENT THAT THE APPLICANT HAVE TO PROVIDE FOR PARKING ON
HIS OWN PROPERTY, IF PROPERTY EXPANDS PARKING CAN EXPAND. LORI

Rick Vann said that there is enough parking available for the building size on his lots,
if the vacation is not granted.
Phil Bryson asked if the City Attorney has been apprised of this situation. La Shot
answered, "yes". Bryson said it was his assumption that no rights were being granted
for any property which is not in present ownership.

Chairman Walker opened the item for public comment, seeing and hearing none he
brought it back to the Commission and asked for staff comments.
La Shot reported that the applicant plans to put an addition on the west side of the
building and extend parking in that direction. The landscaping plan is minimal and
there may be room for a tree or shrubs.
Phil Bryson said he would be abstaining from this item as his firm was providing
design services for the expansion.

Jack La Shot mentioned that the lease for this property had been approved on a
previous item. The landscaping will be similar to the adjacent car wash, a mounded
area with four trees and a roped fence.

Jack La Shot said that some natural vegetation will be left and a lawn will be planted
between the new building and the existing building.
Phil Bryson asked if lot BLM 151 is own by the church & 152 is owned by the city?
La Shot answered both lots are owned by the city, there is an existing encroachment.
The church would like to purchase these lots but they have been designated park
lands and it is virtually impossible to sell them.
Bryson asked if the sitepian approval was for Lot 1? La Shot said yes and you could
further state that it does not pertain to the existing building.

6. PUBLIC HEARINGS

MOTION:

Clarence Aiken, Director of Technical Services, Cellular One, 411 Mellow Place,
Anchorage.
Ed Call, said he saw some discrepancies in the application. One place the tower is
135 #oot and the other says 120.
Aiken said he didn`t see anything with 135, the correct height is 120 feet. The FAA
document requires that everything be included, even the antennae above the tower,
so Cellular One gives themselves same leeway on the application.
Edward Call asked if there would be a red light on top of the tower.
Aiken, replied that is based on FAA regulations, but the distance that the tower is from
the airport should not require a red light on that tower. The FAA filing is more a
~ courteousy to the FAA, to give them the final judgement on that. Based on their
guidelines it shouldn't require one.
Edward Call, 1202 Lilac, asked if the tower would affect property values in that area?
Mr. Aiken felt there shouldn't be any affect on the valuation.
Call asked if there were any code requirements to make sure there were buffers
between this business and residential properties? La Shot said this development was
in place before the Landscaping/Site Plan code was developed.
Phil Bryson asked if the transmissions would interfere with focal television reception,
etc? Aiken said that the frequencies are well above television frequencies, he did not
know of any instances where this was a problem and if anyone felt things were being
interfered with, Cellular One would be happy to come and take a look at it.
Edward Call said his concerns had been addressed.
Tom Moore, PO Box 944, Kenai, said he own a duplex behind the proposed tower
area. He said he had no objections but was concerned that there not be a red
flashing light on top of the tower. He asked if a condition could be made that a red

light not be allowed.

a. Spruce Bark Beetle -Moose Pass Cooperative Project
~a Shot noted that the City Manager had requested that the Commission review the
packet of information and make recommendations to the State. Chairman Walker said
this is a threat to the Peninsula's future and asked if anyone had comments on this
item.
~ Ron Goecke said he wasn't sure what action was being requested of the Commission.
Walker asked if the Commissioners should review the information and come prepared
to discuss this at the next meeting.

Chairman Walker asked for a motion for Fisherman's Paint Vacation and noted this
would rescind the original action taken at the last meeting.

DISCUSSION:
Chairman Walker asked far further comments on this issue.
Bryson asked if this only affected lot 4 or the Breeden Knackstedt property, if it was a
joint petition?
Breeden said she was a joint signer on the petition.
Bryson said the intent of his motion was both lot 4 and what's referred to as the
Knackstedt remainder, Gv't Lot 7.
Ron Goecke said he did not have a big problem with the vacation, the problem he had
was people and the snowplow coming down that narrow street, where do they turna-
round? in front of Victor Hett's house (answer from audience). He suggested that the
city talk with Breeden about developing a twenty foot area to develop that turn, in case
road conditions make it impossible to use the area in front of Hett's.
Loretta Breeden said that all the lots at the end of the road are sold. There will be no
more people moving in so traffic should not increase.
Teresa Werner-Quads said she had originally voted no on this issue because she had
gone down Barabara Drive and she fait it was a narrow road and it was hard to turn
around there. She hadn't really understood how the neighbors felt about people
turning around in there driveways. Breeden stated it had never been a problem.

Phil Bryson had reviewed a city map and said he had trouble addressing this issue
because it should be addressed first as a change to the land use plan. He felt the
property owners along the spur corridor should initiate the rezoning. He felt that the
corridor was approaching more commercial status but there are still large residential
areas that may resist commercial status.

