CARL GLICK MOVED APPROVAL OF RESOLUTION PZ 9422. PHIL BRYSON
SECONDED.
DISCUSSION:
Chairman Walker asked for public comment. Seeing and hearing none he brought the
item back to the Commission.
Jack La Shot reported that the zoning is now Central Commercial. A similar plat was
reviewed at the last meeting. The owner and surveyor are now creating four lots out
of eight and vacating aright-of-way (ROW) between the new tots 6A & 5A. La Shot
asked that the City retain a 30' utility easement for a portion of where the ROW was,
and otherwise had no objection to the vacation. The city may have main utility lines
where the easement will be retained.

PUBLIC HEARING:
\~ Chairman Walker asked for public comment. Seeing and hearing none he brought the
item back to the Commission.
DISCUSSION:
Chairman Walker noted the memo regarding notification. Four property owners had
been missed within the 300 foot perimeter required by code. He then asked the
Commission if they wished to proceed with action on the item, or have staff repeat the
public hearing notification? Walker felt Staff had made an adequate attempt to notify
interested parties. Ron Goecke called for the question.
Carl Glick asked if the four people that were missed were contacted? Loretta Harvey
said that the local residents picked up a packet, the two property owners from
Anchorage were not directly notified, due to time constraints.
Walker noted that this application was consistent with existing developments in the
area and thought it would be a good area to be zoned for commercial recreation
activities.

7. NEW BIISIIVESS
a. Corps of Engineers Permit - 22-910107 Kenai River -The Pillars
Chairman Walker introduced the item and felt the COE was looking for a letter of
support or non-objection from concerned agencies. Goecke said he had a problem
supporting this project if it would jeopardize the other project the Commission had
reviewed at a previous meeting.

MOTION:
CARL GLICK MOVED TO SEND A LETTER OF SUPPORT FOR THIS PROJECT TO
THE COE. THE LETTER SHOULD INCLUDE A STATEMENT THAT THIS NOT
JEOPARDIZE THE PREVIOUS PROJECT. CHARLIE PIERCE SECONDED.
Leo Oberts explained that the property was part of his homestead and he had sold it
to the State for development of a park. In the next two years the State will develop
two boat launching ramps, two docks and public restrooms.
Phil Bryson said that the COE permit is for the docks and is not concerned with the
land. He had the same concern as Goecke that the projects not jeopardize each
other, however the projects are quite a ways apart on the river and would not directly
impact each other.

b. KPB Notice of Proposed
Lot 4A & Lot 5A Shelikof
Management Officer
Land Classification
S/D -Ray Dudley, KPB Land
Roy Dudley, Land Management Officer for the KPB said under a new Land
Management Ordinance Chapter 17.10 all Borough land must be classified before it
can be dealt with. In order to classify land, it must be reviewed, the Planning
Commission holds a public hearing and makes their recommendation to the
Assembly. The two small lots 4A & 5A Block 1, Shelikof S/D are owned by the School
District and have been classified as Government and had been designated for houses
to be built by school students. However, these houses will not be built due to budget
cuts. The District does not plan to dispose of these at this time, but if properties are
not needed they would retain the government classification.
Carl Glick said the lots were too small to build government buildings and there is
presently no access. He asked if there would be a problem in classifying the lots as
residential since which would be more consistent with the City zoning designation?

Dudley said he had no problem with classifying them as residential. He added that
~ the Ordinance has two classifications which can be used residential and rural
residential which is low density, out of the way areas.
Kevin Walker said he owns land adjacent to the property and asked the Commission if
he should abstain from this item? The Commission felt it was not a conflict since he
would not benefit directly by the sale of these lots.
MOTION:
CARL GLICK MOVED TO RECOMMEND THAT THE TWO SMALLER LOTS BE
CLASSIFIED RESIDENTIAL AND NO OBJECTION TO THE OTHER LOTS AS
RESIDENTIAL. PHIL BRYSON SECONDED.
DISCUSSION:
Teresa Werner-Quade asked Dudley, if this was a general classification of Borough
lands? Dudley answered, °yes°. She wondered if because it's classified residential
doesn't necessarily mean a large development will happen there. If something was
,going to happen would interested partes be notified again?
Dudley said that was correct.
j Phil Bryson said the Borough is required to classify these lands in order to include
them in any kind of planning. It is not a zoning situation it is not even a land use
situation. It is a very early stage in the Borough's planning for this area.
Wemer-Quade said she is concerned that the large parcel if close to the airport. She
was concerned about another subdivision coming in so close to the airport run-up
area. This could be a big problem to the residents of a large subdivision, especially in
the summer when the large hauling planes are flying.
Walker pointed out that the map in the Comprehensive Plan and the distance from the
airport to be farther than it appears on the map provided by the Borough. Werner-
Quade reiterated that she was concemed about the future, she had spoken to the
Airport Manager and if the airport is expanded it would go in that direction. She did
feel her questions had been answered about this matter, that it is just an initial step in
the planning process.

