Jack La Shot -reported that this plat will take three government lots and split them
into smaller lots. The only problem he had was with some of the utilities and the
owner's son had cleared that issue up.

b. Vacation ROW: Riverview -TSH Zone
Chairman Walker introduced the item and asked if their was anyone in the public who
wished to comment. Clarence Ladd asked what TSH stood for? It was then
determined that the property was actually in the Central Commercial Zone not TSH.
Walker asked for a staff report.
Jack La Shot reported that the preliminary plat had been approved at the previous
meeting. This is an attempt to make four lots out of several smaller lots, on that
previously reviewed plat there was a note that said the ROW being vacated this plat,
this is the actual process for that vacation. La Shot had commented when the plat
was reviewed that the City should retain a utility easement, 15 feet of either side of
the southerly lot line, Lot 6 A. He believed that there may be utilities in there now and
if not there may be a future need to bring utilities through that easement.
MOTION:

Clarence Ladd, owner of the property, stated that the surveyor was taking care of this
item for him, but he had no problem with retaining a 30 ft utility easement.
Walker brought the item back for Commission action.

Chairman Walker introduced the item and asked the pleasure of the Commission?

development not to approve the development as resubmitted.

PUBLIC HEARING
Sandra Vozar, 1001 Mission Street, stated she and her husband owned the Beluga
Lookout RV Park and the building that is being re-reviewed. She said when they
originally brought the plan before P&Z the drawing showed a porch. At the time, they
had explained that the dormer on the plans would be extended so there would be less
loss of space. Vozar apologized for not coming back before the Commission when
they decided to enclosed the porch. The original plans called for a concrete
foundation but as the building progressed they decided to put down pilings. When
they put down pilings the porch would cantilever under the main building. So when
they were working on the bluff during the winter they realized that the porch should be
enclosed due to the windy conditions. Vozar apologized again for not coming back
before the Commission before changing the building plans.
Vozar said she had spoken with Jack La Shot about the roof, if there would problems
because they might be higher or lower than the 20 feet indicated on the original plans.
La Shot said that if the new building was not higher than the Toyon Villa there
wouldn't be a problem. Vozars had also discussed the change to the roof. That too,
did not seem to be a problem. Vozar said she was willing to pay the extra amount for
the permit. Basically the ground coverage has not changed from the original plan.
The only thing that has been done is to enclose the porch. Too close it in later, being
that it was a log building, it would always look like atie-in, so it was better to enclose
the porch during the construction.
Vozar said she was sorry she had not asked before making the changes. She urged
the Commission to approve the development and not to issue astop-work order,
because that would not accomplish anything and leave an unfinished building in Old
Town.
Vozar also mentioned the whale sculpture. Many tourists come down to watch the
whales, but many people have never seen an actual whale. She showed a model of a
Beluga Whale that was used as a pattern for the whale canning. She felt it would be
an enhancement to the Old Town area. People come to watch the whales and this
will help them identify the whales. It is not a sign, there will be nothing written on. It
is just a tourist attraction like the chamber's bear and other attractions visitors like to
see and take pictures of. She said she would be glad to pay a permit fee for the
sculpture and would urge the Commission to let them proceed with their project.
Chairman Walker asked if the whale is on their property? Vozar said yes, they have
three acres there.

