A Resolution of the Advisory Planning and Zoning Commission of the City of Kenai (granting) (denying) a request for a VARIANCE as authorized by 21,76,220 of the Kenai Zoning Code, for Redoubt Terrace Townhome Subdivision located Redoubt Subdivision, block 4, lots 14 & 15 by Mr. Rick Bivens WHEREAS, the Commission finds that Section 21.76.220 provides that a variance from the strict provisions of the zoning code may be granted by the Commission if all conditions specified in 21.76.220 (B.l.b) are met, and WHEREAS, the Commission finds: 1. That an application meeting the requirements of Section 21.76.220 (B.l.b) has been submitted and received on July 19, 1982 2. .That this request is located on land zoned Suburban Residential lR~l 3. That the applicant seeks a variance from the strict provisions of 21.76. 090 from the requirement of Section C 2-4 setback requirements to 4. a. That there are (are not) exceptional physical circumstances or conditions applicable to this property, which do not apply generally to other properties within the same zoning district: C ~- y~ b. PZ _ Page 2 c. That the special conditions (~ (are not) a result of actions by the person seeking relief or for reasons of pecuniary hardship or inconvenience: d. That the granting of this .variance (will) ill n result in material damage to other parties in the vicinity and (will) ill not be detrimental to the public health, safety, or welfare: pending results of .the public hearing -~- S. That a duly advertised Public Hearing, meeting the requirements of Section . 21.76.140 (C. 2) has been held by the Commission on August 11, 1982 6. That the following additional facts have been found to exist: the proposed townhouses are already established in the form of apartment houses. The variance will allow the apartments to be sold as townhouses. NOW, THEREFORE, BE IT RESOLVED, by the Advisory Planning and Zoning Commission of-the City of Kenai that the conditions specified in 21.76.220(B.l.b) (have) (have not) been shown to exist, and, therefore, the Commission (denies this request for a variance) (grants this variance as specified herein, and authorizes the administrative official of the Kenai Zoning Code to issue a Certificate of Zoning Compliance). ~/'~ Moved by : ~h,.
