ROLL CALL City Clerk Freas administered the oath of office to Commissioner Teresa Werner-Quade. Chairman Phil Bryson called the meeting to order at approximately 7:00 p.m. in the Council Chambers of Kenai City Hall. Members Present: Charlie Pierce, Ron Goecke, Lori McComsey, Carl Glick, Phil Bryson Teresa Werner-Quade, Kevin Walker Also Present: Councilman Hal Smalley; Jack La Shot, City Engineer; Kathy Woodford, Administrative Assistant 2. APPROVAL OF AGENDA Chairman Bryson asked for requests from the Commission. MOTION Goecke MOVED for approval of the agenda and asked for unanimous consent. Walker SECONDED. Pierce stated the date on the Agenda needed to be changed from October 13, 1993 to October 27, 1993. Bryson asked for objections to the Motion. There were no objections. APPROVED BY UNANIMOUS CONSENT. 3. APPROVAL OF MINUTES Bryson asked for any corrections. MOTION Pierce MOVED for approval of the minutes of the October 13, 1993 Planning and Zoning Commission meeting. Glick SECONDED. There were no objections. APPROVED BY UNANIMOUS CONSENT. 4. PLANNING None 5. PUBLIC HEARINGS None KENAI PLANNING AND ZONING COMMISSION Meeting -October 27, 1993 Minutes Page 2 6. NEW BUSINESS a. Resolution PZ 93-45 -Variance Request -Jack and Mary Keck STAFF REPORT La Shot stated he had no additional information and he would answer any questions from the Commission. Bryson asked the Commission if they would Like the Kecks to summarize their information. Hearing no comment, Bryson asked for a motion. MOTION Glick MOVED for approval of PZ 93-45. Goecke SECONDED. Bryson stated the Keck's proposal is to construct a structure slightly encroaching in the front set-back. City Council -Hal Smalley Smalley said Bob Cowan attended the last Council meeting regarding the TSH Ordinance. He said Cowan expressed his and several other land owners' concerns about being included in the TSH map. Smalley stated he will talk more about TSH later in his report. Smalley stated the contaminated soils removal project was awarded to Glacier Environmental. He said Glacier will probably cover the pile for the winter and begin soil washing in the spring. Smalley said there are several ways to remove the contaminated KENAI PLANNING AND ZONING COMMISSION Meeting -October 27, 1993 Minutes Page 3 soil; soil washing; chemical treatment; bioremediation; and thermal-remediation. He added thermal is the most expensive. Pierce asked Smalley if soil washing is done on- site. Smalley said it is done on-site, and filters are used to prevent contamination from going into the subsoil. Pierce asked Smalley what is done with the material after it is cleaned. Smalley said the material will be washed, cleaned, and inspected then removed to a fill site, possibly the Airport. La Shot said there were proposals for paving at the Airport but the soil will not be used at the Airport. Smalley said the Airport gift shop had asked for a reduced rent during the winter months and Council approved it. He added there was a lot of discussion as to what to do with the gift shop once the lease comes up for renewal. Smalley said Councilman Bannock has been assigned to be the liaison officer for Parks and Recreation Commission. Smalley said the City of Soldotna asked the City of Kenai to join in a venture for a water project. Kenai's Council rejected the offer stating the City has already committed itself to efforts here on a water study, drilling test wells, etc., to hopefu Ily resolve the potential problem of having to eventually put in a new treatment facility, which would cost several million dollars. Pierce asked Smalley where wellhouse 1 and 2 are located. Smalley said wellhouse 1 is on this side of Beaver Loop Road and wellhouse 2 is adjacent to Beaver Loop Road. Smalley said the ice rink was discussed. He said the project would be a joint venture between the City and the Borough and involve very little City money. Smalley said the Ice Rink Committee is going to have a public meeting at Kenai Central High on November 9, at 7:00. Smalley said the Governor has committed to 1.2 million if the Committee can raise $600,000. He said the Committee will have forms for donations for corporations and private individuals in order to raise the $600,000. Smalley added there is a $300,000 grant they could get to be part of the $600,000. Smalley stated his position against expending City money to fund the facility. He said the facility would be much smaller than the Soldotna facility but still a nice facility. The Committee did a cost estimate for a six month operation and came up with almost $6,000 profit. Smalley added the Committee is looking at additional projects the ice rink could be used for during "off ice" seasons. He said the Peninsula Oilers and the Little League are interested and added the idea of a summer ice skating camp for kids while the parents use Kenai