9. CODE ENFORCEMENT ITEMS
a. AAA Taxi - 1385 Chisik Drive
La Shot noted that AAA Taxi was staring some cars in a lot across from their
permitted business. A copy of the letter which was sent to them was included in the
packet and they had been given 30 days to correct the violation. There are a number
of sites around the city where junk cars are a problem. La Shot explained that he was
hold off notify property owners because a car crusher is expected to arrive in June
and many of these people have already been contacted to have the cars removed and
crushed.
Charlie Pierce felt the city should pursue letters to junk car owners to be consistent in
enforcement of the ordinance. La Shot said that staff would look into this issue.

Bryson reported that the~City of Homer was pursuing a Coastal Zone Management
(CZM) review for another lagoon on the Spit. This will tie in with the existing lagoon
and be used for an additional fishing area.
Chester Cone has requested an extension for his CZM review on his boat dock.

Phil Bryson asked the Commission to consider reviewing properties in some
recreational areas, such as the Beaver Loop area which may be appropriate for a
Commercial Recreation zone. There are also some residential areas which may fit
more appropriately in RR-1 or RR-2 zones. An overall review of zoning areas within
the city may be an appropriate project for the Commission in the near future.

DISCUSSION:
Chairman Walker asked for public comment. Seeing and hearing none he brought the
item back to the Commission.
Jack La Shot reported that the zoning is now Central Commercial. A similar plat was
reviewed at the last meeting. The owner and surveyor are now creating four lots out
of eight and vacating aright-of-way (ROW) between the new lots 6A & 5A. La Shot
asked that the City retain a 3Q' utility easement for a portion of where the ROW was,
and otherwise had no objection to the vacation. The city may have main utility lines
where the easement will be retained.

Chairman Walker asked for public comment. Seeing and hearing none he brought the
item back to the Commission.
DISCUSSION:
Chairman Walker noted the memo regarding notification. Four property owners had
been missed within the 300 foot perimeter required by code. He then asked the
Commission if they wished to proceed with action on the item, or have staff repeat the
public hearing notification? Walker felt Staff had made an adequate attempt to notify
interested parties. Ron Goecke called for the question.
Carl Glick asked if the four people that were missed were contacted? Loretta Harvey
said that the local residents picked up a packet, the two property owners from
Anchorage were not directly notified, due to time constraints.
Walker noted that this application was consistent with existing developments in the
area and thought it would be a good area to be zoned for commercial recreation
activities.

a. Corps of Engineers Permit - 22-910107 Kenai River -The Pillars
Chairman Walker introduced the item and felt the COE was looking for a letter of
support or non-objection from concerned agencies. Goecke said he had a problem
supporting this project if it would jeopardize the other project the Commission had
reviewed at a previous meeting.

MOTION:
CARL GLICK MOVED TO SEND A LETTER OF SUPPORT FOR THIS PROJECT TO
THE COE. THE LETTER SHOULD INCLUDE A STATEMENT THAT THIS NOT
JEOPARDIZE THE PREVIOUS PROJECT. CHARLIE PIERCE SECONDED.
Leo Oberts explained that the property was part of his homestead and he had sold it
to the State for development of a park. In the next two years the State will develop
two boat launching ramps, two docks and public restrooms.
Phil Bryson said that the COE permit is for the docks and is not concerned with the
land. He had the same concern as Goecke that the projects not jeopardize each
other, however the projects are quite a ways apart on the river and would not directly
impact each other.

b. KPB Notice of Proposed Land Classification
Lot 4A & Lot 5A Shelikof SID -Ray Dudley, KPB Land
Management Officer
Ray Dudley, Land Management Officer for the KPB said under a new Land
Management Ordinance Chapter 17.10 all Borough land must be classified before it
can be dealt with. In order to classify land, it must be reviewed, the Planning
Commission holds a public hearing and makes their recommendation to the
Assembly. The two small lots 4A & 5A Block 1, Shelikof SID are owned by the School
District and have been classified as Government and had been designated for houses
to be built by school students. However, these houses will not be built due to budget
cuts. The District does not plan to dispose of these at this time, but if properties are
not needed they would retain the government classification.
Carl Glick said the lots were too small to build government buildings and there is
presently no access. He asked if there would be a problem in classifying the lots as
residential since which would be more consistent with the City zoning designation?

