a. PZ04-21 - A resolution of the Planning and Zoning Commission of the City of Kenai,
Alaska, recommending to the Council of the City Of Kenai, Alaska, that the Land Use
Table in KMC 14.22.010 be amended to provide that FAA authorized uses are allowed in
the conservation zone for those properties contained inside the airport perimeter fence or
having access to aircraft movement areas, ramps, taxiway or parking aprons.
b. PZ04-22 - A resolution of the Planning and Zoning Commission of the City of Kenai,
Alaska, recommending to the Council of the City Of Kenai, Alaska, that the Council elect
to administer the Kenai Peninsula Borough's Anadramous Streams Habitat Protection
Ordinance by adopting it and incorporating it by reference into KMC 14.20.165.

MINUTES
ITEM 1: CALL TO ORDER
Chair Glick called the meeting to order at approximately 7:00 p.m.
1-a. Roll Call
Roll was confirmed as follows:
Commissioners Present: J. Barrett, J. Harnmelman, B. Eldridge, N. Amen, C. Glick
Commissioners Absent: P. Bryson
Others Present: Acting City Clerk Padilla, Council Member Ross, City
Manager Linda Snow, City Planner Kebschull
1-b. Agenda Approval
Chairman Glick requested the following:
ADD AS: Item 7-c -- Amendment to KMC 14.20.245--Recreational Vehicles --
Discussion -- Schedule Public Hearing.
MOTION:
Commissioner Eldridge MOVED to approve the agenda with the addition of Item 7-c
and requested UNANIMOUS CONSENT. Commissioner Barrett SECONDED the
motion.
VOTE:
There were no objections. SO ORDERED.

MOTION:
Commissioner Barrett MOVED to approve the consent agenda as presented and
requested UNANIMOUS CONSENT. Commissioner Eldridge SECONDED the motion.

ITEM 2: APPROVAL OF MINUTES -- June 9, 2004

ITEM 5: PUBLIC HEARINGS
5-a. PZ04-21 - A resolution of the Planning and Zoning Commission of the
City of Kenai, Alaska, recommending to the Council of the City Of Kenai,

Commissioner Eldridge MOVED for approval of PZ04-21 and Commissioner Amen
SECONDED the motion.
Kebschull stated several parties are interested in leasing these properties. She said
the airport is studying the issue at this time and is waiting for suggested uses. The
FAA defines the area adjacent to the runway and inside the fence as the "airport
perimeter," Kebschull said. Amen asked if there would be access, and Kebschull
answered there would be access through the gates. She also said this would be only a
short-term solution. Glick asked if this item had been approved by the Airport
Commission and Kebschull answered yes.

5-b. PZ04-22 - A resolution of the Planning and Zoning Commission of the
City of Kenai, Alaska, recommending to the Council of the City Of Kenai,
Alaska, that the Council elect to administer the Kenai Pexunsula
Borough's Anadrornous Streams Habitat Protection Ordinance by
adopting it and incorporating it by reference into KMC 14.20.155.
MOTION:
Commissioner Eldridge MOVED for approval of PZ04-21 and Cozxirnissioner Amen

~~ There were no public comments. Amen asked what criteria they should use to make a
decision. Since there is no information in the code, Kebschull said, they should use
the information provided them. Amen asked if they should consider the cost to the
City and Kebschull said Councilman Bookey had advised the Commission the Council
would decide haw to fund it.
Barrett stated he completely disagreed with the ordinance far two reasons. First, he
said, "there are no boogey men" on the Borough Assembly. Second, it would be a
"degradation of City services" because staff would be spending too much time on it
rather than other things.
Amen asked why the Commission became involved in the issue and Kebschull said
any issue affecting Title 14 always goes before the Planning & Zoning Commission.
Barrett said it was his understanding that during the last two years the City would
have been involved in making 64 decisions if the Gity had been administering the
ordinance. Further, he said, if the City can't make the rules more lenient (because of
the Borough ordinance), then why bother.
Hammelman said the City was better off to have the Borough handle it. He said there
was nothing wrong with the way it was being handled currently, and the ordinance
was being proposed for the wrong reasons. Hammelman said he thought people might
have forgotten why the Borough implemented the ordinance originally and that was to
promote responsible development along the Kenai River, not to stop development.
Also, he stated, it wasn't fair for Kenai citizens to have to pay for a service that's
already being provided.

MOTION:
Commissioner Barrett MOVED for approval of the lease application and Commissioner
Hammelman SECONDED the motion.
Kebschull reported the application did not meet the zoning code; however, it did
comply with the Airport Master Plan and the Comprehensive Plan. She said if the
amendment to the Land Use Table was adopted, the lease would then meet the zoning
code. Hammelman asked if the motion should be reworded to note the amendment
would have to be adopted or the property rezoned. The Commission agreed with
amending the motion, though no formal motion was made.

7-c. Discussion and Set Public Hearing -- Amendment to KMC 14.20.245 --
Recreational Vehicles.
Kebschull explained some people were taking advantage of a "loop hole" in the code
allowing RV's to be parked and used in the City for 30 consecutive days. She said the
City's intent for long-term use was to allow for company/relatives staying with an RV
for up to 30 days, but same people are now parking them on empty residential lots.
Kebschull said she spoke with the City Attorney and they drafted language for the
code that would prevent this. The new wording would include that a property must
have a principal permitted structure on it.
The Commission agreed to put the recommended change on the agenda for public
hearing on July 14+x.

ITEM 10: REPORTS
10-a. City Council -- Councilman Rick Ross reported the helmet ordinance
public hearing would be held at the July 7, 2004 council meeting.

10-b. Borough Planning -- None.
10-c. Administration -- Kebschull reported the following:
• The landscape site plan had been received from the Snowder clinic on
Bidarka;
• Information had been requested for remodeling the Burger King, but it
was not known who inquired;
• Kenai Landing would not be opening by July 4 as the building inspector
had not done the final inspection. Opening would probably be two or three weeks
later;
• She would provide a report on building permits for the next packet.
Eldridge commented he had driven by Kenai Landing recently and there was no
launch ramp. Kebschull stated that it is believed construction had been delayed and
the area will be screened to protect the public.
ITEM 11: PERSONS PRESENT NOT SCHEDULE --
Phil North, 3$10 Wildrose Avenue, Kenai -- North stated he agreed with the
Commission's decision not to pass the river protection resolution, but he wanted to
comment on it anyway. He said one reason for the Kenai River Center being built was
to put ail the permitting functions in one building to make it easier for the public, and
it also turned out to be good for the departments involved. The Corps of Engineers
also had plans to move into that building, pending funds, he stated. North said he
thought moving those functions from the River Center would degrade the way the
system worked.
Also, North said, his wife used to work for the City at the Library, so he was somewhat
familiar with issues of staffing shortages. He said the City shouldn't be adding
services while cutting staff. When asked, North said he works for the EPA, but he was
speaking as a resident of Kenai.
ITEM L2: INFORMATION ITEMS -- None.
ITEM 13: COMMISSION COMMENTS 8a QUESTIONS
Barrett thanked staff for the anadromous stream information included in the
packet.
Hammelman said he was a big fan of Kenai because of its diversity, though
small. He said he wanted the City to continue to grow and develop, but he didn't want
it to take on river protection.
Eldridge noted, at the Chamber luncheon Home Depot reported they had
exceeded their six-month goals for Kenai.
