Chairman Twait called the meeting to order at approximately 7:00 p.m.

5-a. P207-45 -- An application for an encroachment permit fora 6-foot front
yard setback encroachment for the property known as Lot 4, Block 3,
Central Heights Subdivision (300 Sterling Court), Kenai, Alaska.
Application submitted by Joseph J. Pedginski, 300 Sterling Court, Kenai,
Alaska.
City Planner Kebschull reviewed the information presented in the packet, noting the
shed had been built without a permit and she could recommend moving the shed to
the side of the garage.
Chairman Twait read the rules for public hearings and opened the meeting for public
comment.
Cheryl Samples, 302 Sterling Court -- Submitted a letter with pictures in the
packet. Samples stated her opposition to the issuance of a permit and added, moving
the shed would obstruct vision of drivers in the area and the shed would be placed
near a fire hydrant.
Ted Williamson, 1.06 Tern Avenue -- Opposed to the permit, noting, with twa small
children, he was worried about driver vision being obstructed.
There being no further comments, the public hearing portion of the meeting was
closed.

Commissioner Roxnain MOVED far approval of PZ07-45 with noted staff
recommendations. Commissioner Bryson SECONDED the motion.
Commission coxnnraents/questions included:
• Had administration visited the site (the Building Official had).
• Whether the shed had pluxnbing, electricity, heat.
• What would happen if the shed was not moved by the deadline? (The
owner could be cited and fined up to ~ 1000 per day.)
• People are building without permits and coming into the City for them
after the fact.
• Possibility of chaxiging the two-way stop sign to a four-way stop sign.

5-b. PZ07-46 - A resolution of the Planning and Zoning Commission of the
City of Kenai recommending to the Council that Lots 1 and 2A of Schurr
Subdivision be rezoned from General Commercial to Limited Commercial.
Application submitted by Charles L. and Patricia G. See, P.O. Box 1412,
Kenai, Alaska.
Kebschull reviewed the information in the packet, noting the City Attorney had
concerns regarding spat zoning if the rezone would be approved and challenged.
Additionally, the rezone to Limited Commercial would be more compatible with the
area than General Commercial.
Twait opened the meeting for public comment. There being no comments, the public
hearing was closed.
MOTION:
Commissioner Bryson MOVED to approve PZ 07-4b. Commissioner Smagge
SECONDED the motion.
Commission comments included:
• The rezone would allow a house to be built an the property and conforms
to the Comprehensive Plan.
• Concern with a phone line over part of the existing house.

6-a. Discussion -- Residential use in the CG -General Commercial Zone
Kebschull reviewed the August 2, 2007 memorandum sent to the Commission and
requested input on changing the zoning. A work session would be scheduled.
ITEM 7: NEW BUSINESS
7-a. Discussion -- Angler Acres Subdivision Zoning
Kebschull reviewed the August 14, 2007 memorandum sent to the Commission.
requesting it consider initiating a rezone from Rural Residential to Recreation, The
Commission requested work session be scheduled.
7-b. PZ07-47 - An application for development in the Townsite Historic zone
for a building that will contain arestaurant/catering business and
residential units for the property known as Lot 22A, Block 5, Original
Townsite of Kenai Vozar Addition (510 Upland Street). Application
submitted by Sandra J, Vozar-Ginavan, P.O. Box 1430, Kenai, Alaska.
Kebschull reviewed the information in the packet, noting the following:
• Commission approved a conditional use permit for arestaurant/dwelling
in June of 2006.
• The application was required by the Conditional Use Permit.
• An updated drawing with a parking plan had been provided by the
applicant prior to the meeting.
• Mixed use development was encouraged in the area.
Tcxrait opened the meeting to public comment.
Rosalie Tepp, Kenaitze Tribal Chair -- Stated her opposition to the application due
to insufficient parking and snow removal areas and that the building would not fit the
character of Old Town.