Dudley said he had no problem with classifying them as residential. He added that
the Ordinance has two classi#ications which can be used residential and rural
residential which is low density, out of the way areas.
Kevin Walker said he owns land adjacent to the property and asked the Commission if
he should abstain from this item? The Commission felt it was not a conflict since he
would not benefit directly by the sale of these lots.
MOTION:
CARL GLICK MOVED TO RECOMMEND THAT THE TWO SMALLER LOTS BE
CLASSIFIED RESIDENTIAL AND NO OBJECTION TO THE OTHER LOTS AS

Teresa Werner-Quade asked Dudley, if this was a general classification of Borough
lands? Dudley answered, "yes". She wondered if because it's classified residential
doesn't necessarily mean a large development will happen there. If something was
going to happen would interested partes be notified again?
Dudley said that was correct.
Phil Bryson said the Borough is required to classify these lands in order to include
them in any kind of planning. it is not a zoning situation it is not even a land use
situation. It is a very early stage in the Borough's planning for this area.
Werner-Quade said she is concerned that the large parcel if close to the airport. She
was concerned about another subdivision coming in so close to the airport run-up
area. This could be a big problem to the residents of a large subdivision, especially in
the summer when the large hauling planes are flying.
Walker pointed out that the map in the Comprehensive Plan and the distance from the
airport to be farther than it appears on the map provided by the Borough. Werner-
Quade reiterated that she was concerned about the future, she had spoken to the
Airport Manager and if the airport is expanded it would go in that direction. She did
feel her questions had been answered about this matter, that it is just an initial step in
the planning process.

c. Leo Oberts
Mr. Oberts presented a copy of a plat which had been drawn up previously and never
finalized. He explained to the Commission that he is considering developing the
subdivision near the area discussed under item 7a. the Pillars. He would probably sell
the lots #or residences or condominiums and just wanted the Commission to know his
plans which will be coming before them for approval in the future.
8. OLD BUSINESS
a. Spruce Bark Beetle -Moose Pass Cooperative Project
Chairman Walker noted this item had been carried forward from the previous packet to
give the Commission time to review the project and make comments.
MOTION:
RON GOECKE MOVED TO SEND A LETTER OF SUPPORT TO THE STATE OF
ALASKA URGING ACTION ON THE SPRUCE BARK BEETLE PROBLEM,
INCLUDING IMMEDIATE LOGGING OF INFESTED HILLSIDES IN THE COOPER
LANDING AREA. CHARLIE PIERCE SECONDED.
DISCUSSION:
The Commission compiled a list of the following suggestions:
Extensive logging of infected areas, burning forest debris.
Slash burning or chemically treating infected areas.
Establishing multiple contracts which are easily understood by all involved
parties.

Chairman Walker noted the memo which was included in the packet regarding this
property. When the names were reviewed at the Borough level there was a
discrepancy discovered in the Borough Ordinance. The names had been changed to
the correct designations and the Staff wished for the Commission to review the
resolution again before it is passed to Council.

1 Q. REPORTS
a. City Counci
Councilman Smalley noted that the Budget workshop sessions went well and the City
is in good shape for the next Fiscal Year. Several new staff may be added, two part-
time at the Library and an Engineer Technician in Public Works. A 4% cost of living
adjustment has also been considered.
The Landscaping Siteplan Review which the Commission approved on the Doyle Car
Wash was an issue of concern. It was discovered that the building, which is on airport
lease land is located in the no-fly zone. The applicant has been apprised of the
situation and notified that the FAA can request that the structure be removed within 90

~~ days of notice if there are problems. The applicant is reviewing his plans.
b. Borough Planning
Phil Bryson reported that the Whisker's Replat as approved at the previous meeting
was passed at the Borough level. The new plat Original Townsite of Kenai Whisker's
Replat is a result of some of the concerns which were expressed at the Borough level.
Bryson also noted that there is a nice addition to the Homer lagoon which has passed
through the Coastal Zone Management Review process. Bryson asked to be excused
due to another commitment.
c. Administration
Jack La Shot noted that the Commission had previously reviewed an Applicatian for
Development in the TSH zone for Beluga RV Park. At the time the project was
approved for an office, showers and washing facilities. The building which is presently
under construction is approximately 54% larger than what the Commission approved.
La Shot asked if the Commission wished to require that the Vozar's, owners of Beluga
Point Lookout RV Park submit an updated Application for Development and the
Commission hold a re-review of the development?
Carl Glick said he felt the development should come back before the Commission
since it was such a large change from the first plans that were submitted.

La Shot noted that the Thompson Park project bids had been opened. Faster was the
apparent low bidder until Council approval on May 4th. There will be a community
meeting on May 10th in regards to this project.

Chairman Walker noted that there will be a Scoping Open House for Fort
Kenay/Mission Street Improvements on May 17, 7:00 - 10:00 p.m. at Kenai City Hall.

Teresa Werner-Quade asked that the Commission observe a moment of silence in
memorial to former President Nixon.
Charlie Pierce noted that he would not be able to attend the next meeting.
Chairman Walker expressed concern about the road condition at the end of Mission
and Main Street. The bluff has eroded dangerously close to the log barricade and he
asked if the City should erect a new barricade or possibly close the road until the
situation can be evaluated. Also Walker asked that the City review the problem of
roller-bladers on city streets. La Shot said he would look at the problem and discuss
options with Administration.
The Commission took a moment of silence in honor of former President Nixon.
