ROLL CALL Present: Commissioners: Bryson, Bannock, Rehm, Glick, Graveley, Murphy Councilman: Smalley Planning Staff: La Shot, Harvey 2. APPROVAL OF AGENDA MOTION AND VOTE: Commissioner Murphy moved for approval of the agenda as presented, seconded by Commissioner Glick. Passed by Unanimous Consent. 3. APPROVAL OF MINUTES - May 8, 1991 Commissioner Bannock asked that remarks he made during Commissioner's Comments be added to the minutes. So noted. MOTION AND VOTE: Commissioner Bannock moved for approval of minutes as amended. Commissioner Glick seconded. Passed by Unanimous Consent. 4. PERSONS~PRESENT SCHEDULED TO BE HEARD 5. PLANNING a. Resolution PZ 91-14: Senior Addition Jack La Shot, City Engineer, introduced the plat and said that it was part of the City's plan to reorganize their property. He also noted the memo from the Building Inspector which asked that Ryan's Drive be changed to Spur View Drive, and Senior Drive be changed to Senior Court. Commissioner Murphy asked when the road would be put in. RENAI PLANNING & ZONING COMMISSION Page 2 May 8, 1991 La Shot said it would depend on availability of funds for the Congregate Housing Project. The two intersections will be aligned and the road will extend to the Congregate Housing parking lot and also to the existing Senior Center parking lot. MOTION AND VOTE: Commissioner Graveley moved approval of Resolution PZ 91-14, Commissioner Glick seconded. Chairman Bryson said that he would be abstaining from the vote on this Resolution. So noted. Commissioner Graveley amended motion to include staff comments regarding changing Ryan's Drive to Spur View Drive and Senior Drive to Senior Court. Second concurred. Motion passed unanimously. One abstention. b. Res__PZ 91-15: Baron Wood Subdivision No 2 - Replat La Shot explained that the City did not need this section line easement in regard to utilities or streets. MOTION AND VOTE: Commissioner Gravely moved approval of Res Pz 91-15. Commissioner Glick seconded. Passed unanimously, 6. NEW BUSINESS 7. OLD BUSINESS 8. REPORTS a. City Council Councilman Smalley reported that the Nu-State Nursery appeal had been scheduled by the Board of Adjustment for June 5th at 7:00 p.m. b. Borough Planning Briefly noted items on KPB Planning Agenda. RENAI PLANNING & ZONING COMMISSION 1 Page 3 May 8, 1991 c. City Administration Reported that Commissioner Scott had requested that the Foster Brother's Conditional Use Permit be researched by Staff to assure they are in conformance to Code. Requested publication of Notice in Peninsula Clarion June 7 and 10. Staff Recommendation The Planning Staff agrees that all conditions under KMC 14.20.185(a) have been met. Discussion Rhonda Clayton, Sales Associate, A Point of View Realty, submitted this application on behalf of Mr. Liebersbach, who is in the process of selling the duplex in question. It appears that all criteria for an encroachment permit have been met, as follows: 1. An encroachment as defined in KMC 14.20.185 a exists: The As-built, which was submitted with the application was completed 8/13/80, it appears that a portion of the "frame", (see diagram), encroaches into the 25' setback. 2. The encroachment does not encroach u on a Federal State or City right-of-wav or (ROW) utility easement No Federal, State or City ROW appear to exist. 3. The issuance of the encroachment ermit will not authorize a use which is not a principal permitted use in the zoning district in which the property is located• A duplex is a principal permitted use in a RR zone. 4. The complaint, from several neighbors, entailed a belief that two businesses were being carried on within the residence, that of a fishing charter service also. The complaint, based upon this assumption, included the parking of large vehicles in the street, boats on the property, and cleaning fish which exuded an odor throughout the neighborhood. The result of the meeting with the Fandels provided varification of activities: 1). A tour of the home itself identified the areas utilitized for the bed and breakfast. No area was used for the charter service. The bed and breakfast itself falls completly within the Code guidelines. 2) The boats being stored upon the property are in the process of being sold as they no longer meet the Kenai River guidelines. I was shown ads which have been placed in the Clarion beginning in early May. The boats being utilized for the charter service are based at Porter's Landing. This was varified through Mrs. Porter, and several signs on the property leased by Mr. Fandel. 3) The Fandels own the adjacent lot which has been upgraded to provide a firm base for a second drive and parking area completely removed from any neighbors within a close proximity. At the 1 ~ C current time, an area has been cleared at the rear of the property where the larger vehicles are parked, and again, do not appear to - disturb any neighbor within a close proximity. Any parking in the street or the small strip originally cleared by the City of Kenai for the upgrading and paving of Lawton Drive, is part of the 50' setback, however, the Fandel's assure me that parking on that strip is of a minimal nature with caution exercised to ensure full vision of vehicles at the intersection. Once the adjacent lot upgrading is completed, the parking along the strip should be eliminated. 4) I viewed the operation of the Charter Service at Porter's Landing and find that all cleaning of fish by the service is done at the site provided for all charter services. This was substantiated by Mrs. Porter who stated that all fish cleaning is done at the site and feels positively that Mr. Fandel has not allowed his clients to remove fish ungutted from the area. Any fish cleaning done at the Lawton Street site appears to be strictly of a personal nature and not connected with the charter service. The Fandels, upon being informed of this phase of the complaint feel that the day of the fish odor was day the Fandel's sons cleaned their own fish. No guests were registered on that date, only family were at the residence. Mr. Fandel further substantiated the fish cleaning aspect by furnishing substantiated records of fish processing by Echo Lake Lockers and dates of charter catches and packaging. 5) Mr. & Mrs. Fandel further allowed review of the records of the two operations. Bookings for charters are taken at the Porter Landing site and through King Oscar's Hotel. Any overflow from either the charter or the bed and breakfast are housed at that hotel. As part of both the bed & breakfast and charter service, the Fandel's advise clients to rent a car. This is done either at the airport or through King Oscars. It appears that the operations being run by Mr. & Mrs. Fandel are highly. lucrative for both themselves and the money that is being brought into Kenai from a select group of clients. (Upon review of the bookings, an example would be the head of a large Nevada banking chain.) Both operations are extremely neat, no trash or clutter is visible at either locations, and all persons involved in any phase of either operation are highly complimentary of the Fandel's and their operations. Attached are photographs taken on June 29, 1987 of both locations and surrounding property. The Fandels have expressed a desire to work with neighbors and Administration during all times of their operation to ensure a harmonious environment. Therefore, in view of the the situation and 2 the cooperation from the Fandels, it is felt that .the steps taken by Administration and the Fandels should resolve any problems, present and future, at the site. He was also told that a Public Hearing would have to be conducted and at that time, depending upon public input, the Commission would make a final decision on granting the Variance. Staff Comments• Under RR-1 zoning the minimum lot requirement is 20,000 sf. minimum. Included in this permit was the reclamation of the area for a residential housing development. In 1988 Fosters decided to change the permit to allow an RV Park and man-made lake, instead of the housing development. Did the changing of the CUP from a housing development to an. RV Park and lake, demand a new CUP under the KMC? Also, if not, does the time limit for completing the RV Park fall under the KMC for extraction of gravel, or under the general CUP time limit? ~ .