Bonnie Julliussen, Kenaitze Tribe Member -- Stated her opposition to the
application due to lack of parking in the area and concerned with a conflict between
two eating facilities so close together.
Mary Lou Bottorff, I~enaitze Tribe Member -- Stated her opposition to the
application and noted she felt the restaurant would be unfairly in competition with the
Kenaitze Tribe's.
Sandra Vozar Ginavan, Tpyon Villa Apartments, # Y 1, Kenai --- Stated she had lived
in Old Town for 34 years; she purchased additional land to make the lot larger; felt the
city anal Commission should support her development plan because she would pay
taxes and the Tribe would not; and, her development would not be in competition with
the Kenaitze Tribe as her restaurant would be open to the public.
Commissioner Smagge noted the Kenaitze Indian Tribe pay taxes on some properties
and were paying taxes on the property adjacent to the proposed developxzzent.
Wayne Wilson, Kenaitze Tribe Member -- Stated his apposition due to lack of
sufficient parking.
There being no further comments, the public hearing was closed.
MOTION:
Commissioner Romain MOVED to approve PZ07-47 with staff recommendations and
Commissioner Bryson SECONDED the motion.
Commission questioned staff on total parking places and Kebschull noted a possibility
of 14 spaces were planned anal that curb cuts could be permitted through the Public
Works Department.

9.10.015 requiring dumpsters to be screened on at least three sides.

8-c. PZ07-28 - A Resolution of the Planning and Zoning Commission of the
City of Kenai, Alaska, recommending to the Council that KMC 12.20.03C
be amended by better describing and defining what constitutes
prohibited storage of "Junk," "Garbage" and "Litter" under the City code.

ITEM 9: REPORTS
9-a. City Council -- Ross reviewed the action agenda items from the August
15, 2007 city council meeting and noted there was not a quorum at the last Airport
Commission meeting.
9-b. Borough P1anx~ixa.g -- Bryson reported the last meeting was August 13,
2007 and reviewed the agenda included in the packet.
9-e. Administration -- Kebschull noted the following:
• The next meeting would include a work session on amending the land
use table.
• The Kenai Historical Society would meet in September, feedback on the
presercration plan would be submitted to staff and then a public hearing could be
scheduled for the first Commission meeting in October.
• Requested the Commission's preference of work session topic for the
October 10 meeting, i.e. Connex use or dumpsters. The Commission decided on
Connex use.
ITEM 10: PERSONS PRESENT NOT SCHEDULED
Barry Eldridge, 267 Bowpicker Lane, Kenai -- Presented Commission background
on houses within the Historic District.
Kebschull requested the Commission to consider whether or not the code provided
enough protection for the Historic District. Broyles requested clarification on the
Vozar plan in relation to the Historic District and was informed the
restaurant/dwelling would be within the Historic District but not part of the
Preservation Plan.

