Kenai, Alaska. NAr ~s~s Received Kenai I 'b ~~ the Conditional Use Permit for RV as Government Lot 168, (11844 Kenai As property owners of the adjoining lots, former Government lot 169 (now Letzring Subdivision), we feel that the use proposed is incompatible with the current surrounding area. The entire city block, defined within Birch Street, Spruce Street, First Avenue and Second Avenue is at this time used for residential homes. As you look at the diagram attached to the Fublic Hearing Notice, not shown on the diagram is our home. It is on Letzring Lot 2, where the numb®r 31 is. As proposed, any motor homes parked in lot 168 will be within eighteen feet of our children's bedrooms and four feet of our back deck. This is a large lot and there is no reason that a parking area needs to be butted up against the property line of the only adjacent home, where we have lived for over ten years. Noise from RV generators late at night as well as loud group gatherings is a concern. There would also undoubtly be arrivals and departures at all hours of the day and night. Any commercial use should be restricted to the present commercial area across First Avenue. There is an old house, unsuitable for living and unsafe for habitation on lot 168. There is no operating water or sewer to this lot and in the past when the lot's owner rented the dwelling, the inhabitants used the bushes as an outhouse. With no toilet or shower facilities available we fear this would be a greatly multiplied sanitary problem. We also fail to see how the owner of the lot can safely allow an RV Lot to operate here while this unsafe building stands on the property. (Q C: ,~ There are at least two RV lots currently available in downtown Kenai, within a couple of city blocks, in more accessible areas. We are further concerned that the quality of people attracted to a RV lot at this location would be questionable, which presents a whole new set of problems associated with the security of our home and safety of our children, not to mention a decline in property values. We do not desire to have cannery housing in this area! The increase in traffic is also a concern as we have two children ages 10 and 12 who play and ride bicycles, along with other children from the neighborhood, in the street. Recreation vehicles are not known for their unobstructed view and ease of maneuverability. Because of the children we are also concerned with the type of transient people who can pick up and go at a moments notice and who would be aware of our children and their daytime habits. We are not simply opposed to any business being started as we did not oppose the permit for a sawmill although it would be across the street from us and we would look at it every day. The key was that the sawmill would be run during normal business hours. An RV park would be open all hours. Perhaps the most important aspect it that this property does not meet codes and standards for a RV parking area. There are no toilet or shower facilities available for those RV's that are not fully self contained. Electricity is a basic need which is not provided, all night running of generators will disrupt the entire neighborhood. Simply leveling and graveling is not going meet the needs of an RV parking area. In consideration of our concerns, and those concerns expressed in letters and in person by the homeowners who received notice of this application, we request that you act in the best interest of the neighborhood and deny the application for the Conditional Use Permit for RV Parking at this location. Besides the normal concerns of having a business located in a residential area, I have the following specific concerns: 1. Upon speaking with the City Engineer, I was informed that this permit has an indefinite life. I would request that any conditional permits be given a definite term. It is extremely difficult to determine the impact of these permits and their uses until a period of time and use has expired. This would give the permit holder as well as those affected by the permit an opportunity to review and examine the outcome of that permit, before being issued again. 2. As the map shows, North Lupine is a major ingress to Valhalla Subdivision. There are only two ingresses for this subdivision, so the amount of traffic those two streets get with normal traffic is major. Beyond the problems of speeders, and having an unpaved street that generally leaves a dust cloud of about 12' high regularly until such time the City starts its' dust control program. Then we have about 6 week reprieve of no dust. Any additional traffic on this road would add to an already aggrevated problem. Another issue is a safety factor. There are several children in the area that are in the streets with bikes, etc. In the general vicinity there are no less than 10 children within a close radius that go back and forth on bikes or walking to their friends. Increased traffic, also increases the risk of one of these children being harmed by additional and/or new traffic, which would have no idea of the children's patterns or of the children. 4. I would like the Commission to request of the permit holder to define what are "summer months", i.e., May through August, June through September, June through August. I would request that the permit holder start no earlier than the day after school finishes and close no later than the first day of school. Children gather at bus stops early in the morning and afternoon. With that many children concentrated at bus stops, the risk increases for accidents to happen. If the above conditions could be addressed, I would withdraw my objections to this permit. Thank. you for your consideration. We have conferred twice on the issue and concluded that an appeal of a plat at the preliminary stage is premature. Title 20 of the KPB Code provides an appeal process for final plats but not for preliminary plats. Approval of a preliminary plat by the Planning Commission does not constitute approval of the final plat, but means only that the basic lot and street design are acceptable. The subdivider is on notice that it is his responsibility to provide all the information required by Title 20 for final plat approval. Plats in first class and home rule cities must be in compliance with any city ordinances concerning installation of improvements and zoning regulations before fmal approval can be granted by KPB. The recommendations of the City Advisory Planning and Zoning Commission shall be incorporated into the final plat as a condition for final approval. Recommendations must be based on lawful ordinances and the land use plan adopted in the comprehensive plan for the city. The City Advisory Commission does not have the authority to deny a preliminary or final plat. If a final plat of Richka Park Estates Subdivision is submitted to KPB, final approval will be withheld until all applicable provisions of the City of Kenai ordinances have been met. 'This letter is to request that you postpone or table aCdon an this subdivision, which is ewrently scheduled to be heard on your May 8, 1995 agenda. The City of Kenai Planning and Zoning Commission denied approval of the first version of this plat at its meeting on Aprll 12, 1995. The developer then appeased that denial to the Kenai City Council, which will hear the appeal on Saturday, May 13, 1995 (copy of appeal notice attached)_ In addition, an April 13, 1995, the developer filed a second version of this plot with the City and the Borough. The second version of the plot was scheduled to be considered the Kenai Planning and Zoning Commission on April 26, 1995, but the Commission did not havye a quorum that night, and so postponed co~asideza.tion to May 10, 1995. Since the second version of the plat, which ~-ou will consider an May 8, 1495, has not been considered by the Kenai Planning and Zoning Commiesion, action by the Borough Planning and Zoning Commission is premature. I understand that the Borough Planning and Zoning staff has recommended that you approve this plat, because the e~ty took no action on the plat at its April 12, 1995 meeting. However, as you can see from the City notice, the City denied the plat at its April 12t 1995 meeting. Zhe plat you ace considering tonight has not been eonsidenxl by the City. The Cornnrittee is opposed to this subdsvision for a number of reasons, and the Committee and its members would like the opportunity to testify about these reasons in front of the Commi=lion, However, three heariugs on this subdivision are scheduled the week of May 8, 1995, two at the City, and one at the Borough, and it will be difficult for many of them to attend all three.
