At their meeting of January 9, 1991 the City of Kenai Planning
and Zoning Commission denied your application for an Encroachment
Permit. The Commission found that the following requirements
were not met under Resolution 91-1:
3. That the applicant has demonstrated with plans and other
documents that he does not meet the following specific
requirements as set forth in Sec. 14.20.185 (d):
3.(2) The encroachment does. encroach upon a Federal
State or City right-of-way or utility easement.
(4) The encroachment is located across a platted lot
line.
The Commission recommends that the applicant obtain a Petition to
Vacate from the Kenai Peninsula Borough Planning Department.

(73) "Yard" means an open, unoccupied space,•other
than a court, unobstructed from the ground to t'.:e sky,
except where specifically provided by this ordinance, on the
same lot on ~rJhich a building is sitaat~d.
(74) "Yard, front" means a yard extending across the
full width o~ the lot between the front lot line of the lot
and the nearest exterior wall of the building cahich is the
nearest to the front-lot line.
(75) "Yard, rear" means a yard extending across the
full width of the lot between the most rear main building
and the rear`lot line,.
(76) "Yard, side" means a yard on each s~.de of a main
building and extending from the front lot line to the rear
lot line. The width o~ the required side yard ehal~, be ~,
measured horizontally from the nearest point of a side lot
line to the nearest part of -:'the main building.
(77) "Zoning change" means the alteration or moving of
a zone boundary; the `reclassification of a lot; or parcej, of
land, from one zone to another; and the cha3lga of any of the
regulations contained in this chapter.
(78) "Zoning ordinance'or ordinances" means the zoning
ordinance of the City of Keriai.

14.20.321 Bed & Breakfast "^,stablisr,~:,er_ts: (a) Tntnnt: It
' is the intent of this chapter to?.per~;it bed & breakfast
establishments by conditional use which is compatible with other
permitted uses, with the residential character of a neighborhpod,
and which is clearly secondary or-incidental to the residential
use of the main building. ~~
(b) Provides that these establishments s:`~all be owner-
operated, not more than one persgn outside the fam~.ly shall be
employed in~the bed and breakfast; rent out na more,-than thirty
percent (30%) of the total floor '..area; have adequate off-street
parking for owner and all guests;: and shall r~:eet all other

1. That an application meeting the requirements of Sec.

3. That the applicant had demonstrated with plans and other

Commissioner Graveley moved for approval. Commissioner
Murphy seconded. Passed by Unanimous Consent

MOTION AND VOTE:
Commissioner Scott moved for approval of the minutes as
corrected, seconded by Commissioner Glick. Passed by Unanimous
Consent
5. PLANNING
a. Res. PZ 91-1: Encroachment Permit - Jay and Kristy
Schmelzenbach
MOTION AND VOTE:
Commissioner Glick moved for approval. Graveley seconded. The
encroachment permit was denied by unanimous consent.
Jack La Shot said that by Code the encroachment could not be
approved because it does encroach across a lot line and also is
in a City ROW.
RECOMMENDATION: The Commission recommended that the applicant
pursue a Right-of-Way Vacation permit through
the Kenai Peninsula Borough.
b. Res. PZ 91-2: Conditional Use Permit - Garcia

Commissioner Glick moved for approval. Rehm seconded. Passed
unanimously.

c. Res. PZ 91-3: Home Occupation - Garcia Enterprises
Commissioner Glick asked that the space which will be used for
the Home Occupation be specified in the application documents.
Mr. Garcia explained that this was basically a mail order
business. They ordered from Washington and then their customers
picked up the merchandise, or they delivered it, as soon as it
arrived. A small office in the home was used for this purpose.
The Commission asked that the site be specified in the
application which would be on file with the City.
MOTION AND VOTE:
Glick moved for approval with addition to application as noted.
Murphy seconded. Passed unanimously.
6. NEW BUSINESS
a. Application for Lease - Lot 2, Gusty Subdivision No. 8 -
James C. Bookey III and Phyllis J. Bookey
MOTION AND VOTE:
Commissioner Graveley moved for approval. Commissioner Scott
seconded. The Commission unanimously supported approval of this
application.
b. Election of New Vice Chair
Commissioner Murphy nominated Commissioner Graveley.
Commissioner Scott seconded.
Commissioner Graveley nominated Commissioner Rehm. Commissioner
Glick seconded.
Commissioner Murphy closed nominations. Commissioner Scott
seconded.
VOTE:
Commissioner Graveley was elected to be Vice Chairman for 1991,
by secret ballot.
c. City of Kenai Proposed Land Sale
Kim Howard reported that the Kenai Parks and Rec Commission had
recommended that all lands be released for sale except 5 acre
Tract 1 of Mommsen's Subdivision which should be reserved for a
future park.