A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF
KENAI, ALASKA, RECOMMENDING TO THE COUNCIL THAT KMC 12.20.030 BE
AMENDED BY BETTER DESCRIBING AND DEFINING WHAT CONSTITUTES
PROHIBITED STORAGE OF "JUNK," "GARBAGE" AND "LITTER" UNDER THE CITY
CODE.
WHEREAS, KMC 12.20.030(a) currently prohibits the keeping of various kinds of debris and
junk on property within the City of Kenai; and
WHEREAS, the City Code does not provide a precise definition of what constitutes "garbage,
"junk" or "litter"; and
WHEREAS, better definitions and descriptions of prohibited activity are needed in KMC
12.20.03 0; and
WHEREAS, it is in the best interest of the City of Kenai to amend KMC 12.30.030.
NOW, THEREFORE, THE PLANNING AND ZONING COMMISSION OF THE CITY OF
KENAI RECOMMENDS THE COUNCIL OF THE CITY OF KENAI, ALASKA, AMEND
KMC 12.24.030 as follows:
12.20.030 Debris and junk prohibited.
(a) [NO OWNER, LESSEE, AGENT, TENANT, OR OCCUPANT SHALL
ALLOW OR PERMIT ANY DEBRIS, JUNK, OR INDISCRIMINATE
STORAGE OF MACHINERY, EQUIPMENT PARTS, LUMBER, OTHER
MATERIAL, OR ANY ACCUMULATION OF GARBAGE, MANURE,
OFFALS, RUBBISH, STAGNANT WATER, OR ANY FILTHY LIQUID OR
SUBSTANCE, OR ANYTHING THAT IS OR MAY BECOME PUTRID OR
OFFENSIVE TO BE OR REMAIN UPON HIS YARD, LOT, OR PREMISES,
OR UPON ANY YARD, LOT, OR PREMISES OWNED OR CONTROLLED
BY HIM.] The owner_and the__occupant of an~r private property in the city shall at
all times maintain the premises free from significant accumulations.of funk,
garbage or litter that a reasonable person would find, offensive. This section shall
not rohibit the stora e of 'unk or litter in authorized rivate rece tacles for
collection. A significant accumulation of junk or litter on any, private property in
the city contrary to this section is deemed to be a public nuisance.
(6) No owner, lessee, agent tenant or occupant shall allow or permit slash to
be or remain upon any lot: I) for longer than one hundred twenty (120) days
within the RU, RS1, RS2, TSH, CC ar CG zones; or 2) far longer than one
hundred twenty (120) days on lots smaller than forty thousand {0,000) square
feet within the C, RR, RS, IL, IH, R ar ED zones.

As used in this chapter, the following words are defined in this sectian:
"G~rbage" means all_putrescible wastes, except sewage and body waste, including
food wastes resulting Pram the handling, I?rep~ration, cooking, or consumption of
food or the cans containers wra ers or other tan ible items wasted or used
along with such materials."
"Junk" means any worn-out, wrecked, scrapped, partially or fullY.dismantled or
discarded tan ible material combination of materials or items that cannot without
further alteration and reconditioning be used for their original purposes, including
but not limited to appliances, building material, chemicals, equipment, furniture,
rnachiner metal ra s rubber a er used tires lastics and woad. Stacked
firewood or building materials stored for future use shall not constitute "junk."
"Litter" means alI improperly discarded waste material including but not limited

to convenience food, beverage and other. rap duct packages or containers
constructed of_steel, aluminum, lg ass, paper, plastic and other natural and
synthetic material, thrown or deposited on, the lands and waters within the
boundaries of the city.
"Occupant" means the person in possession,of the real property on which the junk
or litter is located.__"Occupant" includes tenant and lessee.
"Owner" means the owner of the real ro ert on which the 'unk or litter is
located, or the agent of the owner.
[(C)]"Slash" is defined as: branches and other residue left after the [CUTTING]
felling of timber. Tree trunks trimmed free of roots and branches or cut firewood
stacked and separated from branches and other residue of tree cutting shall not
constitute "slash."

ANALYSIS
General information:
KMC 14.25 specifies the requirements far iandscapelsite plans within the City of Kenai.
Sec#ion KMC 14,25,030 details Landscaping/Si#e Plan submittal requirements. This is a
preliminary landscapelsite plan for the Arctic Barnabas Ministries hangar and office
building. The applicant has submitted a site plan for the proposed development. The
plan shows the proposed building, driveways, drainage, parking, dumpster, fencing,
snow storage sign, and landscaping.
Four types of landscaping are defined in KMC 14.25.040:
PerimeterlBuffer Landscaping -involves the land areas adjacent to the lot
lines within the property boundary and serves to separate and minimize
the impact between adjacent uses.
o This development is on the corner of North Willow Street and Granite
Point Street. The landscaping plan includes landscaping along three
sides of the lot with the exception of driveways. The rear of the lot is
on the taxiway and cannot be landscaped. The landscaping is limited
in some areas due to the need to provide far parking. In addition, the
area along the Willow Street right-of-way is already landscaped.
Landscaping includes lawn areas, shrubs and trees, Landscaping
stones are used in and around the shrubs and trees. A concrete patio
with a flower garden is planned for the northwest side of the property.