Jim Arness, a member of the newly appointed Townsite Historic Board, said he felt
that the Commission was aware of the ordinances that have been enforce for quite
some time. Arness said he was not necessarily concerned with the Vozars project.
His concern is that over the years, since the establishment of the first Ordinance that
provided for specific zoning in that part of town there has been very little concern on
the part of the Planning Commission or the Council to listen too or consider any
concerns from the people who have been appointed to carry out the mandates of the
Ordinance. There was a previous Board that had to approve any development in that
area, the Board was eventually dissolved. But now a new Board has been
established, and Amess felt that it may not being utilized properly. The Board was
established in March and there has not been a meeting, which follows how these
Boards have been utilized in the past. Amess was concerned with policy, there is an
Ordinance 1421.05 that provides for specific review processes by the Townsite
Historic Board that are supposed to be considered by the Planning Commission before
they approve anything in the TSH zone. The City made the law and Arness is
concerned if the policy is going to be to disregard the law, then there should be steps
to eliminate the Ordinance and the Board.
Amess said there was a law in place. And if the Commission is considering a need
for the building permit, there was not a permit required for the RV Park. The Building
and RV Park were supposed to be reviewed by the Historic Board. Amess said he
wished to put the Commission on notice that they should know what the Ordinances
are.
Councilman Duane Bannock, as a Planning & Zoning member just last fall, said he
had been involved in approving the plans for the Vozar development. In his opinion
when the building which had been approved was presented he imagined a long, two-
story log building, similar to what is currently being built. Whether that building was a
mile or two-miles long the visual effect remains the same. Bannock suggested that
the Commission take several actions to help with their decision. First, to remind
applicants that when changes are made they must be pre-approved. Secondly, the
City of Kenai must be in the position to accept some of the responsibility for this. It is
the City of Kenai's job to make sure that plans are being implemented as submitted.
Bannock urged the Commission to vote positively for the completion of the first
positive development in the TSH zone in a long time.
Chairman Walker asked if there was any one else that wished to speak to the item.
Seeing and hearing none he brought the item back to the Commission.

Jack La Shot reported that Staff started the re-review process due to the increase in
building size and the addition of the whale structure. These changes will require an
amendment to the original building permit. La Shot and the City Attorney had
reviewed the procedure for the re-review and felt the item should be reviewed under
the guidelines in effect at the time the original permit was issued. La Shot said he
estimates the building is approximately 50% larger than the original plans outlined.
The review should pertain to the building and the whale only, since that is what is
required for the building permit.
Ron Goecke said he did not understand what the whale had to do with the building
permit? La Shot said the City viewed it as a large structure and it does fall under the
guidelines of the building code.
Phil Bryson said he felt that the footprints of the building had not been altered from the
original submitted plan. Jack La Shot said the city had a floor plan when the first
permit was issued which listed the floor plan as 20 X 60. The new floor plan, since
the porch was enclosed is more like 21 wide X 85.5 feet long.
Councilman Smalley commented with regard to Councilman Bannock's comments
regarding the City's responsibility to measure projects. It is not the City's responsibility
to measure projects, they may choose to do it, but they are not required to do it.
Phil Bryson asked Administration concerning the general procedure of review in TSH
zone. Under the procedure, is this review following through with what should have
been done at the time the original permit was issued? Should it have been reviewed
by the Historic Board at that time? La Shot said he felt there was no other committee
or Board established at the time of the original permit.
Chairman Walker asked for additional comments or questions on the item.
Bryson asked if the motion was specific to the building itself, separate from the large
wood structure? Loretta Harvey read the motion which was to re-review the
development in the TSH zone.
Teresa Werner-Quade, said she had gone to the site and spoken with the Vozars.
She had contacted several people in regards to this project so she could get as much
information as possible on this item. She noted that Vozar's letter had stated that they
wished to enclose the porch. Werner-Quade did not have a problem with that. In the
original minutes Vozar said the plans for the upper level were not included because
there was no immediate plans for that space and it may not be developed for awhile.
When developed the area would be a small one-bedroom or a meeting area. Werner-
Quade felt the extension of the upper level to 85.5 feet is really excessive given the
fact that surrounding property owners might not have been able to have input about