as a vacation site was discussed. Goecke asked Smalley how much ice time was figured by the Committee. Smalley stated he thought 11:00 a.m. to 7:00 p.m. He added the Soldotna facility is open from 6:00 a.m. to midnight and they still don't have enough ice time. Goecke stated his concern of the Soldotna facility running for 18 hours a day and not being able to make it. He mentioned the facility at one time had to ask the City of Soldotna for $70 to $80,000 just to pay for the HEA bill. Smalley said the Soldotna facility's problem is not the slab of ice, it's the electric bill and the compressor. He said the Kenai facility would not be heated as much as the Soldotna arena, and added the Kenai facility will be much smaller. Smalley said the Courthouse dedication is November 9, at 5:00 p.m. for anyone interested. Smalley said Judith Bittner sent a letter to the City stating it is too late to get any grant money for TSH this year but to keep applications current. He said Councilwoman Swarner made a motion of reconsideration of the TSH ordinance. Council approved reconsideration of the TSH ordinance amending the code and the ordinance determining the boundary. Bryson asked Smalley about the Slaughter water/sewer problem. Smalley said the City is looking into hooking the Slaughter residence into City water and sewer. La Shot added the Slaughter's sewer crib is failing and it would cost them approximately $10,000 to hook into water and sewer. b. Borough Planning Commission -Phil Bryson Bryson said the meeting was very short with no discussion on any of the items. c. Administration -Jack La Shot La Shot said the City is operating under the old zoning code guidelines since the .new zone is being reconsidered. Goecke asked La Shot about the cars parked in the yard on Birch Street and the Quandt place. La Shot said the Birch Street problem is probably going to court and there is nothing new on Quandt. Goecke stated Quandt did make an effort to remove some of the cars. Bryson added the residents on Birch Street did haul at least a whole dump truck toad of debris off the property, but the cars are still there. La Shot said the Spur Motel removed some cars. He added it is hard to tell which are running and which are junk. 10. PERSONS PRESENT NOT SCHEDULED None 11. INFORMATION ITEMS a. Letter appointing Teresa Werner-Quade 12. COMMISSION COMMENTS & QUESTIONS Werner-Quade stated she is glad to be on the Commission and will try to fulfill her obligation to the best of her ability. La Shot said it is a dust pan and it will be taken care of. 13. The property description is the southern 4.7 acre portion of Tract B, Baron Park Subdivision No. 5. The City received title to this property from the Federal Aviation Administration in 1964. The Quitclaim Deed restricted the property to lease for aviation purposes only. In 1986, the City requested a deed of release for the sale of Lot 1, Tract B and Tract C, Baron Park Subdivision No. 5. A deed of release for sale was received for Lot 1. However, our records do not indicate whether the release for sale of Tracts B and C were ever finalized by the FAA. The City Administration is working with the FAA to finalize the release for sale. Any sale of Tracts B and C would be contingent upon the City receiving an official deed of release from the FAA. KMC 22.05.010 states, "Disposal or sale of lands shall be made only when, in the judgment of the City Council, such lands are not required for public purpose." If the Commission recommends selling the property, an ordinance will be introduced at the November 17, 1993 Council meeting finding the property is not required for public purpose and can be sold. If the ordinance is approved by the Council, the property will be subdivided, an appraisal will be ordered and the property will be sold by competitive bid. Does the Planning and Zoning Commission desire to retain the proposed parcel for public purpose or does the Commission recommend selling the southern 4.7 acre portion of Tract B, Baron Park Subdivision No. 5 by competitive bid, providing a deed of release is obtained from the FAA? KENA: Ms. Kim Howard Administrative Assistant City of Kenai 210 Fidalgo Ave., Suite 200 Kenai, AK 99611-7794 Dear Ms. Howard: RE: Purchase of City Property Homer Electric Association has determined, by means of a recently completed Long Range Transmission and Distribution Plan, that a new electrical substation must be built in the City of Kenai to replace obsolete facilities which are being retired from service. We have studied the situation and concluded that this new substation should not be built on any existing property owned by Homer Electric Association due to size or access limitations. However, these studies also indicate that the southern 4.7 acre portion of Tract B, Baron Park Subdivision No. 5 (which is presently owned by the City of