MOTION AND VOTE:
Commissioner Scott moved to support Parks and Rec's
recommendation to reserve 5 acre Tract 1 Mommsen Sub for a future
park and dispose of other City lands. Commissioner Graveley
seconded. Passed unanimously.
T. OLD BUSINESS
a. Comp Plan Review
Animal Control - Commissioner Murphy suggested changing the word
encourage to encourages and delete the should in the second
paragraph on the last page. Also include recommendation that
Borough develop an Animal Control program outside of City limits.
Library - Commissioner Scott recommended that the 5 year time
line for additional staff be deleted.
Transportation - Commissioner Bryson felt that some mention of
trails which need improvements should be made.
Utilities - Last paragraph should reflect the desire for the
proposed landfill to be in a remote part of the Borough outside
City limits.
8. REPORTS
a. City Council
Councilman Smalley noted the updated CIP list and reported that
the funds for the Congregate Housing Project have been requested
from the Governor's portion of the State budget. This will mean
that this project will be competing against fewer requests for
State dollars.
La Shot informed the Commission that an Ordinance will go before
Council at their next meeting to rezone a portion of Marathon
Road to facilitate the proposed UAA Training Facility. Planning
and Zoning will hold a public hearing on this issue January 23rd.
Due to time constraints the Ordinance will go to Council for
introduction before Planning and Zoning can act upon the request.
Hopefully construction of this project will begin in June.
Councilman Smalley also mentioned the "Clean and Lien" Ordinance
which was mailed to the Commissioners. There is currently no
provision for this type of ordinance within the City of Kenai.
Smalley felt that the Council and possibly the Planning and
Zoning Commission should hold a work session to discuss this
idea.
Councilman Smalley reported that the Council had appointed Cary
Graves as the new City Attorney and that he has accepted that
position.

b. Borough Planning
Chairman Bryson reported that the Plat for Spur Sub. #9 was
granted Administrative approval.
Bryson also reported that the Borough is in the process of
completing their Comp Plan and one of the issues being addressed
is the need for Boroughwide animal control, outside of City
limits.
c. City Administration
Jack La Shot recommended that the Commission hold a work session
after their next meeting to discuss the Land Use Plan section of
the Comp Plan.
He also reported that the City will begin several construction
projects this spring including: Reconstruction of Marathon Road,
including utility upgrades; Airport drainage project; Trading Bay
Road extension; Sewer Treatment Plant Modifications; Kenai
Bicentennial Visitor and Cultural Center; and Congregate Housing.

Commissioner Glick asked for an excused absence from the next
meeting. So noted.
Commissioner Scott asked what the process would be to get a speed
zone established on the Bridge Access Road which would reduce the
speed from the City Dock to the stop light.
Councilman Smalley said he would suggest this to Council at their
next meeting.

The leases for the referenced properties require the City to
consent to any assignment of lease. The procedure in the leases
include submitting the proposal for assignment for approval by the
Kenai Planning Commission and the City Council.
An Agreement for Assignment of Lease and Contract for Sale was
executed on November 30, 1990 between lessees without prior
approval by the Kenai Planning Commission and the City Council. A
copy of the agreement is attached.
Does the Renai Planning Commission approve of the assignment? The
agreement will be brought to the Council on February 6 for their
approval. If approved, a consent to assignment will be prepared
for the City Manager's signature.

