ROLL CALL Present: Bryson, Murphy, Scott, Bannock, Glick, Rehm, Graveley, Smalley 2. APPROVAL OF AGENDA MOTION AND VOTE: Commissioner Rehm moved for approval. Commissioner Murphy seconded. Passed by Unanimous Consent 3. APPROVAL OF MINUTES - January 9, 1991 Commissioner Graveley noted that he had attended the previous meeting, although his name did not appear as being present. Planning Secretary Harvey made note to add Commissioner Graveley's name to the minutes. MOTION AND VOTE: Commissioner Scott moved for approval of the minutes as corrected, seconded by Commissioner Bannock. Passed by Unanimous Consent. 4. PERSONS PRESENT SCHEDULED TO BE HEARD 5. PLANNING a. Res. PZ 91-2: Rezone Portions of Sections 32 & 33, T6N, R11W, S.M. AK City Engineer Jack La Shot explained that the area proposed for rezone was airport lands. It was the intent of the Planning Department to change some of the zoning in this area in conjunction with the Comprehensive Plan. Chairman Bryson asked if the zone which was shown as RR1 was correctly shown. La Shot said he would research that section to make sure zoning shown was accurate. B. Purpose as stated in petition: Tract A is being resubdivided into alarger - parcei, existing easement may conflict with future construction on the parcel. C. Section 33, Township 6 North, Range li West, Seward Meridian; Kenai Recording District, Alaska In accordance with AS 29.40.140, no vacation of a city street and/or easement may be made without the consent of the City Council. This vacation action has been approved by the Planning Commission, therefore, it is being sent to the Kenai City Council for their consideration and action. The Council has 30 days from February 25, 1991 in which to veto the decision of the Planning Commission. If no veto is received the Commission within the 30-day period, the decision of the Commission swill stand. The vacation request has been approved subject to the conditions set out in the attached excerpt of draft minutes. PUBLIC HEARINGS "1. Petition to vacate ten foot utility easement along northerly, easterly and westerly boundaries of Tract A, Baron Park No. 5 within the City of Kenai. Section 33, Township 6 North, Range 11 West, Seward Meridian, Kenai Recording District, Alaska. KPB File 91-018 STAFF REPORT PC Meeting 2-25-91 Petitioner(s): City of Kenai Purpose as stated in petition: Tract A is being replatted into a larger parcel, existing easement may conflict with future construc- tion on the parcel. Public Notice appeared in the February it and 19, 1991 issues of the Peninsula Clarion. Four certified mailings were sent to owners of property within 300 feet; and to other interested parties. All of the receipts have been returned. Statement of non-objection from Homer Electric Association. No statements of objection received. Findings of Fact 1. Sufficient easements have been granted to serve surrounding properties. Alternative easement will be granted on replat. 2. No surrounding properties will be denied access or utilities. 3. Per Petition, utility easement is not being used for utili- ties. 4. Vacation will be accomplished with the filing of Baron Park Subdivision No. 7 which received Preliminary Approval February 11, 1991. STAFF RECOMMENDATIONS: Approve vacation of ten foot utility easement within Tract A, Baron Park No. 5 as petitioned; subject to the following conditions: 1. Submittal of final plat within one year of vacation approval. M 2. The City Council of the City of Kenai, has thirty days in which they may veto Planning Commission approval of the vacation. END OF STAFF REPORT as presented by Richard Troeger, Planning Director. Chairman Hammelman opened the public hearing. Hearing and seeing no one, Chairman Hammelman closed the hearing to the public. Commissioners Hursh/Bryson moved to approve the vacation of the ten foot utility easement within Tract A, Baron Park No. 5 as petitioned; subject to staff recommendations.