the development. She also felt that any contractor doing business within the City has
a responsibility to come to the City first, before going ahead with any extension of
plans such as these. Wemer-Quade felt a city imposed fine might be in order.
Paul Vozar, said he had been a contractor for 30 years. He felt that if this was the
case, when he put on the addition he'd have gone to Jack and said he had changed
the plans and paid for the changes. Vozar said he did not do anything wrong, he built
according to the needs of the site. He said if you don't add the third story enclosure.
He said he was not trying to get away with anything, he would have talked to Jack to
see if he owed the City more money. And he felt it was not right for people to say
they were going to shut the project down. He has lived on the bluff for 30 years and
been a builder in the area for 25 years. Vozar thought it wasn't fair that he had to
come back before the Commission like being in court and he couldn't see why he had
to do that.
Teresa Werner-Quade said she felt it was a shame he couldn't see that. Phil Bryson
asked that all comments be directed through the Chair.
Paul Vozar said he was sorry that this happened. He didn't realize he had to come
back before the Commission he thought he could deal directly through Jack. He didn't
realize he had to bring his plans before a woman.
Teresa Werner-Quade said she wanted to answer Mr. Vozar's comments since she
felt personally attacked. The matter is not a personal thing, it's a matter of procedure.
When you make significant changes to any project you need to check in with the
proper authorities.
Sandra Vozar apologized for her husband. She said that they have been building in
Kenai since 1974 and in the past the process has been fairly loose. This was never
an issue before, but she realized that building codes are getting tougher, and they
should have come to the City and asked. The reason they didn't ask was there was
going to be a deck on top, the upper portion will not be started on until October or
November. The rest of the space has not been planned for on the upper level. If
Vozar's would have just put on the deck, it would have been a possible safety issue.
The winds on the roofs might be a hazard, if the deck is enclosed the people will be
protected from windsheers on the bluff.
Chairman Walker asked fora 10 minutes recess at 8:40. Meeting reconvened at

BUILDING IN THE TSH ZONE AND INCLUDE THE WHALE STRUCTURE. PHIL

DISCUSSION ON AMENDED MOTION:
Phil Bryson asked for clarification on the amendement. Is the amendment to re-
approve the presently submitted building application? Bryson asked if there was a
1994 building permit? La Shot said they will not issue a perm it until the Commission
makes their decision. Bryson asked if the amendment was for the building as
presently being constructed including the artwork? Goecke said that was correct.
Bryson concluded that this does not include any encroachments are alleged
encroachments.
Chairman Wacker asked if there was any further discussion on the amendment?
Seeing and hearing none he reopened the public hearing for comment on the
amended motion. Seeing and hearing none in the audience that wished to present
public comment the item was brought back to the Commission.
Jack La Shot said it is staff's feeling that they are not making judgement on whether
the character of the building is changed. The re-review was a requirement of re-
issuing the building permit.
Phil Bryson felt that the footings in the original plan and the re-submitted plan had not
been changed. So from his perspective the impact to the neighborhood has not
significantly changed. At some point the views of the structure changed from a barn
type roof to the present roof plan.
Chairman Walker said he felt that a gable style roof is just a matter of preference, he
did not feel one roof is preferred over another in the TSH zone. He also felt the
enclosure of the porch was appropriate on the bluff.

Phil Bryson felt it would be appropriate to request that Administration follow-up with
setting an organizational meeting of the Townsite Historic Board. Chairman Walker
asked if Bryson would make a motion to that effect.

8. CODE ENFORCEMENT REMS
Jack La Shot noted the Code Enforcement Table which had been made available at
the meeting. He noted that property owners listed on the table would be sent letters
regarding junk or abandoned vehicles with the Commission's concurrence. The
Commission requested that the letters be sent. Lori McComsey mentioned there was
a junk trailer off of Tern, next to the apartments. Hal Smalley reported a old truck with
an abandoned trailer off Linwood. Staff said they would investigate these new items.
9. REPORTS
a. City Council
Councilman Smalley reported that Karen Mahurin spoke on behalf of the Save
Oldtown Committee, which is not an officially recognized committee by the City.
Mahurin reported that a lot of people in the TSH are concerned about preserving and
cleaning up the area.