Kenai) would be particularly well suited for this purpose. Therefore please consider this letter an official application to purchase the subject property as shown on the enclosed plat. I understand that a $3, 000 good faith deposit is required to initiate the purchase process and have enclosed a check in that amount. I also understand that if we perform the subdivision survey, this deposit will be refunded or applied to the purchase price of the property. I further understand that our proposal will be reviewed by your Planning and Zoning Commission who will determine if the sale is appropriate and if so, will authorize sale under the competitive bid procedure. If a higher than fair market value bid is received, the Association shall have the option of meeting that bid to secure the property. The acceptance of Homer Electric's offer to purchase and a firm price agreed to will be subject to approval by the Homer Electric Association Board of Directors. Grimm and R.J. Johnson at their October 13, 1993 meeting. The City Council approved the assignment at their October 20 meeting. The parties have now requested a Security Assignment of Lease. The lease requires the approval of the transfer by the Planning Commission and by the City Council. The lessee is current in lease payments and property taxes. On October 6, 1993, the Kenai City Council took action and passed these ordinances. Ordinance No. 1569 set the Townsite Historic Task Force Alternate No. 2 recommendation as the boundary to the TSH zone. At the October 20 ,1993 council meeting, motions to reconsider Ordinances No. 1567-93 and 1569-93 were made and passed. Enclosed are copies of Ordinances No. 1567-93 and 1569-93. The Kenai City Council will again discuss these ordinances at their regular meeting of December 15, 1993. The meeting will begin at 7:00 p.m. in the Council Chambers, Reaai City Hall. OF THE CITY OF KENAI, ALASKA, REPEALING ORDINANCE 1133-86 AND REPLACING TT WITH ORDINANCE 1567-93, CHANGING THE STRUCTURE OF THE TOWNSTTE HISTORIC DISTRICT AND CREATING A HISTORIC DISTRICT BOARD. WHEREAS, it is is the best interest of the City of Kenai to take steps to maintain and preserve the area of Kenai known as Old Town Historic Site; and WHEREAS, the City Council believes that protection of Old Town requires an amendment to the code; NOW, 'THEREFORE, BE TT ORDAINED BY THE COUNCII. OF THE CITY OF KENAI, ALASKA that the current KMC 14.20.105 is repealed and replaced by the following: 14.20.105 To~wasitie Iistoric ('I'SH) Zoning Disbric~ (a) Intent: The TSH Zoning District is intended to provide for a mined, controlled use in a designated area, which will protect and enhance the historic character of the zone. The goal of the TSH zone is to manage all new development, reconstruction and alterations within the zone. The intent of the Townsite Historic Review Board is to enhance and identify the city of Kenai's heritage, to present this heritage in a manner that promotes civic pride, and to foster an awareness of where we as a people have evolved. (b) Historic District Board. A historic district Board will be established to regulate development within the TSH zone- The following provisions will govern the Board's activities through the State of Alaska Certified Local Government Program: (1) The Board will consist of a minimum of seven members with a demonstrated interest, competence, or knowledge in historic preservation, appointed for terms of not less than three years. A majority, plus one member must be residents of the City of Kenai. (2) To the extent available, three Board members shall be professionals, as defined by National Pazk Service regulations, from the disciplines of history, architecture or architectural history, and archeology. (3) The Board will meet twice each year or as necessary and conduct business in accordance with the Open Meeting Laws of Alaska. This includes public notification of meeting plane, time and agendas. (4) Written minutes of each Board meeting will be prepared and made available for public inspection. (c) Historic District Board Duties: (1) The Board shall make recommendations to the Kenai Planning and Zoning Commission as to the area of the city to be included within the zone and any adjustments to the boundaries in the future. (2) The Board shall review zoning requirements and review all proposed changes to the zoning law within the TSH Zoning District. (3) The Board shall schedule a minimum of two meetings annually and special meetings as requested by the Planning Department to review proposed building permit applications within the zone or other business considered n~Y by the Planning Department. (4) The Board shall conduct or cause to be wnducted a survey of the .historic, architectural, and archaeological resources within the community. The survey shall be compatible with the Alaska Heritage