c. Leo Oberts
Mr. Oberts presented a copy of a plat which had been drawn up previously and never
finalized. He explained to the Commission that he is considering developing the
subdivision near the area discussed under item 7a. the Pillars. He would probably sell
the lots for residences or condominiums and just wanted the Commission to know his
plans which will be coming before them for approval in the future.
8. OLD BUSINESS
a. Spruce Bark Beetle -Moose Pass Cooperative Project
Chairman Walker noted this item had been carried forward from the previous packet to
give the Commission time to review the project and make comments.
MOTION:
RON GOECKE MOVED TO SEND A LETTER OF SUPPORT TO THE STATE OF
ALASKA URGING ACTION ON THE SPRUCE BARK BEETLE PROBLEM,
INCLUDING IMMEDIATE LOGGING OF INFESTED HILLSIDES IN THE COOPER
LANDING AREA. CHARLIE PIERCE SECONDED.
DISCUSSION:
The Commission compiled a list of the following suggestions:
Extensive logging of infected areas, burning forest debris.
Slash burning or chemically treating infected areas.
Establishing multiple contracts which are easily understood by all involved
parties.
Build access roads (along section lines when possibly) to facilitate clean-up
effort.
Request the City Council to draft a resolution in support of the project.

b. Street Names-- Black Gold Estates
Chairman Walker noted the memo which was included in the packet regarding this
property. When the names were reviewed at the Borough level there was a
discrepancy discovered in the Borough Ordinance. The names had been changed to
the correct designations and the Staff wished for the Commission to review the
resolution again before it is passed to Council.

9. CODE ENFORCEMENT ITEMS
10. REPORTS
a. City Council
Councilman Smalley noted that the Budget workshop sessions went well and the City
is in good shape for the next Fiscal Year. Several new staff may be added, two part-
time at the Library and an Engineer Technician in Public Works. A 4% cost of living
adjustment has also been considered.
The Landscaping Siteplan Review which the Commission approved on the Doyle Car
Wash was an issue of concern. It was discovered that the building, which is on airport
lease land is located in the no-fly zone. The applicant has been apprised of the
situation and notified that the FAA can request that the structure be removed within 90
days of notice if there are problems. The applicant is reviewing his plans.

b. Borough Planning
Phil Bryson reported that the Whisker's Replat as approved at the previous meeting
was passed at the Borough level. The new plat Original Townsite of Kenai Whisker's
Replat is a result of some of the concerns which were expressed at the Borough level.
Bryson also noted that there is a nice addition to the Homer lagoon which has passed
through the Coastal Zone Management Review process. Bryson asked to be excused
due to another commitment.
c. Administration
Jack La Shot noted that the Commission had previously reviewed an Application for
Development in the TSH zone for Beluga RV Park. At the time the project was
approved for an office, showers and washing facilities. The building which is presently
under construction is approximately 50% larger than what the Commission approved.
La Shot asked if the Commission wished to require that the Vozar's, owners of Beluga
Point Lookout RV Park submit an updated Application for Development and the
Commission hold a re-review of the development?
Carl Glick said he felt the development should come back before the Commission
since it was such a large change from the first plans that were submitted.

Jack La Shot said he would check with the City Attorney regarding the proper
procedure for the re-review of this development.
La Shot noted that the Thompson Park project bids had been opened. Foster was the
apparent low bidder until Council approval on May 4th. There will be a community
meeting on May 10th in regards to this project.

Chairman Walker noted that there will be a Scoping Open House for Fort
Kenay/Mission Street Improvements on May 17, 7:00 - 10:00 p.m. at Kenai City Hall.
13. COMMISSION COMMENTS & QUESTIONS
Teresa Werner-Quade asked that the Commission observe a moment of silence in
memorial to former President Nixon.
Charlie Pierce noted that he would not be able to attend the next meeting.
Chairman Walker expressed concern about the road condition at the end of Mission
and Main Street. The bluff has eroded dangerously close to the log barricade and he
asked if the City should erect a new barricade or possibly close the road until the
situation can be evaluated. Also Walker asked that the City review the problem of
roller-bladers on city streets. La Shot said he would look at the problem and discuss
options with Administration.
The Commission took a moment of silence in honor of former President Nixon.

