A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF KENAI
GRANTING A REQUEST FOR A CONDITIONAL USE PERMIT TO:

WHEREAS, the Commission finds:
1. That an application meeting the requirements of Section 14.20.1 SO has been submitted and
received on: Seutember 19, 2008
2, This request is on land zoned: TSH --- Townsite Historic District
That the applicant has demonstrated with plans and other documents that they can and will meet
the following specific requirements and conditions in addition to existing requirements:
a. Obtain a commercial building permit for the restaurant/kitchen portion of the structure.
This will require stamped plans by a professional licensed in the State of Alaska to
produce commercial building plans.
b. Landscape/Site Plan (PZ-0754) must be modified to meet ADA requirements which
will require relocating the handicap-accessible parking space closest to the door.
c. Complete the requirements fox the LandscapelSite Plan - PZ07-54. (Copy attached.)
d. Complete and obtain City's approval for the Installation Agreement signed November 6,
2007. (Copy attachcd.)
e. Obtain a Certificate of Occupancy from the Building Official for the commercial portion
of the structure.
4. That the Commission conducted a duly advertised public hearing as required by KMC 14.20.280
on: October 22, 2008.,
5. Applicant must comply with all Federal, State, and local regulations.
NOW, THEREFORE, BE IT RESOLVED, BY THE PLANNING AND ZONING COMMISSION OF
THE CITY OF KENAI THAT THE APPLICANT HAS DEMONSTRATED THAT THE
PROPOSED CAFE AND CATERING MEETS THE CONDITIONS REQUIRED FOR SAID
OPERATION AND THEREFORE THE COMMISSION DOES AUTHORIZE THE
ADMINISTRATIVE OFFICIAL TO ISSUE THE APPROPRIATE PERMIT,
PASSED BY THE PLANNING AND ZONING COMMISSION OF TH~ CITY OF KENAI,
ALASKA, OCTOBER 22.2,!108. ,