AGREEMENT FOR ASSIGNMENT OF LEASE
AND CONTRACT FOR SALE

1990, by and between ROBERT T. BIELEFELD of P.O
Box 46, Kenai, Alaska 99611 (hereinafter "Buyer"), and STEVEN
SCHUMACHER, of P.O. Box 1866, Kenai, Alaska 99611 (hereinafter
"Seller").
RECITALS
1. The parties own in common the leasehold interests in the
following described real property:
Lot Two (2), Block Two (2), GENERAL AVIATION APRON, and
Lot Two (2), Block Four (4), GENERAL AVIATION APRON,
Kenai Recording District, Third Judicial District, State
of Alaska;
Said leasehold interest for Lot Two (2), Block Two (2),
arising from that certain lease dated May 6, 1976, recorded in the
Kenai Recording District, Third Judicial District, State of Alaska,
in Book 95, at Page 2.62, between Gerald Wasson and the City of
Kenai; and said leasehold interest for Lot Two (2), Block Four (4),
arising from that certain lease dated May 6, 1976, in the Kenai
Recording District, Third Judicial District, State of Alaska, in
Book 95, at Page 252, between Gerald Wasson and the City of Kenai.
2. Seller desires to assign, and Buyer desires to assume, all
rights, liabilities, and duties of Seller in the lease of the above
Property.
3. The parties own as tenants-in-common an airplane hanger
and certain other improvements and fixtures located on the Property
(hereinafter collectively referred to as the "Improvements).
4. Seller desires to sell, and Buyer desires to buy, the
Improvements and fixtures located on the Property.
5. The Improvements are pledged as security for the following
encumbrances:
First Deed of Trust to First National Bank of
Anchorage, in the principal amount of
38,000.00.
Second Deed of Trust to National Bank of
Alaska, in the principal amount of
$122,000.00.

6. Buyer has agreed to assume the obligations of the
aforementioned Deeds of Trust, and has agreed to pay the balances
owed under the notes secured thereby.
NOW THEREFORE, in consideration of the mutual covenants and
conditions set out below,. the parties agree as follows:
1. Assignment. On or before thirty (30) days from the date
of execution of this Agreement, Seller shall execute an Assignment
of Lease by which Seller will assign to Buyer all of Seller's
interest in the leasehold estate to the Property.
2. Sale. Seller shall sell to Buyer, and Buyer shall buy
from Seller, the airplane hanger and all of the other improvements
and fixtures located on the Property. This sale shall become
effective upon receipt of the payment specified in Paragraph 3
below.
3. Purchase Price. Buyer shall pay to Seller as the purchase
price an amount equal to $13,123.93; said sum shall be payable on
or before the date specified for the execution of the Assignment of
Lease as set out in paragraph 1 above, and shall be in the form of
a promissory note bearing interest at the rate of ~~, payable in
installments of $1,000.00 or more per month. In addition, the
Buyer shall assume and agree to pay and hold Seller harmless from
the obligations secured by and set forth in the encumbrances set
forth in Recital 5 above.
4. No Liens or Encumbrances. At the time of the execution of
the Assignment of Lease by Seller, the Property, and the airplane
hanger and all other improvements and fixtures located on the
Property, shall be free and clear of liens and encumbrances, except
for those Deeds of Trust mentioned in this Agreement.
5. Time of the Essence. Time is of the essence of this
Agreement, and of each and every covenant, term, condition, and
provision thereof.
6. Law Governing. This Agreement shall be gaverraed by a~.d
construed in accordance with the laws of the State of Alaska.
7. Entire Agreement. This Agreement contains the entire
agreement between the parties and cannot be changed or terminated
except by a written instrument subsequently executed by the parties
hereto.
8. Waiver. The waiver by either party of any breach of any
term, covenant, or condition contained herein shall not be deemed
a waiver of any subsequent breach of the same or any other term,
covenant, or condition hereof.

9. Binding Effect. The covenants and conditions contained
herein shall apply to and bind the heirs, legal representatives,
and assigns of the parties hereto,. and all covenants are to be
construed as conditions of this lease.
