No resident of the community will be able to purchase a federal flood insurance policy. Impact examples: An owner trying to sell an uninsured residence will not be able to do so if the buyer needs to obtain a mortgage or loan from afederally-insured or regulated lending institution. No federal grants or loans for building may be made in identified flood hazard areas. Includes all federal agencies such as HUD, EDA, Small Business Administration, HEW, etc. This includes repair or improvement loans. No federal disaster assistance may be provided in identified flood hazard areas. This includes homes financed by FHA, VA, Farmer's Home, etc. -. On conventional loans, lenders: must notify buyer or lessee that property is in flood hazard area; and must notify buyer or lessee that property in flood hazard area is not eligible for federal disaster relief in a declared disaster. No Federal National Mortgage Association and Government National Mortgage Association purchase of mortgage in the secondary market may be made if the properties that are the subject of these mortgages are located in special flood hazard areas of non-participating communities. No Alaska Housing Finance Corporation (AHFC) loans for new construction or mortgage purchases may be made if properties are located in special flood hazard areas in non-participating communities. Actuarial rates go into effect for first-layer coverage of all construction occurring after the effective date of the Flood Insurance Rate Map (FIRM), regardless of whether or not the community participates in the program at that time. Construc- tion which is allowed in flood-prone areas because of the lack of an effective or- dinance, will be subject to prohibitively expensive flood insurance rates when the community does, enter the program. Also, the risk of flood damages and expen- sive flood insurance premiums will adversely affect the future market values of structures. Construction which occurs within identified floodways, without regard to the fact that such construction does increase flood water depths and velocities, increase flood cTa'mages to adjacent properties in the event of major flooding. If flooding occurs, it is possible that the local governments could be held liable by residents and/or businesses who could not get flood insurance because of the decision not to participate in the National Flood Insurance Program. (b) Provide appropriate information concerning present uses and occupancy of the flood plaice. (c) Cooperate with Federal, State, and local agencies and private firms which undertake to study, purvey, map and identify flood plain areas, and cooperate with neighboring communities with respect to management of adjoining flood plain areas in order to prevent aggravation of existing hazards. AN ORDINANCE OF THE CITY OF ALASKA ESTABLISHING LAND USE REGULATIONS TO CONFORM TO REQUIREMENTS OF THE NATIONAL FLOOD INSURANCE PROGRAM AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS. Alaska Statutes 29.35.260(a) empowers the City of to exercise a power not othervvise prohibited by law. WHEREAS, it is desirable to provide the residents and businesses of the City of the opportunit~r to purchase flood insurance; THEREFORE BE IT ENACTED BY THE CITY COUNCIL AS FOLLOWS: Section 1.0 Statutory authorization, findings of fact, and purpose Section 2.0 Definitions Section 3.0 General Provisions Section 4.0 Administration Section 5.0 Flood Hazard Reduction 5.1 General Standards 5.2 Residential and Nonresidential Construction Section 6.0 Erosion OPTIONAL STANDARD Section 1.0 Statutory authnri~a+~~., finding~f fact and vu ose. The .City Council of ,Alaska, does recognize that the city is periodically subject to flooding, and areas adjacent to the river bank may be subject to erosion, furthermore, both hazards may result in loss of life and property, health and safety hazards, and public expenditures for flood protection, relief and erosion control, all of which adversely affect the public health, safety and general welfare. Thr's purpose of this ordinance is to promote public health, safety and general welfare } and to minimize flood losses. To acwmplish this purpose, it is the intent of this ordinance to: 1. Encourage land uses vulnerable to floods be protected against flood damages at the time of initial construction or substantial improvement; 2. Modify land uses which are dangerous to health, safety or property in time of flood or cause excessive increase in flood heights or velocity 3. insure that subdivision and development of land within the city are consistent with the need to minimize flood hazards; and Insure that the sale of flood insurance is available to residents, and that those who occupy the areas of special flood hazard assume responsibility for their actions Section 2 0 Definitions "AREA OF SPECIAL FLOOD HAZARD" means the land in the floodplain within a community subject to a one percent or greater chance of flooding in any given year. "DEVELOPMENT' means any man-made change to improved or unimproved real estate, including but not limited to buildings or other structures, mining, dredging, filling, grading, paving, excavation or drilling operations located within the area of special flood hazard. "FLOOD" or "FLOODING" means a general and temporary condition of partial or complete inundation of normally dry land