The Tomrdle's have renovated an old fishing boat and came before Council requesting
they be able to set it in front of the Kenai Bicentennial Visitors and Cultural Center
(KBVCC). Council felt this item should be addressed by the KBVCC Board. The
resolution on street names within Black Hills Subdivision was pulled because a citizen
reported that the streets had been named previously. Council had requested that
Planning Staff further research this issue.
Council should approve the budget at their next meeting. It appears there will be a
4% Cost of Living increase for city employees, also several positions will be added,
including a Engineer Technician position in Public Works. Concerns had been
expressed regarding traffic problems on Lawton. Staff was asked to investigate
making one side of Lawton a "no parking" area. The Thompson Park Water & Sewer
Extension Project is underway, it is hoped a walking path/bike trail will be developed
across the extension sometime in the future.
Councilman Smalley said he would be unavailable for the June 22nd meeting.
b. Borough Planning
Phil Bryson reported on items specific to Kenai which were the Land Classifications
the Commission reviewed at a previous meeting. The Planning Commission
recommended withdrawing two of the parcels,. the large one and one of the smaller
ones. The recommendations will now go to the Assembly for final approval.
c. Administration
Jack La Shot reported that new signs had been placed on the end of Mission Street
near the bluff and on the storm drain running through the bluff.
Loretta Harvey reported that she had spoken with Dick Troeger, Planning Director
KPB, and other KPB Planning Staff regarding the street names in Black Hills S/D.
The Borough had no records of any names on these streets. Troeger explained that
Black Hills had been identified as one of the problem areas in the Emergency Service
Number project which had been contracted through McLane & Associates. The
Borough had received a draft copy of the report on March 18th, after they review the
project they will be meeting with cities within the scoping area to discuss street name
problems. Troeger suggested that the City hold off on any street naming actions,
unless absolutely necessary, until the plan can be reviewed by all agencies.

10. PERSONS PRESENT NOT SCHEDULED
Sandra Vozar requested that the Council review their policy on allowing large RV
caravans to camp on City property. The RV park owners have gone to great expense
to develop their lots and it seems the City should not be in the business of renting
camping spots.
Kevin Walker said that when he was on the Council it was within the City Manager's
purview to allow RV's to park on City property. The idea was that RV Caravan's
brought additional tourism dollars into the City. He felt it would be appropriate to bring
the item before Council for review.
Sandra Vozar said she realized it had been necessary in the past to accommodate
these Caravans, because there were no alternatives. Now there are several RV Parks
within the City limits so the policy should be reevaluated.
Clarence Ladd, 807 Cook Ave, said he was also concerned about the erosion of Main
and Mission Street. He asked that the Commission keep a fire lit under the Council to
continue to monitor and seek ways to take care of the erosion problem on these
streets.

ANALYSIS
The northwest property line setback is 15 feet due to the house being 2-story on that
side. The other side is a daylight basement, requiring a 10 foot setback. The builder
thought that 10 feet was required for both sides. The encroachment is 0.7 foot into the
setback.
RECOMMENDATIONS
There have been five encroachments approved in this Subdivision since 1989:

WHEREAS, the Commission finds:
1. That an application meeting the requirements of Section

2. This request is on land zoned Suburban Residential (RS)
3. That the applicant has demonstrated with plans and other
documents that he can and does meet the following specific
requirements as set forth in Sec. 14.20.185 (d):
(1) An encroachment as defined in KMC 14.20.185 (a) exists
(2) The encroachment does not encroach upon a Federal, State
or City right-of-way or utility easement.
(3) The issuance of the encroachment permit will not
authorize a use which is not a principal permitted use in
the zoning district in which the property is located.
(4) The encroachment is not located across a platted lot
line.
4. That a duly advertised public hearing as required by Section
14.20.280 was conducted by the Commission on 5/25 ~

