Fisher, 640 Tern Avenue Lot 5, BL 2, Sungate Park S/D **PUBLIC HEARING** Chairman Bryson opened the session to a public hearing. There was no one in the audience who wished to testify. MOTION: Ron Goecke MOVED approval of Resolution PZ93-48. Teresa Werner-Quade SECONDED. **DISCUSSION** Bryson asked the applicant if there was a house on Lot 4? And also if the applicant owned that lot? Curtis D. Fisher, applicant replied that there was no house and he did not own the lot. REPORTS a. City Council -Not available. b. Borough Planning Bryson reported that there were no items pertaining to Kenai. KENAI PLANNING AND ZONING COMMISSION November 24, 1993 -Minutes Page 2 c. Administration La Shot presented some plans for an addition to Peninsula Memorial Chapel which had been received after the packet deadline. According to the Code P&Z must review all additions for aLandscape/Site Plan. This is an addition to the living area behind the structure. There will not be additional parking requirements and the landscaping will not be altered. The property is in a General Commercial Zone and a residence is a secondary use according to the Land Use Table. MOTION AND VOTE: Goecke recommended approval of addition to Peninsula Memorial Chapel. Charlie Pierce seconded. PASSED UNANIMOUSLY. lA. PERSONS PRESENT NOT SCREDIILED 11. IIVFORMATION ITEMS a. Capital Improvement Projects - 1994-95 Walker commented that water and sewer improvements had topped the list for several years. He was disturbed that the Animal Shelter improvements were listed above water and sewer in the current brochure. BoX 582 Kenai, Alaska 99611 Requested Action: Rezone Legal Description: Lots 1,2 & 3, Block 2, Bush Lanes S/D Esistinq Zoninq: Suburban Residential Current Land Use: Medium Density Residential ANALYSIS KMC 14.20.270 Amendment Procedures (a) (2) Amendments to the Official Zoning Map shall be considered only if the area to be rezoned contains a minimum of one (1) acre (excluding street or alley rights-of-way) unless the amendment enlarges an adjacent district boundary. The proposed rezone area would expand a present General Commercial Zone which fronts the Kenai Spur Highway. There is also a proposed alley vacation and replat which coincides with this rezone. All property being rezoned presently is owned by the same party. Currently, a business is operating on the area to be rezoned. RECOMMENDATIONB The City has reviewed the proposed vacation and replat. The rezone is an attempt by the property owner to bring his business into compliance with the KMC by creating one large parcel all zoned commercial. Keith, I installed the fence to try to keep all of the kids off of our property because they were continually climbing up on our trailers and I am afraid they will fall off and get hurt. I believe I have a legal right to .fence where I did because my title search shows that there is a utility easement of 20' across our property between the lots and not a right of way (See Schedule B of First American Title Insurance Company). As a follow up, Keith, I have retained Dale Dolifka law office to investigate further, and if this is not correct and if it is in fact a right of way, he is proceeding to get the right of way vacated and make it into a utility easement. Enclosed is a platte of the 36 lots that are on each side of the easement and of the 36, as of today, 20 lot holders are in favor of having this become an easement. So we have over 51' in favor of an easement. Keith, I hope this will help explain what is happening and also I hope you will work with us on this for safety sake. It makes more sense for this to be an easement; also the City will receive more tax dollars than if it is a right of way.