areas from: (1) the overflow of inland or tide[ waters and/or (2) the unusual and rapid accumulation of runoff of surface waters from any source. "STRUCTURE" means a walled and roofed building, manufactured home, and includes a gas or liquid storage tank that is principally above ground. "SUBSTANTIAL IMPROVEMENT' means any repair, reconstruction, or improvement of a structure, the cost of which equals or exceeds 50 percent of the market value of the structure either: (1) before the improvement or repair is started, or (2) if the structure has been damaged, and is being restored, before the damage occurred. For the purposes of this definition "substantial improvement: is considered to occur when the first alteration of any wall, ceiling, floor, or other structural part of the building commences, whether or not that alteration affects the external dimensions of the structure. ---- -._ __ .-~__ .___ ~ vii av SECTION 0 G _naral rovisions 3.1 LANDS TO WHICH THIS ORDINANCE APPLIES This ordinance shall apply to all areas of special flood hazard within the jurisdiction of the City of Until such time as a "Flood Insurance Study" and "Flood Insurance Maps" are published by the Federal Insurance Administration for ____i, the city shall reasonably utilize the High Water Marks of Record. SECTION 4.0 Administration 4.1 ESTABLISHMENT OF DEVELOPMENT PERMIT 4.1-1 Developlrtent Permit R nuiran A development permit shall be obtained before construction or development begins to determine if such development is proposed within flood-prone areas. The permit shall be for all structures, including manufactured homes, and for all development including fill and other activities. 4.2 Designation of the Lo al dminic+ratnr (usually the City Administrator of City Clerk) The is hereby appointed to administer and implement this ordinance by granting or denying development permit applications in accordance with its provisions. 4.3 DUTIES AND RESPONSIBILITIES OF THE Duties of the shall include, but not be limited to: 4.3-1 Permit Review (1) Review all development permits to determine if the proposed development is located in a flood hazard area. (2) Review a(I development permits to determine that all necessary permits have been obtained from those Federal, State, or local governmental agQncies from which prior approval is required. (3) Review all development permits to determine if the proposed building sites will be reasonably safe from flooding. 4.3-2 Inf°tmation to be Obtained and Maint fined (1) Maintain for public inspection all records pertaining to the provisions of this ordinance. (2) Where base flood elevation data or High Water MarKS of Record are provided, obtain and record the actual elevation of the lowest floor of all structures; and if applicable, elevation to which any structure has been floodproofed.. SECTION 5 0 PROVISION FO FLOOD HAZARD REDUCTION 5.1 GENERAL STANDARDS If a proposed building site is in a flood-prone area, all new construction and substantial improvements shall meet the following standards: 5.1-1 Anchori' (1) Be designed and adequately anchored to prevent flotation, collapse or lateral movement of the structure; a!I manufactured homes must likewise be anchored to prevent flotation, collapse or lateral movement. 5.1-2 Construction Ma ari~tc anri ~~othods (1) All new construction and substantial improvements shall be constructed with materials and utility equipment resistant to flood damage. (2) All new construction and substantial improvements shall be constructed using methods and practices that minimize flood damage. (3) Electrical, heating, ventilation, plumbing, and other service facilities shall be designed and/or otherwise elevated or located so as to prevent water from entering or accumulating within the components during conditions of flooding. 5.1-3 'Utilities (1) All new and replacement water supply systems shall be designed to minimize or eliminate infiltration of flood waters into the system: (2) New and replacement sanitary sewage systems shall be designed to minimize or eliminate infiltration of flood waters into the systems and discharge into flood waters; sewage lift station electrical panels shall be elevated above High Water Marks. 5.1-3 Subdivision Pro osals (1) All subdivision proposals shall be consistent with the need to minimize flood damage; (2) A!I subdivision proposals shall have public utilities and facilities such as sewer, gas, electrical, and water systems located and constructed to minimize flood damage; (3) All- subdivision proposals shall have adequate drainage provided to reduce exposure to flood damage. 5.1-4 'I in P rmit Where flood elevation data is not available either through a Flood Insurance Study or from another authoritative source, applications for building permits will be reviewed to assure proposed construction will be reasonably safe from flooding. The test of reasonableness is a local judgment and includes use of historical data, high water marks, photographs of past flooding, where available. Failure to elevate at least two feet above grade in these zones may result in higher insurance rates. 5.2 ~ (1) In all areas of special flood hazards, new construction and substantial improvement of any residential structure shall have the lowest floor elevated to or above base flood elevation if established, or the high water marks of record. (2) Fully enclosed areas below the lowest floor that are subject to flooding are prohibited. 