Resources Survey and able to be readily integrated into statewide comprehensive historic preservation planning and other planning processes. Survey and inventory documents shall be maintained to protect the site location(s) from possible vandalism. The survey shall be updated every ten years. (5) The Board shall review and comment to the Stale Historic Preservation Officer on all proposed National Register nominations for properties within the boundaries of the City. When the TSH Board considers a National Register nomination which is normally evaluated by professionals in a specific discipline and that discipline is not represented on the Board, the Board will seek expertise in this area before rendering a decision. (~ The Board shall act in an advisory role to other officials and departments of local government regarding the identification and protection of local historic and archaeological resources. (T) The Board shall work toward the continuing education of citizens regarding historic preservation and the community's history. (g) The Board will review all building permit applications as well as all exterior architectural alterations and demolition within the designated zone. The Board's responsibility will be to provide it's recommendation for approval, denial or modification to the Planning and Zoning Commission. The guidelines to be followed by the Board will be designed to preserve the character which typify development in the zone and provide the basis for preserving the historical character of the zone. Applications must be accompanied by a schematic drawing of proposed changes within the zone. (9) The Board shall develop a local historical preservation plan that will be compatible with the Alaska State Historic Preservation Plan and produce information that is compatible with the Alaska Heritage Resource Survey. (d) Application: An application requiring review in TSH Zoning District shall be filed with the Planning Department. The TSH zoning district, as located within the bounds shown on the City of Kenai Official Zoning Map. The application shall contain: 2 (1) One reproducable copy of the application signed by the applicant and, if leasing the premises, co-signed by the owner indicating type or nature of business. (2) Current color photographs of the site and of any existing structures representing both the overall condition of structures and accurately portraying materials and color. (3) Reproducable schematic plans of the proposed construction sufficient to show building size and layout, exterior elevations, proposed zr~ateriais and colors. (4) A landscaping and site Plan complying with KMC 14.25 and the development criteria of this chapter drawn to scale showing the existing structure and all proposed alterations and additions in relation to the site. (e) Development Criteria. The development criteria is intended to provide for a district in which residential and business enterprises co-habitat as a desirable and compatible use. All proposed construction, renovation, demolition, or alteration shall: (1) Encourage, whenever possible and compatible with historic character of the TSH zone, foot traffic; restaurants, gift shops, Parks, etc; indigenous Kenai Peninsula flora; wooden structures including log style with soft colored or natural sidings. (2) Discourage uses which will violate the historic and scenic quality of the TSH zone; buildings and building additions that are not compatible with adjacent buildings or which violate the existing character and scale of the district. (3) Specific structures and activities which will not be allowed, but are not limited to: (a) Buildings with "modern design style of architecture" that have no historical correlation with the district; (b) Multiple family residences (excluding duplexes); (c) Gas stations; (d) Auto repair shops; (e) Rental storage of any kind; (t) Kennels or similar uses; (g~ livestock, Stables, Commercial horseback riding; (h) Auto body and paint shops; (4) Commercial buildings are limited to a total area of no more 5,000 square feet per story. Any individual unit within the structure may be of no more than 2,500 square feet, except that the Commission may allow a larger individual unit if it is dexermined to be compatible with the zone. (S) Metal-sided buildings may be allowed if the Commission determines they are compatible with the zone. (f) Criteria for determining acceptable use shall include, but not be limited to the following: (1) All alterations to existing structures should be performed so as to preserve the historical and architectural character of the TSH zoning district. (2) The distinguishing original qualities or character of a building, structure, or site in its environment shall not be destroyed. The removal or alteration of any historic material or destruction of architectural feahues cannot be done without approval. 