KENAI MUNICIPAL CODE
14.20.185 Encroachment Permit: (a) Definitions. "Encroachment" means any object
or structure above or below ground and constructed or located in a manner other than
set forth in the Development Requirements Table.
(b) Intent. An encroachment permit is the relaxation of the development
requirements of this chapter to remedy encroachments which do not fall under Section
14.20.050, nonconforming uses and which satisfy the requirements of financial
institutions.
(c) Permit application. An application for an encroachment permit shall be filed
in writing .with the City Planning Department and signed by the owner of the property
concerned or representative of the owner. A fee of $100 shall be paid to the City of
Kenai at the time the permit application is filed.
(1) The application shall contain the following:
[A] A legal description of the property involved.
[B] Plans showing the location of all existing buildings, rights-of-ways or
easements, setbacks, elevations, and data pertinent to the application.
(d) Review Criteria. The Planning Department shall submit the application to
the Planning Commission for review and public hearing. The Planning Commission
shall establish a finding that all of the conditions set forth in Subsections (1) through
(4) of this section have been found to exist before issuing an encroachment permit.
(1) An encroachment as defined in KMC 14.20.185 (a) exists.
(2) The encroachment does not encroach upon a Federal, State or City
right-of-way or utility easement.
(3) The issuance of the encroachment permit will not authorize a use
which is not a principal permitted use in the zoning district in which the
property is located.
(4) The encroachment is not located across a platted lot line.
(e) Public Hearing. The public hearing and notification procedure for an
encroachment permit application shall be accomplished in accordance with the
requirements of this chapter.
(f) Unauthorized Encroachments. Unauthorized encroachments shall be
immediately removed by the owner upon being given notice by the City. Notice shall
consist of a written letter, sent by certified mail, return receipt requested, or by
personal service, explaining the violation and allowing twenty days to remove the
encroachment.
(g) Expirations of Permit. Permits shall expire automatically upon termination
or interruption of the use; damage to the building, structure, or object which makes it
uneconomic to repair the building, structure or object; or, the expiration of the useful
life of the building, structure, or object, whichever come first.
(h) Right to Appeal. Any revocation, suspension, or denial of an encroachment
permit by the Planning Commission may be appealed. to the City Council by filing a
written notice of appeal with the clerk and stating the grounds for such appeal. The
appeal notice shall be filed within thirty days after the effective date of the revocation,
suspension, or denial of the request for the encroachment permit. All notices of
appeal must comply with Section 14.20.290. (ord. 1188)

STAFF RECOMMENDATIONS: Grant approval of the preliminary plat subject to any above

VACATING THE TEMPORARY TURNAROUND EASEMENT WITHIN LOT 4, FISHERMANS
POINT SUBDIVISION (PLAT 74-87 KRD) AND WITHIN GOV"I' LOT 7; ALL WITHIN
SECTION 10, TOWNSHIP 5 NORTH, RANGE 11 WEST, SEWARD MERIDIAN, KENAI
RECORDING DISTRICT, CITY OF KENAI, ALASKA.
WHEREAS, a request has been received to vacate the temporary turnaround easement within
Lot 4, Fisherman's Point Subdivision (plat 74-87 KRD) and within Gov't Lot 7, all within Section 10,
Township 5 North, Range I 1 West, Seward Meridian, Kenai Recording District, City of Kenai,
Alaska.; and
WHEREAS, on March 28, 1994, the Kenai Peninsula Borough Planning Commission held
a public hearing and addressed all concerns about this proposed vacation; and
WHEREAS, the Planning Commission has found that vacating the temporary turnaround
easement will not be detrimental to the public interest; and
WHEREAS, 20.28.120 of the Kenai Peninsula Borough Code of Ordinances authorizes the
Planning Commission to accomplish vacations by Resolution.
NOW THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE
KENAI PENINSULA BOROUGH:
Section 1. That the temporary turnaround easement within Lot 4, Fisherman's Point
Subdivision and within Gov't Lot 7, Section 10, Township 5 North, Range 11 West, Seward
Meridian, Kenai Recording District, City of Kenai, Alaska, is hereby vacated.
Section 2. That this Resolution is eligible for recording aRer approval of the vacation and will
be deemed void if not recorded within 90 days of adoption.
Section 2. That the City Council of the City of Kenai has thirty days, from the date of
approval, in which they may veto said approval.
Section 4. That this Resolution becomes effective upon being properly recorded with
petitioner being responsible for payment of recording fees.

Dear Mr. Oja:
The City of Kenai Planning and Zoning Commission has reviewed the Moose Pass
Cooperative Project Scoping Document. The Commission agrees that this issue is of
great concern to the Kenai Peninsula and would like to' make the following
recommendations to help alleviate this problem:
Extensive logging of infested trees throughout the Borough. Which may include
multiple contracts for logging and removal of infected trees.
Chemical treatment and slashed as needed.
Access roads should be allowed -utilizing section lines, whenever possible.
Make contracts simple enough that all parties can understand and State can
administer.
Education of residents on causes, impacts and individual efforts that can be
taken to help solve this problem.