5.3 Nonresidential [:nn~+~ ~.~+~~~ New construction and substantial improvement of any commercial, industrial or other nonresidential structure shall either have the lowest floor elevated to or above the level of the vase flood elevation or high water marks of record; or, together with attendant utility and sanitary facilities shall: (1) Be floodproofed so that below the base flood level the structure is watertight with walls substanitally impermeable to the passaage of water; (2) be certified by a registered professional engineer or architect that the design and methods of construction are in accordance with accepted standards of practice for meeting provisions of this section and such certifications shall be provided to the city manager. (3) Fully enclosed areas below the lowest floor in nonresidential elevated structures that are subject to flooding are prohibited. Walker asked for additional staff comments. La Shot stated there were no additional comments to the information already in the packet. Walker asked if there was anyone in the public wishing to comment on this resolution. Kenai Planning and Zoning Commission Minutes -August 9, 1995 ~ Page 2 Tony Doyle, Batir Creative, 7984 Kenai Spur Highway. Doyle stated he is the general contractor on this project. They are upgrading the exterior of the old Bailey building, adding a small addition in the back and a covered porch on the front to make the handicap access better. Mahurin asked Doyle to explain the awning cover over the patio and walkway. Doyle said they are going to replace the old wood with blue metal siding. The awning is a porch cover that will extend off the front with some hand rails. Doyle said off the back is a crafts room addition, a concrete patio with a 10 x 18 roof over it. Mahurin asked if the awning is fabric. Doyle stated the roof will be metal. Glick clarified - in the front they are just putting a roof over the sidewalk. Doyle said that is correct, they'll be extending the sidewalk to the end of the building and covering the ramp. Bryson asked if the building is still owned by the Bailies. Doyle said he thinks Central Peninsula Counseling Services purchased it from the Bailies. CODE ENFORCEMENT ITEMS Kenai Planning and Zoning Commission Minutes -August 9, 1995 ~ Page 3 10. REPORTS a. City Council Duane Bannock commented on the Board of Adjustment Decision. He noted that this Commission has looked at rezoning along the Spur Highway, and it is in the current Comprehensive Plan. He said he doesn't like to see the rezone happen a parcel at a time, but feels it does need to be rezoned to commercial. Bannock said the council went on a field trip through Old Town. He said there were several ideas about what to do with the Spruce Street beach, i.e., maybe a permanent parking lot; whether to keep the beach road open or close it; etc. There was also some discussion regarding the Vozars cabin situation. Bannock reminded anyone who puts up campaign signs must have them removed within two weeks. Bryson noted Bannock made reference to the existing Comprehensive Plan supporting the decision that was made. Bryson said he interpreted that portion of the Land Use Plan (sheet 4 in the existing plan) as designating the area as low density residential. Bannock said there is a written paragraph in the Plan that states the entire Spur Highway corridor within the city limits should be commercial. Bryson asked if the Land Use Plan should represent the long term intent. Walker stated the Land Use Plan is a current land use map, the plan will be what is actually written into it after the Commission's review. b. Borough Planning Phil Bryson had no report because the Borough has not had a meeting since July. c. Administration La Shot said he had no report . 11. PERSONS PRESENT NOT SCHEDULED None 12. INFORMATION ITEMS a. Board of Adjustment Decision -Benton Walker stated the Council overturned the decision of Planning & Zoning Commission and Kenai Planning and Zoning Commission Minutes -August 9, 1995 Page 4 asked for any comment. Bryson said their rationale seemed to be directing the Planning & Zoning Commission to address the whole area at a later time. Bryson said perhaps the Commission should look at that at a later time. 13. COMMISSION COMMENTS AND QUESTIONS None 14. M/L situated in the NE 1/4 NE 1/4 Sec. 3, T5N R11W, SM, AK, Kenai Existing Zoning: R Current Land Use: Recreation ANALYSIS City Engineer: This plat dedicates r/w southerly from Lawton Dr., through city owned and leased property (golf course) to property to the south. Legal access now exists along the section line easement, however the proposed alignment presents a better physical alignment (through edge of wetlands) and creates a more aesthetically appropriate situation along the golf course. RECOMMENDATIONS Recommend approval contingent upon the following: 1. An installation agreement to construct Swires Drive from Lawton south, and Lawton from the end of existing to Swires. The agreement shall cover street, drainage and miscellaneous. 2. Since the city owns the property, KPB 20.16.155 requires that "All parties having an interest of record in land being subdivided shall sign a certificate of ownership and dedication printed on the plat."