An 8-foot security fence will separate the fron# of this property from the
taxiway.
Interior Landscaping -involves areas exclusive of the perimeter and
parking lot areas.
o No interior landscaping is planned.
Parking Lot Landscaping -involves areas adjacent to or within parking
lots and access drives.
a Areas adjacent to the driveways will be landscaped and the area along
the perimeter of the parking lot will be landscaped.
Street-right-af-way Landscaping -. intent to soften the impact of land uses
along rights-of-way but does not obscure land uses from sight.
o As noted, this property abuts the Willow Street right-of-way that is
already landscaped with lawn. There is additional landscaping
planned along edge of the property and the right-of-way. Along
Granite Street there is grass planned and landscaping between the
lawn area and the parking spaces.
Landscaping plants include Hoopsii Spruce, Spruce, Red Leaf MayDay, Green Leaf
MayDay, Ruby Frost Maple, European Mountain Ash, Ash Leaf Spirea, Lilac, Potentilla,
and Dwarf Mugo Pine.
Kenai Municipal Code 14.25.045 identifies the objectives for the site plan. The site plan
provided in this application meets the objective of the code. The plan shows the location
of the building, access to and from the site, parking lot layout, landscaping, snow storage
and location for signage.
The plan provides 32 standard parking spaces, 2 handicap spaces and a fuel truck
parking area. The hangar-portion of the building is 8000 square feet. The code requires
one space for every 1000 square feet of gross floor area far a required 8 spaces. The
two-story office portion of the building is 7040 square feet. The code requires one space
for every 400 square feet of gross floor area for a required 18 spaces. The plan provides
for sufficient parking for the proposed uses. The parking lot will be paved.
The plan shows a dumpster northwest side of the hangar portion of the building. The
plan shows the dumpster behind an 8-foot high chain length fence "with visual barrier."
The code requires dumpsters screened in alight-obscuring structure made of wood or
concrete.
Sign permits are issued as part of the building permit. The Building Official will review
proposed signage to insure signage meets both the building code and zoning code for
size and location prior to issuing the permit.
The planned development does not meet the setback requirements for the building code.
The hangar as shown on the site plan (20 feet from the side lot line}, will require a 2-hour
rated wall to meet the building code. It is also Hated that the hangar is placed 50-feet
from the lot fine on the rear of the lot. This appears to meet the airpor# requirements for
the setback but should be verified by the Airport Manager prior to the building permit
being issued.
City Engineer:
Buildings appear to be placed outside the Airport ALP designated restricted areas.

Drainage and snow storage appear adequate. Access -recommend moving or
eliminating the north driveway access to Willow Street due to the short distance to the
WillowlGranite Point intersection.
Building, Official:
Aircraft hangars require a minimum 30-foot setback from property lines unless walls are
constructed with a 2-hour rating.
RECOMMENDATIONS
The landscapelsite plan far the proposed Arctic Barnabas Ministries hangar and office
building appears to meet the objectives of KMC 14.25. This preliminary site plan is
approved with the following requirements:
1. All required landscaping as presented in the approved landscaping plan
must be installed within ane year after issuance of Certificate of
Occupancy.
2. One hundred percent (100%) of ground cover of the landscaping beds
must be planted and maintained so that there is no exposed soil within
three years of the approved plan.
3. The plan shows same landscaping into the edge of the City's right-of-ways
along Granite Point Street and Willow Stree#, Robert Frates, City of Kenai
Parks and Recreation Director must approve this landscaping prior to
construction.
4. The parking lot must be paved within two (2) years of the Certificate of
Occupancy.
5. Snow storage must be located on the lot and canno# be placed on
required parking spaces or the snow must be removed from the site. No
snow may be stored in such a manner that would block visibility for
ingress and egress to the lot.
F. The structure for the dumpster must be constructed of wood or concre#e.
City administration may approve an alternative plan prior to construction.
7. If construction of the project has not started within one year of the
approval of the landscapinglsite plan, the approval shall lapse unless
extended for good cause.