I understand that concerns regarding the above referenced subdivision were
expressed at the Council meeting of May 4. Some of those concerns were:
1. What, who, or why was the request for street naming brought up?
On approximately March 28, a real estate agent called me to obtain addresses for
several lots in Black Gold S/D. When I went to look up the addresses in the City of
Kenai Map Index 1990, I discovered there were street numbers but no names. I told
the agent I would have to get back to her, because we may have to assign street
names in order to give her the correct address. She said a street number was
adequate, since there was only an offer on the lots, when the sale was finalized she
would contact the City regarding the street name. She asked if the street could be
named "Nancy" after the client who was interested in purchasing several of the lots.
said I did not feel that would be a problem if a street name did not already exist.
After that discussion I began researching street names in the subdivision. Besides no
listing in the Kenai Map Index 1990, there were no listings in the "City of Kenai Alaska
Area Atlas" produced by Alaska Mapping Systems (Tom Luzny), or on the original plat
which was filed in 1986. I then contacted Jane Gabler at the Borough to see what
street names they had and they had no listed names for Black Gold Subdivision. I
spoke to Jack about this and he said to assign street names and bring them before
the Planning and Zoning Commission.
2. Were there names for these streets at time of platting? If no, why not? Have
these streets ever had names?
It appears these streets were never officially named, except possibly Alpine. I
checked with Jane Gabler and Robbie Harris of the KPB Planning Department and
their base map does not list names, nor do any of their other records. Jane explained
that many of the earlier platted subdivisions within the Borough were filed without
street names.
3. How were the street names chosen?
The woman who was purchasing properties along the proposed Nancy Way requested
a woman's street name, we felt it would be consistent to name the streets after other
women. We also wished to honor Howard Hackney, by naming one after him.
4. Lady at meeting said she lived on Bluebell off Alpine. I think she said she
thought Bluebell continued to street we called Kathy Lane. Please check on the
street name north of Kathy Lane to see if it is called Bluebell.
The lady at the meeting, Iona Wilson, just left this office (1:22 p.m. 5/11/94). She left
a map which was obtained from the phone company which shows the street names
listed. I called Todd, PTI Engineering regarding these records. He said they came
from the PTI Plant Record maps, which are in no way official records, but are for
office use only. None of his other maps of Black Gold Estates showed street names.
CONCLUSION:
As you may know the Borough recently contracted with McLane and Associates on
the Enhanced 911 Maps and Address project. This project identifies Emergency
Services Numbers (ESN) throughout the Borough, and also identifies problems with
duplicate, problem, or non-existing street names. The preliminary study was received
by the Borough March 18, 1994. I spoke with Jane Gabler on May. 11 and asked her
if the study showed any street names in Black Gold Estates. The study does not.
I have met with Dick Troeger and Cathy Wagner of the KPB regarding this issue on
May 4. Dick said that there were approximately 1500 streets within the Borough
which had been identified with problems. He recommended that the City hold off on
street naming actions until a joint meeting can be held to identify and correct problem
areas within the Borough.
STAFF RECOMMENDATION:
According to KMC 14.15.110 Plan Adopted (a) The Planning and Zoning Commission
is hereby authorized to prepare and present to the Council a complete plan for naming
of all streets, avenues, and public ways within the City in accordance with KMC
14.15.010 through 14.15.140.
A plan has never been prepared or presented to Council. The Planning Staff has
used portions of the Borough's system in recent street naming situations. At this time
Staff would recommend that no further action be taken on the above referenced
matter until the Borough and City can meet to discuss the ESN system and potential
street naming problems within the city. If any of the unofficial names are adopted they
may be duplicates of existing street names. This would mean that they may have to
be renamed in the near future. In the meantime, if Council concurs, Staff and the
Planning and Zoning Commission will prepare a street naming plan to present to
Council.