3 (3) Changes which may have taken place in the course of time are evidence of the history and development of a building, structure, or site, and its environment. These changes may have acquired significance of their own, which should be recognized and respected. (4) Landscaping requirements according to City of Kenai as required by KMC 14.25. (~ All exterior construction must be completed within a year of date of approval. (g) Existing structures: All structures existing prior to the enactment of this ordinance will be allowed to continue in their present form and use. In the event of loss of the existing structure due to demolition, fire or natural causes, the structure may be rebuilt with the following requirements: (1) The structure to be rebuilt must conform to the previously existing structure in terms of size, shape and location unless the Commission determines the new structure is more compatible with the intent of the TSH zone. (2) The use of the new structure must be the same as the use of the previous structure. (3) Application for reconstruction of the structure must be made to the Planning Department within one year of the date of loss due to demolition or damage. (4) Reconstruction of the structure must be complete within two years of the date of the loss due to demolition or damage. (~ If applicant wants to rebuild, other than apre-existing structure, the existing structure provisions as stated above are not applicable. (h) Criteria for designation of landmarks to be included in the TSH: (1) Its age -approximately fifty years old. (2) Its character, interest or value as part of the development, heritage, or cultural characteristics of the city of Kenai. (3) Its location as the site of a significant historic event. (4) Its identification with a person or persons who significantly contributed to the culture and development of the city of Kenai. (5) Its distinguishing characteristics of an architectural type. (~ Its relationship to other distinctive areas that are eligible for preservation according to a historical, cultural, or architectural criteria. (i) Uses. (1) Principal Permitted Uses as allowed in Land Use Table. (2) Conditional Uses: As allowed in the Land Use Table and subject to the provision of this chapter. 1. Such uses must be similar to principal uses permitted in the zone. 2. Such uses must be in harmony with the intent of the zone. (j) Review process. Upon submittal of an application, the Planning Department shall schedule the application for review by the TSH Zoning District Review Board at the following appropriate meeting. The Board shall make a recommendation regarding the permit application to the Planning and Zoning Commission. The Board's recommendation shall be based upon the 4 development criteria in this section and all other pertinent provisions of the Kenai Municipal Code. (k) Signs. signs shall be allowed in the Commercial Zone as set forth in KMC 14.20.220(c). (1) penalties. penalties for non-compliance with this Chapter shall be as set forth by KMC 14.20.260. (m) Definitions. 1. Alteration-Any act or process that changes one or more of the exterior architectural features of a structure, including, but not limited to, the erection, construction, reconstruction, or removal of any structure which requires a building permit. 2. Construction-The act of adding an addition to an existing structure or the erection of a new principal or aaxssory structure on a lot or property which requires a building permit. 3, Demolition-Any act or process that destroys in part or in whole a landmark or a structure within a historic district. 4. Certified Local Government-A local government "that has been certified to carry out the purposes of the National Historic preservation Act" . 5. Historic District-An area designated as a "historic district" by ordinance of the City Council, which contains within de5nable geographic boundaries, one or more landmark and which may have within its boundaries other properties or structures that, while not of such historic and/or architectural significance to be designated as landmarks, nevertheless contribute to the oveiail visual characteristics of the landmark or landmarks located within the historic district. 6. Historic preservation-The act of adopting regulations and restrictions for the protection and preservation of places and areas of historical and cultural importance to the Kenai. 7. Landmark-A property or structure designated as a "landmark" by ordinance of the City Council, pursuant to procedures prescribed herein, that is worthy of rehabilitation, restoration, and preservation because of its historic and/or architectural significance to the city of Kenai. 8. New Development-Any development which requires a building permit. 9, Reconstruction-The action of returning a structure to original state. 10.
