Street, Suite 1000, Anchorage, Alaska.
b. PZ07-42 - An application for an Encroachment Permit fora 6-foot front setback for
the property known as Lot 4, Block 14 Original Townsite of Kenai (1011 Alaska Ave.)
Kenai, Alaska. Application submitted by Kent P. Cheerier, 124 East 3rd Ave., Suite 211,
Anchorage, Alaska.

a. PZ06-75 -Conditional Use Permit -Bed & Breakfast -Lot 2, Block 2, Illiamna View
Subdivision (4520 Kenaitze Court) -McKenzie -Status.
7. NEW BUSINESS:
a. PZ07-43 - An application for development in the Townsite Histoxic zone for a storage
shed for the property known as Lot 4, Block 14, Original Townsite of Kenai (1011
Alaska Avenue). Application submitted by Kent P. Cherrier, 124 East 3rd Avenue, Suite
211, Anchorage, Alaska.
b. Residential use in the CG -General Commercial Zone -Discussion.
8. PENDING ITEMS:
a. PZ07-24 - A resolution of the Planning and Zoning Commission of the City of Kenai,
Alaska, recommending to the Council that KMC 14.20.200 {Accessory Structures) be
amended by adding a section prohibiting the use of connex-type metal shipping
containers for storage in residential zones. (Postponed 7/11/07 - no time certain.)
b. PZ07-25 - A Resolution of the Planning And Zoning Commission of the City Of Kenai,
Alaska, recommending to the Council to enact KMC 9.10.015 requiring dumpsters to be
screened on at least three sides. (Postponed 7111107 - no time certain.}
c. PZ07-28 - A resolution of the Planning and Zoning Commission of the City of Kenai,
Alaska, recommending to the. Council that KMC 12.20.030 be amended by better
describing and defining what constitutes prohibited storage of "Junk," "Garbage" and
"Litter" under the City code. (Postponed 7125107 - no time certain.)

ITEM I: CALL TO ORDER
Chair Twait called the meeting to order at approximately 7:00 p.m.

The roll was taken and confirmed as follows:
Commissioners present: R. Wells, J. Twait, P. Bryson, R. Smagge, S. Romain
Commissioners absent: T. Lewis (excused)
Others present: City Planner M. Kebschull, Council Member R. Ross
A quorum was present.
1-b. Agenda Approval
MOTION:
Commissioner We11s MOVED to approve the agenda as presented. Commissioner
Bryson SECONDED the motion. There were no objections. SO ORDERED.
1-c. Consent Agenda
MOTION:
Commissioner Smagge MOVED to approve the consent agenda as presented and
Commissioner Wells SECONDED the motion. There were na objections. SO
ORDERED.

ITEM 2: APPROVAL OF MINUTES -- July 25, 2007

5-a. ~ PZ07-40 - An application for a Conditional Use Permit fora 180-foot

City Planner Kebschull reviewed the information presented in the packet; noted, due
to the tower height, FAA approval was required and was received; arid, the old tower
will be removed after the new one has been successfully installed.
Twait read the rules far public hearing, and opened the meeting to public hearing.
There being no comments, the public hearing was closed.
MOTION:
Commissioner Bryson MOVED for approval of PZ07-40 incorporating all staff
comments and Commissioner Smagge SECONDED the motion.
Ken Carlson, GCI Communica~i~ons -- Provided the Commission with a copy of the
FCC requirements far removal and replacement of the tower.
Commissioner comments included:
• Bryson noted he believed the application met the intent of the zone and
the current tower was placed prior to the city assuming zoning powers.

Kebschull reviewed the packet information and Chair Twait opened the public hearing.
Don Baker, 1010 Alaska A~renue -- Supports the petition. Site is well maintained.
Commissioner comments included:
Bryson reported he visited the site and noted the site plan. included in
the packet did not indicate the paved parking, lawn, and telephone pole on one side of
the shed that would restrict development to the site. He added, he would support the
motion because the site was well developed and relocation of the shed would require
placement either into the paved area or lawn.
There being no further comments, the public hearing was closed.
MOTION:
Commissioner Bryson MOVED for approval of PZ07-~42 with staff comments and
Commissioner Smagge SECONDED the motion.

ITEM 6: OLD BUSINESS
6-a. PZ06-75 -Conditional Use Permit -Bed 8a Breakfast -- Lot 2, Block 2,
Illiamna View Subdivision (4520 Kenaitze Court) -McKenzie -Status.
Kebschull reported the permit had not been issued because the applicant had not met
the conditions and therefore would need no review by the Commission.
ITEM 7: NEW BUSINESS
7-a, PZ07-43 - An application far development in the Townsite Historic zone
for a storage shed for the property known as Lot 4, Block 14, Original
Townsite of Kenai (1011 Alaska Avenue) . Application submitted by Kent
P. Cherrier, 124 East 3rd Avenue, Suite 211, Anchorage, Alaska.
Kebschull reviewed the staff report included in the packet.

7-b. Discussion -- Residential use in the CG -General Commercial Zone
Kebschull reviewed an August 2, 2007 memorandum sent to the Commission noting
Administration requested Commission's assistance in reviewing residential use in the
General Commercial zone. The Commission requested additional information be
provided from the City Attorney for their next meeting. There was no further
discussion.
ITEM 8: PENDING ITEMS
8-a. PZ07-24 - A resolution of the Planning and Zoning Commission of the
City of Kenai, Alaska, recommending to the Council that KMC 14.20.200

9-c. Administration -- Kebschull reported the Camrnission should consider
rezoning in the Angler Acres Subdivision and added, the State now requires seasonal
lodge liquor licenses for places currently providing free alcohol to their guests.