We apologize for any confusion concerning the size of our Lodge Building that
was Approved by you on September 8,1993.
Our original plans end color picture submitted August 23,1993, clearly
showed a Deck/Patio on the Bluff, overlooking the Cook Inlet and the Kenai
River with sliding glass doors opening onto it.. '9ye ch,~se to enclose this Deck
because of the winds. We felt that enclosing this area would be safer and more
comfortable for our guests, and we would not lose a Iot of heat from the glass
sliding doors,
Because the Building is mane of Logs we would oat have had the option to
enclose this area'later' and have it snnform with the'Iog construction' and look
Iike anything but an add-on.
When we made this decision, it did not cross our minds to correct the plans with
the Building Official. This was an oversight on our part which we are sorry
for.
We are in the process of obtaining a Letter from a Licensed Engineer stating
the Building is safe and sound, and will forward that to the Building Inspector
within 3t# days.
With regards to the mood Carved Beluga Whale, I had no idea that I needed
permission to have this work of art approved by the City. It is not a sign and
will have no lettering on it or the rock it sits on. Many Visitors come to Kenai to
see the Beluga Whales and i have showed them a small plastic one, so they
lutow what they look Tike. I thought it waruld be grand to have a life size Beluga
Whale so Visitors can have their picture taken with it. I have gone to great

culverts, and possibly underground utilities (sewer) which could or do infringe
upon property owned by others. It is your responsibility to remove or make
other arrangements to deal with any encroachments caused by you, including
drainage rerouted from Mission Ave. to the Inlet.
2. I received an interim approval from ADEC dated July 13, 1993 to operate the
water and sewer systems. Please forward to the City your permanent
certificate to operate these systems as soon as possible.
3. The building under construction is considerably larger than the proposed
building that was reviewed by the Planning and Zoning Commission for
construction within the TSH zone. I have asked the Commission for their
concems regarding this. It will be necessary to re-review this structure. Please
submit new information to present to the Planning and Zoning Commission. It
will be reviewed under the original TSH guidelines in effect at the time of the
first review. This matter would be in addition to any new submittals to the
Building Official for revision of your building permit.
4. Please provide a remote readout for the water meter as you have discussed
with Clyde Johnson.

I would like to clarify, for the record, what I understand, was the source of confusion or
concern at the May 4th Council Meeting.
My letter to the Vozar's, dated May 2, 1994 was prepared after a meeting between the
above referenced Administration and myself, was held to discuss these matters. The
letter represented as closely as possible, what I felt was the consensus of concerns of
everyone at the meeting. It was agreed that I should write the letter and sign it and it
was reviewed in draft form before being sent.
The request to have the project re-reviewed by Planning and Zoning under the "old°
guidelines was discussed with the City Attorney also, prior to its inclusion in the letter.
On the afternoon of May 5th, Sandra Vozar brought in the information needed for the
P&Z packet for the May 11th meeting. She also discussed some of the other items
with myself and the Building Official.
It is my understanding that some members of Council do not approve of the
Administration's handling of this matter, however, I believe Administration thoroughly
evaluated the situation and acted accordingly. If any changes to the direction we are
taking on this matter are needed, please let me know.

RE: PROHIBITED USE OF RECREATIONAL VEHICLES
You are the owners of record of a property located at Lot 1 A, Block 1, Thompson Park
Subdivision, or 5791 Kenai Spur Highway. We have recently received a citizen
complaint about a Recreational Vehicle (RV) that has been set up for long term use
on this parcel. This is in violation of section 14.20.245 of the Kenai Municipal Code.
A copy of section 14.20.245 of the Kenai Municipal Code and a copy of the penalties
section is attached for your information.
The building on this tot is °Chris's Custom Upholstery". The people there were notified
of this violation on June 24, 1992 by Howard Hackney, the former Building Official,
who gave 30 days to have the RV removed. Mr. Hackney died shortly after the
notification so no further action was taken at that time. I feel that the people living in
the RV have had sufficient time to relocate. Therefore, you have thirty (30) days from
the receipt of this letter to remove the RV from this lot, to avoid further action on this
property.
It has also been brought to our attention that there may be non-operating, partially
dismantled, junked vehicles on this tot. This is a violation of KMC section 12.25.030
(also attached). You have thirty (30) days from the date of receipt of this letter to
remove these junk vehicles to avoid further action. If you have questions feel free to
