A RESOLUTION 01= THE PLANNING AND ZON[NG COMMISSION OF THE CITY OF
KENAI REVOKING HOME OCCUPATION PERMIT PZ02-63 DUE TO FAILURE TO
MEET REQUIREMENTS OF KMC 14.20.230(h)(1).
WHEREAS, the Commission finds:
1. That Hame Occupation Permit PZ02-63 was approved on October 24, 2002.
2. The permit was for the property located at Lot 1, Black 2, Peck Subdivision,
414 Haller Street, #1.
3. The Kenai Peninsula Parcel Number is 04302033.
4. The land is zoned Suburban Residential.
5. On September 15, 2008, Ms. Gage's fire inspection had expired.
6. On September 16, 2008, the permit holder was notified that she needed to contact
the Fire Marshal to schedule an inspection.
7. On September 23, 2008, f attempted to contact the permit holder, but number on
file was disconnected. The referenced property is a duplex owned by Ms. Gage's
parents who live on the other side. After locating the number of Mr. Gage,
requested a new contact number for his daughter. Mr. Gage informed me he would
pass the information onto his daughter and have her contact the City. As of this
date, the City has had no contact with the applicant.
8. On October 2, 2008, the permit holder was notified via regular and certified mail
that a revocation hearing of her Home Occupation Permit was being scheduled for
the November 12, 2008 Planning and Zoning Commission meeting.
9. On October 3, 2008, Ms. Gage signed for the certified letter.
10. On October 14, 2008, notice of the revocation hearing was sent to all property
owners within 300-feet of the referenced property.
11. On October 22, the Planning and Zoning Commission was notified that a revocation
hearing would be set far the next scheduled meeting.
12. That a duly advertised public hearing as required by KMC 14.20.280 was
conducted by the Commission on November 12, 2008.
NOW, THEREFORE, BE IT RESOLVED, BY THE PLANNING AND ZONING
COMMISSION OF THE CITY OF KENAI THAT CONDITIONAL USE PERMIT PZ02-$3
HELD BY BRANDY GAGE FOR A HOME DAYCARE BUSINESS IS REVOKED,
PASSED BY THE PLANNING AND ZONING COMMISSION OF THE CITY OF KENAI,
